    Lets talk about lawyers.Lawyers serves two purposes -to clariy, and to conuse. Ask a

    lawyer what time it is, and hell

    tell you how to build a clock, as

    the old joke goes. The lawyer is

    there to either screw with your brain,

    or to screw with somebody elses on yourbehal. They do it by arguing that words dont

    mean what they mean, or by simply throwing

    out nonsensical answers with great conviction.

    You might remember that last week, I

    asked the Guadalupe County District Attorney,

    Heather McMinn, why she declined toprosecute Leonidas-Mark-Jason-Patrick-Moore-

    McGonigal ater obtaining a grand jury

    indictment against him.

    She told me that she couldnt prove

    that the Leonidas-Mark-Jason-Patrick-Moore-

    McGonigal she had arrested last year wasthe same Leonidas-Mark-Jason-Patrick-Moore-

    McGonigal that was arrested in Brazoria

    County some 25 years ago, even though he

    had ngerprints taken both times.

    Apparently, I was supposed to accept

    that as a legitimate answer, but i theres onething that gets my attention, its somebody

    selling me baloney or being over-the-top

    stupid. McMinn is either a ull-on baloney

    salesperson, or the absolute dumbest person

    to ever walk the earth. You decide.

    Either way, I think the voters o GuadalupeCounty have to replace her next time around

    with either someone more honest or less brain-

    damaged. (And i youre going to bemoan the

    act that Ive described her as either stupid or

    dishonest, eel ree to berate me with any third

    possibility at [email protected].)Anyway, lets move on. Now that we know

    what lawyers are or to clariy or conuse

    lets talk about the latest lawsuit the City has

    us involved in, the one against current Texas

    Attorney General and-probably-next Governor

    o Texas, Greg Abbott, and my conversationwith our City Attorney, Val Acevado, about it.

    See, theres this otherlawsuit pending, the

    one ormer District One Councilman Richard

    Zapata has against the City. He wants to get

    his hands on ormer City Manager Michael

    Morrisons emails, as he is entitled to underexisting Attorney Generals opinion.

    Morrison and the rest o Council decidedagainst complying with that opinion, and now

    Zapata has to take them to court, at his expense,

    to get them to. This shouldnt come asa surprise to anyone that has lived

    in Texas Most Corrupt City

    or any length o time. Its justhow things are done here.

    Heres where it gets reallygood: The Houston-owned

    Herald-Zeitung requested thatthe City provide them with a

    copy o Zapatas settlement demands,because, according to reporter GregBowens Tuesday HZ piece a tipster saidthe demands would prove interesting.

    O course, the only people with knowledgeo what those demands were at the time wouldhave been somebody in or connected to theupper echelons o City Hall, or perhaps CityCouncil. As weve seen beore, with DistrictFives Bryan Mirandas relationship withKathleen Kruegers Kitchen Cabinet, there is arecord o in-house inormation fowing reelybetween certain members o Council and theoutside world. So, you know, history and all.

    Anyway, the HZ requested the ino, andthe City decided they didnt want the HZ tohave it. So the City asked the States AttorneyGeneral or permission to withhold it. (EditorsNote: Welcome to our world, HZ.) Muchto City Halls dismay, the AG denied thatpermission, and told the City to give the HZwhat they wanted. So the City did what anyreasonable entity would do once theyve beentold to comply with the law: They sued the AG.

    So I called up City Attorney Val Acevado

    to ask her a ew things about the case and thequotes attributed to her in the Herald-Zeitung.Now, the number one excuse lawyers andpoliticians use to deend themselves againstjournalists is Youre taking me out o context.In an eort to put Acevados comments inabsolute, unimpeachable context, wereprinting the conversation word-or-word. Noediting o any kind. We join the interviewat the point where we address the Richard

    Zapata case. See i you can ollow this:City Attorney Val Acevado: it was

    Zapatas attorneys, you know, who had since,kind o uh, threw out an idea there aboutsettling or, you know, certain dollar gures,and Im telling you this, Mike, but thats, thatsnot o the, on the record, I dont, I dont, youknow, and I know Greg will run with, with thedollar gures and, and, and those kinds othings, but I think that, um, itll be taken outo context, and itll be tainted, in a way that isinaccurate, you know?

    whats in those, in those emails. I mean thats

    something that Zapata entrusted his attorney, to

    relay, you know, settlement oers to us, and then

    our client, you know, had responses to those,

    and those are things that should be sacrosanctand, and should be kept condential or the

    protection o, o uh, o that rule o evidence.

