PENNSYLVANIA ANNOUNCES NEW SCHEDULE FOR ATTORNEY ADMISSIONS TO EASTERN

DISTRICT OF PENNSYLVANIA

Chief Judge Juan R. Sánchez announces that the Eastern District of Pennsylvania will conduct attorney admissions ceremonies on Thursdays at 10:30 a.m. in Courtroom 5-A in the Philadelphia Byrne Courthouse. In the event the Eastern District of Pennsylvania is closed or a federal holiday falls on a Thursday, the next attorney admission ceremony will take place the following Thursday. Applicants and sponsors should report to the Clerk’s Office on the second floor of the Byrne Courthouse by 10:00 a.m.

This is a change from the Eastern District of Pennsylvania’s past practice of scheduling attorney admissions weekly with different times, days of the week, and courtrooms. Chief Judge Sánchez stated, “Bar associations and attorneys have been asking the EDPA to conduct attorney admissions at a set time and day of the week. The EDPA is pleased to ac-commodate this request for the convenience of applicants and their sponsors.”

Quiet Title—Paper Streets—Petition for Sanctions— Reasonable Counsel Fees—Appellate Practice.

Plaintiff brought an action seeking to quiet title and a declaratory judgment. The Court denied the Defendants’ preliminary objections in the nature of a demurrer. The case proceeded and the Defendants filed dispositive motions which the Court granted. Plaintiff appealed. Plaintiff discontinued her appeal before the appellate court addressed its merits. Subsequently, one of the Defendants filed a petition for sanctions with the Common Pleas Court, arguing that the case was “groundless and frivolous” because the facts “obviously” did not support Plaintiff ’s legal theories.

The Common Pleas Court denied the petition. The Court noted the case was not arbitrary, vexatious, or in bad faith. Rather, the Plaintiff ’s choice of law and cause of action were directly related to the facts she pled. Additionally, the Plaintiff ’s voluntary discon-tinuance of the appeal did not establish vexatious conduct because appeals may be discon-tinued for any number of legitimate reasons. Accordingly the Court denied Defendant’s request for counsel fees.

Varricchio, J., August 30, 2018. This matter is before the Court based upon Defendant Kristin M. Keenan’s Petition for Sanctions Against Plaintiff filed March 19, 2018, and Defendant Kristin M. Keenan’s Brief in Support of Her Petition for Sanctions Against Plaintiff filed April 6, 2018, and the Plaintiff ’s Response to Defendant Kristin M. Keenan’s Petition for Sanctions Against Plaintiff filed April 9, 2018, and the Brief of Plaintiff in Support of the Denial of Defendant, Kristin M. Keenan’s Motion for Sanctions filed May 23, 2018. This Court held argument on July 11, 2018, attended by Neil D. Ettinger, Esquire, counsel for Plaintiff and Zachary J. Cohen, Esquire, counsel for Defendant Kristin M. Keenan. For the reasons herein, the Petition for Sanctions is DE-NIED.

The instant matter arises from a dispute of ownership between the Plaintiff, Karen Alfano, and the City of Allentown over an al-leyway, identified as Kurtz Street in the College Heights Improve-ment Subdivision Plan formerly part of South Whitehall Township. Pl.’s Second Am. Compl., ¶10. Plaintiff Alfano’s property borders Kurtz Street to the south. Id. ¶¶5-9. Defendant Kristin M. Keen-an and Defendant Georgine A. Olexa’s property borders Kurtz Street to the north. Id. Plaintiff alleges that Kurtz Street has never been opened by the City of Allentown nor used by the pub-lic since its creation as part of the College Heights Improvement Subdivision Plan making Kurtz Street a paper street whose land should become the adjoining landowners. Id. ¶¶24-26.

PROCEDURAL HISTORY

The relevant procedural history follows. Plaintiff filed her Second Amended Complaint on September 15, 2016 consisting of Count 1, Action to Quiet Title Pursuant to the Pennsylvania Rules of Civil Procedure 1061 et seq.; Alternative Count I, Action in Ejectment; and Count II, Action for Declaratory Judgment pursu-ant to 42 Pa. C.S.A. §7541 et seq. Defendant Olexa filed an Answer with New Matter to the Second Amended Complaint on October 19, 2016. On October 20, 2016, Defendant, the City of Allentown, filed an Answer with New Matter. The Plaintiff filed Responses to the two New Matters on November 17, 2016. On December 5, 2016, Defendant Keenan filed an Answer with New Matter to Plaintiff ’s Second Amended Complaint. Plaintiff did not file an Answer to Defendant Keenan’s New Matter.

