On the one hand, thepublic has put in billionsto stop the bank goingdown completely andthey should be paidback first. On the otherhand, it was the previousboss of the bank thatgot it into such a terriblestate so why shouldStephen Hester who haspretty much done whathe was supposed to dobe penalised – especiallyas it was part of hisoriginal deal when hetook on what must bean incredibly difficultand stressful job? It tookhim three days to decidenot to take the bonus,under enormouspolitical pressure, butdecline it he did in theend.
The problem is, if Britaintakes on people to do acertain job at a certainprice then says, prettymuch: “Ah, yes, well weknow we said that then,but now, well, we thinkwe shouldn’t actuallygive you that after all,”what is going to happenis that the people whocan turn the businesses,and therefore thecountry round are goingto say a probably-not-very-polite “up yours”and go to the States,Canada, Australia, newZealand, in fact,anywhere that will valuethem more than Britain.Personally, I am in twominds still aboutwhether he should havetaken the money or notbut, if offered a job withthose conditions, about99% of people wouldhave kept it like a shot!

Spanair collapse won't be investigatedSources at the CGT union saidSpanair employees werewarned of their fate by emailand some workers wereprevented from entering theairline's facilities after theannouncement was madeFriday afternoon.
Some 22,770 passengerswere left stranded overweekend and as many aspossible were put onalternative flights operatedby Vueling, Air Europa,Lufthansa and Iberia. Spanair
had built up a debt of over€300 million, includingvarious loans from theregional government, itsmain shareholder, which isalso facing a financial crunch.The collapse came after QatarAirways withdrew fromtakeover talks, ending anyhopes of further financing.The airline was once ownedby Scandinavia's SAS Airlines,which still has an 11% stake inthe firm. It was bought out bythe former regionalgovernment in 2008.

Basque Country, instead ofall round Spain, the ministersaid the “only roadmap isthat of applying the law” andthe prisoners' cases wouldbe dealt with individuallyand not en masse.Fernandez Diaz said only 30ETA prisoners had called on
the group to disband andthat the rest (over 700) stillfollowed orders from thegroup. In view of recentarrests of ETA members inFrance and Spain, theminister said the securityforces did not intend tolower their guard.

Since lastJanuary the Guardia Civiland Customs Police haveseized more than 740,000cartons of cigarettes inoperations in Santa Cruzde Tenerife, Seville,Madrid, Barcelona and
Galicia and arrested morethan 30 people for taxevasion. Meanwhile,tobacconists sold 3,015million packets ofcigarettes last year, downfrom 4,514 million in 2008.“We're both selling thesame cigarettes,” onetobacconist said. “It's justthat the smugglers aren'tpaying the taxes.”

The law is aimed at crackingdown on websites thatillegally share digitalcontent. Called the SindeLaw after the former cultureminister, it will create a newgovernment commission todeal with appeals by
Spanish copyright-holderswho feel a site is illegallydistributing their contentwithout their permission.Complainants mustidentify the owners of thesite infringing theircopyright and present the
content and links. Theowners of the websites willhave three days to presenttheir defence to thecommission.
If the commission ordersthe removal of the content,
internet service providers(ISPs) will have 24 hours toblock the service or removethe content. The websiteowners will not be able toappeal. If they fail to removecontent voluntarily, a courtwill intervene to close down
the website or block theservice, requiring ISPs toreveal the identity of theinfringers. A governmentspokesman said the entireprocess should take nomore than 10 days. Unlikethe SOPA Act (Stop Online
Piracy Act) currentlymaking its way through theUS Congress, which targetsinfringing websites andusers, the Sinde Lawfocuses only on those whoare making money fromcopyrighted content online.

accused of receiving giftsfrom the Gürtel network ofbusinessmen who arecurrently facing charges ofbribing PP officials inValencia, Castilla-LaMancha and Madrid inreturn for public contractsworth millions of euros.Francisco Correa, the jailedalleged ringleader of Gürtel,gave evidence in the trial
against Camps and Costa.The Gürtel case erupted in2009 when High CourtJudge Baltasar Garzón blewthe lid on the network.Garzón was tried last weekin the Supreme Court fortapping telephoneconversations betweenjailed Gürtel suspects andtheir lawyers. The court hasyet to reach a verdict.
Camps notguilty ofcorruption
Justice minister AlbertoRuiz-Gallardón revealed aseries of proposed legalreforms during his firstappearance in parliamentlast week, which were notentirely unexpected. Theyincluded a modification ofthe abortion law passed bythe previous Socialistgovernment to eliminate acontroversial clauseallowing minors aged 16 to18 to seek abortionswithout their parents'consent.
The minister also wantsto raise the charges forcourt appeals. Otherproposed reforms includewhat the minister called“reviewable life sentences”in response to a growingdemand for life sentences
to really mean that ratherthan a maximum of 20years, a change in thesystem used to electmembers of the GeneralCouncil of the Judiciary(CGPJ), reforms to theMinors' Law and theintroduction of a system ofrevisable detention thatequates to a form ofwhole-life sentence. Amodification of the same-sex marriage law was not
on the minister's list,leaving open the questionof whether or not PrimeMinister Mariano Rajoy,who is opposed to single-sex unions, plans to revokethe law entirely.
Gallardón said he wouldseek consensus on thereforms, but with itsabsolute majority, the PPwill be able to push themthrough.

The number ofunemployed rose to 5.3million in the last quarter of2011, according to figurespublished by the NationalStatistics Institute – upfrom 4.9 million in the third
quarter. The new figuresshow more than half of all16-24 year-olds are jobless –51.4% compared with45.8% in 2011. Spain’sjobless rate of 22.8 per cent– the highest in the 17-
nation eurozone – is morethan twice the averageunemployment rate of theeurozone, which stood at10.3% in November,according to data releasedearlier this month.

