How do you make a helicopter safer to fly? You crash one.

NASA aeronautics researchers recently dropped a small helicopter from a height of 35 feet (10.7 m) to see whether an expandable honeycomb cushion called a deployable energy absorber could lessen the destructive force of a crash.

Researchers must analyze the test results before they can say for sure whether the deployable energy absorber worked as designed.

“I’d like to think the research we’re doing is going to end up in airframes and will potentially save lives,” said Karen Jackson, an aerospace engineer who oversaw the test at NASA’s Langley Research

Transportation Safety Board, more than 200 people are injured in helicopter accidents in the United States each year, in part because helicopters fly in riskier conditions than most other aircraft. They fly close to the ground, not far from power lines and other obstacles, and often are used for emergencies, including search and rescue and medical evacuations.

For the test at Langley, researchers used an MD-500 helicopter donated by the U.S. Army. The rotorcraft was equipped with instruments that collected 160 channels of

data. One of the four crash test dummies was a special torso model equipped with simulated internal organs. It came from the Johns Hopkins University Applied Physics Laboratory in Laurel, Md.

Technicians outfitted the underside of the helicopter’s crew and passenger compartment with the deployable energy absorber. Created by engineer Sotiris Kellas at Langley, the device is made of Kevlar and has a unique flexible

hinge design that allows the honeycomb to be packaged and remain flat until needed.

Kellas initially came up with the idea as a way to cushion the next generation of astronaut-carrying space capsules, but soon realized it had many other possible applications. So the concept became part of a helicopter drop test for the Subsonic Rotary Wing Project of NASA’s Aeronautics Research Mission Directorate in Washington.

Jackson said researchers tested the deployable energy absorber under realistic conditions. “We crash-tested the helicopter by

suspending it about 35 feet

(10.7 m) into the air using cables. Then, as

it swung to the ground, we used pyrotechnics

to remove the cables just before the helicopter hit so that it reacted like it would in a real accident,” she explained.

The test conditions imitated what would be a relatively severe helicopter crash. The flight path angle was about 33 degrees and the combined forward and vertical speeds were about 48 feet per second or 33 miles per hour (14.6 meters per second, 53.1 kph).

“We got data to validate our integrated computer models that predict how all parts of the helicopter and the occupants react in a crash. Plus the torso model test dummy will help us assess internal injuries to occupants during a helicopter crash.”

Engineers say the MD-500 survived relatively intact as a result of the honeycomb cushion. They plan to recycle the helicopter and drop it again next year, but without the deployable energy absorber attached, in order to compare the results.

(AFS) has received a Supplemental Type Certificate (STC) from the Federal Aviation Administration (FAA) for an Inlet Barrier Filter (IBF) system for the AgustaWestland AW139. A welcome equipment addition to this versatile aircraft, this new IBF prevents engine damage in adverse and ramp environments alike. AW139 operators now have the opportunity to realize the proven operating cost reductions and increased operational capabilities an IBF offers.

Donaldson’s Aerospace and Defense Group partnered with AgustaWestland, a Finmeccanica Company, to ensure the design of a well engineered system and one that addressed the AW139’s operational requirements. After successful joint development of the IBF for the AW119 series, Donaldson’s engineering department worked closely with AgustaWestland’s technical team to refine the AW139 IBF design.

“Listening to our customers’ needs and providing second-to-none customer support is critical to our team,” commented Mike Scimone, President of AFS. “Responding to operators and AgustaWestland priorities, we came up with a plan to provide an expedited and superior engine protection solution.”

existing engine doors, creating a sealed intake plenum. As with all certified Donaldson IBF’s, the AW139 system includes an alternate inlet air bypass system. This emergency bypass capability is an important IBF feature and is absent in most traditional sand filters and particle separators. A simple compact cockpit switch allows indication and activation of the bypass system. An integral Filter Maintenance Aid also allows for on-condition inspections pre- and post-flight to assist in mission planning and visual inspection of filter condition.

Providing the most comprehensive line of IBF solutions, Donaldson Aerospace and Defense is the industry leader in the design, development and manufacture of high-performance engine IBF systems for commercial and military propulsion systems. GRAND PRAIRIE, TX – In a celebration event on its Grand Prairie campus, American Eurocopter received D-Level certification from Eurocopter for the repair and overhaul of tailbooms and stabilizers for EC135 model aircraft. It becomes the first company to receive this designation outside of Europe.

