Mayor Ovard opened the meeting at 7:00 P.M. The Pledge of Allegiance was led by Phil Paskett.

The first item on the agenda was a request from Terry Diston for a business license. The business will be called 3 D Trucking and will consist of a dump truck that will be based out of Henefer. Terry Diston stated that the business will have no impact on parking, sewer, or water. The dump truck will be used primarily on job sites. Terry Diston has been given permission by the Moore’s to temporarily park the truck at their barn. Mayor Ovard called for a motion to approve a business license for 3 D Trucking. Ryan K. Mayor Ovard suggested amending the 2017-2018 budget for $50,000 out of the Capital Improvements Fund. Mayor Ovard’s suggestions for using this money are as follows:

1. Roof leak repair in men & women’s bathrooms.2. Possible repair of one half of the entire roof of the building. Mayor Ovard

explained that the North Summit School District owns the other half.3. Installation of window in front of the compressor in the kitchen so that the

compressor can vent.4. Carpet removal from entire Town Office and meeting room. Installation of Pergo

Mayor Ovard explained that this would also leave extra money in the budget for additional expenses throughout the year. Robin K. Riches informed the public that she had spoken to a contractor regarding these repairs and improvements. Brent G. Ovard explained that the UV lights in the sewer facility need to be upgraded. Brent estimates the new lights to cost between $12,000 - $13,000. Brent G. Ovard suggested amending the sewer budget to $20,000 to cover these repair costs. Earleen T. Paskett suggested adding an additional $50 to the water budget to cover Weber River Water fees. Mayor Ovard explained to the public that they have the right to know of every dollar that is in the budget. Mayor Ovard asked if there was any public comment. There were no public comments. Mayor Ovard called for a motion to close the public hearing. Ryan K. Mosher made a motion to close the public hearing to amend the 2017-2018 budget. Robin K. Riches seconded the motion. COUNCIL MEETING RESUMES

Mayor Ovard read resolution 2017-213 to amend the 2017-2018 budget. Robin K. Riches made a motion to accept the resolution 2017-213 to amend the 2017-2018 budget. Kay H. Richins seconded the motion. Vote: AYE: Randy C. Ovard, Brent G Ovard, Kay H. Richins, Ryan K. Mosher, Robin K. Riches NAY : none ABSTAINING: none ABSENT: none

Randy C. Ovard asked Robin K. Riches to obtain bids on all of the repair work. Mayor Ovard explained that bids aren’t necessary if the job does not exceed $40,000 but since the budget was being amended for $50,000 to cover repairs, bids may be necessary.

Mayor Ovard called for a motion to open a public hearing for the Richins Properties Subdivision (Grant, Kelly, Timothy, and Brett Richins). PUBLIC HEARING

Mayor Ovard asked Robert P. Richins, town planner, to give a brief review of the Richins request for the subdivision of the property directly below their property that currently has several business’s and storage units. Robert P. Richins explained that the Richins’ have requested that the property be subdivided into three lots. Robert P. Richins informed the Town Council that a road has already been pushed for access below storage units. The Planning Commission has concerns because the road has not been finished yet. Robert P. Richins informed the Town Council that the main concern of the Planning Commission is how water is going to be obtained for fire suppression. Robert P. Richins explained that it was the feeling of the Planning Commission that this be sent to the Henefer Town Council to determine how water would be supplied to this area because adequate water is absolutely necessary for fire protection. The Planning Commission had no control over decisions on how water will be supplied to new sub-divisions. Mayor Ovard explained that there are already storage units, shops, garages, and a large barn on this property. This is in addition to those existing buildings. Mayor Ovard

