proud to have been chosen to go toLagos to aid those who had been caughtup in the accident.“I was in Bela Bela for a funeral when I

The Department of Labour’s OccupationalHealth and Safety (OHS) Act states that“every employer shall provide andmaintain, as far as is reasonablypracticable, a working environment that issafe and without risk to the health of hisemployees”. In ensuring this is so, the Department’s

Inspection and Enforcement (ISE) willhost a Hazardous Biological Agents(HBA) seminar as part of its initiative toensure compliance with health and safetylegislation. The seminar will take place atthe ForeverResorts, Bela Belaon Friday, 26September underthe theme“Improving OHS inthe Health Sector”.The Department’s

Deputy Director-General ofInspection andEnforcementService (IES)Thobile Lamati andother managers inthe Department areexpected to address the seminar. Therewill also be speakers from the NationalInstitute for Occupational Health (NIOH),the Approved Inspection Authority andGeo-zone.The seminar will be preceded by a day’s

training of shop stewards on matters ofHBA Regulations, OHS Act, ChemicalStressors Regulations, PhysicalStressors Regulations, MachineryRegulations and reporting of injuries anddiseases.Topics for the seminar will focus on

OHS, health and safety compliance inpublic hospitals, the vision of nationalhealth, cross contamination and infectioncontrol, medical surveillance andbiological monitoring, waste managementin public hospitals, monitoring and controlof the working environment. In terms of OHS Regulations for HBAs,

a biological agent is defined as: “anymicro-organism, cell culture or humanand/or parasite, including any which havebeen genetically modified, which maycause an infection, allergy or toxicity, orotherwise create a hazard to humanhealth”.The agents are divided into various

groups and include those that are unlikelyto cause human disease and those thatcan cause severe human disease. “Although the Department of Labour

Street lights in Bela Bela have been left onduring daytime hours in the past fewweeks. The Beat has observed street lights in

Reitz, Stoffberg, Robertson and HospitalStreet that have been left on and evenreceived a complaint that street lightsLudorf Street had been left on for a longtime.Residents feel that the seemingly irregular

use of these street lights as a waste ofelectricity and taxpayer’s money.“We have to pay while the municipality

wastes a lot of electricity. How can theyask us to use electricity sparingly but theywaste electricity and we have to pay,” theysaid. It had also been suspected that the street

lights are left on due repairs but residentsfeel that there is no need for a whole blockof streets to be left on only to repair onestreet’s lights. The spokesperson for theBela-Bela municipality, MatomeSebelebele, said he was not aware of thesituation, but that he will follow it up with themunicipality’s technical services.

Service (IES), the Occupational Healthand Safety Act employers also have anobligation to ensure a safe workingenvironment for their employees. Thelegal responsibility for health and safetyrests primarily with the employer. It istheir responsibility to make sure thatorganisation has the necessarymanagement framework to ensurecompliance with health and safetylegislation. One aspect of thismanagement system will be the control ofexposure to hazardous substances

including biologicalagents.Micro-organisms

are found virtuallyeverywhere in thenaturalenvironment. Mostof these areharmless tohumans and domany importantjobs. However, certain micro-organisms cancause disease andemployees may be

exposed to them at work.In health care institutions, patients

come in daily suffering from variousinfectious diseases, thus spreadingbiological agents and exposingemployees to them,” said theDepartment’s spokesperson JohannesMokou. There are four sources of infection

through which employees might beexposed to biological agents at work andthese include blood and other body fluidssuch saliva, human waste products suchas faeces, urine and vomit, respiratorydischarges such as coughs andsneezes, and skin direct contact. Thus, the Department states that in terms oflegislation, employers have a legalresponsibility to ensure a number ofmeasures are put in place to prevent asrequired by the Regulations forHazardous Biological Agents. Mokousaid that these measures include a riskassessment strategy, identifying thehazard, assessing the risk andcontrolling the risks. Other additionalmeasures to consider includesupplementary controls, security andaccess, disinfection and disposalprocedures, information and training, useand maintenance of controls, handlingincidents/emergency planning, medicalsurveillance, labelling, packaging, transporting and storage; and disposal ofwaste containing HBAs.

The Bushveld center at Bela Bela isslowly but surely nearing completion.According to Anton Kilian, the leasing

agent of the centre, delays in theprocess were apparently due tonegotiations between the currentowners and potential buyers.Construction has been stopping and

starting since 2011 and was resumed inApril this year. Killian said that thecurrent owners, Zephan Properties soldthe centre to Excelerate Properties butregistration is yet to be finalized.“Recently there have been negotiations

between Zephan and Excelerate topurchase the promises. It has recentlybeen signed and constructioncontinued,” said Killian. He said that the shops Hout is Goud

and Oasis have since been moved tothe back of the centre. He said thatOasis’ moved is permanent, while Houtis Goud was only temporarily relocated.Other businesses such as PNA andShoe City will also relocate. The owner of Hout is Goud, Erika

All was not smiles in a meeting heldbetween the residents of Phomolong, alsoknown as Skierlik, in Bela Bela, and theirward councillor the former mayor of BelaBela Freddy Hlungwane recently. Wordswere exchanged and arguments grewheated. The meeting, which was held on Sunday,

21 September at the Zone 14 soccergrounds, was about service delivery andspecifically the future of the section, asresidents complain that they have beenstaying in shacks without electricity orsanitation for some time now.According to a source, Hlungwane shifted

the blame for the lack of services to thenew mayor, Lucas Nhlapo, saying that hewas not in a position to make thingshappen at present. He commented on theExtension Eight pavement, which was notcompleted before the construction teamsmoved on to Leseding.