“Our employees have worked very hard to achieve this designation,” said Marc Paganini, President and CEO of American Eurocopter. “This is very important for our future and it is another step in our development to better serve our customers.”

American Eurocopter can now perform all tailboom repairs for

the EC135, EC145, BO105 and BK117 at its facility in Grand Prairie, TX. Earlier in the year, the company announced that it had expanded its certification for repairs on EC135 gearboxes.

“The award of this designation is fully inline with the MRO strategy of the Eurocopter Group to provide the most advanced service and support close to our customers,” stated Serge Panabiere, Eurocopter’s Vice President of Support & Services, Repair & Overhaul. “With this designation, American Eurocopter

becomes the regional repair hub for North and South America, and will provide our customers with quicker turnarounds, decreased costs and increased satisfaction in their tailboom repairs.”

Sammy Pence, American Eurocopter Vice President of Commercial Programs and MRO, explains that the company will continue to expand its repair and overhaul programs to meet the demands of the customer. “2010 will be a busy year for us. D-level certification for our Blade shop is currently underway and by second quarter we expect to have a full airframe jig for the EC135/EC145. With these in place, we can perform any type of repair on qualified airframes.”

STRATFORD, CT -- The S-76D™ helicopter program is entering production, signifying the latest major milestone in the program that is manufacturing the next generation model of the popular S-76® helicopter.

The first S-76D helicopter airframe has entered production on the assembly line at Aero Vodochody (Aero) in the Czech Republic in preparation for the customer deliveries planned to begin in 2011. The first S-76D helicopter airframe had its fuselage joined and then entered final assembly at Aero. The fuselage is scheduled to depart Aero in April 2010 for delivery to Sikorsky Global Helicopters facility in Coatesville, PA, where final assembly and completion of the S-76D helicopters will take place.

“It has taken a tremendous amount of coordination, teamwork and dedication to reach this important milestone in the S-76D helicopter program, both within Sikorsky’s operations and with many key suppliers who have contributed to the program,” said Tim Fox, S-76D helicopter program manager. “Today we can say we are manufacturing S-76D aircraft, and we are truly excited about it.”

helicopter fuselages at an initial rate of one per month, beginning with the first fuselage due in April 2010. Full S-76D helicopter production rates are expected to be achieved in 2011.

The S-76D helicopter production effort is supported by more than 30 key suppliers. “These suppliers are committed to the program and are working collaboratively towards the delivery of the aircraft. With the airframe originating in the Czech Republic, the engines in Canada, avionics in France, and tail pylon in Turkey, to name a few components, the S-76D helicopter is truly a world citizen supported by world-class suppliers,” Fox said.

Among the S-76D helicopter’s features are all-composite, flaw-tolerant main rotor blades; an advanced Thales avionics system and autopilot; dual speed rotor with active vibration control; powerful Pratt & Whitney Canada PW210S engines; a quiet mode for enhanced public acceptance; and an optional Rotor Ice Protection System (RIPS) for all-weather capability. The S-76D helicopter also will offer an increase in useful load and extended range performance versus the S-76C+™ and S-76C++™ aircraft currently fielded.

MARIGNANE, FRANCE – Eurocopter Japan has handed over the first EC135T2i training helicopter to the Japan Maritime Self Defense Force (MSDF). The delivery ceremony took place at the Tokyo heliport in the presence of the Japan Ministry of Defense and MSDF representatives as well as Defense attachés from the German and French Embassies, manufacturer and air industry community members.

The Japanese Ministry of Defense had signed a contract for two EC135 helicopters in February this year. The first helicopter is delivered on schedule. The second helicopter is planned to be delivered in February 2010.

The helicopter will be instrumented and evaluated by MSDF Test & Evaluation air squadron before effective training starts at the Naval pilot training school by the second half of 2010.

MSDF instructor pilots were dispatched to Eurocopter Deutschland’s training academy in Donauwörth and Manching from September to November, and completed their training to obtain EC135 type rating. MSDF instructor technicians have also completed their training in Germany.

Xavier Poupardin, Eurocopter Vice President for the EC135 program, stated at the ceremony, “We are extremely proud that our helicopters have been chosen by MSDF. This clearly shows the customer’s confidence in our products. We have worked hard to deliver the first helicopter to MSDF on time, only nine months after the contract signature in February. We will continue to serve our customer for a successful start of operation and for the future helicopter deliveries.”

