During a radio interview, hesaid that the next step in theETA peace process would betaken by the governmentelected on that date.Opposition leader MarianoRajoy, who is tipped to winthe election, has said “thereis nobody who cannot feeljoy (over ETA'sdeclaration)," but addedthat he would nevernegotiate with the group.

The announcementETA announced its“definitive cessation ofviolence” in a video sent tothe BBC and aired lastThursday. In the preambleto the statement, a hoodedETA spokesman flanked bytwo others said "a newpolitical age is opening" inthe Basque Country. "Weface a historic opportunityto obtain a just anddemocratic solution to theage-old political conflict."He continued: "ETA hasdecided on the definitivecessation of its armedactivity. ETA makes a call tothe governments of Spainand France to open aprocess of direct dialoguewhich has as its aim theresolution of theconsequences of the conflictand thus the conclusion ofthe armed conflict. With thishistoric declaration, ETAdemonstrates its clear, firm

and definitive purpose."

Prime Minister José LuisRodriguez Zapatero said themove was "a victory fordemocracy, law andreason", adding that aftermore than 40 years of bombattacks and assassinations,Spain was now experiencing"legitimate satisfaction" atthe victory over terror. Hesaid it should never havehappened and must neverbe allowed to return.

The declaration, iffollowed through, wouldend ETA's campaign ofviolence, which has lastedmore than 40 years andkilled more than 850 people.The declaration came threedays after a conference inSan Sebastian which wasattended by internationalstatesmen including formerUN Secretary General KofiAnnan, and protagonists inthe Northern Ireland peaceprocess, who called on ETAto lay down its arms. Theseinternational mediators

have been active sinceJanuary this year, when ETAdeclared a permanent and"internationally verifiable"ceasefire, but thegovernment has refused tonegotiate with the groupuntil it lays down its armsand disbands. Thegovernment is cautiousabout engaging in anotherpeace process, after the lastone failed. It startedcontacts when the groupcalled a "permanent"ceasefire in 2006, only tobreak it a few months laterby bombing an airport carpark in Madrid, killing twopeople. The group has alsoabandoned previousceasefires.But some analystssay it may be different thistime. ETA has not killedanyone in the past two yearsand earlier this year itstopped collecting a“revolutionary” tax frombusinessmen, which wasnothing more thanprotection money. Inaddition, there have beenno street protests by ETA

supporters for severalmonths, until last Saturday,when thousands took to thestreets of Bilbao (see photo).

But ETA's days wereprobably numbered in anycase. Thanks to a concertedSpanish and Frenchcrackdown, dozens of ETAmilitants, includingsuccessive leaders, havebeen arrested and jailed, inrecent years and the securityforces have said there areprobably more ETAmembers in jail thanoutside. However, they havealso warned that ETA stillhas hidden caches of armsand explosives and couldbecome active again.

National Day spoiltOctober 25th marked the32nd anniversary of theBasque Statute, by whichthe government in Madriddevolved a number ofpowers to the Basqueregional government,including the right to haveits own police force. This isthe first year that it has beenan official holiday but onlythe Basque Socialist Partyand the Partido Popularattended the celebrations.The Basque National Partystayed away as did all thesmaller nationalist partiesbecause of differences overhow the ETA peace processshould be handled.

Some of us in The newsoffices are followers of theMoto GP bike riding and, onSunday a young and up-and-coming rider, MarcoSimoncelli lost his life duringthe second lap of the race inMalaysia. This young manwith the wild curly hair andattitude was only 24-years-old and knew what he wasdoing on a bike – you don’treach that level of racingwithout being incrediblygood but, the fact remainsthat being on a motorbike ofany kind is a dangerousplace to be. When we learntto ride motorbikes in the uKit was because I wassurveying in london andthe traffic had got to thestage where it was prettymuch impossible to do myjob in a car. The first thing Iremember my instructor,Andy, telling me was: “nomatter how good you are, orthink you are, there is alwayssomething that can kill youso never use all your power– you may need it to get youout of something – andremember to have eyes inthe back of your head too!”There was nothing the otherriders in the GP could havedone to miss Simoncelli ashe came off but it certainlybrings it home to you justhow dangerous the sport isand all of you who thrashalong the roads in Spain inshorts, T-shirt and flip-flopsshould take note. Just acouple of seconds ofsomeone not looking whatthey’re doing and that’s it so,at least make sure you’rewearing the proper gear – itcould save your life.

On a much happier note, onSaturday I went and had myteeth whitened at the“Perfect White Teeth” salonat the Tamisa Golf Hotel,Fuengirola. I have good,strong teeth but they areuneven and I love my cuppaso tend to get stained fromthe tea. I expected to see alittle difference but, Wow! Istill haven’t got a Hollywoodsmile and, frankly, do I wantto look like Simon cowelland blind people every timeI open my mouth? But I nowhave lovely, naturally whiteteeth again. I’ll tell you allabout it next week!