asked for public comment on any portion or part of this proposal. Mayor Ovard read a letter from Diane Moore which expresses her concerns on the sub-division. Diane was out of town at the time of the meeting and therefore unable to attend. In the letter, Diane states that she has no problem with new homes being built in our town, but she does have a problem with the lack of water that we have. Diane would like to know why we were put on water restrictions the first of June when we had a very wet winter. Mayor Ovard explained that once the 600,000 gallons of tanks are full all of the run-off goes into the river. Mayor Ovard asked for Phillip Paskett’s opinion on the amount of water that Henefer operates on. Phil Paskett stated that he was shocked at the relatively small amount of water that the town lives on. Mayor Ovard explained that the town basically has 11” of water coming in to supply 305 homes. Therefore, water restrictions are in place before summer watering begins. Water restrictions are put in place because we use culinary water to water lawns and Henefer does not have enough water to play with. The current water restrictions allow you to water for 6 hours, 6 days a week. Mayor Ovard felt that Diane Moore’s letter addressed the concerns of much of the public. The public is extremely concerned about this subdivision. Input from the public suggests that no more building should occur until water issues are resolved. There are currently 10 more homes to go in subdivision by the church, 6 more homes for Paskett’s lots, remaining homes in Rowser subdivision, and 3 homes in Wyatt Sargent subdivision. Therefore, Mayor Ovard feels it is very difficult to project how much additional water these homes will require. Whitney Stephens addressed the council with the question that if an additional tank was put in, is there enough water during the summer to supply it? Mayor Ovard explained that he checks the tanks daily. Mayor Ovard explained that for the last 7 years the earliest time that tanks overflow is about 5:30 p.m. This year, because of the good winter, on Monday it overflows at 1:00 p.m. Tuesday-Saturday it overflows at 10:00 a.m., Sunday it overflows all day. Mayor Ovard feels if it was a good winter that the additional tank would be able to be filled. It is Mayor Ovards opinion that the letter from Diane Moore expresses the feeling of many people in Henefer. Options for additional water have been looked at. The only options at this time are for Henefer to drill a well or put in a water treatment plant to use water from the river. Henefer has nearly 100 shares of river water that they could convert to drinking water. Mayor Ovard informed the public that Henefer has enough money to install another 250,000 gallon storage tank. Mayor Ovard has had all the survey’s completed on the Lundquist property to trade property so that Henefer Town will have enough room for an additional tank. Mayor Ovard suggested that all engineering for the new tank be completed this fall. Whitney Stephens asked if the council has looked at other possible building sites in the R2 zone before more annexations are allowed? Mayor Ovard addressed the public and explained that there are very few lots left in the R2 zone that could support multi-family dwellings. Mayor Ovard told the public that a 6 month moratorium has been issued so that no more multi-family dwellings can be built in the R2 zone. At the end of that time, 30,000 square feet will be required to build a multi-family dwelling. Mayor Ovard accepts a motion to close the public hearing on the Richins Properties Subdivision. Robin K. COUNCIL MEETING RESUMES

Mayor Ovard asked for town council members input on Richins Properties Subdivision. Ryan K Mosher said that his main concern was the water issues associated with the subdivision. Ryan K Mosher asked