Crown Prince Felipe andPrincess Letizia visited thetown of La Restinga, themost affected by theunderwater volcaniceruptions off El Hierro, thesmallest of the CanaryIslands on Monday in aneffort to boost tourism,which has dropped to zerosince the eruptions beganlast October. The Prince had visitedthe island in 1995 duringthe filming of the TVEdocumentary 'La Españasalvaje' at the Centre forthe Recovery of the GiantLizard, and again in 1997.It was Princess Letizia'sfirst visit.

Mikael Davud, a Norwegianfrom China's ethnic Uighurminority who had links toal-Qaeda, was jailed forseven years. An Iraqi Kurd,Shawan Sadek Saeed Bujak(pictured), was given three-and-a-half years. Anotherman, David Jakobsen, was

UK Prime Minister DavidCameron said hisgovernment would act ifthe treaty threatened UKinterests, saying he still has"legal concerns" about theuse of EU institutions inenforcing the fiscal treaty.

compliance and imposefines on rule-breakers.

European Unionleaders also discussed waysto stimulate economicgrowth despite thestringent austerity budgetsin many countries – andfocused on how to reduceunemployment across theeurozone. The European
Commission said €82billion of EU money isavailable for countries tospend on projects to boostjobs and growth.
The eurozone crisisdominated Monday'ssummit, with debt-ladenGreece still at risk ofdefaulting. A general strikein Belgium, paralysingtransport, reminded EUleaders of public discontentwith austerity as theyarrived for the summit.

The Syrian governmenthas rejected the Arab Leagueplan, which would see MrAssad's deputy forming anational unity governmentwithin two months.

Justice Secretary Kenneth Clarke has unveiled plans for a newinitiative to stop criminals from claiming from the Criminal InjuriesCompensation scheme for injuries and psychological damages aspart of refocusing the tax-payer funded scheme.
Under the present rules,criminals who are servingprison sentences havebeen claiming huge sums –with more than 20,000claimants with criminalrecords receiving £75million over the last tenyears. Almost £300 millionwas paid out during theyear spanning 2010/2011.
Inmates, includingSoham murderer IanHuntley, have claimedcompensation after beinginjured by others. The killerof schoolgirls Holly Wellsand Jessica Chapman(pictured right)made the£100,000 claim, saying thePrison Service failed in itsduty of care towards him,after he had his throatslashed by another inmatein March 2010. He needed21 stitches in the seven-inch wound and blamedprison staff for notprotecting him sufficientlyagainst such attacks. Hisassailant, prisoner DamienFowkes, was said to have a
pathological hatred of childkillers and had also killedanother inmate bystrangling him.
The Ministry of Justicproposals should alsoreduce the long backlog ofcompensation claims sinceif they are adopted onlythose who are “blamelessof crime” would be eligiblefor a payout – criminalswould no longer be eligible– meaning that victims ofcrime would get theircompensation sooner.
The government alsowants to make thecriminals pay for theircrimes through the “victimsurcharge” scheme. Thatmeans that those whocommit the crimes will bere-imbursing the victimsupport services for thepay-outs. Money will bededucted from whatever“wages” they receive whileworking in prison with theaim of raising an extra £50million from offenders
instead of from taxpayers.
The new scheme wouldsee the victim surchargeraised from just £15 to £120for every offender. At themoment, the levy onlyapplies to those given finesin court.
Mr Clarke is alsoplanning to increasespeeding fixed penaltyfines from £60 to £100, withthe £5,000 cap on fineswhich can be levied bymagistrates' courtsremoved.

gambled away the cash butCity watchdog, theFinancial ServicesAuthority and its Swisscounterpart, are askingwhy UBS failed to spot thefraudulent trading. Aprovisional trial date hasbeen set for September 3rd2012 and the proceedingsare likely to be lengthy.Adoboli of Clark Street,
East London worked for thebanks global syntheticequities division buyingand selling exchangetraded funds which trackdifferent types of stocks,bonds and commodities,including metals. He isaccused of using hisposition at the bank forpersonal gain and exposingthe bank to losses orcausing them losses.
As the pre-trialarrangements wereannounced, he sat forwardtaking notes. He isrepresented by Paul GarlicQC of Bark and Co who arefamous for specialising infraud cases. Last year fraud reached
an all time-high in the UKaccording to KPMG’s FraudBarometer – reaching anastonishing £3.5 billion.

Ministerial meetings withthe chaplain, the VenDavid Sutch, andchurchwardens Mrs DellaMarshall and Mrs NoreenFrew on Friday morningwere quickly followed bythe social highlight of theweekend a Burns’ NightSupper! This was the firstBurns’ Supper thatBishop Geoffrey had everattended. The bishopparaded the haggis, led bypiper Leslie Thompson,and, following BillyDawson’s eloquent
address to the haggis,downed his malt whiskyfrom the ceremonialquaich. Billy Dawson,who hosted the event,proposed the toast to theimmortal memory ofRobert Burns. The VeryRevd Alan Woods,formerly Dean ofGibraltar cathedral,proposed the toast to thelassies and Mrs DellaMarshall replied onbehalf of the lassies. RoyAlan, of the Nelson MusicAcademy, provided
background musicduring the evening andled the diners in severaltraditional Scottishmelodies. The eveningraised 1925� forchaplaincy funds.Despite the late night
Saturday brought norespite for the bishopwith the morning spent ata chaplaincy councilmeeting. This enabledhim to hear first-hand ofthe problems andsuccesses of the laypeople from every
worship centre who givetime and energy to keepthe chaplaincyfunctioning. The bishopcommended all membersfor their loyalty and hardwork. The meetingconcluded with a sharedlunch to which membersof the ministry team wereinvited, thereby enablingthe bishop to meetinformally with manypeople.Sunday was
Confirmation Day. StAndrew’s Church was full
to overflowing and extrachairs had to be found toget everybody in. It wasgood to have people fromall the scatteredcongregations of thechaplaincy worshippingtogether on this joyfuloccasion. Welcomingthem into the church thebishop confirmed ShirleyBarber, GloriaButterworth, DorothyBuckley, Sarah Farrand,Cristina Gomez-Linderand EmmanuelUmeojiaka. The service
concludedwith the bishop re-licencing PeterHammond, Jim Marshalland Bill Oliver ascongregational worshipleaders. After the service the
bishop met with many ofthe congregation during asumptuous bring-and-share lunch.
This was, for allconcerned, a busy,enlightening and fulfillingweekend.

