The Government Notice which publishes these regulations notes that they were made on the recommendation of the Medical and Dental Council of Namibia. It also repeals the regulations in GN 238/1999 (GG 2222). These previous regulations were made in terms of the Medical and Dental Professions Act 21 of 1993 (GG 711), which was repealed by the Medical and Dental Act 10 of 2004. Pursuant to section 65(2) of the Medical and Dental Act 10 of 2004, they were deemed to have been made under that Act.

PART I
PRELIMINARY
Definitions
1.In these regulations, unless the context otherwise indicates, a word or expression defined in the Act has that meaning, and -
additional qualification means an additional qualification referred to in section 31(1)(a) of the Act, awarded by an educational institution and prescribed by regulation 13;
certified means certified as a true copy of the original by a commissioner of oaths appointed under section 5, or designated under section 6, of the Justices of the Peace and Commissioners of Oaths Act, 1963 (Act No. 16 of 1963);
general medical practitioner means a person registered as a medical practitioner under the Act, but not registered as a specialist;
pathology (anatomical) means the medical subject which deals with the morphological changes of pathological conditions;
pathology (chemical) means the medical subject that deals with the biochemical changes of pathological conditions;
pathology (clinical) means the medical subject which deals with the clinical application of the subjects pathology (chemical), haematology and microbiology;
pathology (forensic) means the medical subject which deals with the study of the pathology of the effects of the physico-chemical agents and the medico-legal and forensic application of pathology (anatomical), pathology (chemical) and basic pathology principles;
pathology (haematological) means the medical subject that deals with the study of blood and blood- forming organs, blood groups, blood coagulation and the serological aspects connected therewith;
pathology (microbiological) means the medical subject which deals with the study of bacteriology, serology, virology, parasitology, mycology and immunology;
pathology (virological) means those medical subjects that deal with the study of viruses and the related aspects of general medical microbiology, molecular biology and immunology for the purpose of achieving a comprehensive training in virology;
specialist medical practitioner means a medical practitioner in whose name a speciality is registered, and specialist has a corresponding meaning;
speciality means a speciality in medicine prescribed by regulation 4;
sub-speciality means a subdivision of a speciality in medicine prescribed by regulation 11;
training hospital means a hospital or other institution providing the education, tuition and
training for the purpose of specialist registration and recognised or approved for that purpose by the registering authority of the country in which the training hospital is situated, and training facility has a corresponding meaning; and
the Act means the Medical and Dental Act, 2004 (Act No. 10 of 2004).
PART II
REGISTRATION OF MEDICAL PRACTITIONERS
Application for registration as medical practitioner and submitting of particulars
2.(1)An application for the registration of a person as a medical practitioner under section 19 of the Act must be accompanied, in addition to the documents, particulars and payments specified in subsection (2) of that section, by -
(a)a certified photocopy of the identity document or of the passport of the applicant;
(b)proof, to the satisfaction of the Council, that he or she has completed the prescribed internship; and
(c)the original certificate of registration to practise as a medical practitioner in the country where the applicant obtained the qualification, issued by the registration authority responsible for the registration of persons to practise as medical practitioners in that country.
(2)If the applicant is not registered with the registration authority referred to in paragraph (c) of subregulation (1), he or she must submit to the registrar, together with his or her application for registration -
(a)a certificate, issued by that registration authority, certifying that the qualification or qualifications of which the applicant is the holder, entitles him or her to registration as a medical practitioner in that country; or
(b)if he or she had been so registered previously, a certificate issued by that registration authority, specifying that the applicant had been so registered previously, that his or her name had been removed from the register and the grounds for the removal.
(3)The Council may require the applicant to furnish proof, in such manner as the Council may determine, of the applicants proficiency in the English language.
Additional education, tuition and training
3.(1)The Council must determine, when registering a person conditionally as a medical practitioner under section 21(2)(a) of the Act, the additional education, tuition or training, as the case may be, to be undertaken by the person so conditionally registered in order for him or her to qualify for registration as a medical practitioner.
(2)Particulars of the additional education, tuition or training, as the case may be, determined by the Council under subregulation (1), must be endorsed upon the certificate of conditional registration issued by the Council, under section 21(2)(b) of the Act, in the name of the person registered conditionally.
