The Support Services Committee met on Monday, March 9, 2015 in the Board Room of the Fuller Administration Building, 511 Cleveland Street, Durham, North Carolina.
Board Members Present Leigh Bordley, Chairperson; Sendolo Diaminah, Vice Chairperson; Minnie Forte-Brown; Natalie Beyer; Mike Lee; Heidi Carter and Matt Sears were present.
Administrators Present Dr. Debbie Pitman, Assistant Superintendent of Student, Family and Community Services; Dr. Bert L’Homme, Superintendent; Dr. Stacey Wilson-Norman, Deputy Superintendent of Academic Services; Marcia Pearson, Chief Information Officer, and William Sudderth-III, Director of Public Information.

Call to Order/Moment of Silence Chairperson, Leigh Bordley called the meeting to order at 6:18 P.M. and presided over a moment of silence.

Committee Reports
Update on School Nurses, CHAPP Programs, and Duties of Non-medical Staff Public Comment: None Dr. Richard Lemke, Principal of DPS Hospital School provided an overview of the types of nurses serving DPS students (traditional, Child and Family Support Team, ECP separate classroom, individual contract, and enhanced role nurses in the Child Health Assessment and Prevention Program. He provided details on the school assignments, partnerships, highlights, and functions. Dr. Lemke provided information on CHAPP including a flyer in English and Spanish and shared the five elementary school locations (EK Powe, George Watts, Glenn, Merrick-Moore, and Oak Grove). He also shared the scope of employee duties to provide some

medical care in accordance with N.C. GS. §115C-375.1.
The board had a full discussion. The agenda item was presented for information.
Playworks, Physical Activity Programs at Middle Schools and Non-traditional Afterschool Public Comment: None John McCain, Area Superintendent, provided an update on Playworks and Larry McDonald, Director of K-12 PE/Health, provided an update on traditional middle schools and non-traditional afterschool physical activities.
The Playworks information included the objectives, implementation, start-up, fitness activities, the five components (class game time, junior coach program, out-of-school time, recess, and interscholastic leagues) and the participating elementary schools (Eastway, Eno Valley, EK Powe, Fayetteville St., Glenn, Hope Valley, Lakewood, Merrick Moore, Parkwood, W.G. Pearson, Sandy Ridge, Y.E. Smith, and C.C. Spaulding).
The middle school physical activity update included healthful living minutes, recess/physical activity time, and non-traditional approaches to physical activity. Additional information was provided regarding the physical activity schedule per day, implementation examples, and options according to School Wellness Policy 3021 for school year 2014-15.
The board had a full discussion. The agenda item was presented for information.
Summary of Follow-Up Items Explore scheduling options to bring schools into compliance with the 225 minutes of physical activity.
There being no further business, Ms. Bordley adjourned the meeting at 7:45 P.M.

POLICY 5430 TEACHER DISMISSAL, DEMOTION AND NONRENEWAL NON-
RENEWAL OF TEACHERS ON RENEWABLE CONTRACTS
All actions for dismissal, demotion or nonrenewal of teachers shall comply with North Carolina law.
Nonrenewal Procedure for Probationary Teachers
1. Notice of Nonrenewal Recommendation and Right to Request Information and a Hearing
a)
1. Grounds for Contract Non-Renewal
The Superintendent shall provide written notice to a probationary teacher of the Superintendent’s
recommendation Board may elect not to renew the teacher’s contractcontract of any non-career status
teacher for any cause it deems sufficient, so long as the cause is not arbitrary, capricious, discriminatory,
prohibited by May 15. The notice shall inform the state or federal law, or for personal or political reasons.
However, a non-career status teacher in at least the fifth year of consecutive service as a teacher on a
renewable contract, who has demonstrated proficient or better performance in all standards on the last
three (3) annual evaluations prior to the current school year, may be non-renewed only for one or more of
the teacher’s right to file following reasons:
a written request to the Superintendent within 10 days for (a) the reasons and documents in support of
the Superintendent’s recommendation and (. Inadequate performance.
b). Immorality.
c. Insubordination.
d. Neglect of duty.
e. Physical or mental incapacity.
f. Habitual or excessive use of alcohol or nonmedical use of a controlled substance as defined in
Article 5 of Chapter 90 of the General Statutes.
g. Conviction of a hearing beforefelony or a crime involving moral turpitude.
h. Advocating the board ifoverthrow of the teacher is eligible at government of the time for a career
status decision (however, there is no right to a hearing ifUnited States or of the reason for the
recommended nonrenewal is aState of North Carolina by force, violence, or other unlawful means.
i. Failure to fulfill the duties and responsibilities imposed upon teachers by the General Statutes of this
State.
j. Failure to comply with such reasonable requirements as the Board may prescribe.
k. Any cause which constitutes grounds for the revocation of the teacher's teaching license.
l. A justifiable decrease in the number of positions due to district reorganization, decreased
enrollment, or decreased funding). If the teacher does not file a request to the .
m. Failure to maintain his or her license in a current status.

