    Warren County Report has re-ceived inormation that Front Royalown Attorney om Robinett willsoon be added as a ourth individualdeendant in a $30-million lawsuitled by local representatives o thecompany that brought the initial so-lar power proposal to the town gov-ernment in mid 009. At the time theSolAVerde lawsuit was led in July,three John Does were listed as po-tential deendants yet to be identiedby the plaintis.

    I so named, Robinett will join sit-ting town Councilmen om Sayre,Carson Lauder and Vice Mayor ChrisHolloway as individually named de-endants in the deamation o char-acter and illegal intererence in abusiness contract lawsuit brought bySolAVerde principals and local busi-nessmen Greg Horton (Arctic Air)and Donnie Poe (Poe Construction).

    Te own o Front Royal is alsonamed as a deendant in the suitwhich seeks $30 million in actualdamages, responsibility or whichwould be split equally among alldeendants, as well as an additional

    $350,000 per deendant in punitivedamages. As o September all 6thJudicial Circuit judges recused them-selves rom the case due to Sayrespresence as a deendant who alsopractices law in the 6th Judicial Dis-trict.

    As recounted in our 010 Yearin Review section, the lawsuit wasserved to the town and councilmenduring a break between a July 19work session and closed meeting. Iserved individually, it will be Robi-netts second receipt o the lawsuit.Robinett accepted the initial servingon behal o the town in his role as

    town attorney.And it is other actions alleged to

    Robinett as town attorney that haveresulted in his pending addition as adeendant in the case according to adrat o the amended complaint sentanonymously to this newspaper therst week o January.

    According to that amended com-plaint, Robinett is cited or inten-tional and malicious providing oincomplete inormation to the Rich-mond law rm o routman Sandersin seeking an answer to questionsrst raised to him by Holloway andLauder on March 30. Tose ques-tions were whether jobs and an esti-mated $1. million in direct econom-ic benet to the town cited by thenown Manager Michael Graham ina March 9 closed session could beconstrued as bribes oered by solarprincipals to the town manager.

    Te drat motion acquired by thispaper states Robinett is being addedas a deendant in his personal ca-pacity as town attorney or actionsin not providing routman Sanderswith all the acts necessary to makean inormed legal opinion. Tat itwas intentional and that it wasmalicious and intended to harm theplaintis and that [Robinett] waswell aware that SolAVerde was nota bidder in the RFP process andhe did not take steps to protect theplaintis when the inormation be-came public.

    Silek unsuccessully sought a pub-lic apology and settlement rom the

    town in the wake o the solar bribeissue going public last April 13. Atthe time the lawsuit was served Sileksaid, Tey chose to publicly deamemy clients and they chose this pro-

    in its RFP (Request or Proposals)and were not included in the writtenproposal o the company. Instead,they were apparently made secretly,and one can easily iner that theywere intended to inuence the pro-curement decision Further, such

    secret incentives likely provide a ba-sis or another company to challengethe entire procurement process.

    In preacing her opinion, Rahmanreerences the towns solar RFP (is-sued in December 009), adding, Ithas come to the own Attorneys at-tention that, during the procurementprocess, one o the top three com-panies secretly oered incentivesto the own Manager that were notcontained in its written response tothe RFP. Rahman goes on to identiythose secretly oered incentives as00 jobs and a $1. million paymentto the town.

    In sum, so long as the own Man-ager has not accepted or agreed toaccept the oer, there does not ap-pear to have been any violation o

    either the criminal statures or theVPPA (Virginia Public ProcurementAct). But, the actual oer itsel doesconstitute the type o benet thatwould be considered a bribe undereither 18.-447 or the VPPA, Rah-man concludes.

    And Robinett concludes his coverletter to council and the mayor pre-acing the Rahman opinion by stating,While secret incentives may be anormal part o private business, theyare clearly not acceptable in a publicbusiness setting.

    However, the SolAVerde lawsuitdates that companys discussion othe reerenced incentives to open

    town work sessions beginning in Au-gust 009 and notes that StandardEnergy picked up those discussionsin October 009 prior to the townissuing the RFP in December o that

    year. It adds that similar benets to

    the community are discussed in theStandard Energy January 010 RFPresponse on pages 16 and 17. It ur-ther notes that Horton and Poe werenever principals o Standard Energyand so were never involved in theStandard RFP response.

