7. PUBLIC CONSULTATION 7.0 Introduction (Terms of reference no. 53)

The Ministry of Environment, Forest and Climate Change, (MoEFCC) Government of

India issued Environmental Impact Assessment notification S.O. 1533 dated September

16, 2006 mandating prior environmental clearance for manufacture of synthetic organic

chemicals under category A for projects located outside notified industrial area/estate.

The proposed expansion project of M/s. VJ Sai Chem is located at Sy. No. 240/B,

Dothigudem Village, Poachampally Mandal, Nalgonda District, Telangana. The

proponent obtained the terms of reference vide letter no. F.No. J-11011/67/2014-IA II (I)

dated 26.08.2014, from the MoEFCC, which mandated public consultation. Accordingly

the draft Environmental Impact Assessment was submitted to Regional Officer,

Telangana State Pollution Control Board, Nalgonda District for conducting public

hearing. The public hearing for the proposed expansion was conducted on 07.06.2016 at

11.00 AM near the existing site area. The public hearing was chaired by Sri Ravi

Gugulothu, District Revenue Officer & Additional District Magistrate, Nalgonda and

the member convening was Sri G. Hanumantha Reddy, Environmental Engineer (FAC),

T.S. Pollution Control Board, Regional office, Nalgonda.

7.1 Advertisement

Press notification regarding the date, time and venue of the Environmental public

hearing for the proposed expansion project was issued in Andhra Jyothi (Telugu daily)

and The New Indian Express (English daily) newspapers on 06.05.2016. Copy of the

advertisement is enclosed.

The minutes of the public hearing is enclosed along with the attendance sheet. Concerns

expressed by speakers during public hearing and responses of the proponent are

presented in table 7.1. Response to written representations is presented in table 7.2.

7.2 Concerns expressed by public

He stated that this type of public hearing was not held earlier. He wanted the guarantee of employment to the local people including the educated/ unemployed youth from the village. The industry assured to provide employment an extent of 50% of the total vacancies. He finally concluded his opinion stating that he would go along with the people of the village in respect of this industry.

The expansion requires about 20 people, and the proponent assured to recruit from the local villages only.

2. Sri S. Janga Reddy, MPTC Member, Jiblakpally Village

He expressed his gratitude for conducting public hearing in connection with the expansion of the existing industry. The ground water and air pollution created the problem to this village as well as in the surrounding villages earlier, therefore to avoid adverse impact no public hearing of this type was held. He opined that, the industry can be expanded by providing employment to the local people and also by taking up voluntary developmental works in the surrounding villages, at the same time adopting the pollution abatement measures. Since water has been polluted, he wanted supply of drinking water in the village along with 2 to 3 villages also. Medical camps should be conducted and 60% jobs should be provided to the locals depending on their qualifications. The industry stated that, the plantation program had been taken up to control the adverse impact of chemical emissions, but the negative impact of pollution continued to be felt by the villages. He finally concluded that the industry should take necessary action to control pollution and carry on its operation without causing inconvenience to

After customary address, he stated that the public hearing was conducted to elicit the opinion of the people on that particular industry, under the chairmanship of the District Collector whether to take up expansion or not. There would not be any problem to the people, in case there was no pollution due to the industry and there could be no opposition also to such activity. But the pollution emitted by the industries has turned; the villages sterile. If the industry controlled the pollution problem, the people would have been happier. No welfare activities under taken so far by any of the industry. Compare to other industries, this company provided employment to the tune of 50 per cent to the local people. The industry established a tank as requested by the sarpanch of the village. The pollution affected the water supply bore and water supply pipe line which was laid at a cost of Rs. 3.0 lakhs funds of zilla parshad. The same problem has been posed to the Joint Collector during the earlier meeting. He expressed the apprehensions on the functioning of the government and also its veracity. It is out of place to state that the industry receives the information on enquiries much earlier than the government officials. He demanded that no such things should be permitted again. He sought employment to the local people and as well as protection to the environment by implementing pollution abatement measures. Water was polluted thereby causing inconvenience to the several farmers. Water is being supplied by the industry to a section of people as per the advice of the political party, but not the people who are actually affected by the pollution. The affected people are not paid, and no inspection was conducted so far. He

demanded corrective action from the PCB authorities. No welfare activities have taken up by any of the seven industries being operated in their area; The entire village is affected by air& water pollution and there is not even a single: water source remain Unaffected. He concluded his opinion subject to the effective implementation of pollution control measures by the industry.

