JUNE 6, 2007

PRESENT: Dan Ericksen, County Judge Sherry Holliday, County Commissioner Bill Lennox, County Commissioner Kathy McBride, Administrative Assistant

At 9:14a.m. Judge Ericksen called the meeting to order.

The Court considered the approval of the Regular Session Consent Calendar of June 6, 2007.

Some discussion occurred in regards to the proposed Resolution in the matter of supporting the transfer of property obtained through the foreclosure process in error.

Judge Ericksen explained the research conducted by the County on the Rocky and Jana Webb Property, which is outlined by Dan Boldt, Public Works Director/Surveyor, in the handout document.

At 9:38 a.m. the Court met with Merle Davis from Tygh Valley, Oregon.

Merle Davis informed the Court that Evelyn Knipp has sold the County's property that she has been leasing from the County. Mr. Davis stated that is proof that she has broken the lease with the County. She went to California and only lived on the property for four months. The son has been renting out the property. The son was killed last year.

Discussion occurred regarding the terms of the lease and the purpose behind the County granting the long-term lease to Evelyn Knipp.

Judge Ericksen instructed staff to have the Planning & Development Department flag the property in case any application is filed.

Staff was directed to research what improvements, if any, are located on the County owned property currently being leased by Evelyn Knipp.

Mr. Davis stated that there is a manufacture home and shop located on the County's property, which he believes is owned by Wasco County.

Mr. Davis stated that Mrs. Knipp has six vehicles parked on the County's property. Mr. Davis asked if he could use some of the property for storage of some trailers.

Judge Ericksen responded by stating that the vehicles are parked at the place where they are living. If it becomes a problem, the County will need to do something about it. Staff was directed to check into the vehicles being parked on the property.

At 9:56a.m. Randy Christiansen, Information Services Manager, met with the Court regarding the request to purchase, configure and install a new network and phone system for Wasco County.

Mr. Christiansen stated that the equipment is still functioning. Because of the water damage, the manufacture of the equipment will not maintain the equipment since the damage occurred.

The handout from Mr. Christiansen was reviewed and discussed at this time.

Tyler Stone, Employee & Administrative Services Director, stated that the County's insurance carrier would cover the replacement of the equipment damaged by the water.

Karen LeBreton Coats, County Clerk/Budget Director, stated that the County might need to accept and appropriate the insurance money for the purchase of the new equipment.

At 10:14 a.m. Kay Tenold, Wasco County Fair Board Member, informed the Court that the Fair Board would like to employ Cynthia Moss at $10 per hour up to 1 ,000 hours. The amount of people that are using the fairgrounds and Hunt's RV Park warrants the additional help. Mrs. Tenold stated that she would prepare a listing of duties for Mrs. Moss. The Fair Board does not anticipate hiring any additional help this summer; that will be part of Cynthia's duties.

Some discussion occurred.

Tyler Stone stated that Mrs. Moss would be an employee of the County.

Mrs. Tenold stated that Zack Harvey, Fair Board Member, would be the supervisor for Mrs. Moss.

The Court had no problem with the Fair Board's request as long as there is funding available for said position.

At 10:24 a.m. Tyler Stone informed the Court that Georgia Torland, Human Resources Secretary, is stepping down one day per week to get ready for retirement, which leaves a small void in the Employee & Administrative Services Department. At the same time, an employee at the Public Health Department has had her hours reduced. Mr. Stone is proposing that the Public Health employee job share at the Employee and Administrative Services Department. He is wondering if the job share position needs to be posted for the part time position.

The County Court felt the position did not need to be posted.

Some discussion occurred.

At 1 0:30 a.m. Karen LeBreton Coats spoke to the Court regarding next month's Election Conference. Some discussion occurred regarding product items that could be provided by the County for the conference.

At 10:41 a.m. Judge Ericksen called to order the Public Hearing on the adoption of the Wasco County Budget for Fiscal Year 2007-2008.

