Activities of MHRD Chair/ CIPRA- 2014-15

1. Conference on Enforcement of Copyright in the Film and Recording Industry – Challenges on 23rd April, 2014

With the objective of celebrating the World Book and Copyright Day, The MHRD Chair on IPR and Centre for Intellectual Property Rights Research & Advocacy (CIPRA), National Law School of India University, organizing conference on ‘Enforcement of Copyright in the Film and Recording Industry -Challenges’. The conference was scheduled at conference hall, Academic block, National Law School of India University, Nagarabhavi, Bangalore on 23th April 2014. The aim of the conference was to not only celebrate the creativity and contribution of innovators across the country but also use it as a platform to discuss the New Challenges pertaining to Copyright Law and also to have a discussion with the industry experts, players, and Lawyers who practice in this field, to critically analyze the provisions of the copyright law and the report of the Standing Committee, which affect the rights of the producers, authors and performers in the underlying works incorporated into films and sound recording.

Inaugural session was started with the welcome address by Mr. Vivek Anand Sagar Research Associate, MHRD Chair on IPR, which was followed by the lighting the traditional lamp.

The inaugural address was delivered by the Chief Guest Mr. N.R. Vishu Kumar, Director of Department Information, Government of Karnataka, Mr. T. S Nagabharana, Director, Actor, Former President of Karnataka Chalanachitra Academy delivered the key note address

and the Presidential remark was made by Prof (Dr) R. Venkata Rao, Vice Chancellor, NLSIU

The first technical session was on the topic COPYRIGHT IN FILM INDUSTRY the sub topics was on Ownership of copyrights, Transfer of copyrights, Enforcement and Remedies, Performers Rights, Functioning of the copyright societies. The session started with the frame work presentation by Mr. Sushen Srivathsan, LL.M Student NLSIU and the session was chaired by Mr T S Nagabharana, Director, Actor, Former president of Karnataka Chalanachitra Academy and Mr. Prakash Balwadi, Theatre Director, Mr. N.S. Shreedhar Murthy, Magazine Editor, Mr. Hari Krishna Holla, Advocate Mr. Hamsalekha, Music Director and Lyricist were in the panel for discursion

The second Technical Session was on COPYRIGHT IN SOUND RECORDING INDUSTRY and the sub topics were Ownership of rights, Transfer of Rights, Enforcement and Remedies, Performers Rights, Broadcasting Rights, Functioning of the copyright societies. The session was chaired by Mr. Lahari Velu, Proprietor, Lahari Recordings Company Ltd, and Mr. Hamsalekha, Music Director, Lyricist, Mr. Mohan Chabria, Proprietor, Anand Audios Co. Ltd, Mr. Kaviraj, Lyricist, Mr. Hari Krishna Holla, Advocate, Mr. Prakash Balwadi, Theatre Director were in the panel discursion

The Conference was attended by government officials, lawyers, stake holders in the field of recording and film industry, academicians, researchers, students and public in general.

At last the conference was successful in fulfilling the objective and the concluding remark was made by the Prof T Ramakrishna stating that insightful expression and thought provoking issues raised by the panellist was highly appreciated by one and all. This conference has been very helpful in doing the impact assessment of the change in Copyright Law on the Industry. The gaps notices in the conference would be reported properly and the centre for IPR Research and Advocacy will endeavour to address the issue to the appropriate authority.

2. Posters competition and Books Exhibition

The MHRD Chair on IPR and Centre for Intellectual Property Rights Research & Advocacy (CIPRA), National Law School of India University, organizing “Posters Competition and Books Exhibition” the posters and books Exhibition was held at the Quad Angle, Academic block, National Law School of India University, Nagarabhavi, Bangalore on 23th April 2014 a host of the books were displayed and offered for sale.

2.Two Day “ Capacity Enhancing Program in Intellectual Property Rights for Senior Executives of HAL ”

National Law School of India University and HAL Academy had organised Two Day “Capacity Enhancing Program in Intellectual Property Rights for Senior Executives of HAL” on 23rd and 24th of April 2014 at the International Training Centre, NLSIU, Bangalore.

Inaugural session was started with the welcome address by Mrs. Jugnu Shrivastava, Faculty, HMA which was followed by the lighting the traditional lamp

Academicians and Advocates. The technical sessions was addressed by Prof. (Dr) T. Ramakrishna on Introduction to Intellectual Property Rights, International Regime overview, Law of Patents: Patent Eligibility in India, US, EPO and Determination of Novelty, Non-obviousness/Inventive step. Dr Mannan Bakthavathsalu, Senior Technologist addressed on Tools for “Prior Art Search”, Techniques of prior art search to determine Patentability of technology and Practical demonstration of the search process. Mr. Somashekar and Mr. Nithin Nair, Partner, Banana IP Counsels jointly presented on Procedure for obtaining patent: filing, publication, examination, FER, office action, opposition (pre-grant representation & post-grant opposition), grant, renewal, revocation and Patent Cooperation Treaty PROCESS.

Second day of the programme Mr. Somashekar and Mr. Nithin Nair, Partner, Banana IP Counsels jointly presented on Demonstration of patent procedure, Drafting of Provisional Specification/Complete Specification, Rules for Drafting of Claims, Amendment of claims.

Prof. (Dr.) T. Ramakrishna, MHRD Chair Professor on IPR addressed on Patent Infringement-Defences-freedom to operate, Literal infringement, Doctrine of Equivalents, Prosecution history estoppel and Experimental Use, Regulatory approval defence, exhaustion of rights, government use, compulsory licensing and IP Policy—IP Audit in the organisation

. Mr. Sreeharsha addressed on Patent Valuation—tools and techniques-utility

Mr. Harikrishna Holla, IP Advocate presented on the Procedure for registration of Trademark—protection of Trademark against infringement and passing off and in the last session Prof Ramakrishna covered the rest other IPRs like the Significance of Copyright Protection and Protection of ‘Designs’ in India

The two day Capacity Enhancing Program was concluded with the Valedictory session chaired by Mr. Sing, Prof. T. Ramakrishna and Mrs Jugnu Shrivastava, Faculty, HMA addressing the participants to make use of the theoretical knowledge acquired on IPR in this programme into the practice.

After the successful completion of the Two Day “Capacity Enhancing Program in Intellectual Property Rights for Senior Executives of HAL” conducted by the MHRD Chair on Intellectual Property Rights and Centre for Intellectual Property Rights Research & Advocacy (CIPRA), NLSIU the participants were awarded with certificate by Mr. Sing, HAL.

Awarding certificate to the participants by Mr.Sing Participants had expressed stupendous happiness for involving them in this capacity

enhancement programme and assured that they would utilise this comprehensive information gained in their daily activity of HAL by identifying the intellectual property and enrich the value of IPR in the organisation. Participants also suggested that this kind of programme should be continuously conducted for the officers of the organisation for keeping the pace with development.
