General
The purpose of this document is to provide
developers and designers with a guide on how to
apply for the adoption of new sewers. The guide
provides information on how to apply to have new
sewers adopted under Section 104 (S104) of the
Water Industry Act 1991.
The Sewerage Technical Team is responsible for
undertaking technical assessments on all sites put
forward for adoption, through to the issue of
Technical Approval, undertaking of site inspections
during construction and issuing the Final Certificate
and the Vesting Declaration on adoption of the
assets put forward within the S104 Agreement.
The structure of the team responsible for delivering the end to end adoption of new sewers process is detailed below.

Adoption of New
Sewers (S104)
All submissions for new sewers being offered for
adoption should be made, via the submission of an application form, in accordance with
‘Sewers for Adoption 6th Edition’ or ‘Sewers for
Adoption 7th Edition’, published by the Water
Research Council (WRC), and Yorkshire Water’s
Standard Details.
Sewer Connections
For information on how to connect to the public
sewer network, please refer to our ‘Making a New
Connection to Public Sewer’ guidance document and
the ‘Notification of Connection(s) to Public Sewer(s)’
form on our website.
If you are offering new sewers for adoption, you are
still required to complete the ‘Notification of
Connections to Public Sewer’ form and submit this
alongside your ‘Application for Adoption including
Lateral Drains and Sewers’ form.
No work can be carried out on the public sewer
network without written approval from Yorkshire
Water for your contractor to do so. Our Developer
Services Inspector will monitor the work as it takes
place. We highly recommend that you use a suitable
qualified and experienced contractor to undertake
the works.
Land and Highway Drainage
Yorkshire Water has no legal duty to accept highway
drainage from new developments into the public
sewer network. However, we may consider highway
drainage as part of the overall surface water
drainage strategy for the site. All applications will be
considered by the ‘Sewerage Technical Team
Highways Drainage Panel’ on a site specific basis.
We will not consider land drainage discharges to the
public sewer network.
Discharging to a Water Course
If the surface water is discharging to a watercourse,
it is the developers responsibility to obtain
permission to discharge at an agreed rate from the
relevant Authorising Body.
Written confirmation from the landowner with regards
to the location for the outfall will be required.
The landowner will need to be party to the S104
Agreement.
Sewer Diversions (Developer Led)
A developer must receive approval from Yorkshire
Water and have a signed Agreement in place,
supported by a bond, prior to diverting any part of an
existing public sewer and making the flows live.
Please refer to our ‘Guidance Notes for Section 185
Sewer Diversion’ that can be found on our website.
Sewer Requisitions
If you need to carry out any work within third party
land, the land owner will need to be party to the S104
Agreement.
If you cannot get permission to cross third party land
to outfall to a public sewer, you can apply under
Section 98 of the Water Industry Act for Yorkshire
Water to undertake these works, on your behalf, at
your cost.

The Application Process
The applicant must complete an ‘Application for
Adoption including Lateral Drains and Sewers’ form.
This needs to be completed in full and submitted to
Developer Services along with all the required
supporting information to define the application as a
‘complete submission’.
On receipt of your application, your submission will
be reviewed by the Senior Engineer and you will
receive an acknowledgement letter. We will provide
you with an ‘acknowledgement letter’ within 14
calendar days to advise you if your submission is
‘complete’, ‘substantially complete’ or ‘incomplete’.
If your submission is deemed to be ‘incomplete’, we
will provide you with details of outstanding
requirements and a list of missing information. The
application will not be assessed until the outstanding
information has been provided.