4. Sri P. Ram Reddy, Ex- Sarpanch, Dothigudem Village

After customary address, he wanted to know whether the PH was held to know the impacts on the Dothigudem village and also the problems faced by the villagers or to elicit the opinion of people of this district. Since the industry is located in this village, the problems are faced by them only and not by others. The drinking water used to be potable before the establishment of these industries i.e. prior to 17 years. Now, the cattle, as well as poultry industry are depending upon tanker supplies. The odor pollution is experienced by the villages during evenings after the sunset. But the management of the industry states that scrubbers have been established to mitigate the problem. The public have no knowledge and PCB officials should investigate the problem and find a suitable solution and take necessary action. Further the PCB officials should investigate the quantum of production and the corresponding release of waste matter. There is no differentiation between large and small scale industry and we are not in a position to pin point the exact source of pollution as there are 6 to 7 industries operated in this area. If one industry commits a mistake, the adverse reaction extends to other industry also. So, all the industries should take pollution control measures in tandem. So far no action has been initiated by the PCB against the industries and

only villagers forced them to/close such industries. The people indicated to the industries to dismantle the ground level tank and converted them into open tanks and channels as part of corrective steps. During the previous (public hearing held in connection with the proposal of M/s. Brundavan Laboratories (P) Limited, in the presence of the Joint Collector, it was decided to constitute a committee of villagers who in turn closed down 2 industries. Now two other industries are causing pollution. He felt, if one industry is permitted to expand its capacity, the other big industries will also follow the suit in such a case, he wanted to know the control measures taken up by the PCB. He demanded continuous /monitoring by PCB and also sought employment opportunities to the local people. The industries should be able to inform to the local public regarding employment provided to local people, which was not elaborated. Several outsiders are working and the locals are not engaged as such it has resulted in the lack of information on the effectiveness of control measures. The villagers could not carry out agriculture and denied water to cattle as the water was polluted. At present tanker supply is going on, the villagers were not permitted to fetch water through tankers. He appealed to the DRO to supply water to overcome the water shortage in three villages i.e., Dothigudem, Jiblakpally, Anthammagudem. He appealed to PCB to inspect the industries once in a month by constituting committees with at least one villager as member in such committee. The frequent inspections will definitely bring pressure on the industries to comply with the instructions. He demanded that the officials should take responsibility for effective function of pollution control equipment. Earlier, the compensations were

paid to the bore owners whose lands are affected by the pollutants. At present no such payments are made and demanded the DRO effect payment. He also demanded payment of compensation to the affected villagers in the surrounding villagers. If compensation is not paid he threatened with blockage and agitation against such companies.

5 Sri Ravula Shekar Reddy, Dothigudem Village

He stated that the industries continued to be established since land was available there; government also accorded the permissions, the only exception being the lack of pollution abatement measures. Government directed to establish CC Cameras but no industries established so far. Instead, they are plying effluent tankers during the night time and discharging the untreated effluents in open fields or water courses illegally and no action has ever been taken against such dumping by police, revenue. Despite of their representatives/ complaints to the MRO, RDO & Police, no action has been initiated so far. He demanded the installation of the CC cameras at the first instances. Secondly, the villagers have lost their drinking water sources and water supply to the villagers should be arranged immediate from the bores suck by their local MLA. At present water is supplied through tankers. It is surprising that the industries are spending crores of rupees and are able to mobilize the police force, but not prepared to spend few lakhs of rupees on welfare measures such as establishment of school and hospital. He demanded liberal assistance to the backward villages. He requested the authority to accord permission to the industries, subject to the condition that they should cater to the employment needs of the local people. At present outsiders are working within the factory, whereas locals are employed at the gate of

the factory as casual laborers. He concluded his opinion with a demand for employment to at least 60% local people.

