Can Ban UpdateWell the big news this week is that the disposable container ban made its way to Judge Don Burgess, the travelling judge out of Beaumont assigned to the case after all of our local judges recused themselves from it. One recusal, that of Judge Boyer, was prompted by the fact that Boyer is a former Mayor of New Braunfels, while the rest were likely brought on by a general feeling of “I really don’t need this #### in my life.”
Anyway, things didn’t go very well for the City, whose case has been weak from the get-go. They’ve had to rely on stalling tactics to keep the ban from going before a judge for as long as possible, employing maneuvers ranging from multiple appeals on standing to simply not showing up with the right paperwork. These delays are a cash cow for the City’s lawyers, who travel in packs of three, each at a rate of at about $300 an hour.
On Monday, those three lawyers, along with two City Attorneys, were shot down, again, in favor of the Tourist Associated Businesses of Comal County (TABCC) and their lone attorney, Jim Ewbank.
Judge Burgess granted the TABCC its Motion to Compel the City to name everyone who worked on the ordinance (which outlaws food and beverages in original packaging on the rivers). The City claimed that only former Watershed Manager Nathan Pence and Interim City Manager Robert Camareno had a hand in it, and nobody, including the judge, was buying that.
I laughed so hard when I heard the City’s argument that I spewed sweet tea out of my nose. Burgess actually said that the idea that only two people were involved in writing the ordinance “belies common sense”. No word on what beverage might have shot out of his nose.
The City had also withheld a number of documents that TABCC had requested, citing privilege. Burgess ordered those docs turned over to him, so he can decide which are relevant and admissible. The City had also failed to cough up a number of docs which they had already agreed to provide – that move always miffs a judge – and was ordered to produce them by August 9. Don’t be surprised if it turns out “the dog ate them”.
No court date has been set as of press time, but it’s looking like the second week of December. We’ll keep you posted.
Miss TX CitizenLast Friday, Brooke Heithoff was named history’s first Miss TX Citizen in front of an absolutely packed house at the Phoenix Saloon. The event was a
fundraiser for New Braunfels Puppy Playland, and after all the
post-event donations were factored in, raised over $3,500 toward the construction of a “free range” dog park right here in NB!

4th of July weekend! The time we celebrate our independence and freedom and show off our grilling skills. Oh, I know! Burgers, hot dogs and fresh watermelon will be present at every picnic table in town. They’re traditional and sure crowd pleasers, but how do you bring something different to the table… so to speak? How do you do something so extraordinary that your family and guests will be talking about you and your explosive culinary creativity way past Labor Day?
Tequila Sunrise Shrimp and Cilantro Lime Rice
Not only is this dish a fireworks show in your mouth, but its presentation is visually stunning and guaranteed to have everyone saying, “Ohhh!!! Ahhh!!! So, mix yourself a pitcher of margaritas ladies, because here we go!
• 1lb.freshjumboTexasgulfshrimp• 3tblsoliveoil• 1jalapenopepper,finelychopped• 2clovesgarlic,finelychopped• Zestof1lime(retainlimeforjuice)• Koshersalt• Freshlygroundpepper• 1tblsunsaltedbutter• 4tblschoppedpurpleonion• 1cuporangejuice• ¼cuptequila• 1tblsgreenonions,finelychopped
In a medium bowl, mix oil, half the jalapeno, half the garlic and lime zest. Season with salt and pepper to taste. Add shrimp, stir & coat, cover, refrigerate and let marinate for 15 min. to an hour. In a shallow saucepan, combine remaining jalapeno, garlic, butter, purple onion, salt, pepper and sauté. Add orange juice and tequila. Bring to a boil, reduce heat to medium, and cook until mixture is thick and syrupy. Reduce heat to simmer and keep warm while you prepare the rice.

Now, hand your man a cold beer and gently push him away from the charcoal or gas grill for a few minutes. Using tongs, place shrimp over medium high flame or coals and grill until opaque, about 3-4 minutes on each side. Remove shrimp from grill and return control of the fire to your man. Toss grilled shrimp into warm sauce.
Using more fresh lime juice, moisten the rim of a margarita glass and roll it in a shallow plate of my signature Citrus Lime Salt (which you can order through email at [email protected]). Fill glass about half way with cilantro rice and top with shrimp & sauce mixture. Garnish with fresh chopped green onions and cilantro and place a lime wheel on the rim of the glass;repeatforeachguest.Now,pouryourselfanothermargaritafromthepitcher,sitback,relax, and let freedom ring!