If your submission is deemed to be ‘complete’ or
‘substantially complete’ we will provide confirmation
of this and pass your submission to a Technician
who will commence the technical assessment of the
site and be your point of contact throughout the
assessment process.
Requirements of a Complete Submission
You are required to submit a ‘complete application’
for all sewers being offered for adoption in
accordance with ‘Sewers for Adoption 6th Edition’ or
‘Sewers for Adoption 7th Edition’, published by the
Water Research Council (WRC), and Yorkshire
Water’s Standard Details.
Following receipt of an application, the Technicians
commence their assessment using the ‘Standard
Checklist’ as a reference guide.
Please note that each site is considered on its own
merits and site specific detailed requirements are
excluded from the ‘Standard Checklist’. These
additional requirements, outside the scope of the
‘Standard Checklist’, will be discussed with you
either following receipt of the complete application or
you may wish request a meeting prior to submission
of a formal application to discuss the site specific
details.
The Assessment Process
Pre Submission Requirements
Planning Approval
Connection Approval
To minimise delays in having the S104 application progressed it is
recommended that prior to submission, the Applicant consults with the
Developer Services Sewerage Technical ‘Planning’ Team. This team will
determine the possibility of connecting your foul and surface water systems
to the public sewer i.e. the point of connection and the discharge rate, and
will confirm with the Applicant that Planning Approval is in place
A separate S106 Sewer Connection Application should be included with the
submitted S104 Application details. The Sewer Connection Application will
be assessed and approved separately from the S104 Application, providing
the criteria for the S106 has been adhered to i.e. Planning is approved, type
of connection and materials are satisfactory. The payment for the S106
Application will be included within the S104 fees which will be invoiced to
the Developer when the S104 Application is issued Technical Approval.
Submission of ‘Complete
Application’ by Applicant
A paper copy of the S104 Application form should be completed and
submitted alongside one paper copy of the relevant drawings, hydraulic
calculations, required technical requirements as detailed within the
‘Developers Checklist for Submission’ which is incorporated within the S104
Application Form. This details the requirements of a ‘complete application’
in line with Water UK requirements.

Receipt of
Acknowledgement Letter for
‘Complete Application’
issued by Senior Engineer
On receipt of the S104 Application into Yorkshire Water, the Applicant will
receive an acknowledgement letter (within 5 calendar days) and a S104
safe receipt letter (within 14 calendar days). The S104 safe receipt letter
will inform the Applicant whether there is enough information within the
application for a Technician to undertake an Initial Assessment. The letter
will also advise the Applicant of which Technician will be dealing with the
site and the associated timescales for response

The Technician assigned to the site will undertake their Initial Assessment
in line with the Standard Checklist. The checklist outlines a list of
requirements the Technician uses to assess the technical details of the
requirements against. Each site is considered on its own merits and site
specific requirements are excluded from the Standard Checklist. These
additional requirements, outside of the Standard Checklist, will be
discussed with you either following receipt of a complete application or we
invite you in prior to submission of a complete application to discuss site
specific details

Once the Technician has completed their Initial Assessment, they will
issue a Technical Assessment Letter that details any further information
that may be required for them to complete their assessment

Preparation and Issue of
Draft Legal Agreement
Upon issuing Technical Approval, the Technician will request the required
amount of drawings, along with confirmation of all parties included within
the Agreement and the Solicitor’s details. This information is needed to
enable us to prepare and issue the Draft Agreement
Preparation and Issue of
Engrossed Legal Agreement
On return of the Draft Agreement, the Technician will issue an Engrossed
Agreement to the Developer / Solicitor for signing. Typically, three copies
will be issued, one each to the Developer, Surety and Yorkshire Water. On
return of the Signed Engrossed Agreements, Yorkshire Water will sign and
date the Agreements and return copies to all parties, retaining a copy for
our records.
Technical Approval IssuedOnce all ‘further information’ has been submitted and assessed by the
Technician, and deemed to be satisfactory, the Technician will issueTechnical Approval.