    Since the leaked bribe opinionino suraced last April, one citizenactivist and Graham supporter, re-tired U.S. Energy Department o-cial ina Hobson, has repeatedlyasserted to council, with documenta-tion submitted at meetings, that the

    job and economic benets Robinett,

    Holloway and Lauder all expressedignorance o prior to March 9, 010were documented at a series o pub-lic council work sessions and othermeetings between June and Decem-ber 009.At issue or both plaintis and at

    least one pending deendant now iswhether the inormation Robinettprovided to routman Sanders wascomplete, accurate and reected thetown attorneys ull knowledge o thecircumstance o the solar negotiatingprocess and Standard Energy RFP re-sponse.

    Robinett could not be reached orcomment on his potential inclusionas an additional deendant in thecase.

    On Jan. 4, Mayor im Darr said hewas unaware o any pending move toadd Robinett to the list o deendants

    in the case. Darr also noted that thetowns legal deense was already in

    the hands o a VirgLeague attorney (Julquestioned any levelhow a deense o the tcused ocials would presented.

    In December the Front Roy-al-Warren County Anti-LitterCouncil presented organizers othe uture Warren County DogPark with a grant award in theamount o $,500. Te undingwill be used or the purchase otrash and pet waste receptaclesor the acility.

    Te Warren County Dog Parkwill be a three-acre acility thatwill be added to the CountysEastham Park, located o o Lu-ray Avenue. A one-acre area willbe provided or smaller or moretimid pets; while an accompany-ing two acres will allow largerpets plenty o room to run. Teplanning, development, andunding o the park has comerom the combined eorts oWarren County ocials and theWarren County Dog Park Asso-ciation (WCDPA). Te WCDPAis a grassroots 501(c)3 associa-tion that was ormed to bringtogether dog lovers to promotethe establishment o o-leashrecreation in our community.

    According to AssociationPresident Kelly Walker, Com-munities benet rom dog parksbecause they make dog ownersand their pets better members otheir community.     Te acility has been modied

    to include a music room, three

    small classrooms, a computer

    lab, two large classrooms, and an

    assembly room. Support spaces

    workstations, and a break room.

    by two ederal grants; the rst

    a $46,000 grant rom the U.S.

    Small Business Administration

    and the second a $445,500 grant

    unding.

    2011 Relay kicko honors Bolton or Volunteer Leader

    Maria Bolton is tireless in her e-orts to raise money or the Ameri-can Cancer Societys annual Relay orLie. Since losing her mother, MariaF. Bolton, to cancer in 1995, she hascontributed thousands o hours otime and energy toward undraisingor the event. So it was tting thatshe be awarded the Volunteer Lead-ership Award at Front Royal chaptersNovember kick-o Rally or 011.

    But she was not expecting it.I was surprised and very honored

    that my peers see me as a leader here

    in the county, she said.She became involved with the event

    a ew years ater her mothers pass-ing and was willing to share somethoughts on the subject o cancer.She said that the time caring or hermother in her ght with the diseasewas a big learning experience. It wasone o the best times because I hadmore quality time with Mom and oneo the saddest times because it wasso limited, she said and added, Its asad act that somewhere in lie, mostpeople will be involved with some-one who has to deal with cancer.

    Trowing hersel into the positionas Relay chairman or the last three

    years, Maria has initiated dozens oun and sometimes unusual waysto raise money. One o those was

    sparked by the act that last yearsome members were irritated at dogsbeing barred by the no pet rule at theocial Relay or Lie camp-out.

    Why not give them an event otheir own? And raise money at thesame time?

    And so was born the rst annualBark For Lie Relay this year. wen-ty-nine dogs were registered, and theevent took place at Randolph-MaconAcademy in Front Royal. Te our-hour canine undraiser included dogsdressed in Halloween costumes, en-thusiastically doing their laps aroundthe eld and dunking or hot dogs.Te total raised: $3,500.