The number has grownconsiderably since dozensof towns and cities in theregion held unofficialreferendums onindependence late last yearand at the beginning of thisyear.

The highest turnout ofthose eligible to vote was20%, the lowest was justover eight per cent and anoverwhelming majorityaveraging 98 per cent votedin favour of independence.However, between 80 to 92

per cent of eligible votersstayed away. During arecent visit to Barcelona,Quebec mayor RégisLabeaume told regionalpremier Artur Mas that hewas glad that the Quebecindependence movementhad lost a referendum in1995, when 49.42 per centvoted in favour ofindependence fromCanada and 50.58 per centvoted against, becauseindependence would havebeen disastrous forQuebec.

Former Catalan regionalpremier José Montilla saidrecently that with sevenmillion inhabitants and allthe necessaryinfrastructure,independence from Spainwas “viable but notdesirable or convenient forthe majority of the region'sinhabitants”. Sincewinning the regionalelection a year ago, Sr Mashas become increasinglyoutspoken about thedesirability of breakingaway from Spain.

Minister of the PresidencyRamon Jáuregui (pictured)said on Monday thatmerging local councilscould be a solution toimproving the functioningof public administrations.Such a reform would affect2,200 local councils – aquarter of the total existingtoday – which have less than1,000 inhabitants. SrJáuregui launched theproposal at the 15thCongress of FamilyBusinesses being held inValladolid this week. He alsoproposed eliminating ordrastically reducing the so-called deputations, that is,those local councillors who

represent the interests oftheir municipalities onprovincial governments. TheSocialist Party candidate forthe November 20th generalelection, Alfredo PerezRubalcaba, has alreadymade similar proposals atpre-campaign meetings.

Just over 45 per cent of Catalans would vote in favour ofindependence if a referendum were to be held tomorrow, andonly a quarter would vote against, according to the results of asurvey released by the Centre of Opinion Studies (CEO) on Tuesday.

A recent poll found thatover 70 per cent of thosequestioned believe the self-styled 'indignant ones' arebasically right in theirprotests against thefinancial institutions thatcaused the currenteconomic crisis, as are theirdemands for a moredemocratic system of

government. Only 20 percent said they hadparticipated in protestsand sit-ins organised by the15-M (May 15th) youthmovement, named afterthe mass sit-in whichstarted in Madrid Puertadel Sol square a weekbefore the regional andlocal elections on May

22nd, but 63 per cent saidthe movement shouldcontinue.

The movement hassince spread worldwide asmore and more peoplebelieve that the financialmarkets are more powerfulthan nationalgovernments.

'Indignant ones' rightThe Polisario movement,which is seekingindependence for WesternSahara and runs the camp,has blamed local al-Qaedamilitants for thekidnappings.

In a statement, theAlgeria-based group saidthe armed attackers hadarrived at the camp in four-wheel drive vehicles and

left in the direction ofneighbouring Mali "fromwhere they came". TheAlgerian governmentcondemned thekidnapping, but said it wasawaiting more detailedreports before commentingfurther.

The Environment Ministryhas published its proposedlist of the maritime areasthat it wants declared asnational preserves, withthree glaring absences – theStraits of Gibraltar, ChafarinaIslands and Banco de laConcepción.

A spokesman said thegovernment decided toeliminate these areas fromthe initial protected-zonelist because they arelocated in internationalwaters, two of them inareas of jurisdiction thatare disputed with Gibraltarand Morocco.

The spokesman saidthat where there aredisputes “we are going to sitdown with the Foreign

Jo Yeates killer tells court hewas “in a state of panic”The man who has admittedto killing architect Jo Yeateshas apologised to herparents for putting themthrough “a week of hell”and for dumping her bodynext to a roadside verge.

Vincent Tabak, a Dutch33-year-old engineerdenies murder but pleadsguilty to manslaughter onDecember 17th last yearsaying that “I still can’tbelieve I did that”, addingthat the horror was startedby a flirty remark. Tabaktold Bristol Crown Courtthat he waved to Jo as hewas passing her kitchenwindow on the way to thesupermarket but sheinvited him in. Hedescribed how he took offhis coat and hung it on thecoat rack in the hall thenthey both went into herkitchen. He said that MissYeates made a remarkabout her cat that hadrecently got into his flat

saying that the cat wentinto places it shouldn’t goadding that the cat was: “Abit like me.” Tabak took thisas a flirty remark and saidthat he decided to make apass at her. He got theimpression that shewanted to kiss him so heput a hand on her back andtried to kiss her. At thatpoint, Jo Yeates screamedand Tabak put his handover her mouth to keep herquiet. He said: “I waspanicking. I wanted to stopher screaming. I wanted tocalm her down.” He wenton to explain that afterstrangling her for less thana minute "she went limp,she fell to the floor", Tabaksaid, adding: "I still can'tunderstand whathappened."

