CIRCULAR TO ALL BRANCHES / OFFICES, ADMINISTRATIVE

OFFICES IN INDIA RE: Tax Audit under the Income Tax Act, 1961 for the

accounting year ending 31st March, 2013 Tax Audit is required to be conducted every year under section 44 AB of

Income Tax Act, 1961. All the branches, who are maintaining books of accounts, are required to get tax audit done from their auditors. Tax Audit consists of the following:

1. Form No. 3CA i.e. Audit Report to be given by branch auditors. 2. Form No. 3CD with annexures to be furnished by branches to

auditors for certification. A specimen copy of Form No. 3CA and Statement of Particulars required

for prescribed Form No. 3CD along with annexures are enclosed for the purpose of tax audit for the year ending 31st March 2013. The branches under audit will submit both the forms with annexures duly certified by their statutory auditors’ along with other closing returns. The branches which are not under audit will submit unaudited Form 3CD with

Annexures duly signed by the Branch Manager / Joint Manager. Form No. 3CA is applicable to branches under audit only. The necessary instructions / guidelines for filling the relevant annexures should be carefully noted before submitting information / data. You may attach extra sheet to annexures wherever space is not sufficient.

Specific attention is required to the notes appended to annexures while filing the relevant data.

You are, therefore, requested to meticulously follow the guidelines issued by us from time to time and furnish the complete data as required.

furnished in the Tax Audit Reports. Care should be taken while

mentioning the items in Annex.1, 2A & 2B and 3 (1), (2), (3), (4). Branches should ideally have ‘NIL’ information in respect of Annexure 3(1), 3(2), 3(3) and 3(4). During the course of the audit, if any

instances are noticed before 31st March 2013 where TDS is deductible but not deducted or there is shortfall in tax deducted, it should be accounted in the books of accounts immediately.

If such instances are noticed post 31st March 2013 or during the audit then such cases should be rectified by passing the entry

through Memorandum of Changes (‘MOC’). The branches should deposit all TDS deducted as per books before the completion of the audit. Branches should ensure that reporting under Annexure 3(1), 3(2) and 3(4) is ‘NIL’ after due compliance. TIME SCHEDULE:

Branches which are not covered under audit will submit unaudited tax return (Form 3CD with annexures) by 4th April 2013 positively, while

branches/administrative offices under audit shall submit duly audited and certified returns (Form 3CA & 3CD with annexures) immediately on completion of branch audit to their Regional Office.

Regional Offices will consolidate these reports of all their branches and send the duly audited consolidated Tax Audit Report of the Region to their Zone. Zone will consolidate the reports of their Regions and will

send to Corporate Accounts & Taxation Department after getting it audited from their auditors with annual accounts. Soft copy of these formats and annexures are also required to be submitted by e-mail / in floppy / disc by branches to Region and by Regions to Zone and by Zones to Corporate Accounts & Taxation Department. The soft-copy of the format of these formats is being sent by email separately to all the

regions / zones. SUBMISSION OF EVIDENCES FOR PAYMENT OF GOVERNMENT

DUES:

After submission of Form 3CD, if any payments are made in respect of item details in annexure 2A, 2B and 3 (1), (2), (4) please submit photocopies of evidences in support of such payments to your Regional

Office immediately, and a summary of such payments upto 31/07/2013 and thereafter. A detail of payments made upto 31/07/2013 should be sent by 03/08/2013 to the Zonal Office through respective Regional Office. The Zonal Office will send the consolidated details to Corporate Accounts & Taxation department latest by 05/08/2013 with proof of payment. These expenses are claimed in the Income Tax Return on

payment basis at the time of filing of return. If any amount remains still unpaid, proper records should be maintained at branches, regions and zones with reasons of non payment / compliance. Zones will inform

subsequent compliance with details by 10th of the end of every quarter

to Corporate Accounts & Taxation Department. If subsequent payments are made by the Branch but not reported

to the Corporate Accounts and Tax Department, BCC then such expenses cannot be claimed by us in the income tax return, which is a loss to the bank. Therefore please ensure that particulars of

all payments made after the Tax Audit Report are sent to our department well in time, so that it can be claimed in our Income Tax Return.

We enclose herewith (as annexure to this circular) the important points to be taken care of on the basis of the details of common observations/errors noticed by us/Statutory Central Auditor during tax audit for the FY 2011-12. Branches/Offices are advised to take care of these observations and ensure that the same are not repeated

in the Tax Audit Report of 2012-13. If there is any instance where the branches have a disagreement

with the observation made by the statutory auditor in the tax audit report, the branches/ regional office/zonal office may contact at Corporate Taxation Department, BCC at 022-6698 5288 /5208.