PART III
REGISTRATION OF SPECIALITIES
AND ADDITIONAL QUALIFICATIONS
Registrable specialities
4.(1)For the purposes of section 31(1)(b) of the Act, any branch of medicine mentioned in Annexure A is a speciality which may be registered, subject to compliance with these regulations, against the name of a medical practitioner.
(2)The standard of the education, tuition and training provided by an educational institution in respect of a post-graduate qualification relating to a speciality prescribed by subregulation (1) must be adequate and satisfactory, in the opinion of the Council.
(3)The post-graduate qualification referred to in subregulation (2) must entitle the applicant to registration, in the country where he or she obtained the qualification, as a specialist medical practitioner in the speciality to which that qualification relates.
Application for the registration of a speciality and submitting of particulars
5.(1)An application by a medical practitioner in terms of section 31(2) of the Act for the registration of a speciality must be accompanied, in addition to the documents, particulars and payments specified in subsection (3) of that section, by proof, to the satisfaction of the Council that -
(a)the applicant -
(i)if he or she is not registered to practise as a medical practitioner in Namibia, that he or she is the holder of a qualification which entitles him or her to registration as a medical practitioner in Namibia and has successfully completed the prescribed internship;
(ii)practised as a medical practitioner for a period of not less than five years before submitting his or her application to the Council; and
(iii)complies with the minimum requirements for registration prescribed by subregulation (2) relating to the speciality in respect of which he or she applies for registration;
(b)the post-graduate qualification on which the applicant relies for registration as a specialist medical practitioner entitles the holder thereof to registration as a specialist medical practitioner in the branch of medicine applied for by the applicant in the country where he or she obtained the qualification; and
(c)the post-graduate qualification referred to in paragraph (b) is an adequate qualification for specialist registration in the branch of medicine applied for by the applicant.
(2)For the purpose of subregulation (1)(c), the following minimum requirements, including the education, tuition and training, and the passing of all examinations relating thereto, apply to the following specialities:
(a)For the specialities anaesthesiology, cardiothoracic surgery, dermatology, diagnostic radiology, medicine, neurology, neurosurgery, nuclear medicine, obstetrics and gynaecology, ophthalmology, orthopaedics, otorhinolaryngology, paediatrics, physical medicine, plastic and reconstructive surgery, psychiatry, radiation oncology, surgery and urology, clinical experience for a period of not less than four years as the holder of a clinical appointment in the speciality, at a department of a training hospital;
(b)for the speciality public health medicine -
(i)not less than a total of four years training at a training hospital in all the subjects and domains of public health medicine; or
(ii)not less than a total of five years training in all the subjects and domains of public health medicine and the concurrent holding of a training position recognised or approved by the Council for that purpose,
to the satisfaction of the Council;
(c)for the speciality pathology (clinical), if no other speciality in pathology is registered in the medical practitioners name, not less than four years clinical experience in pathology (chemical), pathology (haematology) and pathology (microbiology) in or at a training hospital;
(d)for the speciality pathology (anatomical), pathology (chemical), pathology (forensic), pathology (haematological), pathology (microbiological) or pathology (virological), if no other pathology speciality is registered in the medical practitioners name, not less than four years clinical experience in that pathology speciality, in a training hospital, but for the speciality pathology (anatomical) the four years clinical experience must include the equivalent of six months experience in cytology and, in addition, the applicant must pass the examinations relating to cytology to the satisfaction of the Council;
(e)if the speciality pathology (clinical) is registered in the name of a medical practitioner who applies for -
(i)the speciality pathology (anatomical) also to be registered in his or her name, not less than three years clinical experience, in pathology (anatomical), in or at a training hospital, which must include the equivalent of six months experience in cytology and, in addition, the applicant must pass the examinations relating to cytology to the satisfaction of the Council;
(ii)any of the other pathology specialities also to be registered in his or her name, not less than two years clinical experience, in that pathology speciality, in or at a training hospital;
(f)if any of the specialities pathology (forensic), pathology (chemical), pathology (haematological), pathology (microbiological) or pathology (virological) is registered in the name of a medical practitioner who applies for any other of those pathology specialities, or the speciality pathology (clinical), also to be registered in his or her name, not less than two years clinical experience, in that pathology speciality, in or at a training hospital;
(g)if any of the specialities pathology (chemical), pathology (haematological), pathology (microbiological) or pathology (virological) is registered in the name of a medical practitioner who also applies for the registration of the speciality pathology (anatomical) in his or her name, not less than three years clinical experience, in that pathology speciality, in or at a training hospital, which experience must include the equivalent of six months experience in cytology and, in addition, the applicant must pass the examinations relating to cytology to the satisfaction of the Council;
(h)if any of the specialities pathology (chemical), pathology (haematological), pathology (microbiological) or pathology (virological) is registered in the name of a medical practitioner who also applies for the registration of the speciality pathology (anatomical) in his or her name, not less than three years clinical experience, in that pathology speciality, in or at a training hospital, which experience must include the equivalent of six months experience in cytology and, in addition, the applicant must pass the examinations relating to cytology to the satisfaction of the Council;
(i)if the speciality pathology (forensic) is registered in the name of a medical practitioner who also applies for the registration of the speciality pathology (anatomical) in his or her name, not less than three years clinical experience, in pathology (anatomical), in or at a training hospital, which experience must include the equivalent of six months experience in cytology and, in addition, the applicant must pass the examinations relating to cytology to the satisfaction of the Council.
