DATE: May 21, 2020 SUMMARY/BACKGROUNDHigher Grounds Coffee Co., 223 Main Street, Lemont, IL, previously applied for an A-3-1Liquor License from the Village of Lemont. The board approved the liquor license with liquorcommissions approval. However, the Liquor License had not yet been issued to HigherGrounds Coffee Co., and they are now going out of businessTherefore, the license will be removed and number of Class A-3-1 Liquor Licenses will bedecreased from 1 to 0 in the Lemont Municipal Code, Chapter 5, Section 5.04, Subsection5.04.060.B, Class of Licenses, Number of Licenses and License Fees.

CHAPTER 5.04, SECTION 5.04.060.B: ALCOHOLIC BEVERAGES

(Decreasing Number of Class A-3-1 Liquor Licenses)

WHEREAS, the Village of Lemont (“Village”) is an Illinois Municipal Corporation

pursuant to the Illinois Constitution of 1970 and the Statutes of the State of Illinois; and,

WHEREAS, Higher Grounds Coffee Co. operating at 223 Main Street, had previously

applied for a Class A-3-1 Liquor License by the Village; and

WHEREAS, this Liquor License had not yet been issued to Higher Grounds Coffee Co.,

and they are now going out of business; and

WHEREAS, the President and Board of Trustees of the Village of Lemont desire to

decrease the number of Class A-3-1 liquor licenses granted.

NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF

TRUSTEES of the Village of Lemont, Illinois:

SECTION 1: The above recitals are incorporated in this ordinance as is fully set forth.

SECTION 2: The number of Class A-3-1 liquor licenses, as set forth in the Lemont

Municipal Code, Chapter 5, Section 5.04, Subsection 5.04.060.B is hereby amended to read as

follow in the manner and form shown in strikethrough type below and inserting therein and

therefore such new text in the manner and form and shown in underlined bold type below, so that

said Section 5.04.060.B shall hereafter provide as follows:

ORDINANCE NUMBER ___________

AN ORDINANCE ADOPTING THE PREVAILING WAGE STANDARDS IN THE

VILLAGE OF LEMONT, COUNTIES OF COOK, WILL AND DUPAGE, ILLINOIS

WHEREAS, the Village of Lemont, Counties of Cook, Will and DuPage, Illinois,

(“Village”) is a non-home rule unit of government; and

WHEREAS, the State of Illinois (the “State”) has enacted the “Prevailing Wage Act,”

820 ILCS 130/1 et seq. (the “Act”) which is an Act regulating wages of laborers, mechanics and

other workers employed in any public works by the State, county, city or any public body or any

political subdivision or by anyone under contract for public works; and

WHEREAS, it is the policy of the State that a wage of no less than the general prevailing

hourly rate, as paid for work of a similar character in the locality in which the work is performed,

shall be paid to all laborers, mechanics and other workers employed by or on behalf of any and all

public bodies engaged in public works; and

WHEREAS, the Act requires that the Village of Lemont investigate and ascertain the

prevailing rate of wages, as defined in the Act, for laborers, mechanics and other workers in the

locality of said Village of Lemont employed in performing construction of public works for said

Village; and

WHEREAS, the Village of Lemont has ascertained and examined the prevailing wage

classifications and rates determined by the Department of Labor for Cook County for March 3,

2020, which is the last available date wage rates were published by the Department of Labor.

NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the

Village of Lemont, Counties of Cook, Will and DuPage, Illinois, by and through its home rule

powers as follows:

Section 1. That the above recitals and legislative findings are found to be true and correct

and are hereby incorporated herein and made a part hereof, as if fully set forth in their entirety.

Section 2. To the extent and as required by the Act, the general prevailing rates of wages in

the Village of Lemont for laborers, mechanics and other workers engaged in construction of public

works coming under the jurisdiction of the Village of Lemont is hereby ascertained to be the same

as the prevailing rate of wages for construction work in the Cook County areas, as determined by

the Department of Labor of the State of Illinois as of the last available date wage rates were

published by the Department of Labor, a copy of said determination is being attached hereto and

made a part hereof as Exhibit A.

Section 3. As required by the Act, any and all revisions of the prevailing rate of wages by

the Department of Labor of the State of Illinois shall supersede the Department’s March 3, 2020

prevailing rates and apply to any and all public works construction undertaken by the Village of

Lemont and that definition of any terms appearing in the Ordinance, which are also used in the

Act, shall be the same as in the Act.

