The Hyde Park City Council meeting of August 24, 2016 began at 7:00 pm and was conducted by Mayor Bryan Cox.

City Officials Present: Mayor Bryan Cox, Council members; Mark Hurd, Bob Christensen, Bret Randall, Sharidean Flint, and Charles Wheeler. Planning and Zoning member; Mark Lynne, Police Chief; Kim Hawkes, and City Recorder; Donja Wright.

Adoption of Agenda: Council member Christensen moved that the Hyde Park City Council approve the agenda for the August 24, 2016 City Council meeting as presented. Council member Wheeler seconded the motion. Council members Hurd, Christensen, Randall, Flint and Wheeler voted in favor. The motion carried 5/0.

Citizen Input: No Input

Public Hearing to receive input regarding Hyde Park City Ordinance 2016 – 06; an Ordinance amending the Hyde Park City Senior Citizen’s PUD Standards and Conditions: The Mayor opened the Public Hearing, there was no comment. The Mayor closed the Public Hearing.

Consider Ordinance 2016 – 06; an Ordinance amending the Hyde Park City Senior Citizen’s PUD Standards and Conditions: The Council discussed the effects that changing the maximum acreage allowed in a PUD (Planned Unit Development) from 6 acres to 7 acres would have on the Legends of North Park and other PUDs. The Council determined that it could increase the PUD by 4-5 houses. Council member Wheeler asked if there would still be the required 30 percent of total gross area in the PUD, including all walkways, sidewalks and greenways. The Council determined that the requirements would still be met. Council member Randall made a motion to approve Ordinance 2016 – 06, an ordinance amending the Hyde Park City Senior Citizens PUD standards and conditions. Council member Flint seconded the motion. Council members Hurd, Christensen, Randall, Flint and Wheeler voted in favor. The motion carried 5/0.

Consider Resolution 2016 – 10; a Resolution adopting the 2016 Pre-Disaster Mitigation Plan; Bear River Region – The Council reviewed the plan. Brian Potts approached the Council and informed them that the plan had changed slightly since the one they looked at in 2015. It included some small corrections and data updates. Council member Wheeler informed the Council that there was an error on page 7, highlighted in yellow. Council member Randall made a motion to approve Resolution 2016 – 10 with the correction to the bottom of page 7 and with the understanding that the document is a living plan that will be updated with current information. Council member Hurd seconded the motion. Council members Hurd, Christensen, Randall, Flint, and Wheeler voted in favor. The motion carried 5/0.

Departments

Parks: Council member Wheeler informed the Council that he received bids for installing sidewalks in front of Osborne’s along 200 West and along Center Street. The City will hold off on putting in the sidewalks along Center Street to see if the City can apply for a Safe Route to School Grant. Council member Wheeler informed the Council that there is currently no sidewalk in front of Gruings on the east side of 200 West. He asked the Council if they were in favor of having the City participate with Mike Grunig to put in that sidewalk. The Council was in favor. Council member Wheeler informed the Council that he had modified the Contract for the tennis courts and sent it back to Tennis & Track Company. He will sign it as soon as they send it back. He informed the Council that there are several eagle projects in the works and he has received word from Cache Landmark that they received a letter of approval from the federal and State Government for the land exchange as a result of the new high school. Lance from Cache Landmark will be bringing that to the City so that the exchange can be finalized. Police Commission: Council member Flint informed the Council that the Police Commission had a meeting with North Park police about some changes that have been implemented. The morale on the police force is low and they have a long way to go to fix some of the long-term problems. The North Park Police is hiring one new officer. Council member Wheeler recommended that next time the Chief works on the Police budget, he researches what parity would cost the Cities and bring a goal to the Council so they can understand what the target is for getting the officers fairly compensated.

Water / Sewer – Council member Randall informed the Council that the sewer rate committee has not met again but the study is mostly done and will be presented shortly. Council member Randall informed the Council that he and several other people visited the well site. They only had 2 drillers show up for the visit, but hope they have more bids come in. Since the water from the spring is low, the wells are still running to pump most of the water being used. It is one of the driest summers in the past 20 years. Sunrise engineering has been working with the City on determining if the City can support 200 new homes above the canal. Sunrise

Engineering has determined that as long as the growth is slow and the City is working on other water sources above the canal, the City will be able to handle to growth.

The Council discussed the importance of having an ordinance that requires dry piping in subdivisions above the canal. The Mayor recommended that the first step should be a dedicated water line from the well to the tank in Lions Park.

Streets: Council member Christensen informed the Council that the roads are complete on 450 North, Center Street from the Highway to the City Shop and Main Street from 1st North to 2nd North. They also asphalted around the City Shop. The Council discussed stop signs. The Mayor informed the Council about an accident on 450 north. He received a letter from an attorney asking for compensation from the City. He has submitted the letter to the City attorney and is waiting for a reply. Police Chief Hawkes said that it is a financial burden on Cities to put stop signs on every intersection.

Emergency Prep: Council member Hurd reported that the Citizens Core Council will be working on the disaster mitigation plan.

Administrative: The Mayor informed the Council about a fire that was close to the water tank. He said that thanks to quick response time, it was put out quickly.

The Mayor informed the Council that he and Mike Grunig met with a resident, Mr. Pitcher to discuss some damage that had occurred due to the large rainstorm. Mr. Pitcher feels that his basement flooded due to a storm water retention issue. Damages are in excess of $5,700.00. The Mayor and Mike are working on determining fault and finding a resolution.

The Mayor informed the Council that Council member Randall had contacted League of Cities attorney, David Church, to get additional information about the process for appointing the City attorney. The Mayor informed the Council that according to Mr. Church’s response, the Hyde Park City attorney is not part of the City staff and therefore; the Council did not need to make a formal vote. Council member Randall informed the Council that Mr. Church indicated in an email that it would be appropriate for Mr. Jenkins to attend a City Council and request a vote. The Council requested that the City compose a policy that requires the City Council to vote on positions such as City Attorney and City Engineer going forward.

Council member Hurd asked what the Council’s standing is on 50 East. The Council will be attending League of Cities and Towns in a few weeks and he would like to be able to talk to North Logan Council and legal about this. The Council had a discussion about options including; 1) Creating cul-de-sacs on both sides with no through street. 2) Requiring that the road is lined up between the 2 Cities and that it is a safe connectivity. 3) Going through the process to vacate or abandon the road.