Brent G. Ovard what size the existing main pipe that supplies Henefer is? Brent G. Ovard explained that it varies throughout different parts of town. Brent stated that there is 10” pvc pipe that enters town, also a 6” iron pipe. There is a 10” pipe coming out of Franklin Canyon and Bachelor’s Canyon. The pipe drops down to an 8” pipe beginning at 200 S 300 W, East Canyon Rd., and Main Street down to Stephens’ Subdivision. On the East side of Main Street it is only a 4” pipe to post office, goes to 8” pipe and then drops to a 6” pipe. Brent G Ovard said that basically covers the periphery of the town. Streets running north and south have a 6” line that connects to the 8” line. In between that are 6” and 4” lines. Ryan K. Mosher agrees with growth and the new business that the Richins Properties Subdivision would bring to Henefer, but feels water issues definitely need to be addressed first. Kay H. Richins asked what the 3 proposed lots in the subdivision would be used for? Brent G. Ovard asked if this subdivision was in the commercial zone and what size the lots were? Tim Richins answered that the lots are approximately 5 acres, 1 ½ acres, and 4 acres. Kelly Richins told the council that these lots would not be used for homes. They will be used to build shops for businesses and would use minimal water, just for toilets and sinks. Ryan K. Mosher asked if fire suppression would be required in the buildings. Ryan K. Mosher said that toilets and sinks were not that big of an issue, but if fire suppression was required, a flow test would need to be performed to see if gallons/minute were adequate. Ryan K. Mosher said at this time he is against the Richins Properties Subdivsion because of the fire suppression issue. Brent G. Ovard asked if the North Summit Fire District has ever evaluated the property to see what would be required to protect the investment on the property? Tim Richins answered that the Richins’ are just selling the lots. At this time, Tim Richins has no idea what size or types of structures would be built on the proposed lots. Robin K. Riches read section 1.08 from the Planning & Zoning Ordinance book. This section addresses fire district review of building plans and requirements for fire suppression. Brent G. Ovard said that the NSFD had given the town council authority to sign off on homes. The NSFD requires review for commercial or industrial parks and sign off by the NSFD. Brent G. Ovard has concerns that the fire code would not be able to be met at the Richins Properties Subdivision. Brent G. Ovard feels that fairly large buildings could be built on those lots and worries that there wouldn’t be enough water to protect those investments. Brent G. Ovard is concerned about the liability of Henefer Town if fire suppression is not in place. Mayor Ovard informed the council that at the time that the Richins Storage Units were built, 90% was under the jurisdiction of Summit County. There has only been about 10% of the buildings built since the annexation. Mayor Ovard asked Tim Richins what Summit County required as far as fire supression? Tim Richins said that nothing was ever required from Summit County. Mayor Ovard explained that the only thing Henefer Town has approved was additional storage units. Everything else was built under Summit County jurisdiction. Brent G. Ovard asked Bob P. Richins what the fire suppression requirements were when the Richins’ leased a building to Snooko for welding. Bob P. Richins explained that fire extinguishers and an eye wash were required for chemical exposure. Brent G. Ovard asked Kelly and Tim Richins if they had considered drilling a well to supply water to the property? Kelly Richins answered that if the Henefer Town water isn’t adequate, than a well won’t supply adequate water either. Robin K. Riches expressed concerns over water and sewer. Robin K. Riches asked Kelly and Tim Richins if they had the required shares to turn over in order to request hook-ups. Kelly Richins answered that they had the required shares. Robin K. Riches referred to a meeting in which the State of Utah came in and addressed the issue of wildland fires. Robin feels that these fires are a very real concern for Henefer Town. Robin K. Richins reads in the planning and zoning book that fire protection facilities are to be installed prior to issuance of a building permit in subdivisions, commercial and industrial parks. Robins K. Richins asked if the lots were sold, would the water shares be sold with the lot? Mayor Ovard explained that 1 acre foot of water is required per home. Depending

on the size of the buildings, more acre feet of water may be required. Kay H. Richins asked how much water currently comes out of Bald Rock? Kelly Richins answered that it was only enough to flush a toilet. Brent G. Ovard explained that Henefer Town has to be able to supply 1,000g/min for 2 hours for fire suppression. This means that 120,000 gallons of water must be available for fire suppression at all times. Brent G. Ovard said that citizens are not able to obtain fire insurance if Henefer Town is unable to provide that. Brent G Ovard isn’t sure if more is required for commercial buildings or not. It is difficult to determine water usage without knowing what will be built on the lots. Brent G. Ovard felt that there needed to be a review on what already exists on the property and what may be built in the future. Kelly Richins explained to the council that there is currently one lot existing and they are asking for two additional lots under the hill. Tim Richins explained that the Richins’ are keeping the top lot and that the two additional lots would be sold. Robins K. Riches asked Kelly and Tim Richins if there is currently fire suppression for the buildings that currently exist? Kelly Richins answered, “No, the county didn’t require it.” Brent G. Ovard would like to ask Summit County what they currently require for fire suppression in commercial buildings. Randy C. Ovard had been over to examine the property and expressed the following concerns:

1. The NSFD requires 250’ between fire hydrants. Therefore, approximately 4 fire hydrants would be required on the property to meet current fire code.

