Being a nurse takes an enormous amount of ener-gy. Energy to deliver safe, quality care. Energy tomaintain our professional competence and furtherour development. And energy to work in today’schallenging healthcare environment, especially herein Nevada, where we have one of the most seriousnursing shortages in the nation. (According to thepreliminary findings of the 2004 National SampleSurvey of Registered Nurses conducted by the federalHealth Resources and Services Administration,Nevada has 604 registered nurses per 100,000 popu-lation, placing us just above California, the statewith the lowest RN to population ratio at 590 per100,000.)

Despite these “energy-zappers,” most nurses stillhave the energy to put their patients first. The role ofthe Nevada State Board of Nursing is also to putpatients first. Our mission, mandated by the NevadaState Legislature, is to protect the public’s health,safety, and welfare by effectively regulating the prac-tice of nursing and enforcing the provisions of theNevada Nurse Practice Act.

When the legislature established the Board in1923, it was to answer the question: “How can we, asa state, be sure that those individuals who wish tomake nursing their career are safe and competent topractice in the real world?”

In addition to creating the Board, the legislatureanswered that question by passing the laws that serveas the foundation for nursing regulation. Together,nursing laws and regulations make up the NursePractice Act. Have you looked at it lately? Do youknow the scope of your license? Do you know yourobligations relating to safe and competent practice? The Board, the legislature, and members of thehealthcare community are continually evaluating theNurse Practice Act to ensure it is current withacceptable and legal limits regarding the practice ofnursing. Many individuals volunteer their time to Boardcommittees to address current practice issues andexplore the need for changes. (Most of the membersof the Disability Advisory Committee are featuredon the cover of this magazine.) These committeesmake recommendations for change and provide theBoard with a wealth of information regarding nurs-ing practice. This input allows our seven Boardmembers to make educated and informed decisionsregarding the regulation of practice in Nevada. Allrecommendations are presented in public meetingsbefore being considered for change to our NursePractice Act.

We at the Board, both staff and members, sin-cerely believe that through the thoughtful collabo-ration of licensed and certified individuals whohave the public interest at heart, protection of thepublic can also mean success in the advancement ofthe practice of nursing. Two months before their Nevadalicense or certificate expires, all nursesand CNAs are mailed blue (nurse/advanced practitioner) or yellow (nurs-ing assistant) postcards. The postcardcontains a Personal IdentificationNumber (PIN) and instructions toaccess the Board’s website at www.nurs-ingboard.state.nv.us for on line renewal.

All you need to renew your Nevadalicense or certificate is a MasterCard™,Visa™ or Discover™ debit or credit

card, and access to the internet. If youare a CNA, you will also need the fullname and license number of your super-vising RN or LPN.

Once you’ve successfully completedthe process, your license or certificatewill be renewed within one business day.Your hard card will follow in the mail.

If you don’t have a MasterCard™,Visa™ or Discover™ debit or creditcard, the postcard will direct you tocomplete and print a renewal applica-

tion from the Board’s website or call foran application to be mailed to you.

If you have a credit or debit card, butdon’t have access to the internet, youcan come to either Board office andrenew your certificate using the lobbycomputer set up just for you!

So, make sure you receive the post-card by ensuring the Board has your cor-rect address—you can update youraddress through our website, or completethe change of address form on page 18.

Please note:• CNAs need the full name and license

number of their supervising RN or LPN.The Board has recently received calls from employersconcerned about supplying CNAs with the RN/LPN licensenumber of their supervising nurse. As a reminder, thisrequirement has been in place for several years. With itsnew application and on line service, the Board has actu-ally made it simpler for employers, as it is no longerrequiring the employer to complete an “EmploymentVerification Information” section in addition to the super-vising nurse’s name and license number.

• License and certificate numbers are pub-lic information. Not only do boards of nursinghave a right to request the license or certificate numberof any nurse or CNA, so does any member of the public.