(3)The following conditions apply relating to the recognition of any period of experience for the purpose of the requirements of subregulation (2):
(a)experience gained in Namibia must only be recognised by the Council if the applicant was registered as a medical practitioner with the Council, or with any of its predecessors, throughout the period that that experience was gained;
(b)experience gained in a country other than Namibia -
(i)must only be recognised if, throughout the period that that experience was gained, the applicant was registered as a medical practitioner with the registration authority responsible for the registration of persons to practise as medical practitioners in that country; and
(ii)may be recognised in respect of community service completed by the applicant in terms of the laws of that country;
(c)experience gained during internship must not be recognised by the Council for the purpose of a speciality; and
(d)experience in a speciality gained at a training hospital of less than six months duration, or for the pathology specialities of less than four months duration, must not be recognised by the Council unless -
(i)a period of less than six months, or for the pathology specialities a period of less than four months, is required for the completion of the period of experience required in terms of subregulation (3);
(ii)the medical practitioner, with the written permission of the training hospital, varied his or her training by receiving training in training positions in various medical faculties in the discipline, to the satisfaction of the Council.
Recognition of experience gained in certain circumstances
6.For the purposes of the requirements of regulation 5(2), the Council may recognise experience gained in the following circumstances:
(a)If a medical practitioner has gained satisfactory experience, in the opinion of the Council, for a period of two years or more, in the speciality that he or she applies for registration in his or her name, in a training hospital or other institution approved by the Council for that purpose, the Council may recognise a maximum of 12 months specialist training or, if he or she has had less than two years of that experience, a proportionate period of time of that training;
(b)in addition to any period of time recognised under paragraph (a), but not exceeding a period of 12 months in total, experience gained by a medical practitioner, in a manner acceptable to the Council -
(i)in a department of a hospital or institution recognised by the Council as affiliated to an educational institution;
(ii)in a department of a hospital recognised by the Council and an educational institution as a satellite teaching department of that educational institution;
(iii)as the holder of an appointment, that the Council considers appropriate, in a department of a hospital or institution referred to in subparagraph (i) or (ii); and
(iv)in a field of study that the Council considers to be related to the speciality which the medical practitioner applied for registration.
Limitation on the practising of a speciality
7.A specialist must confine his or her practice to the speciality registered in his or her name.
Commencement of speciality practice
8.A specialist medical practitioner who commences with the conducting of his or her practice must inform the registrar in writing, within a period of 30 days after the commencement of the conducting of that practice, of the physical address at which the practice is being conducted, and the postal address, telephone numbers, facsimile number and e-mail address of the specialist.
Conditions applicable to the practising of a speciality
9.(1)A specialist medical practitioner may charge fees for conducting examinations or procedures relating to his or her patients, if those examinations and procedures are generally accepted practice in the speciality for which the specialist medical practitioner is registered.
(2)The fees referred to in subregulation (1) may not exceed the fees prescribed in respect of the examinations or procedures.
(3)The examinations and procedures referred to in subregulation (1) and (2) must be conducted only for, or for the benefit of, the bona fide patients of the specialist medical practitioner.