Pedernales Brewing’s Classic IPA I imagine if the American craft beer scene continues the way it has in popularity, our friends across the water will get jealous in that way only the British can, envying the slightly less sophisticated, but younger and much more successful sibling. Of course, the tide will pull in the other direction some times, where we emulate ol’ Queen’s England. Heck, the whole idea of battered and fried food is a very British thing, and we certainly picked it up with gusto ourselves.
So, as with beer, especially the ever-popular IPA style, we can expect the jibes to come in a few years or so. “Oi, yew wont any beer in yer ‘oppy water?” they’ll say from beneath their top hats, casually crushing a polio-stricken orphan’s orbital socket with a sterling silver cane (I assume nothing has changed in England since Dickens.). Well, nuts to those guys! How can we not be ourselves? How can we not take a beer known to be loaded up on hops and LOAD THE HECK OUT OF THEM?
Cranking things up to 11 is our way - The American Way. England invented fish and chips, but do you think they’d ever deep fry grape Kool-
Aid and make bank on it? Not a chance. Now, to COMPLETELY contradict the spirit
of the last paragraph, let me just be the very first ever to say, “Hey America, maybe we should dial it back a little.” Now, now, before the effigies go up, I’m not saying we should become Canada or anyone else that puts royalty on their money. I’m just saying that maybe we should be more like a classy caricature of ourselves like the New York Times’ Al Hirschfeld’s, rather than a twisted, nightmareish version like Hunter S. Thompson’s Ralph Steadman (a Brit!).
Don’t take this to mean that the constant jealous ridicule from the Old Country has gotten to Uncle Sam’s favorite nephew, because it hasn’t. All I’m saying is that sometimes they might have a point, and sometimes their way could also have merit.
One such example of us toning it down a bit to take a lesson from the UK is the Pedernales Brewing Company’s “Classic IPA”. It’s interesting and unusual to see an IPA advertise itself as “Classic” or “English Style”, as it does here. For those in the know it’ll be a welcome indicator of hoppy strength, but it
may be bad if felled on deaf ears. If you’re used to the tongue wrinkling IPAs common to the West Coast of the USA, English Style IPAs will feel like a not-even-pale-ale.
Frequenters of my column will recall my much-documented distain for the whole “IBUs for the sake of IBUs” trend, so an English Style IPA is right up my alley. I had this one from a bottle, quite fresh from the brewery by all sources. It poured a nice, clear copper with a fairly retained amount of head. Very picturesque in an Imperial Pint. It had a distinct, but not aggressive nose to it, some herbal and grassy “Cascade-ish” hops and a tinge of lemony tang.
You don’t get much of the malt in the nose, but it is balanced almost scientifically well in the taste. It is slightly sweet from the barley, and has a good toasty crystal malt flavor. Mouthfeel is very thin and crisp, almost like a lager feel but without any odd yeast to change the clarity or flavor. Doubly refreshing, not just in taste and palate-slaking ability, but also refreshing to see the moniker IPA shown not as a challenge for the weak-tongued, but simply as an indicator for a hoppy, enjoyable beer.

weeks ago about whether Aztec savagery influences violence in Mexico today drew muchos responses, both bueno and malo. Here are two:
Dear Mexican: I enjoy reading all your replies and was thinking about the last reply you wrote about the violence/Aztec blood question posed to you. I grew up in Huntington Beach and am a “brown’ man” (Iranian decent). I’m currently finishing up pharmacy school in Arizona and made an interesting (to me) observation today at a gas station. The reason Mexicans are the way they are (“sketchy” or “violent” or whatever the stereotype) is due to the level of treatment they receive from their respective environment.
I’ve played lots o’ fútbol back home and worked lots of jobs where I worked side-by-side with Mexicans. What I have found is that while back home, the Mexicans still had some of Napoleanesque machismo complex complete with super pervy sexual (toma, güey, etc.) behavior. Here in this hellhole joke of a state, the Mexicans are about double the classic stereotypes that I encountered back home.
It got me thinking, and what I’ve found is that the pinche güeros here are about seven to ten times more ignorant, and this naturally lends itself to overt racism. While I grew up in bro-y, stars-and-stripes, surf Nazi punk HB, AZ seems to have beat conservative Orange County over in terms of its discrimination (as everyone knows).
This donkey’s ass level of ignorance results in a level of treatment from the white ruling class that is extremely cold, condescending, rude, arrogant and downright oppressive to the minority class which in this case is overwhelmingly Mexican. This level of intolerance of la raza I feel is what develops the combative nature of the Mexican. While this is a very simple observation, I wanted to get your thoughts on it, as I have always been very bewildered by some of the actions of the Mexicans I have interacted with throughout life.
Dear: Persie: You’re referring to internalized oppression, the sociological observation that minority groups end up
believing and acting out the very stereotypes that the dominant culture imposes on them. Such pathologies usually manifest themselves in long-established minority cultures, though;in the case of recent Mexican immigrants, blame any fulfilled stereotypes on the fact that most foreign men overcompensate their machismo to mask their pain of living among Know Nothings—and if you don’t believe me, look at Marco Rubio.
You missed an opportunity to correct a misunderstanding about the in your reply to Puzzled by Narco Violence when he describes the Aztec as “notorious butchers and cannibals.” Yes, human sacrifice was practiced by Mesoamerican cultures like the Mexica, but in the context of religious ceremonies they believed to be necessary to appease their gods so that the universe would not come to an end.
It was part of their belief system and was performed by priests in a very strict ritual and although is was done on a vast public scale, the goal was to recall the spiritual justification for the empire by its subjects. In that respect, they were not much different from their European counterparts, where public executions drew huge crowds and where the goal was to reassert the sovereign’s divine power after it had been injured by a criminal act.
The important thing is that neither society should be judged by its brutality and that in their appetite for death as spectacle they were not fundamentally different. (On the subject of cannibalism, I would remind the writer that recent evidence has proved that it was practiced in Jamestown, Virginia by the pilgrims). (TX Citizen Editor’s Note: The author is referring to the Roanoke Colony, which was in North Carolina, not Virginia, and was not inhabited by pilgrims. Ignorance, as they say, abounds.)