• The Board is auditing for compliancewith the CE requirements for nurses andadvanced practice nurses, as well as theemployment and continuing education/training requirements for CNAs. Althoughyou no longer need to submit copies of these records withyour application, you must keep them for four years incase you are audited. If you cannot prove that you havecompleted these renewal requirements, the Board maytake disciplinary action against your license or certificate.

Problems with on line renewal?

We receive several calls a day from people who have problemswith on line renewal. We are glad to help walk you through theprocess, but here are some tips that may help you help yourself:

• Read the screening questions carefully and answer them truthfully.

• Make sure you enter your license or certificate number with nospaces between the type and the number, and make sure youinclude the leading zeros.

For example: RN00055 or CNA00055.

• The Board’s on line renewal system works best with InternetExplorer. If your internet browser is Netscape, Firefox, or if youhave DSL service, you may encounter problems. If you do, youmay call the Board office for assistance, or complete the paperrenewal application.

• If you need to complete a paper renewal application, you will bedirected to click a link to a PDF form that will open in the AdobeAcrobat Reader program. You will be able to type in your answersdirectly into the application, then print it, sign it, and mail it inwith your fee. Remember to click the link—do not print the on linerenewal screen—it is not the paper renewal application.

Every day, the Board receives manycalls and emails regarding scope ofpractice, asking questions that rangefrom what kind of drugs a nurse isallowed to administer during proce-dural sedation to whether a CNAcan tell a patient a diagnosis.

While the Nurse Practice Act andthe Board’s practice decisions do specifi-cally address some of these questions (e.g.procedural sedation), there is no one“list” of acceptable procedures.

The Nurse Practice Act defines nurs-ing in terms of applying the nursingprocess, teaching health care practices,and managing the practice of nursing.

To determine if providing a specificservice or procedure is acceptable prac-tice, both the specific circumstancesinvolving the patient’s condition andthe competency of the nurse must beconsidered.

Published inside the Nurse PracticeAct (revised May 2004) is a list of spe-cific practice decisions (pages 91-95)and a guideline and decision tree fordetermining scope of practice (pages96-97). (This information is also on theBoard’s website.)

The guideline lists basic questions youshould ask if you’re trying to determinewhether a practice is within your scope.If you can answer yes to all the questions,and other state or federal laws and regu-lations don’t prohibit it, the practice isprobably within your scope.

Here are answers to some of thescope of practice questions the Board isfrequently asked.

Q If my facility employs nursesor CNAs from a staffingagency, whose responsibility

is it to verify they have activeNevada licenses or certificates?

A It is the responsibility of both thefacility and the staffing agency.Per NAC 632.890(30)(c), the

chief nurse where the nurse or CNA isemployed and/or working is responsiblefor verifying he or she has an activeNevada license or certificate. To do so,the Board encourages you to use ourwebsite verification system. It’s quick,convenient, and it’s updated within one

business day of renewal or initialissuance. You can also call the Board forverification at 888-590-6726. Bothmethods ensure you have the most up-to-date information about the license orcertificate status of your employees andpotential employees.

Q Can a nurse cut a diabetic’s toenails?

AYes. Per NAC 632.225 a regis-tered nurse may perform a skill,assessment, intervention or other

duty in addition to those taught in abasic nursing educational program for aprofessional nurse if they meet therequirements outlined in the regulation.Requirements included in the regulationare: is the skill within the scope of prac-tice of the nurse, is there documentationof the nurses’ competence in perform-ance of the skill maintained by theemployer, and are there written policyand procedures in place?

Q If a practice is allowed bythe Nurse Practice Act, canmy facility prevent me from

performing it?

AYes. A facility’s policies and proce-dures may be more restrictive thanNevada laws, regulations, and

decisions. However, a facility may notexpand a nurse’s or CNA’s scope of prac-tice by instituting policy and proceduresthat are in conflict with the NevadaNurse Practice Act.

QMay a CNA tell a patient a diagnosis?

