Whereas, on the basis of an indent placed by Chief Executive Officer,Shri Mata Vaishno Devi Shrine Board, Katra vide No. SMVDSB/CEO/186-189 dated 29-05-2014 a notification under section 4 (1) was issued byCollector, Land Acquisition (ACR), Reasi vide No. Col/LA/ACR/Reasi/14/206-209 dated 11-10-2014 for land measuring 286 Kanals and 13 Marlas(local 181 Kanals 06 Marlas standard) situated in Village Hut, Tehsil Katra,District Reasi ; and

Whereas, the notification issued by the Collector, Land Acquisition(ACR), Reasi under section 4(1) of the J&K State Land Acquisition Act,was serve upon the interested persons for filing objections ; and

Whereas, the Collector, Land Acquisition (ACR), Reasi vide hisletter No. Col/LA/ACR/Reasi/15/152 dated 22-05-2015 has informed thatsome objections were received from the land owners wherein the notificationhas been contended being depriving them of their only source of livelihood,besides dwellings, as they would be rendered landless/homeless due to thisacquisition ; and

Whereas, an opportunity of being heard was given to all the 14objectors vide Notice No. Col/LA/ACR/Reasi/14/379-382 dated30-03-2015 by the Collector, Land Acquisition (ACR), Reasi, out of whichonly twelve (12) objectors appeared and filed their written objectionsthat they belonged to agricultural class and had no other land for theirsustenance ; and

Whereas, a notice was also issued by the Collector, Land Acquisition(ACR), Reasi vide No. Col/LA/ACR/Reasi/15/63-66 dated 22-04-2015 tothe remaining two (02) objectors but they did not turn up for recording theirstatements ; and

Whereas, a camp was held in the Village Hut on 23-12-2015 by theCollector, Land Acquisition (ACR), Reasi where the land owners were toldthat they will be compensated suitably for the land as per the prevailingmarket rates in the village and a plan for their rehabilitation was alsodiscussed with them but they did not agree to any proposal/scheme ; and

Whereas, the land owners were again called by the Collector, LandAcquisition (ACR), Reasi on 02-01-2016 for final hearing but the land ownerscontinued to be adamant on their stand for not parting with their land ; and

Whereas, the Collector, Land Acquisition (ACR), Reasi has reportedthat since the land for construction of Heliport at Village Hut is urgentlyrequired for the public purpose, the personal interests of the land ownersare subservient to general public interest and hence the objections filed bythe land owners are not maintainable ; and

Whereas, the report furnished by Collector, Land Acquisition (ACR),Reasi vide letter referred to above duly endorsed by Deputy Commissioner,

Reasi vide No. DC/Rsi/15-16/2653-55/SQ dated 15-01-2016, DivisionalCommissioner, Jammu vide No. 502/237/Heliport/Hut/Rsi/16/2622-23dated 29-01-2016 and Financial Commissioner (Revenue), J&K vide hisNo. FC-LS/LA-4392/2015 dated 03-02-2016 concludes that the objectionsfiled by the land owners are not maintainable and are liable to be rejected ;and

Whereas, the Government is satisfied on the basis of the report asaforesaid that the land particulars whereof are mentioned in Annexure “A”to this notification, is required for public purposes i. e. for construction ofHeliport at Village Hut, Tehsil Katra, District Reasi.

Now, therefore, in pursuance of section 6 of the J&K State LandAcquisition Act, Samvat 1990, it is declared that the land measuring286 Kanals 13 Marlas (local 181 Kanals 06 Marlas standard) situated atVillage Hut, Tehsil Katra, District Reasi details whereof are indicated inAnnexure “A” to this notification is required for public purpose i. e. forconstruction of Heliport at Village Hut. Further, the Collector, LandAcquisition (ACR), Reasi is directed under section 7 of the said Act to takeorder for acquisition of the said land after giving prescribed notice to theinterested person(s) as required under the Land Acquisition Act/Rules.

However, the Collector concerned shall be personally responsible forproper title verification of all types of land involved in the case, andapportionment of compensation in respect of all the interested persons/rightful claimants in accordance with the relevant laws/rules in force whilemaking final award in the case.

