The latest real estate fi gures to be published show that home and mortgage sales jumped as homebuyer confi dence strengthened and mortgage delinquencies stabilised.

With the Reserve Bank keeping offi cial interest rates on hold, property sales across the nation were 10.9% higher than in July, the fi gures from the Australian Finance Group (AFG) show.

And for the second consecutive month, sales to fi rst time buyers climbed from 9.5% of the market in June to 11.7% in August.

Australia’s biggest mortgage broker said fi rst time buyers share of the mortgage market bottomed at 9.5% in June, before climbing to 11.1% in July and 11.7% in August. The trend was strongest in New South Wales with sales to fi rst time buyers making up 15.5% of all sales, up from 11.7% in June.

‘We now have two months of data which show that fi rst home buyers are coming back,’ said Kevin Matthews, executive director for mortgage broker AFG.

The report also shows

greater competition between lenders on price and policy and increasing loan to value ratios that are supporting both entry level home buyers as well as property investors.

Matthews also said the impact of the government grants, which had the effect of bringing forward fi rst time buyer demand, seemed to have ‘washed through the system’.

‘With property prices in many areas having stabilised, and some lenders prepared to lend up to 95%

of the property’s value, property is becoming more accessible to fi rst home buyers and more attractive to investors,’ he explained.

Property investor activity varied across the states, with New South Wales and Victoria topping the market. Almost 37% of all mortgages sold in New South Wales came from investors, while in Victoria they accounted for 36.4% of all the sales. By comparison, investor

confi dence in the mining states of Queensland and Western Australia remained weak, largely due to the uncertainty over a possible mining super tax.

The index also revealed that buyers preferred to take out their mortgage loans with non-banks. Although still accounting for the lion’s share of mortgage loans, bank loans have dropped

from 92.5% in the fi rst quarter of 2009 to 87.5% in the second quarter of 2010.

Over the same period, the non-banks have increased their share from 7.5% to 12.5%.

Confi dence among homebuyers is upbeat and is now above 2008 levels but has yet to surpass 2009 levels, according to lenders mortgage insurance provider Genworth Financial.

Home sales across the nation reached 6,269 during August, 10.9 per cent higher than in July, as fi rst home buyers continued to return to the market, according to Australian Finance Group Ltd (AFG).

Under the Residential Tenancies and Rooming Accommodation Act 2008 lessors must ensure the premises and inclusions are maintained “in good repair”. What this means is that if lessors have provided a television antenna that receives transmissions at the start of the tenancy, then that should be maintained throughout the entire occupancy. This however does not necessarily mean that the lessor must automatically upgrade systems or include enhancements such as cable installations.

According to the Australian Federal Government’s digital ready website, many existing

antennas will be able to receive digital transmissions without any problem. In some cases, an antenna will need to be upgraded because the new digital channels are in a new frequency band or because the antenna is older or not in good condition.

For existing tenancies, if an antenna cannot receive digital signals and the analogue service is to be turned off, the most appropriate option is for the parties involved to negotiate about the enhancement or replacement of the antenna.

Ultimately, if no agreement can be reached and a tenant considers there has been a breach of the agreement, then they can apply for dispute resolution assistance and if unresolved an application can be made to the Queensland Civil and Administrative Tribunal for a decision about the matter.

Digital television is coming...What it means for landlords

The Australian Federal Government is preparing to shut down analogue television broadcasts in favour of digital. So what are the legal obligations a lessor must meet to ensure the rental property’s antenna can pick up digital signals? The answer to this question is not clear cut.

While the big banks were most likely to do deals on everything from loan interest rates to transaction account fees, they still fi nished at the bottom of an annual customer satisfaction survey compiled by Choice.

For home loan customers, ANZ offered one or more improvements to the least number of customers, 59 per cent compared with 64 per cent for the Commonwealth Bank. However, it did come equal fi rst for offering a discounted interest rate.

A Choice spokesman, Christopher Zinn, said small discounts on interest rates could make a substantial difference over the life of a loan.

‘’A 1 per cent decrease on a $400,000 mortgage will save you more than $75,000 over 25 years, so it really does pay to ask.’’

Interest rates are forecast to rise next month, so customers should research other loan products and see if their bank would match them, Mr Zinn said.

More bank employees were empowered to cut a deal to keep someone’s business, he said, ‘’and it’s a case of asking the right questions of the right person’’.

Another battleground is savings accounts, where increased competition from new and smaller players has pushed interest rates up and fees down.

The big banks, led by Commonwealth Bank and Westpac, were most likely to cut fees, but 30 per cent of customers still walked away empty-handed. Credit unions were less likely to offer reductions on fees and interest rates

The industry body for the mutual banking industry, Abacus, said homeowners could save more than $30,000 by choosing a credit union or building society for their loan.