Once he realised she wasdead he told the court thathe was in a state of panicand carried her back to hisflat to put her into a bicycle

cover adding that he didn’twant anyone to find outwhat had happened so heput the body in the back ofhis car. Once he had donethis he went back into herflat to get the pizza that shehad bought on her wayhome from work and asock that had fallen off ashe moved the body.

He then went to Asda inBedminster, thesupermarket he washeading for before MissYeates had waved at him,with her body still in theboot. He then decided todrive to Bristol Airport butstopped at LongwoodLane, Failand where hethen dumped the bodywhich was found later bytwo dog walkers onChristmas Day.

After the killing Tabaktold the court that hestarted drinking heavilyand searching news

bulletins for any reportsabout her disappearanceand possible discoveryadding that he thought thebody would be found atany moment and that hewould be arrested. He said:“ I should have called thepolice the minute she wasdead. I still can't believe Iwas (capable) of such anact. It will haunt me. I wasresponsible for her death.I'm so sorry." The trialcontinues.

31-year-old Leigh Clift ofLincolnshire Close,Bletchley, who has spentfive years in jail after beingconvicted of grievous bodilyharm on a 19-year-old manin 2000 was last weeksentenced to serve at leastsix years for the murder ofthe same man by LutonCrown Court.

Highway SOS Associationin San Sebastian at 6.30that morning to warn themabout the bomb.

Police in Fuengirolawere able to evacuate thehotel and neighbouringbuildings before the bombwent off at 7 am, injuringsix people, including a

child and a policeman, andcausing considerablematerial damage.

ETA claimedresponsibility for thebombing in July in astatement published in theBasque newspaper “Gara”,stating that it was part ofthe “summer campaign tocapture internationalattention”.

Ruth Breton, 8, and herbrother José, 2, werereported missing onOctober 8th by their father,who told police he had lostthem in a park. However,witnesses said they hadseen him alone in the park,which was confirmed byCCTV footage. The childrenhad arrived that day fromHuelva, where they livewith their mother. Policesearched a house in the cityand a finca on the outskirts

belonging to Breton'sfather but found no trace ofthe children. However, hechanged his story severaltimes, which led to hisarrest.

Breton, who is undersuicide watch, speaks littleand people dealing withhim say he seems unmovedby what could havehappened to the children.They say his behaviourseems to support his claimthat he is bipolar, althoughhe is not taking anymedication.

A new Operation Captura appeal to track down criminalsbelieved to be hiding in Spain Crimestoppers, a Britishcharity organisationdedicated to theapprehension of UKcriminals – including thosethought to be here in Spain– have announced thelaunch of their latestcampaign and are back onthe hunt for 10 seriousfugitives wanted for crimescommitted in the UK.

This latest campaign ofOperation Captura marksthe fifth anniversary of thejoint efforts byCrimestoppers, SOCA(Serious Organised CrimeAgency) and otheragencies. Winter is just around the cornerHow lovely to wake up to the sound of rain after an exceptionally long dry summer. Not quiteso lovely to remember the car roof had decided not to go up when I pushed the button and Ihadn't managed to get around to getting it fixed! Open evening of art

The Centro de Artes deMijas held an open eveningrecently to allowprospective students to seetheir facilities and meet thisyear's teachers.

Three members of the Basqueterrorist group appeared on a videosent to the BBC News last week

saying that given the current politicalsituation, the group had “decided on thedefinitive cessation of its armed activity”and called on the governments of Spainand France “to open a direct process ofdialogue” aimed at resolving theconsequences of the conflict. Thestatement closed: “With this historicdeclaration, ETA demonstrates its clear,firm and definitive purpose. ETA calls onBasque society to get involved in thisprocess until peace and liberty areachieved.”

Everyone knows that the majority ofBasques have been trying for years tolive in peace, free of ETA threats, so

their magnanimous offer of “peace andliberty” must have caused much hollowlaughter in the Basque Country.

Fortunately, the Spanish have longmemories and can recall severalceasefires which ended as soon as

ETA realised it was not going to get its ownway with the government in power. As aresult polls taken since the statement lastThursday show that two thirds ofSpaniards do not believe this is a“definitive cessation” of the violence.

The statement was receivedcautiously by the majority ofpoliticians who said it was an

important step forward, but pointed outthat ETA had made no mention ofdisbanding, handing over its arms orasking its victims for forgiveness.

What ETA has been demandingsince the ceasefire it announcedin January this year is an across-

the-board amnesty for all its membersboth in and out of jail. As a lead-up to that,the group wants all jailed ETA members tobe sent to prisons in the Basque Country –where it will be easier for their families tovisit them. It will also, of course, be easierfor them to conspire about what to do ifthis current cessation of violence turns outnot to be definitive.