6. Sri T.Linga Reddy, R/o Dothigudem Village

He made an interesting observation on the PH. He attributed the large gathering to bring out the problem of water shortage in the village on account of operation of the industries. He cited the report on generation of waste water of 24 ltr out of every 60 ltr of water used by the industry. He contended that waste water was dumped into the wells with 1000 ft depth resulting in generation of red colored water from the adjacent bore- wells. The bore water became contaminated and became un-potable even for consumption by human as well as cattle. He demanded the PCB to enforce the rules and regulations to control pollution. People are utilizing the polluted water for bathing purpose and experiencing itching sensation. Some sort of sores is also observed on account of use of polluted ground water. Recently supplied 14 and 9 tankers of water and supplied the water, which was also contaminated and the people are subjected to diseases like itching and sores on the bodies. He wanted the industry not to pollute air, water and land. He requested the Government not to permit any new polluting industry in this area.

7. Sri Prasadam Vishnu, R/o Dothigudem Village

After customary welcome address, he has stated that 7 to 8 industries are in operation in the village. He compared the present condition of the village to that of 15 years back. At present, the village is strangulated with pollution. He supported the expansion of the industry subject to the adherence to the norms stipulated by the MoEF. He demanded employment for the local people and also solving the water problem faced by the villagers. He warned that villagers would

not hesitate to force the closure of industry, in case of pollution became unabated. The other industries also underwent the same process and started operations. The industries have knowledge and are aware of the problem. Some of the industries have started operations without NOC from the District Collector; all such units are expected to undergo the same process as was done by the present industry. He warned the industry not to depend on political leaders, instead of taking people into confidence. The officers are also expected to enforce the necessary regulations to control pollution and concluded his part with a welcome note.

8. Sri Entigu Malla Reddy, R/o Dothigudem Village

He supported the expansion proposal of the industry, subject to the effective control of pollution. He stated that he sold 1.5 acres of land for this purpose. He concluded with suggestion that the industry should implement whatever that was stated in the public hearing.

9. Sri S. Nagasena Reddy, Environmental Activist

After customary address, the speaker introduced himself as an environmental activist and NGO involved in the maintenance of a hostel for HIV affected children and also a person known to the public here. He explained the aim behind this PH, the procedure to be followed on completion of PH by the authorities. The PH is meant to /elicits the opinion of local people on the proposal submitted by the industry, which, consist of environment impact assessment statement and its management. The present exercise is meant to enhance the production capacity to 450 Kg/day. He cited the

EMP report wherein it was stated that 10% of the capital cost would be spent on pollution control measures. In view of the constraint of area with the management, he suggested to undertake rising of green belt in village community /lands and also by adopting, the surrounding villages, as part of pollution mitigation measure. He wanted a commitment from 7-8 local industries on implementation of welfare schemes as well as pollution abatement measures. Regarding employment of the local people, he requested the management to provide the same, though the unit is very small in nature. He suggested to the management to enhance the allocation of funds for CSR activities to the extent possible. He suggested to the administration to spend the money collected from the industries for the betterment of people residing within 10 km radius of the industry. He appealed to the Government to retain the present EE, TSPCB permanently in the District by providing adequate staff since the district has several prestigious industries. He concluded his opinion with a demand to industry to commit itself for the effective implementation of pollution control measures as stated; in the report to lessen the impact of pollution on the villagers.

10 Sri M. Satyam, R/o Dothigudem Village

After customary address, he dealt with the problem of water pollution. He cited that the water was potable before the establishment of industries there. After 15 years, the water could not be used for drinking purpose by the local residents and people are getting their supplies by purchasing water. He dealt with the odor pollution faced by the residents as industries are emitting the polluted air during the night time and requested suitable measures to control the same. He sought employment to the local people to arrest

/migration of labor in search of employment. Since the industry is smaller, the employment is limited to 30 members only. He stated that the management of this industry contributed Rs.5.0 lakhs for the construction of temple, which is comparatively higher to the size of the industry since it is located on 1.5 acres of land. He demanded employment to the qualified technical people in R&D and processing facilities and also insurance to all the workmen engaged by the local industries. He requested to take suitable action against some of the industries who clumped the un-treated effluent in open areas. He requested the district administration to conduct an enquiry into un-authorized dumping of chemical wastes and industries who did not undergo the process of PH should be dosed through a resolution in Village panchayath.