2. There is only a 6” line. NSFD will not allow you to hook onto that size of pipe.3. Fire hydrants are expensive and cost approximately $4,000- $5,000 installed.4. There is a question as to whether or not Henefer Town agreed to water to the

Richins’ property,Mayor Ovard read a summary of the Richins’ Property annexation that was written by the Town Clerk, Earleen Paskett after her research of the 2008 minutes regarding the annexation of the Richins Property. Mayor Ovard then reads the minutes that pertain to the 2008 Richins’ Property annexation. These minutes are available in the 2008 Richins annexation file. Mayor Ovard asked Tim Richins if he is aware of the bridge problem on the road over to the Richins Property. Mayor Ovard explained that it has been determined that Summit County owns the road past the Richins’ property, Henefer Town owns the bridge, and the State of Utah owns the road on the other side of the bridge. Tim Richins was under the impression that if Henefer Town annexes property on both sides of a road, the road belongs to Henefer Town. Mayor Ovard informed Tim Richins that Summit County still owns the road past the Richins’ property. Kay H. Richins explained that the Summit County Commissioners have agreed to pay half of the maintenance on the bridge. Randy C. Ovard continues with the reading of the 2008 minutes. Mayor Ovard explained that the 2008 minutes explain that the Richins’ agreed to a zone change for the entire property to commercial property to a C2 zone. The Richins’ are allowed to build a small caretaker cabin on the property without further permission from the Town Council. Mayor Ovard read the conditional uses that were stipulated in the 2008 minutes. Mayor Ovard said that none of the conditional uses have been met other than ingress and egress. Mayor Ovard continued reading minutes from 2008 regarding concerns of the annexation and response by Courtney Richins to these concerns in the 2008 council meeting. Richins’ contacted Mrs. Brown, whom owns adjoining property, to hook on to her water. Mrs. Brown declined to let Richins’ hook on to her water. Earleen Paskett has done extensive research and can find no commitment by Henefer Town to provide water to the Richins’ property. Mayor Ovard explains that all annexations have been brought in with no water provided by Henefer Town. Kelly Richins asked when the other annexations were approved. Kelly Richins explained that he believes the stipulation for no water was put into place after the Richins’ annexation. Mayor Ovard said

that the minutes state that if water was brought to the property it would probably have to be hooked on by the Travis Rowser property. Mayor Ovard asked Kelly and Tim Richins ,” If Henefer Town did let you hook on at the Travis Rowser property, will you put in 4 fire hydrants?” Mayor Ovard also asked the Richins’, “If water is taken over to the Richins’ property, how many homes will Grant Richins want hooked to it?” Mayor Ovard explained that the public is concerned that the Richins already have 38 hook-ups. The citizens of Henefer want to know why a developer should be allowed to come in and take all these hook-ups. Citizens are concerned that the water and sewer will triple if a water treatment plant has to be constructed. Kelly Richins answered that they have provided many places for people to live and they have provided many services for the town. Tim Richins asked what this has to do with anything? Tim Richins explained that the Richins’ have paid for and turned over water shares for everything. Tim Richins said that since the 2008 annexation didn’t say the Richins’ can’t hook onto city water, in their opinion, that means yes they can. Mayor Ovard explained that if building continues, the water issues are going to have to be resolved. Tim Richins asked what the rules are and if they will be allowed to hook onto city water or not. Mayor Ovard suggested two things to resolve this issue. Mayor Ovard wants to hire a state hydrologist or an independent engineering firm to examine flow in and out and determine how many more hook-ups can be supported. Mayor Ovard said that after the report, the council will determine if the Richins’ can install a line at their expense to their property and hook on to city water. Mayor Ovard will let a professional make the decision on future hook-ups. Tim Richins asked if anything new will be permitted to be built until the report is completed? Mayor Ovard said no more subdivisions until report is complete. Individual homes would be considered with the option of drilling a well if hook-ups aren’t available. Mayor Ovard suggested that the Richins save themselves the expense of a water line and purchase fire extinguishers for their buildings. Mayor Ovard explained that if the current water system is at its maximum capacity right now, it would take approximately two years and millions of dollars to put a water treatment plant in for river water. Brent G. Ovard said that since fire suppression is a big concern, the NSFD should assess the need of the Richins commercial property. Brent G Ovard said that Henefer Town will have a hydrologist come in and re-examine our water and also get NSFD to give an assessment of fire suppression requirements. Brent G. Ovard asked Kelly to get square footages and uses of existing structures. Randy C. Ovard suggested that the Richins Properties Subdivision be put on hold long enough to address the issues of water and fire suppression. Robin K. Riches clarified that lots will be sold with water shares. Kelly Richins answered, “Yes, water shares will be sold with property.” Randy C. Ovard also asked if building 5-8 homes, as stated in the 2008 minutes, are still in your plans for this subdivision? Tim Richins answered, “No, this is strictly for the storage units.” Kelly Richins said that if they did decide to build homes on the property, all planning and zoning requirements would have to be addressed at that time. Kelly Richins asked if he could receive a list of the conditional uses requirements that have not been met and asked Mayor Ovard if he wanted all of those requirements met. Mayor Ovard explained that a conditional use permit is only good for one year. The conditional use requirements on the Richins property are void now. Mayor Ovard said that planning and zoning would have to give new recommendations. Mayor Ovard said that the 2008 minutes didn’t say yes or no to water hook-ups. All other annexations have said no to water hook-ups. Mayor Ovard called for a motion to approve the Richins Properties Subdivision. No motion was made. Mayor Ovard called for a motion to table the Richins Properties Subdivision until the NSFD was consulted regarding fire suppression regulations, a state hydrologist examines the current water