Important Points to be noted while preparing the Tax Audit Report:

1. Branches / Offices should ensure that full TDS as applicable is deducted

and deposited well in time. For this purpose immediately refer our circular no. BCC:BR:104/242 dated 05.07.2012 on TDS – Other than Salary and circular no. BCC:BR:104/428 dated 04.12.2012

and verify whether any compliance is pending for the months from April 2012 to February 2013.

2. Non-deduction -Annexure 3(1) and short deduction Annexure 3(2)- During FY 2011-12 it was observed that TDS was not deducted on the service tax portion of the invoice in case of payment to contractor, payment of commission or professional fees. In few cases TDS was deducted at a lower rate instead of the rate prescribed by the income tax department. Foreg. Instead of deducting TDS @ 10%, the

branch had deducted TDS @2%. In certain cases, the Branch had not selected the correct TDS code in the Finacle System while opening of FD. As a result, in case of interest paid on Fixed Deposits, it was noted

that although customers did not submit his/her PAN the TDS was deducted @10% instead of 20%.

3. It has been observed that a number of branches report cases where TDS is deposited late i.e after the due date instead of cases of late deduction of tax in the Annexure 3(3) which is for Late deduction

of TDS.

4. Cases where TDS been deducted by the Branches but not deposited has to be reported in Annexure 3(4). Branches should deposit TDS promptly as non deposit of TDS attracts penalty and interest. In case of TDS which has been deducted on payment of expenses (other than

salary) during the month of March 2013, the due date for depositing TDS is 30th April 2013. Therefore branches need not report such cases in this annexure.

5. Expenses where TDS has not been deducted / short deducted / TDS has

been deducted but not deposited are disallowed in Bank’s Income Tax Computation on the basis of information provided by branches / offices in Tax Audit Report in Annexure 3(1), 3(2) and 3(4).

6. If these expenses are disallowed there is a loss of tax benefit

equivalent to 32.445% of such expenses, which affects Bank’s profits adversely.

7. In few cases the statutory auditors have noted that in the absence of

Form 15G/H although Finacle system deducted TDS correctly, the branch refunded the amount to the customer after obtaining the Form 15G /15H declaration from customers instead of remitting the amount

to the government a/c. It was also noted in some cases Form 15G/15H

forms were accepted from customers who did not have PAN. In some

cases Form 15H was accepted from customers who were not senior citizens.

8. As per extant guidelines, customers have to submit the Form 15G/15H at the beginning of the year (for existing accounts) and at the time of opening the FD (for new accounts). Till the time 15G/H is submitted by

the customer TDS to be deducted as per guidelines & remitted to the Govt. A/c. Branch should update the Form 15G/15H details in the Finacle system promptly.

9. Branches should ensure that they comply with the guidelines related to

Form 15G/H as given in our circular no. BCC:BR:104/242 dated 05.07.2012.

10. The subscription and expenditure incurred at clubs like Lions Club,

Rotary Club, Giants Club, Jaycees Club, Bankers Club where no entertainment is done but only the activities for the common public are conducted, is allowed as deductions in income tax and therefore the

branches should not report any payment made to above mentioned clubs in Annexure 1.

11. Branch should not report tax outstanding towards service tax, TDS ,VATetc. in this annexure. Provisions for taxes / duties which are under litigation and accounted in the branch books prior to 1 April 2012 and

carried forward in the books should not be disclosed in this annexure. Only incremental provision made for taxes/duties payable to municipal corporation / central / state government pertaining to FY 12-13 should be reported in Annexure 2A

1. As per Income Tax Act, TDS should be deducted at the time of accounting of the expense or payment whichever is earlier.

3 Reasons for delay should be clearly mentioned and should not be left blank

2. For eg: If the Branch has deducted payment of professional fees wrongly @2% in the Dec 2012 as against correct rate of 10% and the same is

rectified by deducting additional 8% in Jan 2013 bill then this a case of delay in deduction of TDS by 1 month and should be reported in this annexure

2. Branches should report all cases where TDS was not deducted / short deducted and pertain to the period April 2012 to February 2013 and which has been accounted by way of MOC

after 01.04.2013 and deposited before the completion of audit in this annexure as " Late deduction".