11 Sri Surkanti Venkat Reddy, NGO- Choutuppal

After welcome address, he stated that 4-5 industries were established with the help- of ex-minister late Madhava Reddy , to provide employment to the local people. Industrial development also increased the risk of pollution problem which is a natural outcome. All these industries were established during the integrated state and managed by them only. He stated that justice was rendered to the locals only after formation of separate state. The previous managements polluted the water and mined the resources and used for their own development. Now the managements of industries are providing employment to the local people to some extent which lead to the arrest of migration of labor in search of employment. He complimented the management of this industry for undertaking the necessary steps to control pollution. He cited the present policy of Government to issue necessary permissions within 7 days and concluded his opinion,

supporting the expansion of the industry. 12 Sri Ch. Pandu, R/o

Dothigudem Village He stated that water was polluted, whereas the local youth was denied employment opportunities citing the problem of qualification. While supporting the expansion of industry, he stated that the corresponding pollution generated by the expansion activity should be controlled with the co-operation of the local people. He requested that local resources like tractors and autos should be engaged in the expansion process. There are 7 industrial units in the village, but nobody is taking the responsibility of controlling pollution. The units were dosed and sold to the new managements, who are not prepared to accept pollution caused by the units earlier. With respect to employment, the resident factory managers are asking the local youth to approach the registered offices and they in turn are not prepared to provide employment locally but at different place. He appealed to the managements to accommodate the local people in respect of employments at the local units.

The expansion requires about 20 people, and the proponent assured to recruit from the local villages only.

Proponent assured that the Industry shall follow the standards prescribed by Ministry of Environment, Forest and Climate Change (MoEF&CC) with respect to emissions, effluents, solid waste.

13. Sri M. Saidi Reddy, NGO, Green Cop Society

He opined that all 7 industrial units should come together and plan development activities in surrounding 2-3 villages. Rising of green belt, transport of effluent and solid waste to TSDF and other related activities should be taken up jointly so that the pooled funds available under CSR could be effectively utilized to raise plantations and its maintenance as mandated over 33%. The industry should provide 2 or 3 laborers exclusively for planting purposes and services should be used to plant the trees only. The persons engaged should approach the forest department for plants and plant the stock and should take care of their maintenance. He made a suggestion that the funds allocated under CSR should not be utilized for

construction of temples instead they should use for supply of drinking water, construction of schools, organizing medical camps and supply of medicines to the poor people. After formation of separate state, the Hon'ble CM enunciated a policy to encourage industries. The state is developing an industrial park exclusively for pharma and bulk drugs and formulation units at Mutcherla with all infrastructure facilities. He concluded his speech with a request to the management not to pollute the bore-wells and other water sources and control other sort of pollution and provide employment to the local youth and also spend liberally on village development.

14 Sri V. Narsimha, R/o Anthammagudem, Dothigudem Village

He requested employment to the youth. At present, the number of people employed in the industries is not up to the level. He wanted paper mills and iron factories to be set up in this area. He alleged that the PCB officials are not discharging the duties at the desired level and supporting the industry at ail the times by providing advance intimation to the industry managements. He also alleged that the industries took permissions for certain type of products and indulging in manufacture of non-permitted products. The PCB is supposed to enforce the closure of the unit in case of violations. He cited the recent enquiry conducted by officials from Bangalore in connection with the illegal trafficking of certain chemicals manufactured locally. He urged the officials of PCB to conduct regular inspections of the industrial units located in the vicinity.

The other villages those are affected due to pollution are Koyyalagudem, Tangedapalli villages. The water sources are afflicted with pollution. He stated that several times he complained to the officials of PCB. So far no action was taken against any of the units. None of the industrial units are responding to the requests of providing employment to the local people. No information was made available regarding employment position and their place of engagement. Even those provided are working in casual work places. The main impact due to pollution, like fugitive dust due to movement of vehicles etc is felt in Dharmojigudem village. Several times the problems faced by his village were brought to the notice of the District Collector and also through representations. He wanted to know the action taken so far on such representations. It is stated that the industries are assisting the villages in their development activities. So far no such assistance is

erring industrial units. If no action is taken against the violating units, it will send wrong signals to the units, who are complying with the norms. They tend to lose interest in complying the standards stipulated by the PCB. Good units should be given encouragement. He also made an interesting observation regarding provision of employment. In most cases, the industries are not in a position to provide employment to the level expected by the aspirants. The best alternative would be to provide employment under various schemes by utilizing the money available under CSR. He suggested that the CSR amounts from different units should be pooled and should be utilized for the works approved by the committee constituted with local representatives, NGOs. He hoped that industries in this area will implement pollution control measures which will enable them to command respect from the local people.