Both the French and Spanish securityforces have been warning theauthorities since January that this

ceasefire, like the others, was called to giveETA a breathing space and time toredeploy. This time around, however,tenacious pursuit by those same securityforces means there are probably more ETA

members in jail than outside. ETA in facthas never been as weak as it is now and weare slowly learning more details about this“cessation of violence”.

Apparently ETA decided on this stepshortly after the May 22nd regionaland local elections when a new left-

wing pro-independence party called Bildudid spectacularly well in the BasqueCountry. The government has consistentlydeclared “new” Basque political partiesillegal in the past for the simple reason thatthey were Batasuna – ETA’s bannedpolitical wing – under another name. Bildumade a lot of noise about wanting to findpeaceful political solutions to theproblems caused by ETA’s 43-year-longcrusade for independence from Spain so itwas allowed to field candidates in theelections.

The first thing the newly elected Bildumayor of San Sebastian did wasremove the King’s portrait from the

Town Hall, saying he was irrelevant to theBasque people. You can’t get more explicitthan that. And last Saturday, thousands ofpeople took to the streets in Bilbaodemanding independence from Spain.

For a couple of years now, the likes ofSinn Fein leader Gerry Adams, SouthAfrican lawyer Brian Currin,

Archbishop Tutu and an assortment ofother international luminaries have beencalling on ETA and the government tomake peace. The last meeting ofinternational mediators was held lastMonday in San Sebastian and made theheadlines in both the Spanish and foreignmedia. The BBC correspondent describedit as “carefully choreographed, and most ofthe main Spanish dailies seem to have hadtheir stories about the ETA announcementprepared before it was even made”.

It seems to me that the whole charadewas set up to help ETA disband –eventually – without losing face.

From all the reactions following lastweek’s ceasefire announcement byETA there are two that stand out the

most. One positive response surprisinglycame from Popular Party (PP) leaderMariano Rajoy who called the declaration“good news” although he remainedcautiously optimistic as the days went by. "Itshows how a society knows how to remainunited and defend its position because thisannouncement was made without anyconcessions," Rajoy said.

But there is a sector of the PP that isalready talking about revenge. His PPcolleagues, including Madrid regional

premier Esperanza Aguirre and IgnacioCosidó, the party spokesman for interioraffairs, immediately called for theprosecution of ETA members – putting asensitive issue on the front burner before theBasque terrorists lay down their weapons.Aguirre, a PP hardliner, brewed more scornby adding that the statute of limitations formurder never runs out.

While victims' groups are alsodemanding justice and would liketo see the ETA members

prosecuted, one family of a murdered victimhas publicly asked the organisations to stayout of the upcoming peace process. EnricLluch, whose uncle Ernest Lluch, a formerSocialist health minister who was shot in thehead at his home by an ETA assassin in 2000,said that negotiations should be "left topeople who are professional in resolvingsuch issues”. “As victims, we are notobjective. Our time will come when it comesto recognise the victims but we cannot getinvolved in the peace process," said Lluch,who serves as vice president for the ErnestLluch Foundation in Barcelona.

It was a bold but proud statement comingfrom a family who, like thousands ofothers, have suffered during ETA’s reign

of terrorism of the past 43 years. The Basqueterrorists have been blamed for 829 murdersand injuring more than 1,000 people in

Spain and France through bombings,shootings and executions. Families are stillgrieving, yes, but it is time to give peace achance. The Association of the Victims ofTerrorism (AVT), the largest such group, saidit wanted justice not vengeance. But fromthe way they are talking, it seems victims'groups would really like a public lynching.

This is the first time that the politicalparties have come together towelcome an ETA ceasefire, albeit

cautiously. Rajoy’s and Lluch’s encouragingwords demonstrate good faith that goes tothe heart in trying to resolve that long andpainful conflict. Of course, the peace processhas not begun and as Interior MinisterAntonio Camacho has said, it will enter itsmost crucial stage in the coming months.

But there are diversions that are alreadybeing put into place. On Monday, theleader of the Basque Nationalist Party

(PNV) Iñigo Urkullu called for an immediatetalks to begin the transfers of ETA prisonersto Basque Country jails – a petition that hasbeen made by both the radical abertzale leftas well as ETA. In an effort to try toconsolidate his power and wrest control ofthe region from the Socialist and PPcoalition partners as well as keeping theabertzale from dominating the peaceprocess, Urkullu also called for earlyelections believing that his PNV will onceagain be swept into power.

Those who have no interest in tryingnot to jeopardise the peace process –such as the AVT and a large faction of

the PP – should back off. The negotiationsshould be left to the international mediators,such as Kofi Annan and Brian Currin, andgovernment officials; they must not bedistracted. The next most important step isnegotiating with ETA to lay down its armsand disband. Bargaining chips such as thetransfer of prisoners – which should notinclude any favours for ETA – need time tobe ironed out and cannot be introducedfrom one day to the next.