(4)A specialist medical practitioner may treat any person who consults him or her directly, without a referral by any general medical practitioner, other specialist medical practitioner or medical practitioner.
(5)A specialist medical practitioner who is consulted by a patient, or who treats a patient, must keep the general medical practitioner who normally treats that patient reasonably informed of the treatment of the patient.
Cessation of speciality practice
10.A specialist medical practitioner who discontinues practising a speciality must notify the registrar in writing thereof within a period of 30 days after the date upon which he or she so discontinued to practise that speciality.
Registrable sub-specialities
11.The specialities specified in Annexure B are the sub-specialities that may be registered under section 31(1)(b) of the Act against the name of a specialist medical practitioner.
Application for the registration of a sub-speciality and the submission of particulars
12.(1)A medical practitioner who applies for the registration of a sub-speciality in his or her name must -
(a)pass, in such manner as the Council may determine, an examination approved by the Council, or must submit to the Council a certificate in which it is certified, to the satisfaction of the Council, that he or she is competent to practise in that sub- speciality; and
(b)submit proof to the Council that, subsequent to the registration against his or her name of the relevant speciality mentioned in the second column of Annexure B, which forms part of the qualification on account of which he or she is applying for registration of that sub-speciality, he or she has gained not less than two years clinical experience in the particular sub-speciality as the incumbent of a clinical position, to the satisfaction of the Council, under the control of the relevant department in a training hospital recognised by the Council for the purpose of gaining that clinical experience.
(2)A medical practitioner who has not practised his or her speciality for the period of time prescribed by paragraph (b) of subregulation (1), must satisfy the Council, in such manner as the Council may determine, that he or she possesses the skills and the knowledge necessary to practise in his or her speciality before the registration of the sub-speciality may be granted.
(3)The requirements prescribed by subregulation (2) may include a period of time, to be determined by the Council, which period must not exceed two years, which the specialist spent, with the prior written approval of the Council, as an incumbent in the position of a clinical assistant or an equivalent position, in a hospital in Namibia.
Registrable additional qualifications
13.(1)The qualifications prescribed by Annexure C are the additional qualifications referred to in section 31(1)(a) of the Act, which additional qualifications may be registered, subject to these regulations, by the Council in respect of a person registered as a medical practitioner.
(2)An additional qualification prescribed by Annexure C may not be registered in respect of a medical practitioner, unless the registration authority responsible for the registration of persons to practise as medical practitioners in the country where the applicant obtained that qualification recognises that qualification as an additional qualification that may be registered as such in that country.
Requirements for registration of an additional qualification
14.An application by a medical practitioner in accordance with section 31(2) of the Act for the registration of an additional qualification must be accompanied, in addition to the documents and particulars specified in subsection (3) of that section, by proof, to the satisfaction of the Council that -
(a)the applicant -
(i)is registered to practise as a medical practitioner in Namibia; and
(ii)is the holder of that additional qualification; and
(b)the registration authority responsible for the registration of persons to practise as medical practitioners in the country where the applicant obtained the qualification, recognises that qualification as an additional qualification that may be registered as such in that country.
PART IV
REGISTERS AND RESTORATION OF NAME TO REGISTER
Register of medical practitioners
15.The register of medical practitioners established and kept in accordance with subsection (2) of section 23 of the Act, must contain, in addition to the particulars specified by subsection (3) of that section, particulars of -
(a)the specialities, sub-specialities and additional qualifications entered against the name of the medical practitioner in accordance with subsection (4) of section 31 of the Act; and
(b)any change in any of the particulars recorded in the register.
Restoration of name to register
16.An application in accordance with section 25 of the Act for the restoration of the name of a person to a register, in addition to the documentation referred to in subsection (2) of that section, must be accompanied by -
(a)the original registration certificate issued under section 20(4)(b) of the Act in the name of the applicant, or if for any reason the original certificate cannot be submitted, proof to the satisfaction of the Council that the applicant was so registered; and
(b)a photocopy of the identity document or the passport of the applicant, duly certified by a commissioner of oaths as a true copy of the original.

Language of forms and documents
17.(1)Any form or document required to be submitted to the Council or to the registrar in terms of these regulations must be, subject to subregulation (2), in the English language.
(2)Any form or document referred to in subregulation (1) that is not in the English language must be accompanied by a translation thereof into that language, acceptable to the Council.