During a visit toBenalmadena last week,the head of the Junta deAndalucia's Innovationand Science department,Antonio Avila, announcedthat the €2 million projectto build an ITV station inthe town would soon bepublished in the Junta's
Official Gazette, afterwhich construction wouldgo ahead. Mayor JavierCarnero announced that itwould be built on land inthe Santangelo Norte area,near the A-7 exit in Arroyode la Miel. He said biddingfor the project should take10 to 12 months. The

National Police arrested amarried couple in PinosPuente, Granada province,on charges of supplyingdrug dealers after findingmore than 400 marijuanaplants in fourgreenhouses.
The couple had tappedinto the public electricitysupply to light thegreenhouses. The policealso seized €46,000 in cashduring the raid. They hadbeen investigating the
couple for the past threemonths. Police alsoarrested another couple inMalaga after discovering91 marijuana plants in agreenhouse on their land.Meanwhile the GuardiaCivil seized a ton ofcannabis on the beach inEl Ejido, Almeria province.Another 19 bales wereseized at San Miguel Beachin Almerimar, also inAlmeria. One man wasarrested but the rest of thegang got away.

Fifty years on, the citycouncil hopes to attracttourists to visit the sitesBox chose, after decidingthat conditions in Jordan'sdesert – extremetemperatures, frequentsand storms, inadequatelodgings for the film's stars– where he had started outmade filming too difficultand sent production costsway beyond producer SamSpeigel's original budget.
Box checked out otherSpanish cities but settledon Seville because of itsvariety of historicalbuildings which fittedperfectly into the film. Heused Almeria for the desertscenes. He was able torecreate four Arab cities inSeville.

Isuspect that High Court Judge BaltasarGarzon’s “brilliant career” is finallygrinding to a halt. He’s currently in the
dock for the third time, facing charges ofbribery for allegedly accepting money fromthe Banco Santander to organise somelectures in the US while he was on asabbatical year at New York University.Allegedly he shelved a tax fraud case againstSantander CEO Emilio Botín in return. If hisaccusers make this one stick, he faces a jailterm. In the first case, he admitted havingordered the tapping of telephoneconversations of suspects jailed for theirpart in the so-called Gürtel corruption caseto prevent them from salting away their lootabroad. In the second case he is accused offlouting the 1977 Amnesty Law by orderingan investigation into crimes committedduring the Franco dictatorship. Althoughthere were rumours that this case could bedropped because, as things stand, it doesn’tstand a snow flake’s chance in hell ofproceeding, the High Court has just ruledthat it can go ahead. Whatever verdicts areeventually passed down, it looks as if he’llnever practise law in Spain again. However,I’m sure they’ll welcome him in Argentinawhere the descendants of Republicans whofound refuge there after the Civil War haveasked him to take up their case against theFranco regime. No doubt he’ll be givenArgentinian nationality in record time sothat he can get on with trying Franco “inabsentia”.
Those who love Garzon see him as abrilliant crusading lawyer, anadjective that was stuck on him when
he tried to have former Chilean dictatorAugusto Pinochet extradited from the UK toface genocide charges in Spain. A lot ofpeople applauded his bold stand, includingmyself. But his detractors say that theheadlines he earned worldwide gave him ataste for “spectacular” cases andunfortunately he set a trend for a smallclique of Spanish judges. They were reinedin by the High Court a couple of years backafter they tried to open cases against top USmilitary men and a couple of politicians fortheir role in setting up the prison camp atGuantanamo Bay in Cuba and to bringgenocide charges against a couple of Israeligenerals for attacks on the Palestinians.
What many people forget isGarzon’s close association withthe Socialist Party. He was actually
elected to Parliament on the Socialist ticketin 1993 but resigned, he says, because hefelt Felip Gonzalez's government was nottaking corruption seriously enough. His
detractors say he fell out with Gonzalezbecause he wasn't given the Justiceministry. So far all of his targets – apart fromFranco – have been members of the PartidoPopular and political observers have longwondered if Garzon would pursue acorruption case involving Socialists – andthere are plenty of them out there – with thesame zeal he showed in the Gürtel case.
A lowering of tone
I’m not referring to tone as in “class” butas in decibels. I couldn’t help but noticethe difference between the Socialists and
the PP on Sunday, when Socialist Partyleader hopeful Carme Chacon hectored arally of her supporters, literally shoutingthat Rajoy should be here at home, solvingthe country’s problems instead of inGermany licking Merkel’s feet or kowtowingto the EU in Brussels. Actually, Carme, hewas there trying to restore the faith in Spainthat your beloved ex-leader lost.
Meanwhile the PP’s secretarygeneral, Maria Dolores deCospedal was telling another
meeting that the government’s economicmeasures were being well-received abroad,especially in France and Germany and bythe European Commission. She said it wasobvious that Spain now has a “seriousgovernment and a serious way of doingthings”. She also said: “It’s absolutelyincredible that the Socialists dare give uslessons, criticising the government whenthey are responsible for the situation thecountry is now in.” Without raising hervoice above a normal speaking tone, sheadded that both aspiring Socialistcontenders – Rubalcaba and Chacon – areseeking success by “criticising the PPgovernment, boycotting the government ofSpain and not offering any alternative tohelp solve the disaster they left behind”.
The problems with juriesEnd of the line
Francisco Camps says he left theValencia regional premier’s officewith the same amount of money in
his bank account he had when he firstarrived in 2003. The now-absolvedPartido Popular (PP) member gave hisfirst interview on Monday night after hisacquittal last week in the so-called “suit-gate” case. He appeared onIntereconomia’s PP-leaning political talkshow El gato al agua (The cat in thewater) where he defended hisadministration, including the €17.6billion debt Valencia owed at the end of2010. Camps says that many politicianswho come to office leave with massivebank accounts – that wasn’t his case. Hechallenged anyone, includingprosecutors, to look at his own personalwealth to see if he received one euromore than he was entitled to when heresigned last July following hisindictment on charges that he receivedsome €14,000 worth of dress suits from agroup of corrupt businessmen popularlyknown as the Gürtel network.
Ajury acquitted Camps and theformer PP secretary general inValencia, Ricardo Costa, last
Wednesday after they deliberated formore than two days over the allegationsthat both men received fine gifts from theGürtel group as improper bribes, whichby law do not correspond with theirpublic office duties. It was an almostevenly split decision – a five-to-fourverdict in favour of Camps and Costa.Despite the jury’s decision, the evidencewas there. There were receipts frommen’s suit shops that had been altered;communications among those in theGürtel network that demonstratedCamps and Costa were getting gifts fromthe suspects involved in the massivepublic corruption case; testimony fromtailor José Tomás affirming that Campsnever paid for his own suits; and tapedtelephone conversations between Costaand Gürtel’s alleged point man inValencia, Álvaro Pérez, discussing giftsand other favours. What the five peopleon that jury saw that the rest of thecountry didn’t see will remain secret fornow. Jurors in Spain are not allowed togive interviews or even be publiclyidentified. What we do know was thatthere were certain members on thatpanel who seemed disinterested in thecase and, for the most part, paid littleattention to the testimony and evidencepresented by prosecutors. According toEl País reporters who sat in that
courtroom, at least two men – both onthe front row – took more notes duringthe defence’s arguments rather than theprosecution’s presentation.
It appears now there will be an appealby prosecutors, who will demand abench trial. The problem with holding
a jury trial in Camps’ own home region isthe lack of impartiality. There are manypeople who choose not to convict one oftheir own for the sake of dignity: theyprefer not to taint the good name of theirregion or jurisdiction by condemningone of their own. The Partido Popular hasalways had sweeping victories in Valenciafor the past 16 years; there should havebeen a change of venue in the trial. Therewas no way – both the defence andprosecution could have argued – thatCamps and Costa would have gotten afair trial just based on the publicity in thecase.
Jury trials in many countries are fairand are made available to defendantsbecause they are the most
unprejudiced way to determine aperson’s innocence or guilt. But it is truethat in many nations, such as Spain, thepublic is pretty politicised and there canbe difficulties in finding impartial peopleto sit on a jury. Under common law,candidates called to serve are putthrough the “voir dire” process whereprosecutors and the defence attorneyscan single out and even object to certainpeople because of their political beliefs,prior knowledge about the case, and eventheir religious backgrounds. There is nodoubt that the voir dire process in Spainisn’t one of the strongest points in thenation’s judicial system.
After the acquittals, newspapercolumnists began screaming forwhat they called “a professional
trial” (in other words, a bench trial)rather than a jury trial. The suit-gate caseisn’t over for Camps and Costa nor arethere legal problems. There is nowsurmounting evidence that the Gürtelnetwork provided the PP in Valencia withtons of money in illegal contributionsover the years before the allegedconspiracy was broken in 2009.Prosecutors no doubt will get a secondchance at putting both men back in dock.Double jeopardy, you might ask?Perhaps not. In an archaic legal structuresuch as Spain’s judicial system, anythingis possible.