Why “pay to view” when you can “free to view”?

British workers overseas– Employment Law newsfrom De Cotta LawWhere employees workabroad even for manymonths at a time they maystill be entitled to claim therange of rights includingunfair dismissal under theBritish legislation, theEmployment Rights Act1996 (ERA `96). This couldbe beneficial as these rightscan be wider than thoseprovided under Spanishlaw. It used to be the casethat the ERA `96 did notapply to `any employmentwhere the employeeordinarily works abroad´but this clause wasremoved in 1999 and thereis now no statutoryprovision dealing with thisissue, rather it is a matter ofcase law. To fall within thislegislation, the employeehas to prove that there is asufficiently closeconnection with GreatBritain. The employees inthe cases of Serco v. Lawson(2006) and MOD v Wallis(2010) were successful insubstantiating this. In thecase of Serco v. Lawson, aUK company employeewas working in theAscension Islands and allservices were carried outthere. The Judge gave twocircumstances where anemployment relationshipmight be sufficientlyclosely connected with GBso as to enable an unfairdismissal claim to be madeunder the Britishlegislation and these are: (i)where an employee isposted abroad to work for abusiness conducted inBritain and/or (ii) where heis working in a political orsocial British enclaveabroad.

In MOD v. Wallis theemployees were employedby NATO in Europe. Theseemployees were the wivesof armed forces personneland were employed as suchby reason of theirhusbands´ employment.

This was sufficient toestablish the connection asthey were said to beworking in a similarsituation to (ii) in Serco andwere entitled to claimunfair dismissalnotwithstanding that theywere not employed withinGB. The employees alsosucceeded in claiming sexdiscrimination on the basisthat it is a matter of EU lawand therefore irrelevantwhich national law isapplicable, provided that itis the law of a member statewithin the EU.

However in relation tounfair dismissal, the recentcase of Duncombe & othersv. The majority of peoplewho are not Spanish but livehere simply don’t have a cluewhat the procedures arehere. When my neighbourdied leaving no will andapparently no relatives wepaid the funeral bill andfollowed what we knew shewould have wanted but, thelegal mess was immense.She had suffered a heartattack and to all intents andpurposes was dead by thetime they got her to HospitalClinico in Malaga but, shewas on a ventilator beingkept “alive”. Various testswere done and there was nobrain activity so themachines were switched offbut, had there been activityof any sort, would I have hadthe right to give thepermission necessary toswitch off or would therehave had to have been acourt order? I hadn’t a cluealong with pretty mucheveryone else.

So, on Friday November4th starting at 12:30pm thereis going to be an informativemeeting at JK’s (on La TrochaIndustrial estate, Coin, thatis behind the commercialcentre and the La TrochaGarage) to tell you what youcan and can’t do.

The Government haslaunched its Urban BikeScheme. The scheme willbe known as “Gibi Bikes”.The mission statement is“Go Green”.

The Minister forTransport, the Hon J JHolliday, inaugurated thescheme on Monday byofficially commissioningthe bike station at MarketPlace. Work has beenongoing on theconstruction of the stationsand today sees thecommencement of thetesting phase that will seeGibi Bikes employees ridingbetween different stationstesting the scheme. Thisphase of the project isbeing rolled out with 11stations being switched ontoday and the remainingstations coming into usewithin the next two ofweeks. Once all the stationsare operational, the schemewill have 100 bicycles at thedisposal of the public at anyone time and will operatedaily from 07.00am to10.00pm.

The sites that have beenswitched on today are:

Frontier (3 Stations),Waterport Road(Watergardens), Europort,

Grand Parade, ReferendumGates, Line Wall Road,Orange Bastion and MarketPlace (2 stations).

As an incentive tobecome a member, thosepersons that apply formembership before theend of November will begiven an extra month’smembership so theirmembership will expire atthe end of December2012.There will be anannual subscription fee of£24. The area had beendeveloped from wastelandthat had been used fordriving practice by peopleof the Rock coming up totheir tests, into what it istoday, 16,500 m2 oflandscaping and 2,000 m2of leisure facilities thatmakes it a major open-airleisure area for the Rock.There is a children’s playpark, paved walkwaysthrough landscaped greenareas, a tourist informationcentre, café and arestaurant is planned.

Mr Caruana described itas “a wonderful leisurefacility for familiesfollowing significantinvestment by theGovernment”, adding thatthe area will be used byboth local people andtourists.

The area also boastsstunning views of the Rockitself and also Africa overthe straights.

This week sees a few of thebig cruise ships arriving atthe Port of Gibraltar.

ABOUTA peaceful forest, planted for warNow the weather is getting cooler it's an ideal time for exploring since drivingand walking is so much more enjoyable than in the summer heat.