A second contract for three additional helicopters will follow within a few months with the target of attaining a fleet of 15 training aircraft in total for MSDF.

Tailored for advanced training missions, the EC135 is well adapted for air crews from defense forces operating new generation multi-role

or combat helicopters, such as those in Japan. In Europe, countries such as Germany, Switzerland and Spain are already using the EC135 or its military version, the EC635, for the training of their pilots.

This new fleet of EC135 training helicopters will add to the three EC225 VIP helicopters currently flying with Japan Ground Self Defense Force, which entered service two years ago.

The EC135 is a modern, light twin-engine helicopter in the three-ton class with a seating capacity of seven to eight passengers. It has good manoeuvrability, high visibility and low vibration level. Equipped with a glass cockpit and the most advanced technologies, the EC135 allows instructors to perform training missions in optimal safety conditions. It is also simple to maintain and has a low fuel consumption level, which reduces operating and overall training costs.

Thirteen years after making its debut in the market in mid-1996, more than 850 EC135 helicopters have been sold worldwide for a variety of missions ranging from pilot training, law enforcement to Emergency Medical Services (EMS)/Search and Rescue (SAR) and offshore oil and gas industry support. In Japan there are currently 50 EC135s flying for EMS missions (better known as Doctor Heli), news gathering and corporate transport operations.

Established in 1992, the Franco-German-Spanish Eurocopter Group is a Division of EADS, a world leader in aerospace, defence and related services. The Eurocopter Group employs approx. 15,600 people. In 2008, Eurocopter confirmed its position as the world’s No. 1 helicopter manufacturer in the civil and parapublic market, with a turnover of 4.5 billion Euros, orders for 715 new helicopters, and a 53 percent market share in the civil and parapublic sectors.

Eurocopter Japan Co., Ltd was etablished in April 2009 as a subsidiary of Eurocopter (90%) and Itochu Corporation (10%). In July

RIN 2120-AA64Airworthiness Directives; Eurocopter France Model EC225LP HelicoptersAGENCY: Federal Aviation Administration, DOT.ACTION: Final rule; request for comments.SUMMARY: This document publishes in the Federal Register an amendment adopting Airworthiness Directive (AD) 2009-09-51, which was sent previously to all known U.S. owners and operators of Eurocopter France (Eurocopter) Model EC225LP helicopters by individual letters.

This AD requires, before further flight, determining if the ‘’CHIP’’

detector light on the instrument panel (Vehicle Monitoring System Screen) previously illuminated. If the ‘’CHIP’’ detector light did illuminate and it illuminated because of a metal particle on the magnetic plug of the epicyclic reduction gear module (module) of the main gearbox (MGB), or if you cannot determine from the maintenance records which chip detector caused the ‘’CHIP’’ detector light to illuminate or whether the detector light stayed illuminated after the ‘’CHIP’’ detector switch was turned to the ‘’CHIP PULSE’’ setting, replacing the module with an airworthy module is required before further flight.

Also required before further flight is inspecting the MGB module magnetic chip detector electrical circuit and determining whether the system is functioning properly, including whether the ‘’CHIP’’ detector light annunciates on the instrument panel (Vehicle Monitoring System Screen). Finally, this AD requires replacing the module with an airworthy module if the ‘’CHIP’’ detector light illuminates, stays illuminated after the ‘’CHIP’’ detector switch is turned to the ‘’CHIP PULSE’’ setting, and you determine that a metal particle on the module magnetic plug caused that illumination. This amendment is prompted by a mandatory continuing airworthiness information (MCAI) AD issued by the European Aviation Safety Agency (EASA), which is the Technical Agent for the Member States of the European Community. EASA notified us of an accident that occurred April 1, 2009 on a Eurocopter Model AS332L2 helicopter and EASA advises that the ‘’cause of the accident seems to be connected with degradation of the epicyclic module of the MGB, the root cause of which is still to be determined.’’ The actions specified

by this AD are intended to prevent failure of the MGB and subsequent loss of control of the helicopter.DATES: Effective December 28, 2009, to all persons except those persons to whom it was made immediately effective by Emergency AD 2009-09-51, issued on April 17, 2009, which contained the requirements of this amendment.