The Adoption Process
Once the site has been fully constructed, is 51%
occupied, the S104 Agreement has been signed by
all parties and all fees have been paid, the developer
can then request for the site to be put on an agreed
maintenance period. To facilitate this, we require
copies of all the ‘as built’ drawings included within the S104 Agreement, details of the constructed
manholes, long sections, sewer lengths and details
of any ancillaries (such as flow control devices) to be
submitted, alongside the O&M Manuals (if there is a
pump station on the site).
Our Developer Services Inspector will then inspect
all sewer lengths being offered for adoption, against
the ‘as built’ drawings. This could be either a CCTV
survey or a Light Line survey, depending on the pipe
material. We will then notify you of any defects and
these will need rectifying, and another CCTV survey
submitting as evidence the remedial works have
been carried out satisfactorily.
Once the Developer Services Inspector has
confirmed that they are happy with the condition of
the sewers, all remedial works have been
undertaken and all conditions of the S104 Agreement
have been met, we will issue a Provisional Certificate
of Completion.
For some sites the Bond monies will be reduced /
released along with the issuing of the Provisional
Certificate. A retention will be applicable for sites with
pumping stations. Typically, the site will be put on a
12 month maintenance period. During the
maintenance period, the developer is still responsible
for the private system.
At the end of the 12 month maintenance period, our
Developer Services Inspector will undertake a Final
Inspection of the works and advise the developer of
any remedial works that may be required.
Once all remedial works, the legalities and the ‘as
built’ drawings have been completed to our
satisfaction, you will be provided with a Vesting
Declaration for Adoption of the system. The sewer
records will be updated accordingly.
For sites with pumping stations and detention basins,
a formal handover with Yorkshire Water Operations
will be required. Following the handover meeting,
Yorkshire Water will take over ownership and
maintenance of the public sewers. This will conclude
the developers obligation under the S104 Agreement
The Inspection Process
Construction work should not begin until we have a
copy of the F10 notice, the site has been issued Technical Approval and the S104 Agreement has
been signed by all parties.
A pre-start meeting can be arranged between the
Contractor and / or the Developer and a Developer
Services Inspector to discuss the details agreed and
ensure the technically approved drawings are going
to be referred to during the construction phase.
During the construction phase, at the request of you
or your contractor, our Developer Services Inspector
will undertake a number of inspections to ensure
compliance against the technically approved drawings
and in accordance with the S104 Agreement.
If you would like a Developer Services Inspector
to visit your site before Technical Approval is issued,
there is an option of paying an upfront non-refundable
fee to Yorkshire Water, allowing you to start
construction work on site (at your own risk) and for
inspections to commence. However, the S104
submission must have been assessed and
considered to be ‘technically satisfactory’ and all
supporting documentation have been provided. All
associated S104 fees must have been paid prior to
works commencing. This is not a preferred option
due to the fact that works inspected are not
guaranteed to be satisfactory until the system has
achieved Technical Approval and may have to be
altered.
Any changes to the technically approved design,
during the construction phase, must be brought to the
attention of the Developer Services Inspector. These
must be agreed in writing and any significant
variations from the S104 Agreement can be recorded
and amendments made where necessary.

Design of Adoptable
Sewers

new S104 application:

Standard Checklist
Planning
Confirmation that Planning Approval has been granted :
We require confirmation of permission to discharge surface water, the flow rate and the point of connection
We require confirmation of point of connection for foul sewerage
We require confirmation that Highway Drainage to proposed adoptable sewer has been ‘agreed’
We require confirmation of Surety Details, Landowner / Adjacent Landowner details have been received as
part of the application
Developer Programme of Works
We require confirmation of the estimated construction start date.
Please note - no sewer works to be carried on-site until ‘Technical Approval’ is issued.
If the developer opts to start works on site prior to this, they do so at their own risk and we will send out an
‘Early Start on Site’ Letter
Site Location Plan
Site Location Plan details must be:
at a minimum scale of 1:2500
showing the site boundary edged in green with the location and value of the OS Benchmark used and the OS
map reference for the site.
Site Layout Plan
Site Layout Plan must show:
the North Point
site contours
direction of flow, pipe material, pipe size and gradient on all main drains and sewers
the proposed sewerage layout is consistent with any agreed Drainage Strategy for the area
any existing public sewerage assets affected
that there is no possibility of back flooding from sewers. We require confirmation of private drainage drawing
with cover levels shown
layout drawing drawn at minimum of 1:500 scale
connections to existing (public) sewers, have the existing invert / soffit level detailed and verified on site
that manholes are located correctly. Manholes are required at every change in direction, change in pipe size,
change in gradient and located to facilitate connection with a public sewer
the maximum distance between manholes is typically 150 metres a 3 metre wide vehicular access to any chambers containing a flow control device and headwall on any
detention basins, to within 5 metres of the maintainable asset. This should be to highway construction and
surfaced with bitmac or concrete
a turning area to avoid a 4,000 gallon tanker reversing more than 20 metres
a protected strip if any of the prospectively adoptable sewerage is located outside the highway and through
plots that are to be sold, in accordance with Sewers for Adoption 6th
Edition, and shown yellow on the plan