And we are sofortunate inAndalucia to have so

much unspoilt countrysideto choose from. If you fancya change from the beachand the mountains, thendrive down Gibraltar waywhere it is striking how thescenery suddenly changesinto vast tracts of woodlandstretching inland as far asthe eye can see. Turn off toSan Roque and just a fewkilometres from the townare the pine woods of Pinardel Rey, a huge publicrecreational area of some338 hectares, with afascinating history.

Like all schoolchildren Ilearned about theSpanish Armada, the

gallant exploits of FrancisDrake and the pivotal Battleof Trafalgar. I was also

thrilled to hear aboutsunken Spanish galleonsfilled with treasure. But I'dnever really thought muchabout the more practicalissues of how they wereactually built.

When Spain was theworld's leadingnaval power

shipbuilding was ofparamount importance andthousands of trees wereneeded to supply the timberrequired. The forest of Pinardel Rey was in fact plantedaround 1800 to provide thepine trees necessary for theSpanish warships. At thetime of the Battle ofTrafalgar in 1805 the navy'sforces totalled some 150ships but afterwards thepolitical situation meantthat the fleet declined andwith the loss of most of

Spain's colonies in theAmericas ships were nolonger needed in suchnumbers. Consequently thetrees in Pinar del Rey werenever cut down – hence themagnificent specimens stillgrowing there. FerdinandVII then donated the area tothe people of San Roquewho continue to enjoy ittoday.

There are two parts tothe woods, thesouthern end is a

wonderful picnic spot, fittedout in true Spanish fashionwith lots of picnic tables andbenches and barbecuefacilities. There is easyaccess on paved roads andplenty of parking. TheAlhaja stream runs throughthis area, with the Alhajadrinking fountain at themain gate and a beautiful

nature trail (the AlhajaStream Ecological Trail)along its banks. There is aNature Centre in the middleof the park with informationpoints and guides as well asa botanical garden featuringthe wide variety ofindigenous flora, severalthreatened species amongthem. The centre (run by thecouncil of San Roque andVerdemar – a “green” group)is well organised and highlythought of and has beenawarded the blue flag, justlike the Alcaidesa-Torrecarbonera andTorreguadiaro beaches.

The northern part hasbeen left in its naturalstate – vehicles are

prohibited – and is a meccafor serious walkers andramblers. There aredesignated trails with the

evocativenames ofBig UglyBird Gorgeand Eagle'sHill where,apparently,a group ofbaboonsfrom theoldAlcaidesasafari parkhave takenup residence. The park isalso home to more usualfauna such as foxes,mongoose, rabbits andmoles.

Bird watchers can havea field day in theshady glades and

open areas of Pinar del Rey,home to a wide variety,including pied and spottedflycatchers, buntings, jays,

chaffinches, chiffchaffs,willow warblers and tits,spotted woodpeckers andbee-eaters, while eagles(short-toed and booted),buzzards, and kites are to bespotted circling high abovethe canopy.

The other night whilstwatching Johnny

English The Revenge , TheReturn, The Comeback orwhatever it was, at LaTrocha in Coin, I wasunderstandably remindedof the original series ofJames Bond Films .

Before I embark on myramblings, I want to say

a big thank you to theteam who organise thefilms in English at LaTrocha. Despite not likingeverything that is offered, Ithink it is a valuablecommunity event that wedon’t want to lose, so Isupport all of them.

Getting back to mymemories of Bond, I

remember beingenthralled at the antics ofSean Connery in “FromRussia with Love” (my firstintroduction to 007) andfrom then on I washooked. I didn’t get to see“Dr No”, the first outing onfilm, until much later.

Iknow now that it’s allbunkum, but as a young

lad I loved the car chasesand the futuristic high techtoys that made up a largepart of the fun for me. Iloved all those machinegun headlights, poisondart cigarette lighters andsteel rimmed bowler hatstogether with all of theother wonderful, andsometimes ridiculousgadgets that appeared inthe movies.

Ithink it was my exposureto these films that fed my

liking of all things “tech”and as I have aged, I noticemany of these thingscreeping into everyday life.I mean who would havethought back then wewould be walking aroundwith mini computers likesmartphones and Ipadsand getting our freedriving directions fromthat little woman who livesin that small box you stickon your windscreen , whoin turn gets herinformation from a satelliteorbiting around the earth.Back then I used to thinkthe TELEX was a fantasticinvention!

Whilst researching forthis article, I

discovered that there havebeen more than twentyfilms in the Bond series,despite Ian Fleming only

having written twelvenovels – the first being in1953. I also discoveredthat other noted authorslike Kingsley Amis, JeffreyDeaver, and JohnGardener have writtenBond novels. I also wasn’taware that Ian Fleminghad died so long ago(1964).