Taking a few steps involving relatively minimal expense and time can help maximise the return on your asset. Here are fi ve ways to potentially add value to your house.

Declutter and clean upProperty consultant Peter Rogozik says there’s nothing worse than walking into a room “full of boxes, bric-a-brac and unwanted furniture”. He advises a minimalist approach and notes

that if you have items that you want to keep but that tend to make things crowded, consider putting them in storage during the marketing campaign. Clean up the outside of the property as well as the interior; ensure the lawns are trim and garden beds are neat; and get rid of any rubbish lying around, including in sheds. “I’m amazed how many times you

do see old tyres, engines

and all sorts of rubbish lying around and it really detracts from the whole property,” Mr Rogozik says.

Carry out maintenanceProperty consultant Peter Hay sees this an essential part of creating the right impression for buyers — that a house has been well maintained and much loved. “Make sure

all the general maintenance has been done so doors swing freely and close properly, there are no cupboard doors that don’t close [and] the windows open and close properly,” he says. Mr Hay believes a well-maintained property achieve a premium over a poorly maintained one. Again, this also extends to the exterior — make sure fences are in good order and garden gates aren’t hanging off the hinges.

Spruce up the kitchen and bathroomUsually a focus for buyers, it’s important to make a good impression in these rooms. The general rule is to resurface and recoat rather than replace. In the kitchen, this can mean applying a coat of paint to the walls, changing the cupboard handles and resurfacing benchtops. In the bathroom, tubs and other fi ttings

such as vanity basins can be resurfaced if they’re worn or in an undesirable colour. Neutral colours are a good idea. Valuer Peter Buchanan says paying attention to the bathroom and kitchen is worthwhile but suggests seeking expert advice. “I’m a big believer in using experts ... even for cosmetic updates,” he says.

Pay attention to the facadeFirst impressions count so it is wise to pay extra attention to the fi rst part of your property that a potential buyer sees. This might involve reinstating period features that have been removed, such as lacework on a verandah. “It puts back the character and it puts back the period charm,” Mr Rogozik says. He recommends adding a nameplate, particularly to a period property, which can add as much as $5000 to your returns. Other value-adding touches include brass numbers and door knockers, leadlight and a new coat of paint. But make sure any additions are architecturally consistent with the period.

How the upcoming Queensland swimming pool safety legislation will affect youStage two of the new pool laws will come into effect – 1 December 2010 - new and existing poolsNew pool safety regulations will come into effect 1 December 2010. They will target new and existing indoor and outdoor pools associated with houses, residential units, hotels, motels, caretaker dwellings (class 1–4 buildings, see over) and caravan parks.

The regulations are the second stage in a two-stage pool safety improvement program. Stage one came into effect on 1 December 2009 and applies to new outdoor residential swimming pools.

A person will be unable to sell or lease their property until the pool safety barrier has been inspected and a compliance certifi cate issued. Research shows that there is a higher risk of a child drowning within the fi rst six months of moving into a new home, with rental properties posing a greater risk. Inspections will be undertaken by a licensed pool safety inspector.

Who is responsible?Redefi ning the responsibility of ownership of the swimming pool and spa: from home owner to pool owner.The pool owner is generally the owner of the land. The owner of the

property is responsible for ensuring their pool fence is compliant.

Tenant renting property with a swimming poolIf a person renting a property buys a portable pool they are considered to be the pool owner and must ensure the pool is fenced.Tenants are responsible for ensuring that the gate is not kept open and that there are no objects that would allow children to access the pool.

CPR resuscitation signA pool owner must ensure that a resuscitation sign showing the current procedures approved by the Australian Resuscitation Council for CPR and for providing fi rst aid is displayed near the pool. (See Fig 1.)

Does the new legislation affect pools and spas other than residential?Hotels, motels, holiday accommodation and other accommodation of a transient nature will have the same requirements, however will be managed in a staged approach.

• extend pool safety laws to class 3 and class 4 buildings (e.g. hotels, motels and caretaker residences)

and caravan parks

• remove the exemption for indoor pools

• require pool safety certifi cation at the sale and lease of class 1–4 buildings and caravan parks.

• local governments would be required to inspect pools in body corporate buildings where the body corporate failed to produce a pool safety certifi cate to enable a sale or lease to proceed.

What is required under stage 2 measures? Under the stage two measures, 12 different pool safety standards and over 100 local government laws were simplifi ed into one standard, making it easier for Queenslanders to understand their responsibilities.The stage two measures also include:• pool owners would be required to

provide pool safety certifi cates at the time of sale or lease

• upgrade pools to whatever safety requirements are current at the point of sale or lease

• fence portable pools that are 300 mm or more deep

• phase out child-resistant doors

forming part of the safety barrier• remove pool barrier exemptions

and variations granted by local governments so that all pools meet the same safety standards

• fi ve years to meet new pool safety standards unless they sell or lease the property fi rst.