ANo, and neither may an RN orLPN. Informing a patient of adiagnosis is the responsibility of

an advanced practitioner of nursing, alicensed physician, a licensed physicianassistant, a licensed dentist or alicensed podiatric physician.

QWhat drugs may nursesadminister during procedural sedation?

AAccording to the Board’sProcedural SedationPractice Decision, there are

“. . . no limits on the type of medicationor route of medication; there is only therequirement that the drug be ordered byone lawfully authorized to prescribe.

“Specifically, the registered nurse mustbe competent to perform the function,and the function must be performed in amanner consistent with the standard ofpractice. In administering medications toinduce procedural sedation, the RN isrequired to have the same knowledgeand skills as for any other medication thenurse administers. This knowledge baseincludes but is not limited to: effects ofthe medication, potential side effects ofthe medication, contraindications for theadministration of the medication, andthe amount of the medication to beadministered. The requisite skills includethe ability to: competently and safelyadminister the medication by the speci-fied route, anticipate and recognize thepotential complications of the medica-tion, recognize emergency situations,and institute emergency procedures.Thus the RN would be held account-able for knowledge of the medicationand for ensuring that the proper safetymeasures are followed. . . .”

QMay a CNA work as a medical assistant?

AA CNA may choose to have aseparate job as a medical assistant.However, the hours worked as a

medical assistant do not qualify towardthe 400-hour CNA renewal require-ment. This applies even if her employerrequires an employee to have a CNAcertificate for a specific position. ACNA has a very specific and limited

scope of practice. Medical assistant prac-tice falls under the direction and super-vision of a physician and is regulated bythe Board of Medical Examiners.

QMay a CNA supervise another CNA?

ANo. Per NRS 632.0166, CNAswork under the direction (supervi-sion) of a licensed nurse. A CNA

may orient another CNA to his or herassignment, but supervision remains theresponsibility of the licensed nurse.

QMay an LPN supervise an RN?

ANo. Per NRS 632.017, LPNswork under the direction (super-vision) of a registered nurse, an

advanced practitioner of nursing, alicensed physician, a licensed physicianassistant, a licensed dentist or alicensed podiatric physician. LPNs arenot qualified, nor is it in their scope ofpractice, to supervise RNs.

QMay an LPN serve as the chief nurse and supervise RNs?

AThe answer lies both in theNurse Practice Act and in facilityregulations. Per NRS 632.240,

nursing services must be supervised by achief administrative nurse, who must bea registered nurse. Also, LPNs workunder the direction of a registerednurse, not the other way around (seeNRS 632.017).

Facility regulation (NAC449.74517), enforced by the NevadaState Health Division’s Bureau of

Licensure and Certification, allows anLPN to work as the charge nurse in afacility for skilled nursing, but not asthe chief administrative nurse. Here is therelevant text of that regulation:

NAC 449.74517 Nursing Staff.(2) A facility for skilled nursing shall

employ a full-time registered nurseto act as the chief administrativenurse. The chief administrativenurse must have:

(a) At least 3 years of experience pro-viding nursing care in a hospitalor facility for long-term care; and

(b) Experience supervising otheremployees.

QMay licensed nurses administerover-the-counter medicationswithout a physician order?

A If a person is employed as an RNor LPN, he or she can onlyadminister medications (includ-

ing over-the-counter) under the regula-tion that governs prescriptions—NAC632.071 “Prescription” defined.According to that regulation, “prescrip-

tion” means authorization to administermedications or treatment issued by anAPN, a licensed physician, a licensedphysician assistant, a licensed dentist ora licensed podiatric physician in theform of a written or oral order, a policyor procedure of a facility, or a writtenprotocol developed by the prescribingpractitioner. So, an RN or LPN canonly give over-the-counter medicationswith a prescription.

Q Can LPNs do assessmentsin long-term care settings?