Karen LeBreton Coats, County Clerk/Budget Director, went over the proposed changes to Wasco County's Budget for Fiscal Year 2007-2008.

Mrs. LeBreton Coats stated that most of the changes in the General Fund are due to changes in personal services. The decrease in revenue is because of the loss in Community Corrections SB 1145 Funding. The Beginning Balance is being proposed to be increased by $73,584.

Discussion occurred. Mrs. LeBreton Coats noted that the budget is down from $12,393,058 this year to $11,811,473 for next fiscal year. The beginning balance is down $1 00,000; prior year taxes are down by $300,000; personal services have increased by 2.8%, while we cut out 1.5 FTE from the Budget. Insurance and PERS costs increased this year.

Mr. Stone stated that we lost two janitors due to a loss of a contract resulting in a 3.5 FTE total decrease instead of 1.5 FTE.

The Court took a short break.

At 11:20 a.m. the Court reconvened.

The Court discussed naming the Courthouse Basement Meeting Rooms.

Kathy McBride, Administrative Assistant, informed the Court that Courthouse staff, participating in the selection process, was split between the Gathering Places Category (Celilo & Amaton) and the Rivers Category (Columbia & Deschutes).

***It was the consensus of the County Court to name the following Courthouse Basement Meeting Rooms as follows: Meeting Room 1 will now be known as Celilo Meeting Room, and the Back Basement Meeting Room will be known as the Deschutes Meeting Room***.

The Court recessed at 11:36 a.m.

At 12 p.m. the County Court reconvened.

Karen LeBreton Coats informed the Court that she spoke to the County's Auditor who indicated that the County can accept and appropriate the $78,000 in insurance settlement money and that the funds can be appropriated under Capital Outlay.

{{{Commissioner Holliday moved to accept and appropriate $78,000 in insurance settlement money to the Wasco County Information Services Department during Fiscal Year 2006-2007. Commissioner Lennox seconded the motion; it was then passed unanimously.}}}

At 12:02 p.m. Robert Dys met with the County Court to discuss the property he owns, which is described as Township 2 North, Range 12 East, Section 22, Tax Lot 4200.

Robert Dys stated that he lives off Seven Mile Hill Road; his property is not directly connected to Seven Mile Hill Road, it is located 600 feet from the Road. The person who owns the land Steven Bleiler filed a conditional use permit so he could build a home on the property. Mr. Bleiler has an easement through Mr. Dys property. Mr. Dys has an easement to access his property through Richard and Elizabeth Waggoner's property, which is described as Township 2 North, Range 12 East, Section 22, Tax Lot 4300.

Last week when Mr. Dys was driving home, he saw that the County had installed a street sign at the bottom of his driveway. There is a platted road from 1911 for these properties. Mr. Dys stated that Dawn Baird originally told him that the road would not need to be named unless there are three or more residences accessing the road. Mr. Dys wanted to wait to name the road until there were three homes on the road. He is asking if it is possible for him to name the road when the time arises.

Mr. Dys stated that the big issue is that the Planning Department is trying to name his driveway a public road. The platted location of the road is not where the driveway is located. The road was originally punched through the woods some time back. That is why they have easements through the property for access. Mr. Dys is wondering why the Planning Department is allowed to

designate this gravel driveway a public road when it is not platted. There is a platted road, not at the location where the driveway is. If they do that, he loses some private land to the county.

Mr. Dys stated that his driveway is about 50 feet off the platted road. He had no part in the building of the road originally. When he purchased the property there was nothing but a goat trail up there. He improved what was there.

Some discussion occurred. Mr. Dys stated that he believes Mr. Bleiler's application has already been approved. Mr. Dys learned from Mr. Bleiler that he was applying for a conditional use permit; he did not receive any notice from the County. Mr. Dys received a copy of the letter asking for comments a day before it was approved.

Further discussion occurred.

Mr. Dys stated that he does not feel it should be his responsibility to build the public road. He feels the road should be built where it is supposed to be. He and his wife, and the Bleiler would lose private property for this public road.