    According to her sister Christine

    (Chrissy) Tomas, who is also activein the organization, Marias eorts inher chairman role has led the com-

    munity in raising over $400,000. Shedid this, Chrissy said, by tripling thenumber o people involved in Relayand involving cancer survivors in theorganization.

    Te goal now is to raise the numbero all participants rom 131 to 150and to change the total o 9 teamsto 50. Another idea being discussedis to recruit younger people and getthe inormation out to various busi-ness and banks and involve them toact as sponsors.

    Te kick-o rally held at the Ray-mond E. Santmyers Youth Centerwas attended by about 50 dedicatedand caring individuals, and plans orthe 011 Relay For Lie 1-hour over-night event were discussed. It wasscheduled it to be held rom six p.m.

    on Saturday, June 11 until SundayJune 1 at dawn. Camp is to be set upat Skyline High School ootball eldand participants will walk around theeld all night long.

    According to the American Can-cer Society (ACS), the relays are heldovernight, because cancer neversleeps.

    Luminaries, or candles com-memorating those whom cancer hasclaimed, are to be arranged aroundthe eld and lit at nine p.m.

    Maria is still the chairman o thatundraiser and she is still active inraising money or the ceremony. Teoverall goal or next year is $10,000.

    charges related to a ChristmasDay re in a small Linden Bev-erage out building they were in-

    volved in responding to. LindenBeverage is located adjacent tothe Linden Fire House.

    Darren aylor Russo, 19, o theperhaps unhappily appropriateaddress o 3701 Fiery Run Road,Linden, was arrested on Decem-ber 5th and charged with ar-son. roy Allen Elsea, 18, o 718Warren Avenue, # 4, Front Royalwas arrested on December 7thand charged with conspiracy tocommit arson.

    Although Russo was kept incustody until Dec. 7 on a $5,000secured bond imposed by countymagistrate Kathy Weakley, whenElsea was booked on Dec. 7thhe was immediately released bya male video magistrate on a$5,000 unsecured personal re-

    cognizance bond.According to the arson arrestwarrant Russo admitted set-ting the re when conrontedby County Fire Investigator Lt.Gerry Maiatico. Inormation onthe Russo warrant led by Dep-uty Chad Lamma also states thatElsea initially admitted only toseeing Russo set the re with gasrom a can that was inside there department. However, ac-cording to Elseas arrest warranthe later admitted to departmentinvestigator Maiatico that heprovided the container to Russo

    to ll with gas and use in settingthe re.

    Russo told the investigatingdeputy that he was just tryingto be a hero and be able to tellhis 5-year-old nephew he put are out.

    Santa, nor it appears countymagistrate Weakley, apparentlydoesnt reward those kinds oChristmas heroes.

    However, having at least con-tributed to Russos unortho-dox Christmas celebration and

    seeing little immediate conse-quence, Elsea then celebratedNew Years by getting chargedwith assault and battery o hisgirlriend. Elsea was booked at:38 a.m. on New Years Day andcharged with assaulting AshleyHemlick, cited as a cohabitanthousehold member in a Domes-tic Relations Court arrest war-rant. Elsea made a $1,000 se-cured bond later that day.

    Te domestic violence warrantstates Hemlick told ocers El-sea kicked her in the back and

    grabbed her neck when shetried to get to a phone to call orhelp. Ocer Jeremy Seal report-ed that Hemlick had marks onboth sides o her neck but thatElsea stated nothing happened.Te warrant adds that Hemlicktold Elsea not to return to herresidence. Elsea listed a dierentaddress, 93 Pine Shores Drive,on that warrant.

    As we tried to present a bal-anced look back at 010 we real-ized that other than some eel-good community stories, ourreview was becoming top heavywith stories revolving around theturmoil within the town govern-ment. And rather than ght cityhall you know you cant winthere we just rolled with theow o stories that jumped outat us. Because in the end that isHE SORY o 010 the ma-neuverings in and around theFront Royal own Government.

    So get your popcorn and sit backand get ready or a suspension odisbelie because honest, kids,we didnt make any o this up. Itreally happened and continuesto evolve as you will read in thenon-review section o this issue.

    Weve tried to leave room toacknowledge major capital im-provement moves o the countygovernment approval o a newcounty public saety buildingand the rst movement towardrealization o a long sought bysome counties ocials at least,

    Regional Jail. Also, weve tried to

    recall some o this communitysbrighter and more personal com-munity moments.