Many readers will nodoubt be aware of

many of the films and Ithink they can be likenedto Marmite, in that youeither love them or hatethem. I for one love themand always have. Mypreference is for the SeanConnery incarnations andI never really saw RogerMoore as a credible 007,for me he was just playingaround with the role. I dogive credit though toTimothy Dalton who tookup the mantle for “TheLiving Daylights” in 1987and “Licence To Kill” in1989. In these two films Ithink he brought out thedarker side of Bond andwas altogether lessfrivolous in the role.

Isort of liked PierceBrosnan who took over in

1995 and remained until2002 having completedfour further Bond films andfor me the jury is still outon Daniel Craig. I havenever seen “On HerMajesty’s Secret Service”starring the one-offGeorge Lazenby andmaybe I should add thatto my to do list. It shouldmake for a nice rainySunday afternoon film.

Spoofs of Bond are notlimited to Jonny

English, there have been anumber of other offeringslike the Austin Powersmovies and Casino Royalefrom 1967 with DavidNiven. The Bond characteris said to have spawned anumber of TV series –’parodies like Our ManFlint, The Man From Uncle,Get Smart and The MattHelm movies, to name afew. As far as I can discover,Bond number 23 iscurrently on hold due tofinancial constraints,although with all theproduct placement dealswith Rolex, Aston Martin,BMW and Bentley to behad, I can’t see it being toolong before we are allshaken if not stirred by thenext one.

There have been somehuge changes occurring recently and the big difference is that in the past youwere always waiting or depending upon others to get things started or in someway providing for you. A certain relationship may need re-defining and it will be important to setbottom lines and let the other party know how much you are prepared to putup with. Heat the oil in a large saucepan (or preferably a pressure cooker) and add the onion,carrot and potato. Cook until the onion is soft. Add the pumpkin and stock. Bring to theboil and add the passata. Cover and simmer gently until the vegetables are soft andtender. Add the curry powder and paprika and then simmer for a further 5 minutes.Blend with a hand blender, or cool and liquidise. Season to taste with salt and pepper.

Serve into warm bowls with a drizzle of cream and a sprinkle of pumpkin seeds.

There are basically three types oftelescope available – a refractor, a

reflector and a Cassegrain orCatadioptric telescope. But they all dothe same thing, which is to gather asmuch light as possible from a faintobject and then magnify the image.

Arefractor telescope is what mostpeople think of in telescopes. It has

an objective lens at one end that collectsthe light and sends it straight down thetube to an eyepiece at the other end thatyou look through. A reflector telescopeuses a curved mirror at the far end of thetelescope to collect the light and thenreflects it back up the tube to anothermirror which angles the image to 90° tocome out of the side of the telescopeinto the eyepiece. A Cassegraintelescope is almost a mixture of the two;it uses a lens and a mirror to reflect theimage back up the tube to a smallermirror which then reflects it back downthe tube again to come out through ahole in the centre of the main mirrorand into the eyepiece.

Each telescope has its own good andbad points. A refractor telescope can

be used to look at objects on the Earthsuch as ships and other distant objectswhile a reflector always gives an ‘upsidedown/left to right’ image because of themirrors. This inverted image doesn’tmatter when looking at celestial objectsbut is useless for looking at Earth boundobjects. But because mirrors arecheaper to make than lenses thenreflectors tend to cost less thanrefractors.

Size matters in telescopes, it is thelight collecting properties that areimportant and the bigger the telescopethen the more light it can collect. Arefractor with less than a 3” lens or areflector with less than a 6” mirror isfrankly not worth paying for. Advertisingthat claims 200, 300 or even 400 timesmagnification should also be avoided asit is not the telescope that magnifies theimage it is the eyepiece. And a decenttelescope should come with a selectionof at least two or three interchangeableeyepieces.

Eyepieces come in a variety of sizesand the smaller the eyepiece the

bigger the magnification – so a 20mmeyepiece on a 6” reflector telescope willgive a magnification of about 35 times,

while a 6mm eyepiece will magnify toaround 120 times. But there is a downside to magnification, the more youmagnify the image the fainter and lessclear it will become so only objects suchas the Moon or the brighter planets willbenefit from higher magnification.Faint, deep sky objects such as galaxiesand nebulas always look better with lowmagnification.

So what can you expect to see throughyour telescope? Well don’t be misledby images you see in magazines or ontelevision. These wonderful full-colourpictures of nebulas and galaxies havebeen taken with telescopes costingmillions of pounds and are usually theresult of lengthy time exposures usingspecialised cameras taking multipleimages all combined together. The bestthat you will see of a nebula or galaxy isa fuzzy blob. You will however be able tosee craters and mountains on theMoon, Jupiter and its four largestmoons, the rings of Saturn and thechanging phases of Venus. Myriads offaint stars in the Milky Way and otherobjects such as comets that are usuallytoo faint to be seen with the naked eyewill now be visible. But you mustNEVER look at the Sun through atelescope, it will burn your eye andcause irreparable damage.