2. Hearing Procedure
If a probationary teacher eligible for a career status decision files a timely request for a hearing, or if any
other probationary teacher is granted a discretionary hearing following, the filing of a timely petition, the
following procedure shall apply:
(a) The boardBoard may designate a hearing panel of at least three boardBoard members to hear the
appeal and act upon the school administrator’s request, as provided in Policy 1235
.(b) . The decision of the Board panel will be final. The teacher and Superintendent will be notified of
the time, date, and place of the hearing. At least two work days before the day of the hearing, the teacher
and Superintendent willshall provide to the Board and to one another copies of all documents to be
presented at the hearing. Documents not exchanged in advance of the hearing may not be used as
evidence without the consent of both parties or by a majority vote of the Board or Board panel. The
teacher shall include with these documents a statement of the specific reasons for challenging the
Superintendent’s recommendation. The Board will make and maintain a record of the hearing.
(c) A record of the hearing shall be made and maintained by the Board.
(d) The hearing shall be informal. Formal rules of evidence will not apply. The teacher and the
Superintendent may be represented by legal counsel and may present witnesses. Unless otherwise
modified by the Board or Board panel, each side will be allowed thirty30 minutes to make a presentation.
Current Policy with Proposed Revisions
The Superintendent shall make his/her presentation first, followed by the teacher. Either party may
reserve time for rebuttal. The Board or Board panel may limit or exclude duplicative or irrelevant
evidence.
3. Board Decisions on Teacher Non-Renewal
(a) The Board or Board panel may uphold the Superintendent’s recommendation if it finds that the
reason(s) for the recommendation is not arbitrary, capricious, discriminatory, personal, or political.
(b)
If the Superintendent recommends the contract renewal of a non-career status teacher, the Board, in
considering the recommendation, may review any information in the teacher’s personnel file. If the
Board determines that it needs additional information regarding a contract renewal recommendation, the
Board will notify the teacher of the Board’s concerns and provide an opportunity for the teacher to
respond to the concerns before reaching a decision to non-renew the teacher’s contract.
The Board mustwill notify the probationarynon-career status teacher whose contract will not be renewed
for the next school year of its decision by June 15. However, if the teacher submits a formal request for
information as specified in this policy or for If, however, a teacher is granted a hearing, the Board
shallwill provide the nonrenewal notification by July 1within 10 days of the hearing or such later date
upon the written consent of the Superintendent and the teacher. The Board’s decision is subject to judicial
review in accordance with Article 4 of Chapter 150 B of the North Carolina General Statutesteacher.

POLICY 5430 NON-RENEWAL OF TEACHERS ON RENEWABLE CONTRACTS All actions for dismissal, demotion or nonrenewal of teachers shall comply with North Carolina law. 1. Grounds for Contract Non-Renewal The Board may elect not to renew the contract of any non-career status teacher for any cause it deems sufficient, so long as the cause is not arbitrary, capricious, discriminatory, prohibited by state or federal law, or for personal or political reasons. However, a non-career status teacher in at least the fifth year of consecutive service as a teacher on a renewable contract, who has demonstrated proficient or better performance in all standards on the last three (3) annual evaluations prior to the current school year, may be non-renewed only for one or more of the following reasons:
a. Inadequate performance. b. Immorality. c. Insubordination. d. Neglect of duty. e. Physical or mental incapacity. f. Habitual or excessive use of alcohol or nonmedical use of a controlled substance as defined in
Article 5 of Chapter 90 of the General Statutes. g. Conviction of a felony or a crime involving moral turpitude. h. Advocating the overthrow of the government of the United States or of the State of North
Carolina by force, violence, or other unlawful means. i. Failure to fulfill the duties and responsibilities imposed upon teachers by the General Statutes
of this State. j. Failure to comply with such reasonable requirements as the Board may prescribe. k. Any cause which constitutes grounds for the revocation of the teacher's teaching license. l. A justifiable decrease in the number of positions due to district reorganization, decreased
enrollment, or decreased funding. m. Failure to maintain his or her license in a current status. n. Failure to repay money owed to the State in accordance with the provisions of Article 60,