The City of Allentown’s Motion for Judgment on the Plead-ings was filed on December 21, 2016. The Praecipe of Joinder [to the City of Allentown’s Motion for Judgment on the Pleadings] was filed on December 28, 2016 by Defendant Olexa. The Defen-dant Kristin M. Keenan’s Motion for Judgment on the Pleadings was filed on December 28, 2016. Plaintiff Karen Alfano’s Answer to Defendant City of Allentown’s Motion for Judgment on the Pleadings was filed January 11, 2017.

On May 31, 2017, the Court entered an Order and Opinion granting Defendants’ Motions for Judgment on the Pleadings. The

Order and Opinion were docketed on June 1, 2017. On June 29, 2017, Plaintiff, Karen Alfano, timely filed a Notice of Appeal to the Superior Court of Pennsylvania at Docket Number 2035 EDA 2017 from the above Order. On July 20, 2017, Plaintiff timely filed her Concise Statement of Matters Complained of on Appeal. De-fendants filed no response. By Order of Court filed August 4, 2017, the Pennsylvania Superior Court entered an Order at 2035 EDA 2017, transferring the case to the Commonwealth Court of Penn-sylvania, “[b]ecause the City of Allentown is a party in the under-lying matter.” The transfer was accepted on September 14, 2017, and the case was subsequently given the docket number of 1279 CD 2017 by the Commonwealth Court of Pennsylvania.

On February 20, 2018, Plaintiff filed a Praecipe for Discon-tinuance with the Commonwealth Court of Pennsylvania. By Order dated February 22, 2018, the Commonwealth Court of Pennsyl-vania marked the appeal closed. The instant Petition for Sanctions filed by Defendant Keenan followed on March 19, 2018.

PETITION FOR SANCTIONS

In relevant part, 42 Pa. C.S. §2503 provides that:

[t]he following participants shall be entitled to a reason-able counsel fee as part of the taxable costs of the matter:

(7) Any participant who is awarded counsel fees as a sanction against another participant for dilatory, obdurate or vexatious conduct during the pendency of a matter.

(9) Any participant who is awarded counsel fees because the conduct of another party in commencing the matter or otherwise was arbitrary, vexatious or in bad faith.

A party’s conduct has been deemed “dilatory,” where it ap-pears from the record that counsel “displayed a lack of diligence that delayed proceedings unnecessarily and caused additional legal work.” In re Estate of Burger, 852 A.2d 385, 391 (Pa. Super. 2004) (citing Gertz v. Temple Univ., 443 Pa. Superior Ct. 177, 661 A.2d

13, 17 n.2 (1995)). In the context of Section 2503(7), a party’s conduct is “obdurate” if she is “stubbornly persistent in wrongdo-ing” or unyielding. Id. See also, Scalia v. Erie Insurance Exchange, 878 A.2d 114, 116 (Pa. Super. 2005).

The Supreme Court of Pennsylvania discussed the level of conduct necessary under Section 2503(9) and explained that:

An opponent’s conduct has been deemed to be ‘arbi-trary’ within the meaning of the statute if such conduct is based on random or convenient selection or choice rather than on reason or nature. ... An opponent also can be deemed to have brought suit ‘vexatiously’ if he filed the suit without sufficient grounds in either law or in fact and if the suit served the sole purpose of causing annoyance. ... Finally, an opponent can be charged with filing a lawsuit in ‘bad faith’ if he filed the suit for purposes of fraud, dishonesty, or corruption. ...

Thunberg v. Strause, 545 Pa. 607, 615, 682 A.2d 295, 299-300 (1996) (internal citations omitted).

The party seeking an award of counsel fees bears the burden of proving the existence of one of the aforementioned statutory conditions. Berg v. Georgetown Builders, Inc., 822 A.2d 810, 816 (Pa. Super. 2003). In order to sustain an award of counsel fees pursuant to Section 2503, a trial court must make specific findings of the prohibited conduct. Township of South Strabane v. Pieck-nick, 546 Pa. 551, 686 A.2d 1297 (1996); Scalia, supra. “Trial courts have great latitude and discretion in awarding [counsel] fees when authorized by contract or statute” because the trial judge has “had the opportunity to hear and see the evidence presented.” Cummins v. Atlas Railroad Construction Co., 814 A.2d 742, 745-46 (Pa. Super. 2002). A trial court’s determination on whether or not to award counsel fees will only be disturbed for abuse of discretion. Scalia, supra.