Section 4. Nothing herein contained shall be construed to apply the prevailing rate of

wages as herein ascertained to any work or employment except public works of the Village of

Lemont to the extent required by the Act.

Section 5. The Village Clerk shall publicly post this determination or any revisions of such

prevailing rate of wages and keep it available for inspection at the Village Hall by any interested

party. A copy of the determination or of the currently revised determination of the prevailing rate

of wages then in effect shall be attached to all contract specifications.

Section 6. The Village Clerk shall mail a copy of this determination to any employer, and

to any association of employers and to any person or association of employees who have filed or

file their names and addresses, requesting copies of any determination stating the particular rates

and the particular class of workers whose wages will be affected by such rates.

Section 7. The prevailing rate of wages as determined herein, or as subsequently revised,

shall be included in every contract for public works, and all ordinances, resolutions, calls for bids

and bid specifications relating to any public work shall state or provide that any person

performing any public works on behalf of the Village of Lemont shall be required to pay the

prevailing rate of wages to all laborers, mechanics and other workers employed for such public

works. All contractors’ bonds, provided by any contractor on any public works for the Village of

Lemont shall provide a guarantee that the contractor will faithfully perform his obligations to pay

the prevailing rate of wages as provided by the contractor for such projects and in accordance

with the Act.

Section 8. The Village Clerk shall promptly file a certified copy of this Ordinance with

the Illinois Department of Labor, Attention: Prevailing Wage, 900 South Spring, Springfield, IL

62704.

Section 9. The Village Clerk shall cause a notice to be published in a newspaper of

general circulation within the Village and such publication shall constitute notice that the

determination is effective and that said publication shall constitute notice that this is the

determination of the Village and it is effective.

Section 10. If any section, paragraph, clause or provision of this Ordinance shall be held

invalid, the invalidity thereof shall not affect any of the other provisions of this Ordinance.

Section 11. All ordinances in conflict herewith are hereby repealed to the extent of such

conflict.

Section 12. This Ordinance shall be in full force and effect from and after its passage,

EXPLANATION OF CLASSES

ASBESTOS - GENERAL - removal of asbestos material/mold and hazardous materials from any place in a building, including mechanical systems where those mechanical systems are to be removed.  This includes the removal of asbestos materials/mold and hazardous materials from ductwork or pipes in a building when the building is to be demolished at the time or at some close future date. ASBESTOS - MECHANICAL - removal of asbestos material from mechanical systems, such as pipes,  ducts, and boilers, where the mechanical systems are to remain.

CERAMIC TILE FINISHER

The grouting, cleaning, and polishing of all classes of tile, whether for interior or exterior purposes, all burned, glazed or unglazed products; all composition materials, granite tiles, warning detectable tiles, cement tiles, epoxy composite materials, pavers, glass, mosaics, fiberglass, and all substitute materials, for tile made in tile-like units; all mixtures in tile like form of cement, metals, and other materials that are for and intended for use as a finished floor surface, stair treads, promenade roofs, walks, walls, ceilings, swimming pools, and all other places where tile is to form a finished interior or exterior.  The mixing of all setting mortars including but not limited to thin-set mortars, epoxies, wall mud, and any other sand and cement mixtures or adhesives when used in the preparation, installation, repair, or maintenance of tile and/or similar materials. The handling and unloading of all

sand, cement, lime, tile, fixtures, equipment, adhesives, or any other materials to be used in the preparation, installation, repair, or maintenance of tile and/or similar materials.  Ceramic Tile Finishers shall fill all joints and voids regardless of method on all tile work, particularly and especially after installation of said tile work.  Application of any and all protective coverings to all types of tile installations including, but not be limited to, all soap compounds, paper products, tapes, and all polyethylene coverings, plywood, masonite, cardboard, and any new type of products that may be used to protect tile installations, Blastrac equipment, and all floor scarifying equipment used in preparing floors to receive tile.  The clean up and removal of all waste and materials.  All demolition of existing tile floors and walls to be re-tiled.

Other Classifications of Work:

For definitions of classifications not otherwise set out, the Department generally has on file such definitions  which are available.  If a task to be performed is not subject to one of the classifications of pay set out, the Department will  upon being contacted state which neighboring county has such a classification and provide such rate, such  rate being deemed to exist by reference in this document.  If no neighboring county rate applies  to the task, the Department shall undertake a special determination, such special determination being then  deemed to have existed under this determination.  If a project requires these, or any classification not listed,  please contact IDOL at 217-782-1710 for wage rates or clarifications.