SRO-114.––In exercise of powers conferred by section 26 ofthe Jammu and Kashmir Private Security Agencies (Regulation)Act, 2015 (Act No. IX of 2015), the Governor hereby make the followingrules, namely :––

1. Short title and commencement.––(1) These rules may be calledthe Jammu and Kashmir Private Security Agencies (Regulation)Rules, 2016.

2. They shall come into force from the date of their publication in theOfficial Gazette.

2. Definitions.––(1) In these rules, unless the context otherwiseprovides,––

(a) “Act” means the Jammu and Kashmir Private SecurityAgencies (Regulation) Act, 2015 ;

(b) “Controlling Authority” means the Controlling Authorityappointed under sub-section (1) of section 3 ;

(c) “Form” means a Form appended to these rules ;

(d) “Government” means the Government of Jammu and Kashmir ;

(e) “Guard” means the Private Security Guard as defined inclause (i) of section 2 of the Act ;

(f) “License” means a license as under clause (d) of section 2 ofthe Act ;

(g) “Rules” means the Jammu and Kashmir Private SecurityAgencies (Regulation) Rules, 2016.

(2) Words and expressions used in the rules but not defined aboveshall have the same meaning(s) respectively assigned to them in the Act.

3. Manner of making application for grant of license.––(1) Everyapplication by an Agency for the grant of a license under sub-section (1) ofsection 6 of the Act shall be made to the Controlling Authority in the formatprescribed in Form V.

2. Every application referred to in sub-rule (1) above shall beaccompanied by fee as specified under sub-section (2) of section 6 of theAct, in the form of crossed bank draft or banker’s cheque payable to theControlling Authority, as under :––

(a) Rs. 5000/- only, if the Agency is operating in one district ;

(b) Rs. 10,000/- only, if the Agency is operating in more than onebut up to five districts ;

(c) Rs. 20,000/- only, if the Agency is operating in the whole State.

3. Every application referred to in sub-rule (1) above shall be eitherpersonally delivered to the Controlling Authority or sent to him by registeredpost or through a representative :

Provided that where an application is delivered personally or througha representative, the Controlling Authority shall, after noting thereon thedate of receipt of the application, acknowledge the receipt to the applicantor his representative, as the case may be.

4. Verification of the antecedents of the applicant(s).––(1) Everyapplicant while making an application to the Controlling Authority for theissue of a fresh license or renewal shall enclose the Form-I duly filled in allrespects for verification of his antecedents. In case, the applicant is acompany or a firm, or an association of persons, separate Form-I for everyproprietor or shareholder or partner or director of the company would berequired to be enclosed, as if they were also the independent applicants.

(2) On receipt of the application, the Controlling Authority shall makesuch inquiries, as it considers necessary to verify the contents of theapplication and particulars in Form-I.

(3) The Controlling Authority or any officer authorized by him, shallforward the application along with its attachments to the ClD and the DistrictSuperintendent of Police concerned for verification/report of particulars ofthe applicant and recommendations thereof.

(4) On the basis of verification so conducted, the DistrictSuperintendent of Police and the CID will give its No Objection or otherwise,as the case may be, to the commencement of the activities by the Agencyin a district(s).

(5) The CID and the District Superintendent of Police shall furnishthe requisite No Objection or otherwise within thirty (30) days of receipt of

requisition from the Controlling Authority or any other officer authorizedfor the purpose.

(6) The CID and the District Superintendent of Police in addition tothe verification of antecedents of every individual in whose name theantecedent form is filled up, shall also furnish the following information :––

(a) Whether the applicant is/was indulging in activities prejudicialto the National Security or Public Order and if so, detailsthereof ; and

(b) Whether the applicant or the company earlier operated anyPrivate Security Agency, either individually or in partnershipof others and if so, the details thereof ; and

(c) Whether the applicant possesses any special qualification orskill, which may facilitate his operations of Private SecurityAgency.

5. Verification of character and antecedents of the guard.––(1) Before any person is employed or engaged as a guard or supervisor, theAgency shall satisfy itself about the character and antecedents of suchperson in anyone or more of the following manner :––

(a) by verifying the character and antecedents of the person byitself ;

(b) by relying upon the character and antecedent verificationcertificate produced by the person to the satisfaction of theAgency :

Provided that the character and antecedent certificate shallbe valid only if the Agency does not have any adverse reportregarding the person’s character and antecedents from anyother source.