Mike Kurth, the Managing Director of Boeing UK visited The Helicopter Museum in Weston-super-Mare on Friday 20th November to unveil an exciting new exhibit.

The large display comprises major components from the largest helicopter ever built in the West, the Boeing Heavy Lift Helicopter, development of which was abandoned in the late 1980s.The only example built was broken up in Alabama in 2005 and parts were secured for The Helicopter Museum by its Chairman of Trustees, Elfan Ap Rees.

“We are extremely grateful to Boeing and The MLA Prism Fund for

New exhibit unveiledjointly sponsoring the costs of transporting these parts from the U.S.A and assembling this display.” explained Mr Ap Rees.

Also attending the unveiling and representing Weston-super-Mare was Town Mayor Mike Kellaway-Marriott along with

the Museum volunteers who erected the towering

wheels and undercarriage. “The result is a unique exhibit for any aviation museum” added Mr Ap Rees.

The Heavy Lift Helicopter exhibit is now on permanent display at the Weston attraction, which famously

houses the Worlds largest collection of helicopters.

The Helicopter Museum is a registered charity and is open Wednesday – Sunday throughout the year.

MINERAL WELLS, TX – Cobham’s HeliSAS two-axis helicopter stability and autopilot system has received its first Supplemental Type Certification (STC) from the US Federal Aviation Administration (FAA) for use in a Robinson model R44 aircraft. Working with Hoh Aeronautics, Inc. of Lomita, California, Cobham is in the process of achieving HeliSAS certification for use on the Bell 206, Bell 407, Eurocopter AS350, and U.S. Navy’s Bell-made TH-57 helicopters.

The HeliSAS system offers a number of advantages over previously-certified helicopter autopilot systems in terms of

its ease-of-installation and competitive pricing. In addition, HeliSAS’ parallel design requires fewer components, significantly reducing system weight. These factors combine to make HeliSAS particularly well-suited for helicopters with hydraulic control systems. It provides helicopter pilots with precise control during all modes of flight, regardless of wind conditions or shifts in weight. The system is designed to be engaged at all times: “on” before takeoff and “off” after landing, resulting in a

significantly reduced pilot workload.

The pilot and passenger were fatally injured. The accident flight originated from Blackpool.

The pilot continued to fly towards the destination. Approximately one mile from the destination airport the helicopter experienced a dual engine flame-out. The pilot autorotated to a sports field where the helicopter landed hard, sustaining damage to the main rotor blades, tail rotor, tail boom, and horizontal stabilizer.

CEN09CA604DATE: Wednesday, Sept 23, 2009 LOCATION: Fort Worth, TXAIRCRAFT: Bell 407INjURIES: 2 Uninjured.The flight instructor was demonstrating a landing using the manual Full-Authority Digital Engine Control (FADEC) mode. While on short final, approximately three to five feet agl, the helicopter quickly descended right and forward. Suspecting wind shear, the flight instructor applied corrective controls, but was unable to reverse the downward motion prior to

ground contact. The helicopter’s left rear skid contacted the ground followed by the right rear skid before the flight instructor could bring the helicopter back to a hover. A post-flight examination of the helicopter revealed damage to the vertical stabilizer and tail boom.

WPR09FA464DATE: Thursday, Sept 24, 2009LOCATION: Tucson, AZAIRCRAFT: Eurocopter AS 350 B3INjURIES: 4 Uninjured.On September 24, 2009, at 1843 PDT, a Eurocopter AS 350 B3 experienced a loss of tail rotor authority and landed hard on the hospital landing pad, St Mary’s Helistop, Tucson, Arizona. Air Methods operated the medical transport helicopter under the provisions of Title 14 Code of Federal Regulations, Part 135. The airline transport pilot, flight nurse, medic, and patient were not injured. The helicopter was substantially damaged. Visual meteorological conditions prevailed, and a company flight plan had been filed.

The pilot reported to the Safety Board investigator that during the final phase of the landing the helicopter was about five feet over the landing pad at St Mary’s Hospital, when it started to yaw left in an uncommanded fashion. The pilot countered the yaw with right antitorque pedal, which had no effect. He then rapidly lowered the collective, landed hard, and the helicopter came to rest facing the opposite direction.