Letter From A Broad down underLast week I focused on the Huon Highway and parts of Hobart itself. This week, there’s alittle more about Hobart and then a fascinating area called Port Arthur.
Still in Tasmania(previously called VanDiemen’s Land), the lastbits I wanted to tell youabout Hobart will start witha place called Battery Point,some photos are above onthe left.This area is prettymuch as it has been foryears with quaint tea shops,little craft shops, artistsstudios and houses kept tothe true Victorian style ofthis small area of Hobartwith the preserved cottageslining streets to wanderalong and admire. There area couple of particularly nicetea, coffee and cake shops,one of which makeseverything on the premisesso the pies, tarts and cakesare not all a uniform sizeand shape wrapped incellophane but resemblewhat you would have foundon a lovely old fashionedcake plate at yourgrandmother’s in timesgone by. Well worth waitinglunch for! There are alsosome rather nicerestaurants up there fordinner in the evenings.
Hunter Street heritagebuildings (where we stayed)marks the original positionof the Old Wharf whenTasmania was firstsettled.The whole town isoverlooked by MountWellington where you cantake a trip to the top at
12771 metres, and admirethe views over the city andbeyond from its WorldHeritage Area. Here you canwalk and cycle for hours (it’seasy to hire bikes – they alsohave electric bikes for hire ifyou’re not quite thatenergetic – and motorbikesas well as cars).Another place that’s well
worth a visit is the BotanicalGardens with all the localflora, oriental gardens, ABCGardening Australia’sveggie patch – not quiteyour local allotment! – andtheir amazing subantarctichouse.
Last week, I promised totell you about Port Arthur.
The Pydairrerme peoplewere the traditional ownersof the land that is now PortArthur and Middens andother cultural sites stillremain from manythousands of years ago.
The Port Arthur penalstation was established in1830 as a timber camp andthe labour was extremelyhard using the convicts forlogging and preparation oftimber for governmentprojects. But in 1833 a newradical design of penalreform was introduced byEnglish prison reformerJeremy Bentham and hisideas were used at the “New
Pentonville Penitentiary” inEngland.This new idea wasadopted at Port Arthur andit was the original prison onTasmania where re-offending prisoners weresent to for one last chance.Obviously, with Tasmaniabeing an island – eventhough it is quite huge –once there it was a bitdifficult to abscond. If theyfancied trying to escape therip tides are such that it wasmade virtually impossible.There were some whomanaged it, but very fewremained at large evenwhen they did escape.
So, Port Arthur was setup as a rehabilitation centreof sorts. The idea was thatthe prisoners should bemade to be productive insociety and it was describedas “a machine for grindingrogues into honest men”. Tothat end, when a prisoner(not forgetting they hadalready been transportedfrom the UK away fromeverything they knew) hadserved their time in say,Melbourne, Sydney orAdelaide, and then beencaught re-offending theywere sentenced by the thenmagistrates and judges tobe sent off to Tasmania.
In the early days of thepenal settlement, convictswere housed in rough
timber huts. They weretaught to be blacksmiths,shoemakers, shipbuilders,and the more adept at thethree “R’s” becameaccountants, architects andteachers themselves. If theprisoners were unruly, theywere further punished bybeing locked in a cell, insolitary confinement withno contact with the outsideworld and no lightwhatsoever – what todaywe call sensory deprivation.Many men were broken bythis and, when released,ended up in the asylumnext door.
Young boys were kept ona separate island calledPoint Puer Boys’ Prison (forthose of you who learntLatin at school, you’ll knowthat Puer means “boy”)from the adults so that theydidn’t pick up any worsehabits while beingincarcerated. This part ofthe prison operatedfrom1834 to 1949 and wasthe first purpose-builtreformatory for boys in theBritish Empire. Most of theboys were aged between 14and 17 but some were asyoung as nine years old. Itwas renowned for itsregime of stern disciplineand hard punishment but italso taught the boys to readand write and taught thema trade so that when they
were eventually releasedthey could make a living forthemselves and not returnto a life of crime. There aremany stories of the boysfrom this small islandsetting up businesses upontheir release. Theirdescendents are to this dayin the area – pillars ofsociety and highly regardedbusinessmen in the tradesstarted by their criminalancestors.
Another island just offthe main shore is the Isle OfThe Dead where between1837 and 1877 around 1100people were buried. TheIsle Of The Dead is the finalresting place of not only theconvicts but also those wholived and worked at thesettlement. The mostcommon cause of deathsamong the convicts wereindustrial accidents andrespiratory diseases.
By 1840, the colonyhoused more than 2000convicts, soldiers and civilstaff and, with the end ofconvict transportation in1853 it became aninstitution for ageing andphysically or mentally illconvicts to call their homeuntil it finally closed in1877. Since then, many ofits buildings have beendestroyed in bush fires butthe area has now become a
place of peace and quiet,with beautiful gardens andsomewhere to reflect on therights or wrongs of previouspenal systems and theirtreatment of their charges.
Port Arthur was a harshplace to be sent to but, forsome, it turned their livesaround so that they becameuseful members of society.And in most cases theywere far better off here thanin Wandsworth or otherBritish prisons at the time.
On Sunday 28th April1996 a tragic chapter wasadded to Port Arthur’shistory when a gunmantook the lives of 35 peopleand wounded 19 others onthe historic site includingmembers of the site’s staff.A memorial garden hasbeen built – including theshell of the Broad ArrowCafé where 20 people werekilled during the massacre–created as a place ofremembrance, with allthose involved (except thegunaman) named, and aplace of reflection on howfragile life can be.