AThey can contribute to theassessment, just as they can inany setting, according to

At the direction ofan RN, APN, licensed physician,licensed physician assistant, or licenseddentist, an LPN can contribute toassessments of health status by (1) col-lecting, reporting, and recording objec-tive and subjective data, (2) observa-tion of conditions or change in condi-tion, and (3) signs and symptoms ofdeviation from normal health status.

physician has given them directionto do so and has indicated theyare “working under his license”?

A Licensed nurses may only performthose duties and tasks that arewithin their scope of practice as

defined by the Nevada Nurse PracticeAct. Licensed nurses never work “under”anyone else’s license.

The National Council of State Boards of Nursing(NCSBN) is about to launch a practice analysis studydesigned to describe entry-level licensed practical/vocation-al nurse (LPN/VN) practice. Using a survey developed by apanel of experts that included both practicing LPN/VNsfrom a variety of practice settings and specialty areas, aswell as LPN/VN educators, a sample of LPN/VNs will beasked to determine the frequency of performance and theimportance of each of the activities listed. The results of thesurvey will be used to evaluate the current LPN/VN test plan

in an effort to assure that the NCLEX-PN® examinationreflects existing practice.

The LPN/VN survey is due to be launched on June 12,2006. This study offers an opportunity for LPN/VNs to con-tribute to the nursing profession and as such, NCSBNencourages nurses receiving the survey to complete andreturn it as soon as possible.

As we’ve mentioned in previousissues of NSBN News, the 2003 Nevadalegislature passed Assembly Bill 250,which requires that several types ofhealth care professionals, including nurs-es, take four hours of continuing educa-tion “relating to the medical conse-quences of an act of terrorism thatinvolves the use of a weapon of massdestruction.”

As of January 1, 2005, all nursesrenewing their licenses must havecompleted this four-hour bioterrorismcourse as part of their CE renewalrequirement. On that date, theBoard’s random CE audits began toinclude auditing for proof that renew-ing nurses have completed the bioter-rorism course.

The bill specifies that the course ofinstruction must include:

a. An overview of acts of terrorismand weapons of mass destruction;

b. Personal protective equipmentrequired for acts of terrorism;

c. Common symptoms and methodsof treatment associated with expo-sure to, or injuries caused by, chem-ical, biological, radioactive andnuclear agents;

d. Syndromic surveillance and report-ing procedures for acts of terrorismthat involve biological agents; and

e. An overview of the informationavailable on, and the use of, theHealth Area Network.

Completing a bioterrorism coursewhich meets the requirements of the lawis a one-time requirement of all RNs andLPNs with active Nevada licenses. Oncethe course is completed, it doesn’t haveto be taken again.

The four hours may be counted aspart of the 30-hour CE requirement forRN and LPN renewal, and as part of the

45-hour CE requirement for APN andCRNA renewal. (Remember you mustretain your CE certificates for four years,so that you have proof you met the CErenewal requirement in the event youare audited.)

While the legislature didn’t man-date the course for CNAs, the Boardhighly encourages them to take it aspart of their 24-hour in-service train-ing renewal requirement.

When considering any continuing

education course, please make sure thatthe CE provider is approved by theBoard (see below). If it is not, it won’tcount toward the 30-hour renewalrequirement. In addition, when review-ing a potential bioterrorism course, makesure the course content covers the sub-ject matter mandated by the Nevadalegislature. Be aware—many coursesentitled “Bioterrorism” only cover oneor two of the mandated subjects.

If you took a bioterrorism coursebefore January 1, 2005 and afterOctober 1, 2003, AND it met therequirements of the law, the Board willcount that course as meeting your one-time requirement. Just make sure youkeep a copy of the certificate in caseyou are audited.

Kathleen ReynoldsKathleen Reynolds, BHS, RN, brought

30 years of nursing experience to theBoard when she was hired as compliancecoordinator in 2004. Shealso brought a unique per-spective—appointed to theBoard by Gov. KennyGuinn, Reynolds served asa Board member from1995 to 1999. “I appreciat-ed the Board’s insightregarding their mission toprotect the public, andtheir recognition that achemically dependentnurse could be helped andcontinue to practice nurs-ing without endangeringthat mission.”