25. Sri. D. Anil Reddy, R/o Dothigudem Village

He narrated the past history of the industry. A blast occurred in the year 2005 resulted in injuries to 5-10 members and the fate of the workers is not known. Closure orders were served twice and resumed operations. The reasons are not known. There are 7 units which are generating effluent and are dumping illegally into the bores. Several complaints were lodged and alleged that there was no action against any of these units. He contended that he caught hold of the illegal dumping 4-5 times and the matter was enquired after 3-4 hours. He requested the authorities to conduct the enquiry.

on account of industries. He disputed the issue of provision of employment to the local people to a tune of 50%. He stated that farmers are not growing paddy- now for want of water. He alleged that employment was provided to laborers only and all skilled people were transferred to other units. He questioned the permissions accorded by PCB without conducting PH. He contended the PCB officials to explain the environmental status to the people so that the people would be in a position to understand the implications to some extent. Whereas, the opinion is elicited directly and the ordinary public expressed their views in layman's language. He expects the PCB officials to study the environment status of the area and permission should be accorded only after considering all aspects related to air, water and land. He contended that the ground water was over exploited in this region and drawl of additional 64 KLD of water including the source of water should be made available. He compared this area with Patancheru which is badly affected due to pollution. Now water is supplied through tankers which show the pathetic condition of the people. The life span of the people is getting reduced on account of severe pollution of air and water and the area will become a symbol of sterile ground. Farmers are leaving this place, whereas there is demand for employment to an extent of 50%. Now the water table stands at 400 feet which is likely to touch 2000 feet if the present trend is allowed to continue. He finally concluded his elaborate observations with a request to examine the consequences of Industrialization and stated that he is against the proposed expansion of the unit.

She also warned that women organizations would resort to agitations in case of non-dispensing the justice to the local people.

The area of this industry is small and not in a position to raise green belt with in 1.36 acres of land. He has advised the industry to purchase 2-3 acres of land and raise plantation, which may be entrusted to the women organizations, which are conversant with the work of raising of trees. He stated that the underground water was polluted in this area and requested necessary action for its restoration. He sought financial assistance of industries as part of CSR activity, incentives for educating the rural poor people, establishment of library to help the children to access books, an ambulance and establishment of veterinary hospital to cater to the needs of cattle. He has appealed to the public not to harm the wild animals and concluded with a suggestion to forward the proposal to MoEFC for according clearance.

He expressed the same sentiments as narrated earlier. He further stated that Dothigudem, Jiblakpally and Anthammagudem and other villages were suffering from severe pollution problems. The pollution either emitted or discharged by the industries were causing inconvenience to the people. He has felt that the management of industries seems to have turned deaf ear to the problems faced by the local people. He demanded that CSR funds should be utilized to meet the educational needs of the children by establishing hostels, schools, conducting the medical camps by engaging the private doctors. He demanded the raising of green belt in and around the villages and extensive planting of trees by engaging 2-3 persons exclusively for this purpose with a mandate to plant trees in every household. He sought employment to technical people and non-technical graduates may be accommodated in assistant and computer operator posts. Since the area is

He sought assistance for local development and to cater to the needs of the local people, lest the people would take up the agitation. He warned that they too would join them in closure of the units. He concluded his opinion with a recommendation to forward the proposal to MoEF&CC for according clearance.