Specifically, Defendant Keenan contends that Plaintiff ’s lawsuit was “groundless and frivolous because Kurtz Street is so obviously an opened street that is paved and used by the public on a regular basis.” Def. Kristin M. Keenan’s Pet. for Sanctions Against Pl., ¶5. Defendant Keenan further contends that Plaintiff ’s lawsuit

was brought for the purpose of harassment. Id. at ¶6. Defendant Keenan argues that Plaintiff ’s frivolous and vexatious claims have caused her to incur tens of thousands of dollars in counsel fees and created a cloud on Defendant Keenan’s title to her residence. Id. at ¶7. Finally, Defendant Keenan contends that Plaintiff ’s conduct was dilatory because she appealed this Court’s dismissal of the case with prejudice only to voluntarily dismiss the appeal after Plaintiff failed to file a brief. Id. at ¶10.

In opposition to Defendant Keenan’s Petition, Plaintiff con-tends that Defendant Keenan “cannot point to any portion of the Complaint, Amended Complaint, Motion and/or Pleading which could be described or remotely being considered under 42 Pa. C.S.A. 2503(7)(9) as arbitrary, vexatious or in bad faith at any time.” Pl.’s Br., p. 3. Plaintiff further contends that her Complaint had merit because this Court overruled Defendants’ Preliminary Ob-jections. Pl.’s Br., p. 4. Additionally, Plaintiff cites Township of South Strabane v. Piecknick, for the proposition that the rule permitting recovery of counsel fees is not meant to penalize every-one who does not prevail in an action. Id. at 599, 686 A.2d at 1301.

ANALYSIS

At the outset, this Court notes that:

Actions are not brought only where there is certain proof of liability and damages. Punishing all those who initiate ac-tions which are not ultimately successful by granting the defendant’s request for counsel fees would have a chilling effect on [the] right to bring a suit ... . This was not the intent of the rule permitting recovery of counsel fees upon a show-ing of arbitrary, vexatious or bad faith conduct.

Santilo v. Robinson, 383 Pa. Superior Ct. 604, 607-608, 557 A.2d 416, 417 (1989). The perceived motive of a plaintiff in bringing a lawsuit does not, as a matter of law, support an award of counsel fees. Berg, supra at 819.

The first inquiry for this Court is whether Plaintiff ’s conduct in initiating this lawsuit was arbitrary, vexatious or in bad faith pursuant to Section 2503(9). As noted above, Plaintiff ’s lawsuit was grounded upon the theory that Kurtz Street had never been opened by the City of Allentown or used by the public since its

creation as part of the College Heights Improvement Subdivision Plan making Kurtz Street a paper street whose land should become the adjoining landowners. Pl.’s Second Am. Compl. ¶¶24-26. Plaintiff brought her quiet title action in reliance on 36 P.S. §1961, which provides that after a period of 21 years, an unopened and not publicly used street may not thereafter be opened without the consent of the landowners. Thus, Plaintiff ’s choice of law and cause of action were not arbitrary, but rather, they were directly related to the facts she pled.

By Orders dated September 30, 2016 and November 16, 2016, this Court denied Defendants’ preliminary objections in the nature of a demurrer as to the legal sufficiency of Plaintiff ’s Amended Complaint. In the September 30, 2016 Order, this Court explained that:

In ruling on a demurrer, this Court must accept as true all of the well-pleaded, material, and relevant facts alleged in the complaint and all inferences fairly deducible therefrom. Preliminary objections seeking to dismiss a cause of action may not be sustained unless it is clear and free from doubt that the complainant will be unable to prove facts legally suf-ficient to establish a right to relief.

September 30, 2016 Order, p. 1 n.1. Hence, this Court determined that Plaintiff had pled sufficient facts to survive demurrer, state a plausible claim for a right to relief, and inform Defendants as to the nature of the claim. On that basis, it cannot be said that Plain-tiff brought the suit “vexatiously” or in “bad faith” because her claims had sufficient basis in fact and law to withstand preliminary objections in the nature of a demurrer.