She is referring to the Board’sAlternative Program for ChemicallyDependent Nurses, one of her mainresponsibilities as compliance coordinator.The goal of the Alternative Program is toprotect the public by identifying impairednurses and CNAs, providing interventionand education, and requiring treatment.

“It helps heal the healers,” Reynoldsexplains, “by giving nurses and nursingassistants the opportunity to take personalresponsibility for their recovery whilebeing closely monitored through a non-public agreement.”

Reynolds chairs the Board’s DisabilityAdvisory Committee, which administersthe Alternative Program. Committee mem-bers, who are all volunteers, include profes-sional substance abuse and mental healthnurses and nurses who have recovered fromalcohol or drug addiction or have had otherlife experiences around addictions. Thecommittee evaluates whether chemicaldependence is impairing a person’s nursingpractice; submits recommendations to theBoard, which may be accepted, amended,or rejected; and monitors recovery progressthrough scheduled interviews with thenurse or nursing assistant and regularreports from employers, treatmentproviders, and the nurses themselves.

The long-time nurse says, “I welcomeevery opportunity to speak to nursinggroups to increase knowledge about theAlternative Program.” She adds that herwork with the nurses and CNAs who are

committed to their ownrecovery, and the commit-tee members who arecommitted to furtheringthat recovery, is both pro-fessionally and personallygratifying. “I feel that thisis a contribution to thenursing field that I canmake.”

This contribution isjust the latest for Reynolds,who earned her RN diplo-ma at Holy Cross Hospitalin Salt Lake City, Utah,

and her BHS from Chapman Universityin California. She began her career as amedical surgery nurse at St. FrancisMemorial Hospital in San Francisco. Aftermoving to Reno with her growing family,she moved quickly into management posi-tions with St. Mary’sHospital, where she wasneuro-surgical unit manag-er and director of medical-surgical nursing. Her threedecades of nursing experi-ence includes working atall local acute hospitals,medical-surgical, criticalcare, mental health/chemi-cal dependency for adultsand children, emergency,and home care. Reynoldsalso has extensive experi-ence in managed care,serving as director of health services forthe Northern Nevada Health Network,Sierra Health Services, and HometownHealth Plan.

A resident of Reno since 1965, whereshe raised her family, Reynolds says sheenjoys spending time with her threedaughters and four grandchildren, timewith friends or a good book, and traveling(her latest trip was to Ireland, to be therefor the birth of her newest grandchild).

Dean EstesCombining accounting skills with a tal-

ent for information technology might be astretch for some, but it’s a natural combi-nation for Dean Estes. The Board’saccountant/technology officer says he likesthe challenges that are an inevitable partof managing information technology sys-tems, such as the computer operations,online programs, and licensee databaseshe’s responsible for. “I enjoy the opportu-nity to help develop and implement newcomputer technology that helps both ourclients and staff members,” he explains.“And I have a lot of fun doing what I do.”

The technological innovations Esteshas introduced include web-based servicesthat allow nurses and CNAs to updatetheir addresses and applicants to requestapplication packets. He is currently work-ing on a system that will allow individualsto apply for their initial licenses or certifi-cates on line.

In a move that streamlined financialprocesses and made it easier for nurses and

CNAs to pay for Boardservices, the accountant/technology officer expand-ed the Board’s acceptanceof MasterCard™, Visa™or Discover™ debit orcredit cards for all Boardpayments.