kerb lines and service strips / margins are at least 1 metre away from the centreline of the prospectively adoptable sewer and at least 0.5 metre from the outside edge of prospectively adoptable manholes
any prospectively adoptable sewer is located at least 5 metres away from any proposed planting and is positioned at least 3 metres from an existing tree
the minimum size and gradient of the gravity sewers to provide a self cleansing regime. This is site dependant but where fall is available we would look for this to be utilised, where it is not, then the 1 in 150 rule would become applicable. Obviously 1 in 120 is better than 1 in 135, but 1 in 80 is even better still
a manhole being built at every junction of a public / adoptable with a private sewer, serving more than six properties
Please note – we will not accept ground water, land drainage and / or filter drains connected (directly or
indirectly) to the (prospective) public sewer network
Please note – a Right in Perpetuity will be required for vehicular access to the maintainable asset
Please note – a Deed of Grant of Easement will be required for any on site prospectively adoptable sewerage
located outside the highway and through plots that are not to be sold AND /OR if any of the off site prospectively
adoptable sewerage is located outside the highway
Please note – the pipelines which only serve the adoptable highway cannot be adopted under Section 104 of
the Water Industry Act. The applicant will need to discuss these pipelines with the Highway Authority and
incorporate it into the road adoption agreement. These pipelines must be labelled as ‘Highway Drain’ on the site
layout plan submitted to Yorkshire Water
Please note – a separate Section 116 and / or Section 185 Agreement will be required for work on existing live
public sewers within the site boundary
Where possible:
where there are two separate road gullies into a manhole, remove one of the gullies from the manhole and
connect it via a junction pipe to the other gully leg
road gullies should connect via junction pipes to the existing / adoptable sewers and not directly to manholes
(except where they are at a head of a system)
Longitudinal Sections
Longitudinal Sections must:
be drawn at Scales 1:100 vertical and 1:500 horizontal
show existing ground level
show proposed cover and invert levels
show pipe material, pipe strength, pipe diameter and type S bedding
show gravity sewers connected soffit to soffit, where there is a change in pipe size
show offline surface water storage laid invert to invert
show where the depth of cover to top of sewer is less than 1.2 metre in highways and verges (or less than 900mm in none vehicular access areas), a 150mm reinforced concrete slab should be provided above granular bed and surround
show foundation of plots in relation to the proposed sewers
eliminate unnecessary crossovers
show filled ground that has been back filled and consolidated under the supervision prior to any works on the sewer starting

Manhole Schedule
Adoptable manhole schedule must:
should be constructed in accordance with Sewers for Adoption 6th Edition
show kitemarked cover slab
show the opening in the cover slab, in accordance with Concrete Pipe Systems Association (2004)
show manhole covers with a clear opening of 600mm and be Class D400 to BS EN 124 with 150mm deep
frames in highways
backdrops should typically be brought up to the top of the benching to avoid silting
show manholes over 6 metres deep to invert with an intermediate landing with handrails and safety chains
fitted around the opening. Two double rung step irons should be set vertically in the chamber walls to act as
hand grips when stepping off the ladder onto the landing
Please note – we do not accept Type C brick manholes. Our preference are Type B manholes with 1200mm
diameter or 1500mm diameter rings (opening must be sited over channel where depth of cover to pipe soffit is
less than 1.5 metres)
Flow Control Manhole
The flow control manhole details must show:
the model, the make, the head and the flow rate
the penstock details and the manufacturers details
the minimum diameter of the flow control manhole is 1800mm the cover should be a double twin 600mm x 600mm D400 with a fall arrest grille. Step irons / ladders are
not required the drain down pipe being the same diameter as the outlet pipe
the width of the sump being a minimum of 450mm from the base ramp to the front of the flow control unit
the invert level of the outlet / drain down pipe being 50mm lower than that of the inlet pipe (to ensure no standing water over the landing area within the manhole)