Moreover, despite Defendant Keenan’s contention that Plaintiff brought this lawsuit for the improper purpose of harassing her neighbors, Defendant Keenan has failed to carry her burden of producing sufficient evidence to meet the statutory conditions. Defendant Keenan contends that Plaintiff yelled at her and blocked traffic. Def. Kristin M. Keenan’s Pet. for Sanctions Against Pl., ¶6. At oral argument on July 11, 2018, Defendant Keenan’s mother, Maureen Keenan, testified that on two occasions in the summer of 2017, Plaintiff yelled statements to her about the pending lawsuit,

Defendant Keenan’s finances, and the sale of Defendant Keenan’s home. Additionally, Maureen Keenan testified that on one occa-sion, Plaintiff attempted to prevent [Defendant] from driving down Kurtz Street. Initially, this Court notes that the two instances which Defendant Keenan relies on in support of her contention that Plaintiff acted vexatiously in bringing this lawsuit occurred over one year after Plaintiff filed her original Complaint. Additionally, while the statements and actions Maureen Keenan testified to may be evidence that Plaintiff acted in an offensive and rude manner, that conduct is insufficient to support a claim that Plaintiff ’s motive in bringing the lawsuit was solely for purposes of harassment. As previously explained, the perceived motive of a plaintiff in bringing a lawsuit does not, as a matter of law, support an award of counsel fees. Berg, supra.

The second inquiry for this Court is whether Plaintiff ’s con-duct during the pendency of the action was dilatory, obdurate or vexatious pursuant to Section 2503(7). Defendant Keenan contends that Plaintiff ’s conduct during the pendency of the action was dilatory because following this Court’s order granting Defendants’ motion for judgment on the pleadings, Plaintiff appealed the deci-sion and let the case “linger at the appellate courts for more than eight (8) months” before voluntarily dismissing the appeal after failing to file a brief. Def. Kristin M. Keenan’s Pet. for Sanctions Against Pl., ¶10. A party’s conduct is “dilatory,” where it appears from the record that counsel “displayed a lack of diligence that delayed proceedings unnecessarily and caused additional legal work.” In re Estate of Burger, supra.

As summarized by this Court in its January 3, 2018 Statement pursuant to Pa. R.A.P.1925(a), following this Court’s May 31, 2017 Order granting Defendants’ motions for judgment on the plead-ings, Plaintiff timely filed a notice of appeal to the Superior Court of Pennsylvania on June 29, 2017. On July 20, 2017, Plaintiff timely filed her Concise Statement of Matters Complained of on Appeal, raising nine allegations of error. On August 4, 2017, the Superior Court ordered the case to be transferred to the Com-monwealth Court of Pennsylvania, which transfer was accepted on September 14, 2017. On December 4, 2017, the Commonwealth Court granted Defendant Keenan’s Motion for Expedited Dispo-sition on Appeal and ordered this Court to certify the record

within thirty days. The Commonwealth Court received the trial court record on January 10, 2018 and issued a briefing schedule that same day. On February 20, 2018, Plaintiff filed a Praecipe to Discontinue the Appeal.

Based on this procedural history, this Court does not find that voluntary discontinuance of Plaintiff ’s appeal constitutes dilatory conduct. Plaintiff timely filed documents with this Court during the pendency of the case. She also timely filed her Notice of Appeal and her Concise Statement of Matters Complained of on Appeal. Contrary to Defendant Keenan’s assertion, Plaintiff ’s conduct did not cause her case to “linger at the appellate courts.” Instead, much of the delay at the appellate level was the result of the case being transferred from the Superior Court to the Commonwealth Court. Additionally, voluntary discontinuance of an appeal does not, as a matter of law, signify that Plaintiff ’s appeal was frivolous or a dila-tory tactic. Appeals can be voluntarily discontinued for any number of reasons. Though Defendant Keenan contends that Plaintiff ’s appeal was an attempt to “double[]-down and perpetuate[]” harm to her, Defendant Keenan has not met her burden of producing evidence to prove the Plaintiff ’s conduct was dilatory or vexatious. The only evidence Defendant Keenan produced to support her contention that Plaintiff ’s purpose in pursuing this lawsuit was to harass the neighbors, is the testimony of Defendant Keenan’s mother, Maureen Keenan. As previously explained, while the state-ments and actions Maureen Keenan testified to may be evidence that Plaintiff acted in an offensive and rude manner, that conduct is insufficient to support a claim that Plaintiff ’s motive in bringing or continuing the lawsuit was solely for purposes of harassment of Defendant.

