The Populists con- tributed some spirit to the pro- : -edings. Some of them were in a decidedly convivial frame of oind, and they gave Republican factions several severe shocks by speaking the first name of either Sweet or Shoup and then, after a painful pause, calling out in a ioud voice, Clagett !But it was Representative Ben- nett, of Owyhee, who created a genuine commotion. Bennett has voted for Sweet from the first. When it came his turn to vote yesterday he arose in his place and solemnly asked the presiding officer if he would be permitted to explain his vote. Being answered affirmatively, he proceeded, in eloquent terms, to eulogize the man for whom he intended to vote. Praise was heaped upon praise. The Shoup men. believing Bennett was about to vote with them nodded their approval at the end of each well rounded sentence. On the other hand, the Sweet men, Other thinking the speaker surely in- tended to leave their favorite, experienced a most peculiar sen- sation in the vicinity of their vest pockets. Their counteoan- ces gave indisputable evidence of that feeling so much talked of. Bennett brought his speech to an abrupt termination by an un- ostentatious remark that he in- tended to vote for Willis Sweet. L ke a flash the conditions were reversed. The Sweet men smiled faintly and leaned back in their chairs as though over- came by the severe mental strain. The faces of the Shoup men dropped to 10 below zero. Tne vote was : Shoup, 19; Sweet, 18; Clagett, 15; paired. Brown and Hunt. In the House. McCarthy, of Custer, called upon the educa- tional committee for a report on his Challis school of mines bill. He stated the reason for the de- lay was that two of the members of that committee (Gamble and Randolph) were from county, and they were opposed to any measure tending to inter- fere with any branch of the state university. He asked the speak- er to remove one of the Latah members from the committee. The speaker held he had no authority to remove any member of a standing committee without being instructed by the house to do so. McMillan, of the committee, said when McCarthy learned an adverse report was about to be made he requested that the re- port be deferred. McCarthy explained that there was an unconstitutional provis- ion in the bill and he had asked that the report be deferred in or- der to make the necessary cor- rections. He asked the speak­er to remove one of the Latah members from the committee.

The speaker held he had no authority to remove any member of a standing committee without being instructed by the house to do so.

McMillan, of the committee, said when McCarthy learned an adverse report was about to be made he requested that the re­port be deferred.

McCarthy explained that there was an unconstitutional provis­ion in the bill and he had asked that the report be deferred in or­der to make the necessary cor­rections.

On motion of McCarthy the hill was taken from the hands of the educational committee and referred to the committee on mines and mining.

BALL It is said that Senator Dolph was anxious to hurry back to Washington as soon as he was re-elected, and requested the secretary of state to make out in advance his certificate of election and have it ready for signature and acknowledgment upon the ballot being cast in the legisla­ture. He had no doubt of being returned and had his private car. which is furnished him by the railroad company, all victualled and ready for the trip east. That certificate has not yet been made out and the anti-Dnlph faction has been cruel enough to poke fun at Mr. Dolph about that lit­tle slip between a caucus nomin­ation and an election.