Taking pets into the UK
On Monday the 23rd ofJanuary the Lux Mundi,Torre del Mar, ́ Half OrangeGroup´ (Widows,Widowers and Singles)visited the white village ofTorrox. They were blessed
with a glorious sunny dayand were met by a memberof the Tourist Office whogave them a guided tour ofthe village.
The history of the villagedates back to the 12thcentury, settled by theArabs. The narrow streetswind through the villagewhere can still be seen theoriginal buildings andarchitecture. The Arabssurrendered the village tothe Christians in 1487 andthere are 16 ceramicplaques, situated throughthe village depicting thehistory and events thattook place. Annually thereis a prize given for the mostbeautiful street decoratedwith flowers and on theSunday before Christmasthe ´Migas´ Festival isheld, the dish ofbreadcrumbs, flour, oliveoil, mutton and chorizo,being consumed by many,along with the local wine.
The friends had lunch inthe picturesque squareoverlooked by the churchof “La Encarnacion”, builton the foundations of theold mosque. Then time forhome to look forward totheir next event or trip.

Jackie andDon have beenat Mijas bowlsclub for 12 yearsand becomegood bowlers.Don is thecurrent clubmen’s championand thoughJackie had notbowled for awhile, she willalso beremembered asa good sportswoman.
She helped in the clubwith bar and B.B.Q. duties.They have many goodfriends who shall missJackie.
There was a memorialfor her at the club lastTuesday after the
crematorium. Theirdaughter came fromAustralia, and their soncame from the UK. Friendsand family were able to seephotos of Jackie throughthe years and it was a reallynice way to remember her.She will be sadly missed byall her family, and friends atMijas Bowl’s club.

