Minutes December 30th, 2019Mayor Jody Brozik called a meeting of the

Winner City Council to order at 6:30PM onDecember 30th, 2019 at the Council Chamberslocated at 325 S. Monroe St. Councilmen at-tending were Baker, Clay, Curates, Klundt, andMeyer; Sherman was absent. Also attendingwere City Attorney Amanda Work, PublicSafety Commissioner Paul Schueth, PublicWorks Director Troy Kruger, and Finance Of-ficer Chandra Weidner.

The meeting was opened with the Pledgeof Allegiance.

**Amy Bartling Jacobson, attorney forSue O’Donnel attended the meeting by phoneand spoke on behalf of her client. They are ob-jecting he transfer on the grounds of the con-tracts provided to council on December 2ndand on the grounds of a notice of delinquencyfrom the state for West River Tap LLC. CityAttorney Work stated that she received anemail from the Department of Revenue thatstated that their taxes are up to date. FO Weid-ner stated that the State requested a signed af-fidavit from Mr. Schoepne with his transferrequest to prove he is requesting this specificaddress change. All other forms are filled outand correct. It was the recommendation of CityAttorney Work that the council approves thistransfer and does not get involved between twoprivate citizens and a contract that does not in-volve the City.

Motion by Clay second by Baker to rejectthe 2019 Jail Addition masonry bid; motioncarried 5-0.

**A letter from FO Weidner explains: It isthe recommendation of City Attorney AmandaWork to reject the masonry bid due to beingsubmitted late. Puetz will need a formal rejec-tions motion and another motion to advertisefor bids on the specific bid package 3 (ma-sonry). Puetz would then need the council toaccept all other bids with the understandingthat the CMAR amount may change due to theunknown of the masonry bid. Your motion willneed to state this understanding. The FinanceCommittee did recommend that the projecthave a $40,000 contingency. The Councilwould award the masonry bids on the 21st. Atthis time the CMAR amount would be official.

Motion by Clay second by Meyer to ap-prove the 2019 Jail Addition Phase 4 bids (ex-cluding package #3 masonry) as presented byPuetz Corporation; motion carried 5-0.

**FO Weidner expressed that the Councilbe clear that the CMAR amount may changewith the new masonry bids. Clay stated he un-derstood this with his motion.