    And as seems to be the caseeach year as we look back, we arestruck by the old adage thingschange but they stay the same. New town council, new townmanager, new growth propos-als, new requests or town utilityextensions into the county theaces may have, in part, changed;but the basic issues and attitudessound hauntingly amiliar.

    In our opening story reviewingpivotal issues and events o 010,that change/same adage never

    seemed truer. Tese excerptsrom a discussion o development

    Perhaps buoyed by a secondCommonwealths Attorneys opin-ion he has no apparent legal con-ict o interest resulting rom roadproers oered by Front RoyalLimited Partnership (FRLP) in itsrezoning application on 149 acresnot ar rom his home, TomasSayre oten dominated a Jan. 4work session discussion o that ap-plication. Awaiting that most re-

    cent Commonwealths attorneysopinion, recently Sayre has recusedhimsel, i not exactly been silent,during discussion o the FRLP re-zoning proposal on Jan. 4 he wasmaking up or lost time.

    However, the value and accu-racy o Sayre s contributions to thediscussion o a nal, new proerpackage oered by FRLP principalDavid Vazzana prior to a Jan. 11Public Hearing and vote were con-tinually questioned by others pres-ent.

    Five times Sayre belabored theapplication and proer package orthe lack o a site plan, questioning

    how the town could be expectedto approve any rezoning without adetailed site plan to assure thingswere done as promised.

    Five times it was explained byeither another councilman, ownAttorney om Robinett or actingPlanning Director Bruce Drum-mond that by town code or evenstate law a site plan is not requiredin a rezoning application and thatother means existed to assure de-

    velopment plans were adhered to.

    Sayre repeatedly stated that or-mer mayor, councilman and cur-rent 18th District State DelegateClay Athey told him rezoning ap-plications never were approvedwithout a site plan.

    Ater Sayres third allusion toAtheys alleged site plan require-ment comment, J. Daniel Pond III,himsel a ormer councilman, vicemayor and current legal partnero Atheys, interjected. Pond, whowas present representing anotherHappy Creek area developer-prop-

    erty owner, Millennium Lotus, ex-plained he had been present dur-ing the Athey-Sayre discussion orezoning requirements.

    Pond explained that rather than asite plan requirement, Athey toldSayre it was unusual to approverezonings without a conceptualplan. Conceptual plans are notas detailed or as expensive as siteplans

    Following Ponds elaboration onAtheys comments to Sayre, MayorEugene ewalt, Vice Mayor BretHrbek and Robinett all remindedSayre that the applicant had pre-sented three conceptual plans, in-cluding one or the now proposed30 units, to council at a December008 work session at which Sayrewas present.

    thorization was given to the townattorney to proceed with thedrating o a Resolution o Cen-sure o Sayre, the councilmanappeared on WZRVs News atNoon show to deend his actionsrelated to his Dec. 8 closed doordiscussion with Judge Dennis L.Hupp. He also took the opportu-nity to attack his colleagues whomight support his censure.

    Obviously some o my councilmembers are blowing this out oproportion or political purposes.Te election starts today, Sayre,

    who is up or reelection thisspring, told WZRV News Direc-tor Mario Retrosi.

    However some o Sayres subse-quent radio remarks about whathe told Hupp in chambers haveraised urther issues about Sayresconduct and potential breacheso ethical standards.

    Following what appeared to bea great deal o existential angst, orperhaps it was just a total loss odirection and common sense, onMarch the Front Royal ownCouncil passed a motion autho-rizing the town to proceed withremoval o the Riverton Damthrough grants accessed rom theU.S. and Virginia Fish & WildlieServices.

    Te vote was 5-0 on TomasSayres motion enabling the townnot only to apply or, but also uti-lized $13,000 o ed and statemoney to tear down the long unc-tionless and occasionally deadlydam.

    However, exactly one month ear-lier on Feb. , Sayre unsuccessul-

    ly urged council to stop the grantapplication process. Such a movewould have killed the possibility oaccessing the ed and state moneyto remove the dam and created animminent $500,000 to $1 millioncost liability to the town to repairthe dam.