The original village ofBenalmadena,perched on the
hillside some 280 metresabove the Mediterrean seasparkling below it, datesback to Moorish times withtypical whitewashed housesand narrow cobbled streets.In true Andalusian style itboasts a popular andimpressive bullring regularlyfrequented by locals andvisitors looking for a flavourof “the real Spain” (if you
consider it acceptable,personally I don't). Butthese days the village,already home to people ofmany nationalities, offerssome very different delights.
Our first home inSpain was in “thepueblo”, a small
retreat used for extendedholidays, purchased in 2000.The longer-term residentswere complaining thenabout the amount of
construction that hadchanged its character, andnot for the better – thoughthere was still campo belowand above to walk throughin the springtime admiringthe flowers. Gradually thishas been eroded so that nowit is hard to see where Arroyode la Miel ends and thevillage begins and the hillsall around are covered inseried terraces oftownhouses, villas andapartments.
Happily the so-called“developers” couldnot spoilt the heart
of the village whose narrowstreets remain vituallyunchanged. The main roadleading though it is still one-way and controlled by atraffic light, allowing driverstantalising glimpses ofattractive little paved streetsand balconies adorned withflowers. It is well worthfinding a spot to leave thecar and explore on foot –there is a car park on the leftas you come up from Arroyoand another smaller one(next to the lift) going downthe hill to the coast. Walkdown the Calle Real past theplashing fountain, pass thelittle park and continue untilyou come out in the Plaza deEspana – a small squaresurrounded by tapas barsand restaurants whoseterraces spill out under theorange trees, a great place tosit and “people watch”.Here, in the centre of thecircular flowerbed in themiddle of the square is “LaNina”, the statue of the littlegirl which is the emblem ofBenalmadena. And very fewvisitors will leave withouthaving their picture takenwith her!
From the square walkdown Calle SantoDomingo de Guzman
– immaculate little housesline the route and you passhotel La Fonda (lookthrough the huge woodendoor at its charming internalAndalucian patio). Thehotel houses a cateringschool where on certaindays of the week you can eata lunch to remember – justmake sure you are hungryand don't be in a hurry toleave! At the end is theChurch of Santo Domingowhich sits on the edge of arocky outcrop almost likethe prow of a ship. From theterrace which runs all roundthe church there arestunning views of the sea,the coast, and themountains behind, andplenty of seating to take theweight off weary feet. Belowthe terrace are delightfulgardens leading down to thestreet below.
The older part of thevillage has managedto keep its charm
despite the once seeminglyendless march of concretefrom all sides. But the yearshave also brought some newand somewhat differentattractions.
First there is thearcheologicalmuseum on the main
road which houses afascinating and importantcollection of pre-Columbianrelics including thosedonated by the well-knownanthropologist and artistFelipe Orlando-GarciaMurciano. It has thereputation of being one ofthe best collections frombefore the time ofChristopher Columbus inEurope.
Dedicated to thediscovery of Americaand Cristobal Colon
is the curious Castillo deColomares just down the hillfrom the centre of thevillage, looking likesomething that has escapedfrom Disney World. With itsmixture of architecturalstyles and the smallestchurch in the world(dedicated to St Elizabeth ofHungary) it was builtbetween 1987 and 1994 bylocal bricklayers from Mijasafter the ideas of theimaginative – andpresumably rather rich –DrEsteban Martin.
Then looking up to thevillage from the coastyou can easily pick out
the huge golden copula ofthe Benalmadena Stupa –the largest Buddhistmonument in the western
world sited just outside thevillage. The dazzling whitestupa is 33 metres high andfilled with sacred objectswhich are forever sealed intotreasure chambers. A 100square metre meditationroom inside is lined withmurals painted by artistsfrom Nepal to represent thelife story of the BuddhaSakyamui. Visitors arewelcome every day exceptMondays when it is closed.
And the most recentattraction is the“Mariposario” or
butterfly farm – the largestclimate controlled spacededicated to butterflies inEurope (for a small puebloBenalmadena certainlyhouses a lot of superlatives).Visitors could be forgiven forthinking they were inThailand rather than Spainjudging by the architecturenot to mention the exoticsurroundings. Thousandsof gorgeous and delicatewings and equally colourfulorchids are containedwithin the 2,000 squaremetre park, a far cry fromthe brashness and bustle ofthe costa below.

order to survive life. It'sundoubtedly well acted,and Janet McTeer has beennominated for a bestsupporting actress gong forplaying another cross-dressing woman.
Some movie scribes havesaid it's a mix of UpstairsDownstairs with TheBirdcage, but without anygood songs. Close's make-up looks good and the role isa challenge – probably onefor Glenn Close fansthough.

Liam Neeson's "The Grey"topped the weekend boxoffice with $20 million,according to studioestimates on Sunday,continuing the actor'ssuccess as an action star.
The Alaskan survivalistthriller opened aboveexpectations with aperformance on par withprevious Neeson thrillers"Taken" and "Unknown."Those films, both January-February releases, openedwith $24.7 million and $21.9million, respectively.
But the R-rated "TheGrey," which has receivedgood reviews, drove homethe strong appeal ofNeeson, action star. It's anunlikely turn for the 59-year-old Neeson, previouslybetter known for his
dramatic performances,like those in "Schindler'sList" and "Kinsey."
"Liam is a true moviestar, period," said TomOrtenberg, CEO of OpenRoad Films. "My guess isthat Liam Neeson in actionthrillers would work justabout any time of year."

Albert Nobbs Over the past few weeksthe movie on every-
body’s award list is “TheArtist”, it seems to be awinner with critics acrossthe globe – so, now it’s myturn.
In this day and age, who intheir right mind would
decide to make a silentmovie? The answer is, theFrench. I’ve always thoughtthat an actor is only asgood as the script, forexample Robert Deniro, tryto have a conversationwith him without a scriptand what have you got –nothing. This is one of thereasons why Hollywoodcould never pull off amovie like “The Artist”,because Hollywood actorsin general can’t act withouta script.
Let’s get started. I like thismovie, it’s different.
Jean Dujardin had thatperiod look, hisperformance was brilliantand Uggie the dog was anabsolute scene stealer.There was a short scenethat I found slightly Lynchinspired (it’s the nightmarebit – you’ll know it whenyou see it). The story isGeorge Valentin (Dujardin)and his dog are the bestsilent actors in the businessand Pepper Miller wants tobe an actress. Pepper getson set as an extra andmeets George, he gives hera trademark and they gotheir separate ways.However, talking picturesare now all the fashion and
George refuses to partake,while Pepper is making aname for herself as a risingstar.
More happens, butyou’ll have to watch it
to find out. Now, here aremy problems with “TheArtist”. Pepper Miller – Idon’t like her, I don’t likeher at all. First off she lookstoo modern, secondly Ididn’t much care for hergung-ho character. Whenyou look back at real silentmovies, actresses had asoft look, an innocence likePickford’s or vampish likeTheda Bara, Bejo( Pepper)lacked both and lookedwrong for the period.Which brings us to herattitude, with big armgestures and shaking legmovements that seemedrather odd, like she wastrying too hard to be aflapper. She was like a catin a hamster cage, youknow that there should besomething furry in there,just not that big.
The verdict then is thus,“The Artist” is a novelty
movie and perhaps in timeit may become a cultclassic, but I doubt it. It’spopular because silentmovies are a thing of thepast, and people will go tosee because it’s different –however, it fails with youngaudiences because youngpeople don’t want towatch silent movies, theywant cheesy dialogue andspecial effects. “The Artist”has kind of shot itself in thefoot, the novelty of thismovie is what will bringthe crowds in, but it is thesame thing that will turnthem away.
Some people will lovethis movie, I liked it, but
it’s not made it into my top100, some people won’tlike it at all. Let’s make thiseasy, if you like “Avatar”you’ll hate “The Artist” , butif you hate “Avatar” there ishope for you yet.