Judge Ericksen asked Mr. Dys if the platted road stays the same and you continue to use your driveway, is that ok with you?

Mr. Dys stated that he does not want a street sign at the bottom of his driveway. He does not want people building off his road.

This matter will be discussed further with the Planning and Development Department.

Mr. Dys stated that the road is called "Fairmont Drive".

The Court recessed at 12:17 p.m.

The Court reconvened at 1:10 p.m.

The Court met with staff from the Wasco Sherman Public Health Department in regards to increasing the fees for On Site Waste Water Management, Licensed Facilities, and Clinical Services.

Glenn Pierce, Environmental Health Specialist Supervisor, stated that the On-Site Sewage Fees have not been increased for seven years and the Licensed Facilities Fees have not been increased since 2003. The Public Health Department plans to come back on an annual basis to get the fees increased. They are playing a little catch up here. He did a survey of the fees in the state of Oregon. The proposed fees are average, a few cases less than the average, in a few cases more.

Mr. Pierce referred the Court to items listed under Section B of the On-Site Sewage Disposal Systems Fees. Mr. Pierce noted the reasons for some of the increases under this section.

Some discussion occurred.

Mr. Pierce went over the proposed Licensed Facilities Fees, which amount to a 20% increase.

Mr. Pierce noted that the Public Health Department would notify their clients regarding the proposed increase in fees effective July 1, 2007.

Some discussion occurred regarding the survey conducted on other comparable counties' fees.

Lynnette Benjamin, Wasco Sherman Public Health Director, presented the increase in Clinical Fees. Mrs. Benjamin stated that she is not sure how long it has been since we increased our Clinical Fees.

Mrs. Benjamin stated that she would be coming back with increased fees for Family Health.

Some discussion occurred regarding the Immunizations Fees. It was noted that the first column is the cost of the vaccine.

The County Court met with Judy Davis, Wasco County Representative on the Columbia River Gorge Commission, to discuss various issues pertaining to the Columbia River Gorge National Scenic Area.

There were 15 people in attendance.

Judge Ericksen asked Judy Davis to provide the Court with an overview of where the Gorge Commission has gone over the last several years.

Judy Davis informed the Court when she got on the Gorge Commission four years ago the Commission was going through the Management Plan Review Process. They mainly spent time finishing the Plan Review. Since that time, the Commission has processed the historical building ordinance that covers all counties. The Columbia River Gorge Commission has also considered a number of other Plan Amendments, which are helping to solve individual and larger problems in the gorge. The big issue at the moment is the Broughton Lumber Mill Site in the State of Washington. The current regulations envision a camping/ recreational opportunity. They are looking to see if there is space that will allow an economically viable resort in conjunction with protecting the scenic and cultural resources.

Some discussion occurred on the Broughton Lumber Mill Site Project. Mrs. Davis noted the changes in the rules for considering a Legislative Plan Amendment. She noted that the Plan Amendment should come to a vote of the Commission later this year. After the Commission adopts the Plan Amendment, the Amendment would have to be adopted by the Federal Government, as well as Skamania County adopting those provisions within their Scenic Area Ordinance.

Mrs. Davis noted that the Columbia River Gorge Commission is considering this month Wasco County's Fire Standards Ordinance.

Judge Ericksen asked Mrs. Davis to explain the horse boarding case.

Mrs. Davis explained what had occurred in the horse boarding case in Klickitat County, Washington, and recently in a Multnomah County, Oregon, case.

Judge Ericksen asked Mrs. Davis if there has been any discussion at the Gorge Commission regarding the proposed expansion of the Urban Growth Boundary of the City of The Dalles.

Mrs. Davis stated very little discussion has occurred. One issue that came up at a recent meeting was that the Commission is a Bi-State Agency. This particular Commissioner is looking at the application as a Bi-State Application; there is an impact across the river that will impact the local area.