My advice then is unless you intendto use your telescope to its

maximum and not just leave itcollecting dust in a cupboard, then Iwould recommend buying a pair ofbinoculars. £100 will buy a ‘toy’telescope but £100 spent on binocularswill get a very respectable pair and youwill see just as much through them, ifnot more, than with a cheap telescope.

I would like to make knownmy special experience withpickpockets on the Costa delSol, in order to give a warningto helpful decent people. OnSeptember 8th, I enteredMercadona supermarket inBenalmádena-Costa, AvenidaFederico García Lorca, just tobuy some milk. There anunknown man asked me tohelp him lift down a carton ofmilk from the top shelf. Ofcourse I helped him. But he

created confusion bythrowing down a pack of milk(among other things). Anaccomplice of his tookadvantage of this confusionpulling the wallet out of myJeans pocket. So, almost allmy money for the month wasstolen. Some minutes later,with the monitoring device ofMercadona supermarket onecould see on the screen mewith the pickpockets on theirreckless work. Certainly, I

have reported the incident tothe police. But my money isgone, and it is quite unlikelythat I’ll get it back.With this mail I want to givehelpful people a warning thatthey should be very careful incase they are asked in asupermarket on the Costa delSol for help by strangers.Those strangers might bepickpockets. I am always being asked about which telescope

someone should buy and what they can expect to seewith it.

Spanishlaw dictates: All EU citizensplanning to reside in Spainfor more than three monthsshould register in person atthe Oficina de Extranjeros intheir province of residence orat designated Police stations.Upon registration you will beissued with a certificateprinted on green paper. (NB:This is not a valid form of IDbut does prove your NIE.)

I have confirmed with theAgencia Tributaria (TheSpanish Tax Office) that aperson so registered isthereby tax resident in Spainand thus must make taxreturns on their worldwideincome and assets.

Any non-resident bankaccounts will be frozen andany other duties orobligations of a resident willapply. This probably includesnot being able to drive a non-Spanish registered vehicle,worldwide inheritance tax,etc. but the non-residentForeign Owners Property Taxdoes not apply.

The registration may becancelled by attending theoffice where it was issued,with your original passportand a copy, and completingan application form (induplicate). If you haveregistered and are leavingSpain not to cancel theregistration would mean youcontinue to be tax resident.

I am not sure what liabilityone would still have for theperiod for which they weretax resident.

Editor says: There seems to bea worrying “probably” and an“I am not sure” in this letter soI will be asking forclarification over the nextweek as to the legal standingof the residencia and will havean article in the paper toclarify exactly where youstand. However, if you live in acountry and it is arequirement of that country’slaw that you become aresident after that time, youshould do so. Don’t forget that,if you do not comply with thelaw, you could be liable todeportation!

Italy’s Marco Simoncelli dies in SepangItaly’s Marco Simoncellidied on Sunday after ahorrific crash on the secondlap of the MalaysianMotoGP at Sepang. He was

taken by ambulance to themedical centre, and the racewas immediately stoppedand later cancelled so thatmedical staff could continueto focus completely ontreating the Italian. Sadly,Simoncelli succumbed tohis injuries at 16:56 localtime.The Italian fell from

fourth place after losing thefront of his motorcyclethrough the right-hand turn

which had regained gripand was partially upright asit veered back across to thecentre of the track.

Lying sideways and stillfacing forwards, the GresiniHonda rider was then hitfrom behind by ColinEdwards and ValentinoRossi, who had no chance toavoid the sliding #58.Simoncelli's helmet cameoff during those impacts,

which occurred at almostthe same time and leftSimoncelli motionless onthe track.

Very much a rising star,the 24-year-old was the 2008250cc world champion andhad claimed his best everMotoGP finish of secondplace just one week earlier atPhillip Island.

In a cruel twist of fate,Simoncelli's death is the firstin the premier-class sinceanother Gresini rider,Daijiro Kato, was killed atthe 2003 Japanese GrandPrix.

The Disney event featuredthe weakest field of anyDonald has played this year.It's the final tournament ofthe PGA Tour season, filledwith dozens of players welldown the money list whowere desperate to keep theircards for next year. It hardlycompares with his wins atthe Match PlayChampionship in Arizona orEurope's flagship event atWentworth.

Perhaps it was only fittingthat after Donald ran off sixbirdies on the back nineSunday and closed with an 8-under 64 to win theChildren's Miracle NetworkClassic, he struggled to hoistthe bronze trophy over hishead. "It's about a 60-pound

It felt about as heavy as theburden of expectations heplaced on himself all week.Donald knew that his bestchance to win the PGA Tourmoney title, and state aconvincing case that heshould be voted player of theyear, was to win Disney.
