TOURNAMENT WAIVER (Each participant must read & sign)I, the undersigned participant, and, if under 18 years of age, my parent or legal guardian intending to be legally bound, as a condition of my attendance and participation in the U.S. Superyacht Association, Jacaranda Golf Course, Golf Classic (“EVENT”), and on behalf of each of my heirs, assigns, administrators, executors, personal representatives and next of kin, do hereby waive, release, indemnify, defend, and hold harmless the U.S. Superyacht Association (“USSA”), and their respective directors, officers, employees, members, staff, affiliates, sponsors, partners, volunteers, and all individuals assisting in instructing, sponsoring and conducting the EVENT and its related activities (collectively “RELEASEES”), from any and all claims, liabilities, expenses or causes of action of any kind resulting from damage, injury, and/or loss to person or property, including death, which may accrue to me or my heirs arising out of or in any way connected with my attendance, participation in, and/or travel to and from this EVENT and EVENT-related activities. I further recognize that I am fully aware that possible injury or damage may occur to me or my heirs as a result of attendance and participation in said EVENT, and as a result, I agree to assume the full risk, including risk which is not foreseeable, of any injuries, death, damages, or loss regardless of severity, whether arising from Negligence by any RELEASEE or otherwise, to the fullest extent permitted by law.

A “Hole in One” major prize (“PRIZE”) is offered through an insurance program provided by a separate sponsor of the EVENT. If participating in the PRIZE, the participant releases USSA, and their respective directors, officers, employees, members, staff, affiliates, non-insuring sponsors, partners, volunteers, from any and all complications or liabilities for injuries, losses, or damages of any kind in relation to the PRIZE. Winners agree to indemnify and hold USSA, and their respective directors, officers, employees, members, staff, affiliates, non-insuring sponsors, partners, volunteers, harmless from any and all losses, damages, costs, expenses, rights, claims and actions of any kind arising in connection with or as a result of the winner’s acceptance or use of any PRIZE. Without limiting the foregoing, everything in relation to the PRIZE is provided “AS IS” without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness, or non-infringement. This offer is void where prohibited by law and all federal, state and local laws and restrictions apply.

I further attest and certify that I am physically and mentally fit and significantly trained to participate in the instant EVENT. I also grant permission and acknowledge that names, photographs, audio, video, and any other records of my participation and/or attendance at the EVENT may be taken and used for any and all manner and purpose in perpetuity. TOURNAMENT WAIVER (Each participant must read & sign)I, the undersigned participant, and, if under 18 years of age, my parent or legal guardian intending to be legally bound, as a condition of my attendance and participation in the U.S. Superyacht Association, Jacaranda Golf Course, Golf Classic (“EVENT”), and on behalf of each of my heirs, assigns, administrators, executors, personal representatives and next of kin, do hereby waive, release, indemnify, defend, and hold harmless the U.S. Superyacht Association (“USSA”), and their respective directors, officers, employees, members, staff, affiliates, sponsors, partners, volunteers, and all individuals assisting in instructing, sponsoring and conducting the EVENT and its related activities (collectively “RELEASEES”), from any and all claims, liabilities, expenses or causes of action of any kind resulting from damage, injury, and/or loss to person or property, including death, which may accrue to me or my heirs arising out of or in any way connected with my attendance, participation in, and/or travel to and from this EVENT and EVENT-related activities. I further recognize that I am fully aware that possible injury or damage may occur to me or my heirs as a result of attendance and participation in said EVENT, and as a result, I agree to assume the full risk, including risk which is not foreseeable, of any injuries, death, damages, or loss regardless of severity, whether arising from Negligence by any RELEASEE or otherwise, to the fullest extent permitted by law.

A “Hole in One” major prize (“PRIZE”) is offered through an insurance program provided by a separate sponsor of the EVENT. If participating in the PRIZE, the participant releases USSA, and their respective directors, officers, employees, members, staff, affiliates, non-insuring sponsors, partners, volunteers, from any and all complications or liabilities for injuries, losses, or damages of any kind in relation to the PRIZE. Winners agree to indemnify and hold USSA, and their respective directors, officers, employees, members, staff, affiliates, non-insuring sponsors, partners, volunteers, harmless from any and all losses, damages, costs, expenses, rights, claims and actions of any kind arising in connection with or as a result of the winner’s acceptance or use of any PRIZE. Without limiting the foregoing, everything in relation to the PRIZE is provided “AS IS” without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness, or non-infringement. This offer is void where prohibited by law and all federal, state and local laws and restrictions apply.
