the excessive noise created by motorcycles.

Subject: Building Bylaw Amendment: Access Routes

Purpose:

This report introduces an amendment to the Building Bylaw No. 1160, 2008 (the "Building Bylaw") that would

allow the access route requirements of the Building Bylaw to be satisfied by alternate and equivalent means.

The amendment was developed in consultation with the West Shore Developers Association. The objective is

to facilitate development while maintaining an appropriate level of community fire protection.

Background:

In order to gain access to buildings, the Fire Department relies on public roads and private access routes.

Those roads and access routes are built to various standards:

• Public roads are in accordance with the Langford Subdivision and Development Servicing Bylaw No.

1000, 2009 (the "Subdivision Bylaw").

• On-site access routes for large buildings, falling under Part 3 of the British Columbia Building Code (the

"Building Code"), are in accordance with Part 3 of the Building Code.

• On-site access routes for small buildings, falling under Part 9 of the Building Code, are in accordance

with the Langford Building Bylaw No. 1160, 2008.

The Subdivision Bylaw can be varied by Council by means of a Development Variance Permit. The

requirements of the Building Code cannot be varied, but can be satisfied by installations that provide an

equivalent level of performance — called "Alternative Solutions" — when accepted by the Chief Building

Inspector. In contrast, and due to limitations imposed by the Local Government Act, the Building Bylaw cannot

be varied by Council or by the Chief Building Inspector.

Because the Building Bylaw cannot be varied, there is no technical way for the City to consider development

that might not meet the exact Bylaw wording but might still be appropriate where the access route

requirements can be satisfied by acceptable and equivalent means.

Proposed Solution:

Staff explored ways to relocate the access route requirements to a bylaw that can be varied by Council on a

case-by-case basis. However, the access route requirements are technical requirements and are considered to

be necessary for a safe community with adequate fire protection; they should not be varied or "relaxed".

Therefore, staff propose a retention of the access route requirements within the Building Bylaw. To introduce

flexibility, wording changes within the Building Bylaw are proposed. The intended outcome is that Part 9

buildings served by innovative access route designs can be accepted by the City, provided that the access

routes are demonstrated by a registered professional to provide a level of performance that is equivalent to

the standard access route requirements.

This approach mirrors the "Alternative Solution" opportunity contained within the technical requirements of

the Building Code. The intention is not to relax the requirements, but to recognize that there might be more

than one way to 'skin the cat'.

Financial Implications:

There are no financial implications.

Legal Implications:

A new provincial statute - the Building Act— may ultimately regulate the ability of local governments to make

rules about fire department access routes. The province is currently working out details around the

implementation of that Act. Once settled, changes to bring all of the access route requirements in the Building

Bylaw (or wherever they might be located) into compliance with the Act will likely be necessary.

Amending Bylaw No. 1598, delineating the proposed changes to the Building Bylaw, has been prepared for

consideration. This Report and the proposed amendment to the Building Bylaw have been reviewed by legal

counsel.

Recommendations:

It is recommended that the Committee:

1) Forward this Report and amending Bylaw 1598 to Council for consideration,

BYLAW NO. 1598

A BYLAW TO AMEND BYLAW NO. 1160, "LANGFORD BUILDING BYLAW NO.1160, 2008"

The Council of the City of Langford, in open meeting assembled, hereby enacts as follows:

A. Bylaw No. 1160 cited as "Building Bylaw No. 1160, 2008" is amended as follows:

1. By adding the following definitions to Section 1.3.3:

"CLERK-ADMINISTRATOR" means the person appointed to that position by the Council of The

City of Langford and any other employee of the City authorized by the Council to act on behalf

of the Clerk-Administrator."

2. By amending Sentence 5.3.1(1), adding the words: "Except as provided in Sentences (3) and (4),"

before the word "every".

3. By adding Sentence 5.3.1(4):

5.3.1 (4) Where an access route cannot be provided in accordance with any requirement of

Sentence (1), a permit may be issued where documentation prepared by a registered

professional has been provided to demonstrate that the access route will achieve, by

alternate means, at least the minimum level of performance defined by the

requirements of Sentence (1), as accepted by the Clerk-Administrator.

B. This Bylaw may be cited for all purposes as the "Langford Building Bylaw, Amendment No 7, 2015".