ERA09CA542DATE: Saturday, Sept 26, 2009LOCATION: Quarryville, PAAIRCRAFT: Schweizer 269CINjURIES: 1 Minor.

The pilot had agreed to use his helicopter to participate in a publicity event at a golf course. The event consisted of landing in a designated area to pick up a load of golf balls, then dropping the golf balls from the hovering helicopter. Several days before the event, the pilot visited the golf course to survey the landing area. He was not advised to expect a marshaler. On the day of the accident, the helicopter approached the golf course, and entered a hover above the putting green that the pilot planned to land on. Several witnesses reported that a person on the ground began providing hand signals to direct the pilot. In response to the signals, the pilot began to back up the helicopter, and one of the landing skids contacted a wooden statue. The pilot was unable to regain control of the helicopter before it rolled onto its left side and struck the ground. The helicopter sustained substantial damage to the cabin area, skids and tail boom, and the tail rotor was separated. The pilot reported that there were no mechanical malfunctions or anomalies with the helicopter prior to the accident. Subsequent to the accident, it was determined that the marshaler was self-appointed, and that he did not have any formal training in marshaling aircraft.

WPR09CA470DATE: Sunday, Sept 27, 2009LOCATION: Mt Charleston, NVAIRCRAFT: Robinson R44 IIINjURIES: 1 Minor, 2 Uninjured.The pilot stated that he was orbiting at 50 knots about 100 feet above the 11,800-foot msl (mean sea level) mountain peak. As he flew the helicopter out of

the lee ward side of the peak, he encountered a downdraft. He maneuvered the helicopter towards a wide open valley that descended about 5,000 feet below. The downdraft pushed the helicopter into the face of the mountain despite the pilot’s application of full collective, and descending flight into the valley. The helicopter impacted the mountain slope, caught fire, and tumbled. The pilot and his two passengers egressed the burning helicopter with minor injuries. The pilot hiked to the peak, and called for rescue using a cell phone.

WPR10LA012DATE: Monday, October 12, 2009 LOCATION: Fossil, ORAIRCRAFT: MD 369FFINjURIES: 1 Fatal.On October 12, 2009, about 0930 PDT, a McDonnell-Douglas 369FF helicopter collided with a wood power pole about 18 miles southeast of Fossil, Oregon. The pilot, who was the sole occupant, was killed in the accident, and the helicopter sustained substantial damage. The helicopter had been airborne for an undetermined amount of time when the accident occurred.

According to witnesses, at the time of the accident, the helicopter was placing a rope, which would later be used to pull a power line onto pulleys that were mounted on the power poles. During the accident sequence, one or more of the helicopter’s main rotor blades came in contact with the power pole.

The helicopter has been recovered to Maple Valley, Washington, for further examination.

ADDISON, TX – Omniflight Helicopters, Inc., a leading national provider of air medical services, announced today that it has entered into an agreement with FlightSafety International, the world’s leading aviation training company.

The agreement with FlightSafety provides Omniflight the opportunity to train its aviation professionals using FlightSafety’s new AS350 simulator, which is a Level 7 flight training device that basically serves as a replica of the aircraft. The training will take place at FlightSafety’s educational center in Tucson, Ariz., where Omniflight’s own instructors will lead and conduct the process.

Beginning in early 2010, nearly 200 pilots nationwide will be trained using FlightSafety’s AS350 simulator. This includes training for newly hired as well as current Omniflight pilots and will focus on both regulatory and mission-specific, scenario-based training.

Omniflight Helicopters enters into agreement with FlightsafetyConducting training in the

simulator will allow Omniflight to provide instruction on certain specific maneuvers that can be performed more effectively in the device. In particular, Omniflight expects to see increased effectiveness in training for encounters associated with Inadvertent Instrument Meteorological Conditions (IIMC) and a wide range of emergency procedures.

“The FlightSafety training program will allow us to capitalize on the proven benefits of simulator training processes, which include enhanced safety and heightened performance,” said Eric Pangburn, chief rotor-wing pilot at Omniflight who will head the program for the company.

“The training will offer a decreased chance of physical risk and improved cost efficiencies since it will be conducted on the ground, which ultimately results in increased aircraft availability. It

also affords us more flexibility and enhanced productivity in the type of training options it is capable of performing,” Pangburn explained.