31. Sri G. Vijay Reddy, READS-NGO, Nalgonda

He started with suggestion to incorporate the comments of the public hearing in the final EIA, which should be forwarded to the MoEF&CC for clearance. The final EIA may take a week more but all suggestions are required to be incorporated to make it a full-fledged one. He dealt at length the (+)ve and (-)ve angles of establishing the industry. It is essential to expand the industry to improve the economic conditions, employment opportunities and increase in GDP. As per the EIA Notification S.O. No. 1533, the impacts on Water, Air and Land should be assessed and a statement should be prepared indicating the mitigation measures, which is the important issue. His contention is that the government is directed by the corporate and ordinary person cannot withstand against them. He cited the example of M/s Brundavan Labs, the PH was held due to judicial intervention. Consequently, the local industries came into focus and 10-15 industrial units are complying with the environmental norms. The PCB has no staff worth to monitor all the industries and the present staff is engaged in routine affairs. The size of the land is mere Ac.1.10 cts wherein, the industry indicated 33% under green belt in their previous EIA

report. Now, there is no area left for them to expand and meet the requirement of green belt. The water requirement is indicated as 46 KLD which is equivalent to 16,790 cum per year. As. per the Government of India report, Nalgonda is classified water short and the conditions tend to become as semi-desert type If there is no artificial charge of ground water. While, narrating the hydrological particulars of water availability, he calculated that Ac.6.48 cts is needed to meet the requirement of rain water harvesting structure to re-charge the same quantum of water subject to the condition that every drop of water is saved. He cited the example of Beijing, the capital city of China, and the breathing condition and corresponding availability of Oxygen. He has exhorted that the development did not mean only economical but includes socio-economic and environmental also to ensure sustainable development All these three factors put together will ensure all round development. He concluded his speech with a request that the final EIA report shall be sent to the MoEF & CC only after thorough review and incorporation of the views of the members.

He started on positive note and described the problems faced by the area could be solved by adopting scientific techniques. Due to the present public hearing, there was a funding by the industries to take up white washing of four buildings. The managements are trying to make the hearing process a mockery to obtain clearances. He found fault for not extending invitation to the Sarpanch of Jiblakpally, which is actually within the impacted zone and is a major revenue village. He further stated that water is supplied once in 7 days in Dothigudem village, whereas water is supplied once in 3 days in Hyderabad. There is no water and employment. After customary greetings, he recalled his earlier days. The area is covered with forest up to 2002. Now the area is afflicted by pollution and the village became inhabitable. There are no cattle in and around due non-availability; of fodder and not even acre of land is being cultivated. Last year the managements of industries paid compensation towards loss on account of pollution. The people are not beggars and not for alms. He warned that they would fight against these industries till their closure. The youth from the village are not prepared to work in industries. Since qualified local people are engaged to do labor works, whereas the people from Andhra region, though they are not qualified are working in laboratories. The locals are discriminated and there is no need to give any preference in employment. He opposed the setting up of industries in this area. The villagers are determined to approach even Central Government. He squarely blamed the political leaders for creating this discomfort. He appealed to the villagers to elect such representatives who would stand for the development

of people. There are seven chemical factories in and around these villages. The units are the main cause for air, water, and land pollution. The adjacent bore well is also polluted and totally dried up, hence there is no result to indicate the level of pollution. Basing on the facts, he requested the villagers to oppose the setting up of new industries or expansion of the existing industries. He appealed to the local political leaders not to play with the lives of the people. The chemical factories there are discharging their effluent into the bore wells during night time and they are Indulging in bribing the concerned. No ETP is working in any plant. He requested the PCB officials to closely monitor the working of ETPs and the quantum of effluent released from each of the unit and where the effluent is sent for treatment. He threatened the administration not accord permission to this unit. It does not envisage any change in the quality of life in the next 15 years of time. He appealed to the DRO cancel the permissions accorded to the industrial units. The Panchayat president and other ward members are ready to cancel the NOC accorded to the industrial, units. He concluded his opinion with a request to the district administration to cancel the NOCs issued by the President of the Panchayat and initiate action against the concerned.

and they do not seek any Government jobs either. Everyone in the village is aware that they are all dependent on cattle, goat and sheep to eke out a living. The industry nearby is pumping out the water from the pond, denying water to cattle and sheep etc. In the absence of water, there will be no grass and other tree growth. Goats are dying after drinking the polluted water. The industries are paying compensation to the people having power and the other villagers are not permitted inside the factory premises and denied entry beyond main gate. She opposed the setting up of new industries or expansion of existing ones. She sought justice for the loss habitat to people and other living beings and concluded her opinion in negative on the proposed expansion of the unit.