(c) by relying on the report issued by the concerned DistrictSuperintendent of Police or higher rank posted in the saiddistrict and No Objection Certificate from CID, J&K.

(2) The person seeking employment or engagement as guard orsupervisor shall submit the information/particulars in Form-II to the Agency.In case, the person has stayed in more than one district during the last threeyears, he shall have to submit a separate form for each district.

(3) The Agency shall cause an inquiry into the correctness of theparticulars filled in by the applicant in Form-II either by itself or by sendingthe form to the respective District Superintendent of Police and CIDHeadquarters, J&K. Where Form-II is forwarded to the DistrictSuperintendent of Police for verification, the Agency shall pay a fee ofRs. 50/- in the form of a Treasury Receipt creditable to Major Head-0055.

(4) The police authorities shall ensure that verification of characterand antecedents shall be conducted in a similar manner in which theverification of Police Constable is conducted for appointment in PoliceDepartment and verification report is issued within ninety days of the receiptof the character and antecedent from the Agency in a sealed cover.

(5) Character and antecedents verification report once issued willremain valid for three years.

(6) The Agency shall either based on report of the DistrictSuperintendent of Police or having been satisfied as to the correctness ofthe particulars of the applicant by an inquiry conducted by itself, issueCharacter and Antecedent Certificate in Form-III :

Provided that no such certificate shall be cancelled or withdrawnexcept in circumstances where the police report is cancelled by the DistrictSP concerned or the persons ceases to be an employee of the Agency.

6. Security training.––(1) The training for the guards will bemandatory and shall comprise the following subjects, namely :––

(a) conduct in public and correct wearing of uniform ;

(b) physical fitness training ;

(d) fire-fighting ;

(e) crowd control ;

(f) examining/identification of the papers including identity cards,passports and smart cards ;

(g) identification of improvised explosive devices ;

(h) first aid ;

(i) crisis response and disasters management ;

(j) defensive driving (compulsory for the driver of armouredvehicle and optional for others) ;

(k) handling and operation of non-prohibited weapons andfirearms (optional) ;

(1) rudimentary knowledge of Ranbir Penal Code, Samvat 1989(Act No. XII of 1989) right to private defense, procedurefor lodging First Information Report in the Police Station,Arms Act (only operative sections) ; Explosives Act(operative sections) ;

(m) badges of rank in police and military forces ;

(n) identification of different types of arms in use in public andpolice ;

(o) use of security equipments and devices (like security alarmsand screening equipments) ; and

(p) leadership and management (for supervisors only).

(2) The duration of the training shall be for a minimum period ofhundred hours of theoretical instruction and sixty hours of practical training,spread over at least, twenty working days in the recognized training Institutesof Police and Central Armed Forces to imbibe and instill mental alertness,confidence, drill and discipline besides knowhow of electronic securitygadgetry and arms/explosives. The payment for training will be borne bythe Agency :

Provided that such training may not be required in case of a personwho has the experience of having served in Armed or Police Forces of theUnion or the Police Force of the State for a period of not less than 5 yearsor who has worked in Home Guards Organization or in Fire ServicesDepartment for not less than 8 years and is physically fit.

(3) On completion of the training, each successful trainee will beawarded a certificate in Form-IV by the recognized training institute. Allcertificates issued in Form-IV to any person under these rules shall havethe photograph of the holder embedded in it.

(4) The Controlling Authority will inspect the functioning of the trainingfacilities from time to time. Normally such inspection will be conducted atleast twice a year.

(5) All the Agencies shall submit a list of successful trainees tothe Controlling Authority inter alia indicating therein (a) name andaddress of the institute, (b) particulars of the training guards/supervisors,(c) duration of training, (d) performance during training, (e) name anddesignation of the person authorized to issue certificates.

7. Standard of physical fitness for guards.––(1) A person shallbe eligible for being engaged or employed as a guard if he fulfills thestandards of physical fitness as specified below :––

(i) an able bodied person with a clear vision with or withoutcorrective lenses and shall not have such low vision as torender him unfit for duty of a supervisor or guard ;

(ii) should be free from any hearing defect and should be able tohear and respond to the spoken voice and the alarms generatedby security equipments ;

(iii) should have dexterity and strength to perform searches,handle objects and use force for restraining the individuals incase of need ;

(iv) should be free from evidence of any contagious or infectiousdisease and should not be suffering from any disease whichis likely to be aggravated by service or is likely to render himunfit for service or endanger the health of the public.