Judge Ericksen stated that we are not a Bi-State Organization. The City of The Dalles is actually doing the research work for the County. The County will forward the information to the Gorge Commission for their consideration.

Discussion occurred regarding the proposal to expand the Urban Growth Boundary of the City of The Dalles, as well as the purpose of the scenic act.

Mrs. Davis discussed the Gorge Commission's involvement in the UPC Cascade Wind Energy Project, which is located outside the Scenic Area. Mrs. Davis stated that Gorge Commission Staff would be providing technical assistance to the State of Oregon, but will not be providing a position on the issue because the Gorge Commission has no jurisdiction on this issue since the property is located outside the Scenic Area.

The Court had no other issues to discuss with Judy Davis.

Judy Davis stated that in reviewing her application of goals from four years ago she feels that she has worked on implementing the scenic act with the plan review; they have tried to streamline projects. The Commission has added some new uses that can be done effectively and still protect the resources. After coming out of plan review, the Commission has developed a handbook on how to build in the gorge. Mrs. Davis has given a number of talks in regards to the scenic act and has written letters to the editor in regards to the Investment Board and what they have done for the scenic area. Mrs. Davis stated that she is proud of her record and that she would like to be reappointed to the Gorge Commission for another term.

Judge Ericksen asked Mrs. Davis how much she is aware of the funding situation with the Columbia Gorge Discovery Center.

Mrs. Davis stated that Ken Karsmizki has spoken to them regarding their financial situation. She noted that there is a member of the Gorge Commission on the Discovery Center Board of Directors.

Judge Ericksen asked if the Gorge Commission has any influence at the congressional level if Wasco County was to ask for assistance to clear the construction debt. Judge Ericksen asked if we could get the Commission to support our request.

Mrs. Davis stated that this would be a good issue to discuss at the Gorge Commission.

Further discussion occurred on this issue.

The Court thanked Judy Davis for coming in to report on scenic issues.

At 2:16p.m. Bobbie Miller requested permission to read into the record a letter from Angelo Simione from The View Point Inn.

Mrs. Miller was given permission by Judge Ericksen to read the letter at this time.

Judy Davis stated that she voted for what she felt was best. Peter DeFazio would be amazed to say there were no meetings held on Oversight of the Gorge Commission.

Judge Ericksen stated that the letter speaks of killing an application. The application was for a plan amendment.

Mrs. Davis stated it was a plan amendment for a specific location.

Judge Ericksen asked what the process would have been if the plan amendment would have passed.

Mrs. Davis responded by stating that the plan amendment would need to be approved by the Gorge Commission and the County would need to adopt the provisions into their scenic area ordinance. Then the applicant would have to apply for a permit. Mrs. Davis stated that there was a delay of a month or two.

Judge Ericksen stated that Mrs. Miller has the wrong information. It needed to be a plan amendment, which is not a land use application. The View Point Inn could not have done anything without Multnomah County adopting it and then going back for an application. The one-month delay was expanding it from one spot in the gorge to the whole gorge.

Judge Ericksen stated that he does not represent the people of Multnomah County. This was something that we can provide to the entire scenic area instead of to one individual. It would have taken the same amount of time except for the month and a half.

Mrs. Miller stated that there was an application.

Judge Ericksen stated that Multnomah County needs to consider the application. However, they were at the Gorge Commission for a plan amendment.

Doris Flint stated that she sat through all but one or two hearings. Because of the actions of the Gorge Commission, Multnomah County got was they wanted. There was one delay after another. To date, no one else has even applied to restore a historical building. Mrs. Flint does not feel Wasco County should be worrying about what Multnomah County is doing.

Judge Ericksen stated that once The View Point Inn got through the process the issue would have been off the table. In reality, would anybody have come back and pushed this issue again to get it gorge wide.

Mrs. Flint responded by stating that an individual would not have to.