Although you have been highly productive lately, this week sees you slowing downand backing off. You may have been so intently moving in one direction that theuniverse is requiring you to slow down your pace so that important details are notoverlooked. Ingredients: Serves 4
Creamy chicken, bacon and basil pasta
This easy chicken pasta recipe is just the thing if you are in need of a quick and lightlate night supper.
• 3 tbsp olive oil• 3 large boneless chicken thighs,skin removed, cut into strips• 5 rashers bacon, chopped• 1-2 garlic cloves, crushed• salt and freshly ground blackpepper• 300ml/10fl oz double cream• 450g/1lb farfalle• handful fresh basil, torn, plus extrafor garnish
• 200g/7oz cheddar or Parmesan,grated, plus extra to garnish
1. Cook the pasta according to packetinstructions in a pan of salted boilingwater, then drain.
2. Heat the olive oil in a frying pan, addthe chicken strips and bacon and cook for3-4 minutes, or until the chicken isgolden-brown and cooked through.
3. Add the garlic and cook for oneminute. Season, to taste, with salt and
freshly ground black pepper, add thecream and warm through.
4. Add the creamy sauce to the cooked,drained pasta and stir well.
To serve, stir in the basil and cheddar orParmesan. Spoon on to serving plates orbowls. Garnish with extra grated cheeseand basil leaves.

Quite a few years ago my first article on learning Spanish featured the verb Poderexplaining how one uses puedo - I can/I am able plus any other verb.
Puedo ver la montaña - I can see the mountain.No puedo hacer el trabajo - I can't do the work.¿Puedo vender el coche? - Can I sell the car?
We've come a long way since then but Poder remains an extremely useful little verb.
Let's begin with a proverb : Querer es poder which literally means To want to is to be able to or aswe would say in English Where there's a will there's a way.
Then there's the expression for when you've had enough of somethingNo puedo màs - I can't take any more. It can be applied to situatons,the weather and even food and drink.
¿Se puede? means May I? and is used in places where you are asking permissionfor example to enter a place or in a café asking if a seat is free.
No puede ser means That cannot be or It's impossible and will be usedwhen you are finding it hard to believe what you are seeing or being told.No me digas, no puede ser - You're kidding, it's not possible.
El poder is the power and poderoso means powerful. We hear people(usually older people) speaking of Dios todopoderoso All powerful (Almighty) God.
The times are a-changing so we will end with another proverb which says it allPoderoso caballero es Don Dinero. Literally Mr. Money is a powerfulgentleman.Or as we would put it - Money makes the world go around.

The 2012 Screen Actors GuildAwards had few surprises onSunday night, both in awardrecipients and red carpetappearances. ‘The Help’ tookhome several honoursincluding the prize for bestperformance by a cast in amotion picture, andindividual honours for starsViola Davis and OctaviaSpencer. The win gives “TheHelp” a nice boost headinginto the Academy Awardsnext month, where it will facethe Golden Globe-winningfilms“The Artist” and “The

Rather than sit hunchedover the screen as if it werea laptop, the tablet shouldbe raised to a higher level –ideally on a table – with asmart cover propping it atan angle.
Researchers fromHarvard School of PublicHealth, Microsoft andBrigham and Women’sHospital took 15experienced tablet users
and asked them tocomplete a set of tasks,such as Internet browsing,game playing, moviewatching and emailing,with both the Apple iPad 2and Motorola Xoom.
Both have cases that canbe adjusted to tilt thecomputer – the AppleSmart Cover and theMotorola Portfolio Case.Four ways of using the
screens were tested: placedon the lap, using the lapcase at its lowest setting,on a table with the case atits lowest setting and on atable with the case at itshighest angle. Theresearchers found that thehead and neck were ingeneral flexed more thanfor traditional desktop ornotebook computing – andonly when the deviceswere used on the table,
with the cases set at theirsteepest angle, did users’posture approach“neutral”.
The downside, however,is that use of steeper anglesmay affect the arms andwrists. The researchers saidfurther studies to examinethe effects of tabletconfiguration on arm andwrist postures are neededto clarify the best posture.
Over the years, researchershave found that weight gainand moderate to severeacne go hand in hand,particularly among youngwomen. It is not entirelyclear why, but excesshormones most likely playa role. In the most recentstudy – involving around3,600 teenagers –researchers looked closelyat their weight and its
relation to their skin,factoring in severalvariables that could alsoplay a role, including age,puberty and diet. High-sugar junk foods are notonly linked to weight gainbut are also known toworsen acne. Afteradjusting for these andother factors that couldaffect acne risk, theresearchers found that
overweight or obeseteenagers – particularlyyoung women – were muchmore likely to develop acnethan normal-weightadolescents. Another studyof roughly 3,300schoolchildren, publishedin 2006 in The EuropeanJournal of Dermatology,reached similar results.Researchers have proposedseveral explanations for the
link. One is that an excess ofandrogens caused byobesity provokes acne. As towhy girls are more greatlyaffected than boys, it ispossible that having badskin and being overweightcause them greaterpsychological strain, whichin turn prompts the releaseof stress hormones thatonly worsen the problem,the researchers said.

Blood pressure'should be measuredin both arms'Measuring blood pressurein both arms should beroutine because thedifference between left andright arm could indicateunderlying healthproblems, according to astudy review for TheLancet.
Although existingguidelines state that bloodpressure should bemeasured in both arms, it isnot often done. The armwith the higher pressurecan vary betweenindividuals, but it is thedifference between armsthat counts, the researchersfrom the Peninsula Collegeof Medicine and Dentistryat the University of Exeterconcluded, after reviewing28 previous study paperslooking at this area. Mostpeople in the study had an
elevated blood pressurerisk and about one-thirdhad a normal level of risk.The researchers found thata large difference couldmean an increased risk ofperipheral vascular disease(PVD), which is thenarrowing and hardeningof the arteries that supplyblood to the legs and feet.There are often nosymptoms.
Early detection of PVD isimportant because thesepatients could then benefitfrom stopping smoking,lowering their bloodpressure or being offeredstatin therapy. Aspokesman for the BloodPressure Association saidthe study reinforced themessage already in theguidelines from healthwatchdog NICE.