(2) Every Agency shall ensure that every guard working for itundergoes a medical examination after every twelve months from his lastsuch examination, so as to ensure to continued maintenance of physicalstandard as specified.

(3) The guard shall produce the medical fitness certificate fromauthorized medical officer registered with any of the Medical Councils of aState.

8. Provision for supervisors.––(1) For the purpose of supervisingthe guards, the Agency shall employ or engage one supervisor to supervisethe work of not more than fifteen guards.

(2) In case, the guards are on security duty in different premises andit is not practicable to supervise their work by one supervisor, the Agencyshall depute such number of supervisors so that at least for every six privatesecurity guards there is one supervisor available for assistance, advice andsupervision.

9. Grant of license.––The Controlling Authority, after receiving anapplication under sub-rule (1) of rule 3, shall grant a license to the Agencyin Form-VI after completing all the formalities and satisfying itself aboutthe suitability of the applicant and also the need for granting the license for

the area of operation applied for. This shall be done within a period of sixtydays from the date of receipt of the application :

Provided that where the Controlling Authority does not agree withthe No Objection Certificate from the concerned police authority, he wouldbriefly record the reasons of his disagreement and place the matter beforethe Government upon the decision of the Government, and the ControllingAuthority may proceed to grant or refuse the license, as the case may be.

(2) The Controlling Authority may review the continuation orotherwise of license of the Agency which may not have adhered to theconditions of license.

(3) The license if granted shall be valid for a period of fiveyears, unless the same is cancelled by the Controlling Authority undersub-section (1) of section 12 of the Act.

(4) The Controlling Authority shall not refuse the license unless theapplicant has been given a reasonable opportunity of being heard and thegrounds on which license is refused shall be recorded in the order.

10. Conditions for grant of license.––(1) The licensee shallsuccessfully undergo training relating to the private security service asnotified by the Government within the time frame fixed by it.

(2) The licensee shall inform the Controlling Authority regarding anychange in the address of persons forming the Agency and change ofmanagement within seven days of such change.

(3) The licensee shall immediately intimate the Controlling Authorityabout any criminal charge framed against the persons forming the Agencyor against the guard engaged or employed by the Agency, in the course oftheir performance of duties as Agency. A copy of such communicationshall also be sent to the officer incharge of the police station where theperson charged against resides.

(4) Every licensee shall abide by the requirements of physicalstandards for the guards and their training as prescribed in these rules.

(5) Save as provided in these rules, the fees paid for the grant oflicense shall be non-refundable.

11. Renewal of license.––(1) Every Agency shall apply for renewalof license in Form-V to the Controlling Authority not less than 60 daysbefore the date of expiry of the period of validity of the license thereof.

(2) The fees chargeable for renewal of the license shall be the sameas for the grant of license thereof.

12. Conditions for renewal of license.––(1) The renewal of thelicense will be subject to the following conditions, namely :––

(i) the applicant continues to maintain his principle place ofbusiness in the jurisdiction of the Controlling Authority ;

(ii) the applicant continues to ensure the availability of the trainingfor its guards required under sub-section (2) of section 8 ofthe Act ;

(iii) the applicant continues to adhere to the conditions of license ;

(iv) the District Police has No Objection to the renewal of thelicense of the applicant.

13. Appeals and procedure.––(1) Every appeal undersub-section (1) of section 13 of the Act shall be preferred in Form-VIIsigned by the aggrieved person or any other person authorized by him inthis behalf and presented to the Appellate Authority in person or sent to himby registered post.

(2) Every appeal shall be accompanied by a certified copy of theorder appealed against.

14. Register to be maintained by the Agency.––Register requiredto be maintained under the Act by the Agency shall be in Form-VIII andshall contain the details as per section 14 of the Act.

15. Photo identity card.––(1) The Agency shall issue an identitycard to every guard in Form-IX. The identity card shall contain a full-facecolour photo of the guard, name of the Agency, name of the guard,designation, identification number and the period of validity. Any change inthe particulars of the guard shall be entered therein on his identity card.The photo identity card issued to guard shall be returned to the Agencyissuing it, once he is no longer on the roles of the Agency.

(2) Any loss or theft of photo identity card shall immediately bebrought to the notice of the Agency that issued it.