    At the February meeting, Sayre,who had appeared to be on boardwith the removal earlier, citedcouncil candidate and ormertown electric department headJoe Swiger as the source o inor-mation changing his stance on theadvisability o removing the dam.

    Swiger told council during Feb-ruary public comments that he be-lieved the dam could be resurrect-

    ed to some use. Consequently onFeb. , Sayres vote was the only

    one cast against allowing the grantapplication process to continue.Sayres February vote to kill theproject came despite own Man-ager Michael Grahams assurancethat continuing the applicationprocess did not commit the town

    to accept the money and removethe dam i new inormation justiy-ing its repair at town expense cameto light.

    Apparently no such inormationwas orthcoming in the interven-ing month.     that the town attorney had over-stepped his bounds in seekingan outside legal opinion. Heshouldnt have gone to anyoneuntil he got authorization romthe town council, the mayor said

    o Robinetts inquiry to Glass [Shae Parker said,] Incentives

    to the town never came orwardas part o the RFP process. Terewere discussions about scholar-ships, bringing jobs to the com-munity. But I dont understandthe idea that jobs could be con-sidered a bribe. I think a condi-tion o EDA approval o leasingland at Avtex to them was thata number o permanent jobs becreated.

    But now between the badpress, the bad egos and bad eel-ings all around, I am more con-cerned about those trying to de-rail something that could be goodor the community, that wouldbring jobs, bring scholarships orour children and green, sustain-able energy to the community,Parker concluded

    However, both Holloway andLauder are suspicious o the in-volvement o the town managerin the ongoing Standard Energy/SolAVerde negotiations.

    Why is it so important thatStandard Energy (top recom-mendation in all RFP scenarios)

    get the contract? Holloway asks.He asserts that the town attorneywitnessed what he recalled as aMarch 16 assertion by Grahamthat the town could get $1. mil-lion rom Standard i their Pur-

    chase Power Agreement (PPA)was accepted

    Both Holloway and Lauderquestioned the inormation owleading to the bribe inquiries.

    In the RFP there was no dis-cussion o incentives to the town.So why would they be discussedwith anybody? Holloway won-ders.     I his personal style or two years has been non-conronta-tional in a time o high conronta-tion in and around Front Royalsown Hall, on June 14th Mayor

    Eugene ewalt took o the kidgloves and went bare knuckled at least guratively with ele-ments within council he believesare not working in the best inter-est o the town and its citizens.

    With only one more meetinglooming beore he leaves oce

    ewalt said he was embarrassedto have had to work with somemembers o council over the pasttwo years. In his most scathingcriticism ewalt said that somecouncilmen may have lied whenthey took their oaths o oce touphold the own o Front Roy-al. As ewalt neared the end ohis statement, Councilman omSayre suddenly attempted to si-lence the mayor on a point o or-der.

    nation o why he would breaka 3-3 tie and vote to allow thepublic to see the internal coun-cil documents in question.     FRON ROYAL, Va. July 19, 010 Tree members o Front Royalown Council and the own Attor-ney (or the town) were served withlegal documents naming them asdeendants in a $30-million civil suitat a own Hall work session tonight,protesting the whole while.

    Lock em up, said newly installedCouncilman Hollis Tarpe as pro-cess server John Arena calmly wentabout his business with own PoliceLt. Clint Keller briskly raced up rombehind.

    Te council had just voted to gointo a closed session to discuss thepotential lawsuit with the town at-torney (an item conspicuously absentrom the agenda) and it appeared to

    some that one meeting had endedbut another had not yet begun asspectators, sta and reporters beganpacking their items up to leave.

    At this point, process server Arena,6-oot-9-inches tall and armed withsize 18 eet and our 154-page cop-ies o a lawsuit that could cost FrontRoyal taxpayers millions, casuallysprung into action.

    nett, thus serving notice to the towngovernment, and walked away. Ex-pressing some consternation Robi-nett said, Sir, you are going to inter-rupt a public meeting?

    Arena said nothing and methodi-cally proceeded around the tabletoward his next target, Vice MayorChris W. Holloway. Holloway sat anddidnt say anything (yet.)