LANDSCAPING

Landscaping work falls under the existing classifications for laborer, operating engineer and truck driver.   The work performed by landscape plantsman and landscape laborer is covered by the existing classification  of laborer.  The work performed by landscape operators (regardless of equipment used or its size) is covered  by the classifications of operating engineer.  The work performed by landscape truck drivers (regardless of  size of truck driven) is covered by the classifications of truck driver.

MATERIAL TESTER & MATERIAL TESTER/INSPECTOR I AND II

Notwithstanding the difference in the classification title, the classification entitled "Material Tester I" involves the same job duties as the classification entitled "Material Tester/Inspector I". Likewise, the classification entitled "Material Tester II" involves the same job duties as the classification entitled "Material Tester/Inspector II".

DATE: May 21, 2020 SUMMARY/BACKGROUNDThe property owner of 13691 Kettering Parkway, Chris Booth, is requesting a variance to theUnified Development Ordinance (UDO) to construct a 5-foot tall open-style black aluminumfence within the corner side yard when typically the UDO would only allow up to a 4-foot inheight for the proposed location. The fence will meet all other aspects of the UDO such asmaintaining the 20-foot setback from the adjacent right-of-way and ensuring a decorative andopen design.

ANALYSISThe proposal was found to be in line with any applicable goals and objectives for ConventionalNeighborhood (CVN) within the Lemont 2030 Comprehensive Plan. The proposal was found to be sufficiently consistent with the Standards for Variations stated inSection 17.04.150 D. of the UDO. The Planning and Zoning Commission (PZC) held a public hearing on May 6, 2020 to discussthe proposal. WHEREAS, Chris Booth, (hereinafter referred to as “the Petitioner”) is the owner of the property at 13691 Kettering Parkway in Lemont (PIN# 22-34-408-011-0000) (hereinafter referred to as the “Subject Property”), legally described and depicted in Exhibit A; and

WHEREAS, the Petitioner applied pursuant to the provisions of the Lemont, Illinois Municipal Code, Title 17 Unified Development Ordinance (“UDO”) seeking a variation to §17.12.030 of the UDO to allow an open style fence of up to 5-foot in height to be located in the corner side yard within the R-4 zoning district; and

WHEREAS, the Planning and Zoning Commission of the Village of Lemont, Illinois

conducted a public hearing on May 6, 2020, via a remote meeting utilizing Zoom software due to Executive Order 2020-10, as extended and amended, which prohibits all public and private gatherings of more than 10 people for the duration of the Gubernatorial Disaster Proclamation currently extended to May 29, 2020, for the variation request and voted 6-0 to recommend approval of the requested variation with the conditions incorporated in this ordinance; and

WHEREAS, a notice of the aforesaid public hearing was made in the manner provided by

law and was published in the Daily Southtown, a newspaper of general circulation within the Village; and

WHEREAS, the President and Board of Trustees of the Village have reviewed the matter

herein and have determined that the requested variation is in the best interest of public health, safety, and welfare of the residents of the Village of Lemont, and hereby adopts the finding of facts as set forth in Exhibit C.

NOW, THEREFORE BE IT ORDAINED by the Village President and Board of

Trustees of the Village of Lemont, Counties of Cook, DuPage, and Will, Illinois as follows: SECTION ONE: The foregoing findings and recitals are hereby adopted as Section 1 of

this Ordinance and are incorporated by reference as if set forth verbatim herein.

SECTION TWO: The following variation from the UDO is hereby granted: 1. A variation is granted from §17.12.030 of the UDO to allow a 5-foot in height open-

style black aluminum fence to be located in the corner side yard, as depicted in Exhibit A.

2. Specific Conditions. The fence type shall be as depicted in Exhibit B, an open-style

black aluminum fence, that meets all other requirements of the UDO including the 20-foot setback from the adjacent right-of-way.

SECTION FOUR: That the Village Clerk of the Village of Lemont be and is directed

hereby to publish this Ordinance in pamphlet form, pursuant to the Statutes of the State of Illinois, made and provided.

SECTION FIVE: That this Ordinance shall be in full force and effect from and after its passage, approval and publication as provided by law.