16. Miscellaneous.––(1) Notwithstanding whether the Agencymandates its private security guards to put on uniform while on duty or not,every Agency will issue and make it obligatory for its guards to put on––

(a) an arm badge distinguishing the Agency ;

(b) shoulder or chest badge to indicate his position in theorganization ;

(c) whistle attached to the whistle cord and to be kept in the leftpocket ;

(d) shoes with eyelet and laces ;

(e) a headgear which may also carry the distinguishing mark ofthe Agency ;

(f) the uniform of the security guard shall be different from thepolice and other forces with regard to badges and none ofthe guards/supervisors should be permitted to wearpresidential stars as shoulder/cap badges.

(2) The clothes worn by the guard while on active duty shall be suchthat they do not hamper in his efficient performance. In particular they willneither be too tight nor too loose as to obstruct movement or bending of hislimbs.

(3) Every guard will carry a notebook and a writing instrument withhim.

(4) Every guard while on active security duty will wear and displayphoto identity card issued under these rules on his outer most garmentabove waist level in a conspicuous manner.

(5) If a guard is involved in a criminal case at the place of his duty, itis the Agency which shall be responsible for reporting the matter to thenearest Police Station as well as the Police Station of his native place.

(6) An arms license will be issued to the guard only in his personalcapacity by the licensing authority under the Arms Act/Rules after fulfillingthe conditions laid therein.

(7) The Agency shall ensure recording of CCTV footage in thepremises where the services will be provided and shall save records up totwo months for facilitating the investigating agencies in any case(s) ifneed be.

(8) Not more than two guards may be deployed for providing securityto any person at any time at any place.

(9) The Agency shall deploy the guards only for the purpose of privatesecurity as defined under clause (g) of section 2 of the Act.

(10) The Agency shall provide list of employees to the Superintendentof Police/District Magistrate of the territorial district on monthly basis so asto have first hand information for maintaining of surveillance.

(11) The Controlling Authority may, at any time, enter the premisesof the Agency, inspect and examine the place of business, the records,accounts and other documents connected with the license and may takerecord(s), copy of any relevant document(s).

(12) The fee charged for the services rendered by the Agency shallbe reasonable and if at any point of time, it is reported to the Controlling

Authority that the fee charged is not reasonable or uniform, he may issueappropriate directions to the Agency for bringing rationality in the fees socharged.

(13) The Agency may consider covering each guard/supervisor underinsurance cover.

8. Renewal of Licenses :

Licenses shall be renewed subject to depositing of annual prescribedfee and on production of NOC from the Commercial Taxes Departmentand clearance of taxes/levies payable to the Excise Department in themonth of March every year failure to adherence of these conditions shallautomatically revoke the license. However, the license fee and otherconditions are subject to change annually at the discretion of the department.In view of any shift in the policy in future, this provision would undergochange in the context of the changed policy.

9. Sub-Vend Fee :

Sub-Vend fee shall be charged on quarterly basis @ Rs. 1,50,000/-per quarter to be deposited at the beginning of each quarter by the JKEL-2 Licensees operating Sub-Vends on terms and conditions as stipulated bythe department from time to time. This provision will last only till the policy of

11. Engagement of Salesman/Barman/Manager :

All the licensees within a week of engagement of any new Salesman/Barman/Manager will intimate the department the full particulars of suchstaff along with character certificate from the competent authority. Failureto do so will invite penalties as described by the department from time totime.

12. Grant of Licenses :

A. Wholesale Trade :

The present policy of issuing licenses in Form JKEL-1,JKEL-1A, JKEL-1 B, JKEL-1W shall continue.

B. Retail :

(i) No JKEL-2 Licenses will be issued till the final disposal ofthe case pending in the Hon’ble High Court of J&K titledSandhya Devi V/s. State and Ors. and other allied matter.The Sub-Vends shall be permitted in accordance with theprovisions of the J&K Excise Act, Svt. 1958 and the J&KLiquor Licence and Sale Rules, 1984. However, theapplications pertaining to uncovered areas as defined bythe department shall be considered on case to case basison merits and in accordance with the procedure to be issuedby the department separately.