CONCLUSION

The aim of the rule permitting the recovery of counsel fees is “to sanction [t]hose who knowingly raise, in bad faith, frivolous claims which have no reasonable possibility of success, for the purpose of harassing, obstructing or delaying the opposing party.” Possessky v. Diem, 440 Pa. Superior Ct. 387, 402, 655 A.2d 1004, 1011 (1995) (citing Dooley v. Rubin, 618 A.2d 1014, 1018 (Pa.Super. 1993). In the instant matter, Defendant Keenan has not

met her burden of producing evidence to prove the Plaintiff ’s conduct in commencing or continuing this lawsuit met one of the statutory conditions in Section 2503. Therefore, Defendant Kristin M. Keenan’s Petition for Sanctions Against Plaintiff is DENIED.

Ellen holds the designation of Certified Legal Manager through the Association of Legal Administrators (ALA), the credentialing body for the CLM degree. She holds a Certification in Computer Programming from Maxwell Institute, a Certification in Web Site Design from Temple University, and a B.A. from Temple University, where she also did two years of graduate studies in Criminology.

Ellen managed inside law firms for twenty years. Most of that time was spent in a mid-size (35+ attorney) firm environment. She launched her consulting practice in 1998 and joined the Pennsylvania Bar Association in 1999.

“Child Neglect – Medical and Legal Implications”

Presented by: Dr. Jeffrey Bomze Thursday, April 18, 2019

Medical neglect is the most common form of child abuse and accounts for 1,500 fatalities per year in the U.S. as well as countless more injuries and illnesses. There are many social and psychological antecedents, with poverty being a major one. Neglect has many forms – physical, supervisory, emotional, nutritional, medical, educational and dental. Evaluation of neglect requires comprehensive histories, medical examinations and relevant ancillary medical tests. It can be difficult to differentiate neglect from medical conditions that mimic it and many factors need to be considered. Management is multidisciplinary and may warrant reporting to child protective services. Religious objectives to care by parents can lead to serious medical problems and even death. As such, legal consultation and court action may be needed to protect the child. Child neglect has long-term serious health and emotional consequences.

Jeffrey Bomze, M.D., F.A.A.P., is a board-certified pediatrician who practices pediatric and adolescent medicine at The Main Line Health Care office in Broomall, PA. He had previously been in private practice for nearly 29 years. He manages infants, children and adolescents/young adults with a wide variety of medical, developmental and neonatal problems. He attended the University of Pennsylvania Medical School and completed his pediatric training at the University of North Carolina. He also has fellowship training in pediatric infectious diseases (Baylor College of Medicine) and non-surgical sports medicine. In addition, he has special training and expertise in adolescent medicine and school/learning/developmental problems. He has worked in the pharmaceutical industry and is the physician for his local school district for his practice. Dr. Bomze works with attorneys around the state and country as a pediatric expert in medical malpractice cases, family law (custody) cases as a medical and educational expert, drug liability cases and child abuse cases. He serves on the Pediatric Medical Review Board of a major malpractice carrier. He has presented to a wide variety of audiences, including to several attorney groups, regarding a wide variety of topics and has written a chapter on Pediatric Head Trauma, which will be published next summer by the ABA in a book on Head Trauma.

The Lawyer Referral office receives phone calls from clients requesting services from attorneys. At this time, the office will obtain all needed information from the client and contact the attorney to schedule. They are entitled to a half-hour consultation with the attorney for a $30 fee. An information sheet will be faxed to each attorney, which needs to be completed at the end of each consultation. The referral form must be faxed back to the LRS office upon completion of the consultation. Client fees are pre-paid to the LRS office. Fees are determined by the attorney for any services requested after the consultation. Please notify the LRS office if you are unavailable to accept referrals due to vacations, etc. This will ensure no clients are referred to your office while you are away. Please note that screening of clients is not permitted – no telephone consultations prior to the client coming in unless specified on the referral form. All attorneys must contact the client within 3-5 business days upon receipt of referral.

I further agree that I will not charge nor solicit any fees other than the $30.00 referral fee for the first conference, of one-half hour in duration, with the referral client.