Anthony J. DiNota, president and chief operating officer, added: “We have long seen the successes and benefits of flight simulation training when used at major airlines and within other segments of the aerospace industry. Now, the time has finally come when this type of high-level commercial simulator training is available for the AS350. An aircraft owner sent a request to their broker for a Certificate of Insurance for the FBO where they hangar their aircraft. They said the FBO wanted to be named as additional insured on the aircraft owner’s policy and be given a waiver of subrogation for both the aircraft and any aircraft parts stored at the FBO. At the request of the broker, they sent a copy of the hangarkeeping agreement to the FBO, who in turn, forwarded it to the aircraft owner’s underwriter.

First, hold harmless language found in the insurance and indemnity clauses of hangarkeeper agreements are becoming more common, as risk-management savvy FBO’s attempt to limit their exposure and/or transfer risk of the hangarkeeping operation to aircraft owner. They come in many forms. One might consist of a simple paragraph or two stating the owner and his insurance company will hold the FBO harmless for any physical damage to the aircraft beyond the limits of their insurance while in the care, custody and control of the FBO. Another agreement might be a detailed legal document drafted by an aviation attorney. These agreements usually stipulate that the hold harmless agreement does not apply to products or completed operations related to the sale of fuel, parts or any service provided or maintenance performed. They also might have a provision which limits the FBO’s exposure to liabilities such as consequential loss or loss of use.

It is important to note that

An FBO hangarkeepers hold harmless agreement…are you kidding me?even though an aircraft owner signs an agreement, it does not automatically bind their insurance company to abide by those provisions. The insurance company has the right of subrogation against the FBO unless they waive that right in writing. In addition, even though the insurance company may grant additional insured status to the FBO and issue a waiver of subrogation, it does not expand coverage beyond the terms, conditions and limitations of the policy.

This particular agreement is a 15-page document that goes beyond the norm. It stipulates that the aircraft owner will carry at their own expense:

• a set amount of aircraft liability insurance naming the FBO as an additional insured with respect to the aircraft (a reasonable request)

• Premises liability with respect to the leased hangar and office space with set limits of liability naming the FBO additional insured with respect to the leased space. (also a reasonable request)

• all risk aircraft physical damage insurance for full replacement value of the aircraft with no deductible, providing a waiver of subrogation in favor of the FBO. (the waiver of subrogation is without limits)

• aircraft spare engine and parts damage coverage in the minimum of an agreed amount providing a waiver of subrogation in favor of the FBO.(again, the waiver of subrogation is without limits)

• That the aircraft owner’s insurance be primary to and without any right of contribution

from any insurance maintained by or available to the FBO (Are you kidding me?)

• provide the FBO with a 30-day, written notice of cancellation or material change of the coverage (a usual request)

• provide the FBO with a Certificate of Insurance evidencing the above coverages are in full force and effect for the duration of the policy period. (a usual request)

In addition, the contract offered fuel and maintenance services at set rates, yet no language limiting the hold harmless language to hangarkeeping existed. While the contract stipulated that the FBO would carry a reasonable amount of premises liability and hangarkeeper insurance sufficient to insure the FBO for damages done to the aircraft, it did not contain the requirement to carry products/completed operations liability insurance.

The intent and net effect of the hold harmless language in this contract means that the aircraft owner and the insurance company will hold the FBO harmless for damages done to the aircraft for any reason, whether from a faulty premises, improper fueling, improper maintenance or hangar rash, even when it is clearly the FBO’s fault.

When discussing hold harmless agreements with an FBO, an aircraft owner should get some clarification on the hangarkeeper and other services provided, especially if they are asking for language that appears to relieve them of their responsibility.

In addition to providing their

broker with a copy of the agreement, below are some of the same questions a broker and the underwriter would want to know about the FBO:

• Will the aircraft be kept in a dedicated single hangar by itself or a bay hangar with other aircraft?

• Does the FBO move or tow the aircraft? If so, what is the crew compliment and procedure for towing an aircraft?

• Is the owner/pilots allowed or required to tow their own aircraft singly or as part of the tow crew?

• What training procedures does the FBO provide its employees for aircraft towing? (i.e NATA Safety First)?

• What spare parts (and value) belonging to the owner does the FBO usually have in their care, custody, and control that would require a waiver of subrogation?

• What risk management practices does the FBO have in place to protect the spare parts and the aircraft? (Security systems, locked storage areas, etc.)