Georgia Murray stated that when she was here last year she said she would look thru the decisions made by various Commissioners on the Gorge Commission. Mrs. Murray stated that it is too difficult for her to provide this information to the County Court since it is very objective. There are sometimes two or three votes on a single issue. She would need to look at individual minutes and look at the subject matter. In the future Mrs. Murray suggests that we do something similar as Skamania County, have them explain what the issues are, and why they voted the way they did.

Mrs. Davis stated that she would agree that it would be difficult to tabulate. The Commission tends to talk over the issues to fine tune them without a lot of different motions. Most issues are not simply issues of private rights.

Commissioner Holliday stated that the County Court receives the minutes of the Columbia River Gorge Commission. She stated that the Court has been criticized for the Court telling Judy Davis how to vote. We are also criticized on how she votes. You have to realize that you will be criticized either way. Patrick Urain informed the Court of the District's Pure Power Project. They are going out and asking their customers to support their renewable energy project. They are asking government organizations and businesses to sponsor this program with them for at least one year. They are asking for the County Court to consider becoming a Platinum Sponsor at the cost of $170 per month. Mr. Urain stated that there are other packages that the Court could support instead of the Platinum Package.

Some discussion occurred.

Steve Holmes stated that the Board of Directors wants to see this program self sustained. It costs the District money to get this renewable energy from BPA. Mr. Holmes stated that they started doing this at the beginning of 2007. This megawatt of wind power will not come close to meeting the deficit of 2012.

Judge Ericksen suggested that the County use some of the Enterprise Zone money to support this renewable energy project. He suggested that these funds pay for both the County and the City of The Dalles sponsorships to the program.

The Court suggested that we amended the Special Economic Development Fund to transfer $4,080 to the General Fund to offset the cost for the Pure Power Project. This cost would pay the monthly rate for both the County and the City of The Dalles.

{{{Commissioner Lennox moved that Wasco County participate in the Northern Wasco County People's Utility District Pure Power Project as a Platinum Sponsor at the monthly cost of $170 during Fiscal Year 2007-2008. Commissioner Holliday seconded the motion; it was then passed unanimously.}}}

At 3:05p.m. the Court briefly discussed with Todd Cornett, Planning & Development Director, the issue brought up earlier today by Robert Dys. Mr. Cornett informed the Court that he would discuss this matter with Dawn Baird, Associate Planner, and would respond back to the Court at a later date.

Mr. Cornett and the County Court discussed the email received from Gary Nychyk dated June 5, 2007. The email was in response to a letter received from Jim Habberstad, dated May 30, 2007.

Judge Ericksen suggested that Paragraph #1 be reworded as follows: We are required to review all partitions against current regulations since this office has established that partition judgments are not recognized by this Department. The proposed partition judgment would, in effect, create two illegal parcels. Current regulations would not allow us to "legalize" those two parcels, leaving them as un-buildable lots.

Judge Ericksen stated that he supports the language in Paragraph #1 as amended and Paragraph #2 as presented.

The County Court agrees with the interpretation and logic of staff.

Mr. Cornett discussed with the Court the cost of implementing the Ordinance for the Urban Growth Boundary Area. Mr. Cornett stated that he has some good arguments on why the County should be paying less.

The Court feels the best way to approach this issue is to have the language within the agreement amended to address the issue of when the property is removed from the Urban Growth Boundary Area to the City of The Dalles.

Mr. Cornett will draft a letter to the City of The Dalles for Judge Ericksen's consideration.

Mr. Cornett informed the Court that the County has 90 days from the date the applicant requests the Court to take up the remand.

Mr. Cornett discussed briefly with the Court the Continuation of the Public Hearing on the request from Dan Van Vactor for a Measure 37 Compensation Claim. Mr. Cornett does not feel Mr. Van Vactor has to file a Measure 37 Claim at the state level.

It is the preference of the County Court that the hearing scheduled next week is continued to a later date.

Mr. Cornett stated that Laura Buhl, Associate Planner, would be leaving sometime in October. He would like to begin the replacement process soon since he would like to have a body in the office a month or so before she leaves. Mr. Cornett noted that he does not need a decision today.