    When you do have those discussions

    you dont want those things to come back and

    be used against you. Um, and that could be,

    uh, at least play out in the media in a way

    that, you know, unavorable or, uh, one o the

    parties or both o the parties.

    Mike Reynolds: According to the Herald,you had an agreement with Zapatas attorneys

    not to disclose this inormation.

    Val Acevado: No, no, no, no. The emails

    or the documents that Greg Bowen was seeking

    are emails, um, rom and to Zapatas attorneys,

    and they were settlement discussions that, that

    they began with us, and we were responding to.

    The Attorney General ruled that those

    emails, um, are public inormation and, uh,

    we, uh, I had not talked to the, the attorneybut, you know, she, she was very much under

    the impression and understanding that those

    were 408 discussions.

    Read that again. Acevadodid not speak

    with Zapatas attorney, but knows that the attorney

    was very much under a certain impression and

    understanding. #psychiclawyer

    Mike Reynolds: Ok, so, what I have here

    is a quote rom you, in the Herald. It says Both

    Zapatas attorney and us agreed that those

    are typically condential. (sic)

    Val Acevado: Yeah.

    Mike Reynolds: So you had an agreement

    with Zapatas attorney.

    Val Acevado: Um um, no, I wouldnt call

    it a contract agreement, but an understanding

    as attorneys that those are Rule 408 discussions.

    Note: We didnt call it a contract agreement

    either. This is called changing the premise inthe world o rhetorical tricks. Nice try, though.

    Watch how we now attempt to agree on what

    agreed means. #clinton

    Mike Reynolds: Well it says here you agreed.

    Val Acevado: Yeah, I know.

    Mike Reynolds: So you talked to them

    about it.

    Val Acevado: When we were negotiating,

    sure.

    Mike Reynolds: No, no, no When Bowenwent and looked or the inormation. You made

    an agreement with Zapatas attorneys.

    Va Aceva o: Nooooo, no, no, no. No, no.No. And thats what, whats, I guess its dicult

    or people to understand, but i you read the

    Texas Rules o Evidence, Rule 408, discussions

    and communications between the parties, when

    theyre discussing possible settlementsMike Reynolds: Um hmm

    Val Acevado: you know, should be kept

    condential.

    Mike Reynolds: Well, I know that they

    cant be entVal Acevado: No.Mike Reynolds: I know they cant be

    entered into evidence. What Im talking

    about here is, you have a quote. Did Bowen

    misquote you?

    Long, awkward pause.

    Val Acevado: Did Bowen did what? (sic)Mike Reynolds: Did Bowen misquote you?Long, awkward pause.

    Val Acevado: No. No.Mike Reynolds: It says here you had an

    Val Acevado: We, we agreed you

    could say understandingMike Reynolds: Well, what it says is Both

    Zapatas attorney and us agreed that those

    that you talked to them about this. Thats the

    only way you can have an agreement.

    What I see here is that it says you agreed.Val Acevado: Right. We agreed, were on

    the same page. We have an understanding.

    Val Acevado: Ummmmmmmm whenthe discussions were ongoing, back

    several months ago when there were these

    things, these discussions occurred, at that

    time it was with the understanding between

    our attorney and Zapatas attorney that those

    were Rule 408 discussions. And attorneys

    know what that means.In other words, not an agreement, just an

    assumption. I wish shed just said assumption

    in the frst place. We could have avoided thiswhole discussion.