system and prepares a report on his findings, and legal council is consulted. Kay H. Richins made a motion to table the Richins subdivision. Robin K. Riches seconded the motion. Vote: AYE: Randy C. Justin Richins was on the agenda to address speeding issues past his home, but did not attend the Town Council meeting. Item was tabled.

Next on the agenda was Joel Riches with concerns about the potholes on the Henefer streets. Joel Riches asked if the potholes at the end of his street would be able to be repaired by winter. Kay H. Richins told the council that he had met with Kory Richins and they had traveled throughout the town and assessed the street repairs that need to be made. Kay H. Richins said that there were several places in which the asphalt had settled and would be leveled out. Kay H. Richins said that over on Joel Riches street, the drain system would need to be dug out and redone. The concrete would be removed and replaced with asphalt. Kay H. Richins asked when the truck would be available to get the asphalt. Joel Riches suggested that the truck would be available within the next two weeks. Kay H. Riches said that the time frame for repairs would depend on the availability of Kory Richins to perform the work.

Leeta Shepherd was on the agenda to address abandoned homes in Henefer, but did not attend the meeting. Item was tabled.

Bruce Rowser was on the agenda to address water shares for his subdivision, but did not attend. Bruce requested that he be put on the October agenda. Item was tabled.

Kay H. Richins suggested that an amendment to the new planning and zoning ordinance book be considered. Kay H. Richins suggested that all construction of multi-family dwellings be excluded from the R2 zone. Kay H. Richins suggested that Bob Richins contact Cliff Rasmussen regarding his appointment to the Planning and Zoning Commission and have him attend the October Town Council meeting. Randy C. Ovard tells the council that the current members of the Planning and Zoning Commission are Cliff Rasmussen, Joe Archuleta, Angela Jones, Dale Eatchel, and Micah Richins.