(ii) The present policy for the grant of licenses for retail sale ofIMFL viz. Bar with Hotel (JKEL-3), Bar with Banquet(JKEL-3A), Bar with Restaurant or Cinema Theatre or DakBungalow (JKEL-4), (JKEL-4A), (JKEL-4B), (JKEL-4C),Unit Run Canteen by Army Paramilitary Forces (JKEL-5),Master Canteen (JKEL-5A) and Club (JKEL-7),(JKEL-7A), (JKEL-7B), (JKEL-7C) etc. shall continue.

C. Manufacture/Bottling :

The existing Policy of issuence of Licenses for Distilleries,Breweries and Bottling Plants in the State as laid down videGovernment Order No. 99-F of 2003 dated 07-04-2003 read withGovernment Order No. 156-F of 2003 dated 22-07-2003 on needbasis shall continue.

13. Inclusion of different sources in one Licence :

An already issued JKEL-1A licensee shall be allowed to import liquorfrom any of its own distilleries or the distilleries with which it has a validagreement to produce or bottle liquor on its behalf located outside the StateSubject to the condition that license fee of Rs. 3.00 lac in full is paid foreach source.

14. Fixation of Maximum Reatil Price :

(a) The Maximum Retail Price (MRP) of all types of liquor includingJK Special Whisky and Beer shall continue to be fixed by theExcise Commissioner for the year 2016-17.

(b) There will be differentiated MRP taking into account thetransportation and any other valid costs as approved by theExcise Department for the Kashmir Province and LadakhRegion.

(c) The price of all the brands of liquor incuding Beer and RTDshall be so increased and computed that the retail prices arerounded off to the next multiple of Rs. 10/- and increased amountexcluding Sales Tax shall be collected by the department onmonthly basis.

15. All Liquors to be ENA Based :

IMFL manufactured locally or imported from outside the State (otherthan Foreign Liquor bottled in origin/bottled in India or Malt Whisky) shall

be ENA based only and use of rectified spirit as a base in manufacture/saleof liquor for consumption in civil market and CSD/PMF shall remain banned.

16. Restriction on Import of Economy Brands :

There shall be a ban on import of Economy Brands into the State asnotified by the Excise Department.

17. Af fixation of Security Hologram on JK Special Whiskyand IMFL :

In order to safeguard against spurious, adulterated liquor as well assmuggled liquor, the manufacturers of JK Special Whisky and IMFL aswell as Importers (JKEL-1A, JKEL-1B and JKEL-1W) of IMFL/Wineetc. shall continue to affix Security Hologram approved by the ExciseDepartment in the manner prescribed. Penalties for violation, if any, madeby the licensee in use of hologram will be the same as envisaged under theJ&K Excise Act and the rules framed thereunder.

18. Revalidation of Permits :

The permit issuing authority after charging revalidation fee ofRs. 2000/-, may revalidate a permit which remains unexecuted or becomestime barred if there are valid grounds to be satisfied with the reasons fornon-execution.

19. Social Responsibility Corpus Fund :

The department will make an equal budgetary support to thecontribution to be made by the stakeholders/liquor industry to the SocialResponsibility Corpus Fund which will be used for the support to the De-Addiction Centers, measures to reduce the incidence of drunken driving,promoting road safety and other similar purposes to be decided by thedepartment.

This notification shall come in force with immediate effect.

continue to be treated as ordinarily residents of their respective places forinclusion/retention of their names in the electoral roll of the concernedconstituency despite their migration and as such their names were allowed tobe incorporated in the electoral rolls summarily revised under the order of theElection Commission with reference to 01-01-2016 as the qualifying date.

NOW, THEREFORE, the Election Commission of India, in exerciseof powers conferred by section 36-A (2) of the Jammu and KashmirRepresentation of the People Act, 1957, and after consultation with the StateGovernment, for the purposes of giving votes at the bye-election from the40-Anantnag Legislative Assembly Constituency of Jammu and Kashmir beingheld in pursuance of the notification issued by the Commission undersection 152 of the said Act, hereby specifies the aforesaid migrant electorsenrolled 40-Anantnag Assembly Constituency, who are at present residing atvarious camps at Udhampur, Jammu, Delhi etc., outside their place of ordinaryresidence, other than those who have been notified under section 70 (c) of theJammu and Kashmir Representation of the People Act, 1957 to vote by postalballot, as the class of persons for whom special polling stations shall be providedoutside the territorial limits of the Assembly Constituencies concerned in termsof section 36-A (1) of the said Act.