Hlungwane was redeployed by the ANCrecently, being moved from his formerposition as mayor to his current one asward councillor. He was replaced by LucasNhlapo, who could not attend the meetingdue to other commitments.Hlungwane said in an interview with The

BEAT that he understood the community’sfrustration as they were initially promised agood location and rapid development, butsaid that he was unfortunately sackedbefore all was completed.“The residents were upset about services,

which is fair as we had promised todevelop their place in the first LDPmeetings but I was reshuffled before allwas done and I don’t have the power nowto accomplish such development,” he said.Hlungwane said that he would set up an

appointment with his successor in order tourge him to address the residents of Ward4 as they had requested to see him.Nhlapo could not be reached for

store will open at this centre. We arealso negotiating with other major brandsto open stores here,” he said.He added that there is enough building

material to continue construction duringthe upcoming festive season.“We have enough building material to

continue construction during theupcoming festive season,” he said.“There will not be any constructionbetween Christmas and New Year.”It is proposed that improvements to the

centre’s parking are to be made so thatthe trucks that use the area should notinconvenience other motorists. The BEAT also noted that the sewage

from the adjacent Forever Resortsleaves a bad smell in the parking area.Killian said that the matter has been

noted and that negotiations with theresort’s management and the Bela Belamunicipality to improve the situation areto take place shortly.“We will be addressing this issue with

the resort management and the BelaBela municipality because we do notwant visitors to the centre to experienceany unpleasantness,” he said.

On the ninth of August an Americanpoliceman by the name of DarrenWilson shot and killed a young mannamed Michael Brown. This in itselfis not all that unusual — the policein the United States are known to befairly free with their firearms. This case has sparked

controversy, however, because theunarmed Brown, who was due tostart at college just two days later, was shot six times and according towitnesses had his hands in the air atthe time he was shot. The town ofFerguson, where the incidentoccurred, has been rocked byprotests since Brown’s murder, andthe police response has been…lessthan wise. The Ferguson police department

initially refused to reveal Wilson’sname and, more than a month later, has yet to arrest him. Peacefulprotest has drawn violent responsefrom the police, who even went sofar as to institute a curfew and useteargas on a crowd that includedboth very young children and theelderly. It sparked a social mediastorm, with celebrities and activiststaking to Twitter, Tumblr andFacebook to condemn the shootingand its aftermath. The police of the Unites States has

become ever more militarized, andit’s a worrying trend that one cansee even in our own South Africa, toa lesser extent. When ordinarycivilians are afraid to exercise theirrights of assembly and free speech,it is time to take a good long look atthe government and the policeforce. The Marikana shooting here in

South Africa sparked similaroutrage across the world, despiteimages that showed that the minerswere clearly armed and violent, andrightly so.There is supposed to be a

difference between the army andthe police force and that differenceis becoming less and less prominentas the police become more militantin their outlook and tactics. For a contrast, in December 2013

a man was shot dead by police inReykjavik, Iceland. Police and thepublic were devastated, and theChief of Police issued a statementexpressing his grief at what hetermed “a failure”.It was the first time in the country’s

100-year history that a civilian hadbeen shot and killed by the police. That should be something to aim

for. Incidents like the Wilson/Brownone and Marikana should neverhave happened, and should neverhappen again.

Everyone wants to leave a legacy fortheir loved ones. But what if thatlegacy ends up in the wrong hands?Dying without a will or with an invalidone may mean that your last wishescannot be fulfilled. Some people don’t draw up a will

because they believe that theirestate (money, house, car, insurance policies and investments)is small enough for their families tomanage. All they want is a simplewill.“Drawing up a will does not have to

be a complex or an expensiveexercise. A trust company or yourfinancial adviser can advise you onhow to draft the most practical willthat takes into account your personalcircumstances and wishes,” saysSanlam Trust Legal Adviser, CliveHill.Your will is one of the most

important documents in your lifesince it ensures your wishes arecarried out after your death. If youdie without a valid will in place, thelaw determines who inherits yourestate.“That could have far-reaching

consequences for your loved onesbecause the law, and not you, woulddetermine who your heirs would be.A will stipulates how your estateshould be distributed and to whom,”says Hill. But he also warns that having a will

is only meaningful if the will is valid. Itis important that your will should be apractical document that is easy tounderstand and easy to execute. Youshould review it regularly to reflectyour changing life circumstances. For example, a marriage, divorce, thebirth of a child, buying and sellinglarge assets such as a house, thedeath of a family member or heir, andchanges in legislation, all affect thecontent of your will.“You can’t be too careful when

drafting your will. You should be takingadvice from a specialist who works withyour financial adviser to craft the bestpossible will — one that will achieve thebest results for your loved ones,” saysHill. As the week of 15-19 September is

South Africa’s National Wills Week, here are some tips on how to draw upa will: Inform your family beforehand

about your wishes regarding yourfuneral. A will is usually made publiconly after the funeral has beenarranged. When appointing heirs for your

non-cash assets, it is advisable to splityour estate and specify who inheritswhat. To transfer ownership of a houseor car to two or more people can resultin practical problems as well as familyfeuds. If your children are minors,

consider appointing someone to betheir guardian when both biologicalparents have died. Appoint your executor while

drafting your will. The surviving spouseis often appointed as the executor ofthe estate. However, by appointing areliable company as executor you getthe advantage of specialised knowledgeof wills and estates, thereby ensuringthat your surviving spouse is notexploited by people who do not haveyour spouse’s best interests at heart.

Militarizing thepolice force isnever a good plan