EXECUTIVE SESSION

Mayor Ovard explained that the executive session is to review the wages for the new Town Clerk, Shelley Richins. Mayor Ovard explained that the work of the Town Clerk is continually increasing. Mayor Ovard tells the council that Summit County is now requesting at least a half hour whenever building permits are issued to come to the Henefer Town office and review the house plans. Mayor Ovard suggested that the wage for the new Town Clerk be raised to $1500.00/ month. Mayor Ovard suggested another wage review when the new council takes office. Mayor Ovard called for a motion to close the Executive Session. Brent G. Ovard made a motion to close the Executive Session. Robin K. Richins seconded the motion. Vote: AYE: Randy C. COUNCIL MEETING RESUMES

Mayor Ovard calls for a motion to raise Shelley Richins wages to $1500.00/month. Kay H. Richins made a motion to approve Shelley Richins wages to $1500.00/month. Ryan K. Mosher seconded the motion. Robin K. Riches reported to the council that she had contacted Aaron Preece and Chad West for the window installation at the concession building at John’s Park. Robin K. Riches asked if a bid would be necessary for the window at the concession stand and the other repairs to the restrooms at the town park. The town council decided that a bid would not be necessary as previously stated in the meeting, because repairs would be under $40,000.00. Mayor Ovard suggested that Robin contact Aaron Preece and Chad West for window installation at John’s Park concession and also in front of the compressor in the kitchen, roof repairs, men & women’s restroom repairs, flooring removal and re-installation of Pergo flooring in entire town office and council room, and door installation from hall into storage area. Mayor Ovard explained that Henefer Town is responsible for half of the building and North Summit School District is responsible for the other half. Mayor Ovard said that North Summit School District has already repaired the roof on half of the building. Mayor Ovard would like a contractor to get up on roof and assess repairs to see if the entire roof needs to be repaired or just half. Robin K. Richins informed council that she had reached out to Summit County for a sign to be posted on the playground fence. Suggestions for the sign were: park under constant surveillance, no alcohol, no glass containers.

Ryan K. Mosher informed the Town Council that he had contacted someone about new pumps for the sewer. Ryan K. Mosher said that his contact would be happy to come up and meet with the Council regarding these new pumps and give us a bid.

Brent G. Ovard informed the council that the operating permit for the most recent storage tank has finally been obtained. Brent G. Ovard suggested that a thank you letter be sent to Nev for her help in obtaining the permit. Brent G. Ovard also informed the council that the Division of Water Resource is now requiring digital reporting. If reports aren’t filed digitally, we will have to report to the EPA instead of the State of Utah. Brent G. Ovard has sent all instructions for digital filings to Arlin Ovard. Brent G. Ovard suggested follow-up with Arlin Ovard on obtaining new ultraviolet lights for the sewer system. Brent G. Ovard informed council that the source protection plans will have to be redone before

December 2017. Technical help may be required to update the source protection plans. Brent G. Ovard has received all updated paperwork on the procedure to develop a new well or spring.

Brent G. Ovard suggested contacting Wyatt Sargent regarding his plans on how to access sewer and water for his new subdivisions. Brent G. Ovard and Ryan K. Mosher will contact Wyatt Sargent and discuss if the road will need to be cut on 200 West to tap sewer and water. Kay H. Richins suggested that a schematic of the sewer and water lines be drawn up and kept on file for the entire town.

Mayor Ovard informed the council that Paul Ferry has surveyed the Lundquist property in Bachelor’s Canyon. Paul will draw up a plat amendment for the additional property that will be transferred from Kent Lundquist to Henefer Town for an additional storage tank.

Mayor Ovard informed the council that Bruce Rowser is aware that he needs to come in and settle on the water for the four existing homes in his subdivision. Bruce will attend the October Town Council meeting to discuss payment for the water.

Randy C. Ovard suggested that Brent G. Ovard contact an engineer to access Henefer Town’s water requirements immediately. Brent G. Ovard informed the council that the spring water filing on Franklin Canyon needs to be changed from irrigation water to beneficial use water. The beneficial use will be municipal water. Brent G. Ovard also suggested that all of Franklin Canyon water shares be gathered and transferred into Henefer Town’s name and changed to municipal water.

Mayor Ovard informed the Town Council that Jason Stolle has purchased a water share from Dave Holland for a water hook up on his lot in the Bob Richins annexation. Bob Richins property was annexed in with no water, but Jason Stolle will be able to hook on to town water because Jason Stolle has purchased a share from Dave Holland.