• Who is the FBO’s insurance company and what limits of liability for Premises, Products/Completed Operations Hangarkeepers, and property of others are maintained?

The FBO risk manager in this case is merely trying to protect the interest of their employer. They should not object the answering these questions. The underwriter will need the information to determine if they will agree to the waivers of subrogation and if they need to charge additional premium for the additional risk they are accepting.

It appears that by giving the FBO a certificate of insurance with waiver of subrogation, the FBO is asking the aircraft owner and their insurance company to underwrite their FBO operation as it pertains to the aircraft owner’s aircraft, hangar space, office space, spare parts or other products and services provided. The

agreement appears to release the FBO from any monetary responsibility to pay for any damage done to the aircraft or owners property in their care and control for which they would normally be responsible, including loss of use and diminishment of value. While the aircraft owner’s insurance company will repair the aircraft and provide for spare parts, it will not normally address loss of use or diminishment of value issues to the degree the FBO

may be responsible. The owner is left with no recourse.

Bottom line, if the FBO will not modify their hold harmless language, it may be worthwhile to find another FBO.

HORSEHEADS, NY – Sikorsky Aircraft Corp. today celebrated the formal delivery of a UH-60M BLACK HAWK helicopter to the Defense Forces of Bahrain. It is the first of nine aircraft that will ultimately be delivered. Sikorsky is a subsidiary of United Technologies Corp. ( UTX).

The delivery also marks the beginning of the first squadron of UH-60M BLACK HAWK helicopters that will be operated by an international military organization. The Royal Bahrain Air Force will fly the aircraft for military operations that include protection of sovereign borders as well as protection and defense of U.S. and coalition strategic facilities.

Sikorsky delivers UH-60M Black Hawk Helicopter to Bahrain Defense Forces

“The Bahrain Air Force is getting a powerful tool in the UH-60M BLACK HAWK helicopter,” said Doug Shidler, Sikorsky Vice President, U.S. Government Programs. “The sophistication and capabilities of this aircraft will greatly enhance the Bahrain military’s ability, and will serve their country well for years to come.”

Bahrain officials signed the U.S. Army Letter of Offer and Acceptance on May 7, 2007, to purchase nine UH-60M BLACK HAWK helicopters through a Foreign Military Sale (FMS), the first such sale for the UH-60M aircraft.

The aircraft are being completed at Sikorsky’s Military

Derivatives Completion Center in Horseheads, N.Y. Deliveries are scheduled to continue into 2010.

The UH-60M BLACK HAWK helicopter is a twin-engine, medium-lift utility helicopter designed to a U.S. Army requirement to carry an 11-man squad and four-man crew under combat conditions. Sikorsky Aircraft has been manufacturing the BLACK HAWK helicopter for the U.S. Army since 1978. The UH-60M helicopter is the latest and the most advanced model to be fielded to the U.S. Army.

The UH-60M helicopter provides additional payload and range, improved handling qualities, lower operating

costs, and greater survivability than earlier generation BLACK HAWK helicopters. These improvements are achieved with improved engines, revolutionary rotor blade design, improved durability transmission system, advanced digital avionics and an integrated “glass” cockpit.

Subject: Concepts for Fatigue Countermeasures in Part 121 and 135 Short-Haul OperationsPurpose: To provide insights to operators and crew for mitigating fatigue in short-haul flight operations.Discussion: Short-haul pilots commonly identify sleep deprivation and high workload as the main factors contributing to their fatigue. Conversely, long-haul pilots generally attribute sleep deprivation and circadian rhythm disruption caused by multiple time-zone crossings as the main causes of fatigue. However, both short-haul and long-haul flight crewmembers report fatigue resulting from multiple flight legs, early wake times, consecutive duty days, insufficient recovery sleep periods, time demands and high workloads resulting from high density air traffic environments. Fatigue is a hazard that if not properly mitigated or countermeasures enacted, can elevate the risk of these flight operations. Certificate holders must recognize the potential for elevated risk and be proactive in minimizing exposure to fatigue-related incidents or accidents.

Typically, short-haul (domestic) pilots are engaged in “hub and spoke” operations with some limited point-to-point flying. Short-haul crews are challenged by schedules that involve short turn-around times between multiple flights. Pilots conducting these types of operations report their schedules typically consist of four to five segments, averaging approximately six hours of flight time. Thirteen to fifteen hour duty days typify this type of operation. The result is an increased workload due to the multiple

take-offs and landings and time constraints of meeting schedule deadlines over the course of the long day.

