On hearing the news of thenotification of the adaptation ofLaws (Amendment) order, 2019extending Inner Line in Manipur bythe Hon’ble President of Indianotified in the official gazette ofMinistry of Home Affairs,Government of India on December11,2019, the people of Manipur hadoverwhelming joy. However, onminute scrutiny of 5the adaptionorder, the said joy was short-lived.There is a serious legal flaws theadaption order made by the Hon’blePresident. It is a great pain andsorrow to see such legal loop holesin the said order. It seems that Union

Government had wrongly exercisesuch power to issued such orderunder clause (2) of Article 372 ofconstitution of India. For matterswhere the Hon’ble President has toexercise the legislative powers underthe constitution, such casualnessshould not be shown by the UnionGovernment.To point out such legal flaws in theadaptation order are not with mala-fide intention to tarnish the imageof the Hon’ble President and theunion Government, but to protectand uphold the h ighestconstitutional office of the Hon’blePresident. It is due to the UnionGovernment dealing with the matterin a hasty and casual mannerwithout consulting and seeking

proper legal advice from theappropriate legal experts.The fact is that the Adaptation oflaws (Amendment) order,2019 wasissued by the Hon’ble President on11th December,2019 in exercise ofpower conferred under clause (2)provides that the Hon’ble Presidentmay for the purpose of bringing theprovisions of any Law is force inthe territory of India into accordwith the provisions andmodifications of such law as maybe necessary or expedient andspecify the date from which thesame would be effective where upon such lawwill be effective there from, subjectto such adaptation andmodifications. However, in view of

the provisions of clause 3 (a) of thearticle 372, Hon’ble President canexercise the powers under clause (2)not beyond three years from thecommencement of the constitution,i.e. the twenty sixth day of November,1949. This is not an opinion but legalproposition based on factual legalprovisions. This is not an opinionbut legal proposition based onfactual legal provisions. In thiscontext, Hon’ble Supreme Court incivil appeal no .4918 of 1984 decidedon April 1994 (state of Sikkim vs.Surendra Prasad Sharma and others)observed that, “ Article 372 (3) (a)makes it clear that this specialpower conferred on the Presidentis transitory in nature and will notenure beyond three years from the

commencement of theconstitution”.In view of the above discussion,the Hon’ble President should nothave exercised his power under thesaid provision as per mandate ofthe constitution of India. Therefore,the present adaptation order forextension of ILP to Manipur isunconstitutional ,void and has noforce of law. what will be the fate ofthe action taken on the basis of thesaid impugned adaptation order isvery annoying.Now , the only alternative actionsto be taken by the uniongovernment to tide over from thepresent impasse is to introduce aBill in ILP in the current session ofthe Parliament for validating the

impugned adaptation order byinserting a validation clause forsaving all the actions taken underthe said impugned order from thedate of its notification.We want a strong ILP not a papertiger.For anything against the interest ofthe state Government and itspeople, we can’t remain as a mutespectator , we have to raise ourvoice to rectify such mistakes failingwhich our future generation will spiton our graveyards.It is my earnest appeal to all the civilsocieties and the stakeholders toremain clam without resorting toany agitations. We may have ourtrust and hope to the UnionGovernment.

As part of the celebration,Biswajit also inaugurated aSuspension Bridge over River Gangolconstructed under the Local AreaDevelopment Fund of the localMLA. The bridge will connect Wardno 5, Keithelmanbi to Tenjang Veng.Elaborating on the responsibilities ofthe youth in transforming a society,Biswajit said that no development inany society or nation building ispossible without the youth’s powerof ideas and their ambitions.