Our Sun is a star. Itis not ‘burning’,
it’s not ‘on fire’, butinstead it is like agiant nuclear reactor.Inside its corehydrogen atoms arebeing fused togetherto make heliumatoms at the rate ofabout four milliontonnes per second.When each atom ofhelium is produced itgives off masses ofphoton energy thatmust slowly make its way through manylayers toward the surface. So slowly infact that after the photons have beenreleased at the centre of the Sun it cantake between 10,000 and 170,000 yearsfor them to reach the surface.
Once the photon eventually makes itsway onto the surface of the Sun it
finally escapes as visible light and heat,the light from the Sun takes about eightminutes to travel through space to reachthe Earth. The surface of the Sun is notsolid like the surface of the Earth; it is aswirling mass of unimaginable energyconstantly changing writhing andtwisting about. It also creates a giganticmass of charged magnetic areas.
These heavily charged magnetic areasappear as dark spots on the Sun and
are known as sunspots. Sunspots arehuge in size, much bigger than the Earthand although they appear as dark areas,they are only dark in relation to thesurrounding light from the Sun. If youcould isolate a sunspot from the Sun itwould still be shining extremely brightly.If the Sun is either very low down on thehorizon or obscured by thin cloud thensunspots can even be seen with thenaked eye and so their existence hasbeen known about for thousands of yearsbefore the invention of the telescope.
Sunspots always appear in pairs andwhen they appear huge loops of
material known as solar prominencestream from one of them out into spaceand then loop back into the other. Butsometimes the prominence is so big thatit snaps like a huge rubber band andinstead of looping back it throws thematerial out into the solar system at aspeed of a million miles an hour. Thismagnetic ‘wind’ then travels throughspace until it strikes the Earth 93 hourslater where it is attracted by our North
and South magnetic poles and producesthe Aurora Borealis or Northern Lights.
The Northern Lights can normally beseen only in the far north (and south)
regions of the Earth as bands or curtainsof multi-coloured lights dancing acrossthe sky. But recently the Sun has beenproducing far more intense sunspotsthat have caused the Northern Lights tobe seen much further south acrossnorthern England. Last week areas as farsouth as Birmingham have beenreporting seeing the Northern Lights.
It’s not unusual for sunspot activity tofall and rise. Sunspots generally have an11 year cycle when no sunspots are seenon the sun as it was a few years ago to thepeak that we are experiencing now wherethere are masses of huge sunspotslittering the surface. Although all thissolar activity will go unnoticed by mostpeople, it will cause you no harm at all; itcan be lethal for electrical systems andsatellites out in space. In the past it hasbeen known to knock out electricaltransmission pylons and other sensitiveelectrical systems. Precautions have to betaken to protect satellites in space toprevent them from overloading with allthis magnetic flux.
It is possible for you to see thesesunspots using a telescope orbinoculars. CAUTION: NEVER LOOKDIRECTLY AT THE SUN USING ATELESCOPE OR BINOCULARS! To lookat the sun safely use the projectionmethod. Point your telescope orbinoculars at the sun then hold a piece ofwhite card about 12” (30cm) behind thelens allowing the image of the sun to beprojected onto the card. Focus the imageonto the card and you will clearly see thedark sunspots scattered across thesurface.

Without wishing to beboring, I wanted to add myagreement with people thathave written in over the lastcouple of weeks saying howmuch they have enjoyed therecent stories about youreditor’s travels.I am in my seventies and latelast year got on a plane forthe first time to visit my sonand his family in America. was a little daunting to saythe least to think of going thatfast, thousands of feet up inthe air but, with the help of acouple of tots of whisky andan extremely nice and helpfulstewardess, the experiencewasn’t as bad as I thought itwould be. I know your editorsaid in her comment lastweek that you are never tooold to explore and I’m living
proof of that. I had awonderful time and theworld is now my oyster.Keep up with the good workand I was pleased to see thatyou intend to carry on withthe “travelogues” fromaround the world. Whoknows where I shall end upnext!
Just lately our Sun seems to be going through aperiod of intense activity regarding Sunspots.
I had thought that maybe myfavourite paper had been hitby the recession as I couldn’tfind The News anywhere onWednesday but, Thursday,there it was and, what a relief!

was and all hoped to find itsomewhere was incredible soI thought I should write andtell you how much we missedit.
There are a group of us thatsit in our local café and do thepuzzles together and,

On Saturday 28th January, atthe Fernando Hierrostadium in Velez-Malaga, asuperb, physical andentertaining game of rugbywas fought out between thegreat rivals of the Colts(U17,s) of Malaga RugbyClub and Axarquia RugbyClub. Fighting for 4th placein Group B in theAndalucian League this wasa “must-win” game for bothteams.
The first half was playedwith speed and strengthfrom both sides and whilstAxarquia had the lion�s shareof possession, they could notconvert their superiority intopoints and both teams wentinto the half time break, levelat 0-0.
The second halfcontinued in the same vein,with the superb defence ofMalaga holding out againstthe increasing pressure from
Axarquia. Into the last 15minutes, Axarquia scored atry in the corner throughsome great back play but thetry was disallowed and,instead, a penalty was givenfor an earlier infringementby Malaga – why the refereedid not play advantage is stilla mystery. Axarquia captain,Daniel Ward, converted thepenalty to give Axarquia a 3-0 lead.
Axarquia continued todominate and ran down theclock. With full-time up,Axarquia thought they hadsecured the victory but thereferee played anastonishing six minutes ofovertime for no obviousreason and, credit to Malaga,they kept playing and scoreda try with the last play of thegame to win 3-5.