Scheduling factors have a major impact on a crewmember’s ability to sleep and maintain a proper level of alertness. Sleep loss is one of the primary contributors to fatigue in flightcrew and is directly related to a variety of scheduling factors. In short-haul operations, pilots normally fly a round trip out of a hub and then may sit for several hours before their next flight. This type of scheduling has the potential for a latent condition that contributes to the cumulative effects of fatigue.

Effective sleep opportunities are a critical countermeasure to fatigue. This should be the responsibility of both the certificate holder as well as the individual pilots. Certificate holders should consider providing crew rest facilities that have rooms away from the general traffic for quiet, comfortable and uninterrupted sleep as well as expedited transportation to and from the airport in the layover city. Individual pilots must understand the importance of sleep opportunities and ensure they are properly rested prior to the next flight day.

Recommended Action: The part 121 Directors of Operations and Safety and part 135 Directors of Operations should review their current policies and procedures addressing flight crewmember fatigue countermeasures. This review should address at minimum:

•Current scheduling practices;•Scheduled or assigned rest

periods;•Establish effective rest

enhancing prerequisites for layover city hotels; and

•Encourage the use of flightcrew rest facilities between flights to counter the effects of cumulative fatigue.

•Educate their pilots and crew on the importance of proper rest and encourage them to take advantage of rest facilities.

Pilots in part 121 or 135 operations should understand their responsibility with regard to ensuring that they achieve the required rest so they are properly

rested and fit for each assigned or scheduled flight.

The Federal Aviation Administration (FAA) will continue to research the subject of fatigue, evaluate the relevant data and inform the commercial operations community of effective methods for reducing flightcrew fatigue.

With the close of the 2009 comes the challenge of preparing a sound financial plan for 2010. This requires the projection of cash flow. The key to business survival is meeting the cash flow requirements. For the commercial aircraft operator, this means evaluating the financials of each aircraft in the operation. Concentrate on your cash flow and the calculation of Return on Investment (ROI). Prepare budgets and financial plans for each aircraft in your fleet. How?

Tabulate and review all 2009 expenses. Determine the expense categories that are appropriate for your operation. Separate the aircraft expense categories into

annual fixed expenses, variable expenses that vary with flying hours, and extraordinary expenses that occurred due to aircraft improvements, overhauls, special inspections, or other expenses that don’t occur every year. Assign each extraordinary expense to an annual fixed or variable hourly expense. Prorate each expense and assign an annual fixed or variable hourly expense amount as appropriate so future expenses can be estimated.

Evaluate the revenue of each aircraft. Has the revenue exceeded operating expenses? Was utilization and revenue rate high enough to cover the fixed expenses as well as the variable expenses? Are adjustments in rates or utilization

required to achieve the desired ROI?

With all 2009 expenses and revenues available for use, it is time to project financials. Identify any large upcoming cash requirements or expenses (aircraft improvements, overhauls, special inspections, etc.) for each aircraft. Will cash be available to pay the large expenditures? If not, then additional capital will be required. Project the normal annual fixed expenses as well as the hourly operating expenses. Be especially careful to adjust expenses that might change significantly. Examples could be fuel or increased aircraft maintenance expenses due to aircraft being out of warranty or

just being older aircraft.Determine the average expenses,

utilization, and revenue rate to use in projecting the after-tax cash flow and ROI for the next five years. Include all items affecting your cash flow: *Initial investment, *Hourly operating expenses, *Monthly fixed expenses, *Extraordinary expenses, *Interest and Principal (if financed), *Tax benefits including depreciation, *Income from aircraft, and *Resale value of the aircraft at the end of 5 years.

To produce one aircraft cash flow requires making many assumptions and estimates. You can create a general spreadsheet for this cash flow so that individual assumptions can be changed, then the ROI impact can be seen immediately when you change an input. After completing this spreadsheet, use the “Goal Seek” feature of Microsoft Excel to iterate on individual expenses, revenue rates, or annual utilizations until the NPV (Net Present Value) of your net cash flow is zero (using your desired ROI as the discount rate in the NPV formula). The hours spent evaluating different scenarios will assist you in making profitable decisions concerning each aircraft.