Estes, who earned hisbachelor’s degree fromthe University of Nevada,Reno, in 1993, brought20 years of nonprofitexperience to the Board,including a long tenure

with the YMCA of the Sierra. He joinedthe YMCA while he was still in highschool, as a program assistant. As heattended college classes, he also super-vised the day-to-day operations of theYMCA’s youth programs. When heearned his degree, Estes was promoted tochief financial officer for the YMCA ofthe Sierra, then later became the execu-tive director of the Sparks Family YMCA.He was the fiscal officer for the Nevada

Board Revises PICC Practice DecisionRNs may now read chest X-rays to assure proper placement

At its March meeting, the Board adopted a revision to its peripherallyinserted central catheter (PICC) decision. It did so upon the recommendationof its Nursing Practice Advisory Committee, whose member TerryEdmonson, RN, researched the issue. Edmonson told committee that at least15 states allow RNs to check placement of PICC lines by doing a “prelimi-nary reading” of a chest X-ray. He also described how beneficial the prac-tice would be to patients, who often wait several hours after PICC lineplacement to receive needed medications because a radiologist is not avail-able to read the chest X-ray. The committee also heard physician testimonythat nursing would not be expected to do diagnostic interpretation of the X-ray, but should be allowed to verify placement of the PICC line. After furtherresearch and discussion, the committee recommended to the Board that RNswith documented training be allowed to verify placement of PICC linesthrough a chest X-ray. The Board accepted the recommendation and revisedits practice decision (see below) to include this practice (see italics). Therevised practice decision is also on the Board’s website.

Nevada State Board of Nursing Practice DecisionRNs May Place A Peripherally Inserted Central Catheter

PICC insertion in the home setting should be limited to subclavian distaltip placement (12/92) and RNs may, with documented training, be allowedto 1) secure peripherally inserted central lines by placement of a suturewhen securement devices are not available; 2) peripherally insert a centralline in any setting including the home after an assessment is made regard-ing the safety of the setting and arrangements necessary for verification ofplacement prior to induction of infusion; 3) reposition, repair, flush/declot,exchange or remove a peripherally inserted nonfunctional line under thedirection of a physician; and 4) assure proper placement of the catheterwhen the distal tip is positioned beyond the axillary vein by providing apreliminary reading of a chest X-ray for determining placement of the end ofthe PICC in the vena cava.(9/00, rev. 3/06)

Who can I call if I have questions about the complaint or discipli-nary process? The Board encourages you to call any time you havea question about the disciplinary process or what constitutes a vio-lation of the Nurse Practice Act. Just call the Board and ask for oneof the nurse investigators or the director of operations.

What are common types of disciplinary actions?When considering what kind of disciplinary action itshould take, the Board always asks itself, “What isneeded to make this person safe to practice?” Theanswer depends on the nature of the violation, andcan range from reprimanding an individual andordering the person to attend a remedial class torevoking the person’s license or certificate. All disci-plinary action is reported to national disciplinarydata banks. Outlined in the Nurse Practice Act, NRS632.325, disciplinary actions available to theBoard include:

Denial of ApplicationIf the Board denies an application for licensure orcertification, it has determined that the individualviolated the Nurse Practice Act. In most cases, thedenial is due to criminal convictions and/or submit-ting a fraudulent application.

Reprimand and/or FineIf the Board reprimands or fines a nurse or CNA, ithas determined that the individual violated theNurse Practice Act. This action does not prohibit orrestrict the individual’s practice.

ProbationIf the Board puts an individual on probation, itmeans the nurse or CNA may work, but will beworking on a restricted license or certificate andmonitored by the Board for a specific time period.The probation may also include practice and/orsetting restrictions and requirements like classes orrandom drug tests.

SuspensionIf the Board suspends a license or certificate, itmeans the nurse or CNA is prohibited from practic-ing for a designated time period.

Voluntary SurrenderThis means the nurse or CNA has agreed to volun-tarily surrender his or her license or certificate andcannot practice in Nevada. If the person applies forreinstatement, the Board weighs evidence of reha-bilitation and remediation when considering theapplication.

RevocationIf the Board revokes a license or certificate, itmeans the nurse or CNA cannot practice in Nevadafrom a minimum of one to a maximum of 10years. After that time, the nurse or CNA may applyfor reinstatement if all the requirements in theorder of revocation have been met. The Boardweighs evidence of rehabilitation and remediationwhen considering the application.
