Chapter Members and Colleagues, As the 2019 calendar year and my time as Chapter President winds down, I would like to take the opportunity to say thank you to all our members for your participation and support. It is due to your willingness to volunteer and strong commitment that the Tampa Bay Area Chapter (TBAC) of NIGP continues to be one of the most successful in the United States. I am often asked how we do things as a Chapter because word is out the TBAC does a great job! Our Scholarship Program and Golf Tournament are programs, for example, that are a model for other chapters in Florida. Please make sure to continue taking advantage of what the Chapter has to offer, as well as working with the incoming President, Officers and Board to make it even better and stronger. If any members have the inkling to become more involved, please let an Officer or a Board member know. They can always use the assistance and it will only make the whole Chapter an even bigger success. On a personal note, I would like to thank the current and past Board members for all their support and effort over the past four (4) years. I cannot begin to tell you how hard they work and how much they back up each other in order to make your Chapter a success. Please lend them a hand and give them your support if you are able. It is a rewarding experience and one that will enrich your professional and possibly even personal life. The Chapter held several successful and very profitable events this year, which were the result of the Board and Committees hard work, and due to all member participation. 2019 events included the Reverse Trade Show, Golf Tournament, Trade Show, four (4) Chapter Luncheons and four (4) Chapter NIGP sponsored seminars. The Reverse Trade Show had significantly higher attendance numbers and the Golf Tournament was longtime member Jay Jackus 25th and final event as Program Chair. Furthermore, the Board made the decision to move the Trade Show back to the Florida State Fairgrounds, ultimately realizing a greater profit due to a significant cost savings! Finally, as you all know, the TBAC places a great emphasis on being charitable and giving to others in need. This year, through your contributions, the Chapter presented a donation of approximately $1,800.00 to Feeding Tampa Bay at the December Holiday Luncheon. It was quite moving to hear how much our donation was appreciated by this organization and to whom that money would benefit. With that, I just ask that you all continue to support each other and the 2020 Board Member efforts. The 2020 Board will be introducing significantly revised and new programs and opportunities for our members, which I think will be very exciting and successful. It has been an honor to serve you as Chapter President and I look forward to the Past President Elect role and being able to continue to serve to the best of my abilities. Happy New Year! David D. Scholarship Points The Scholarship Point Spreadsheet was updated through December 13, 2019 including any necessary revisions. An email blast announcement has been sent out to members to complete the 2020 Scholarship Applications and submit by February 3, 2020. All members requesting to utilize their points or to roll-over their points MUST submit a completed Scholarship Application prior to February 3, 2020. TBAC Board Strategic Planning Meeting The Board met on November 5, 2019 and December 6, 2020 to strategically plan for the 2020 calendar year. Some new and exciting changes are on the horizon for our members in 2020. Be sure to read your emails to keep up-to-date on these upcoming changes. The Upcoming Year I am beyond excited to service at your 2020 President. The Board has been working hard to get your input and create new and exciting changes over the next few years. As the Chapter’s 2020 President it is my goal to concentrate our focus on member engagement and giving back to our members. We look forward to our upcoming events in April, May, and October of 2020. Happy Holidays I truly hope all of you have a wonderful time with your family and friends this Holiday Season and a happy and prosperous New Year. Thank you for all you do. As 2019 comes to an end, I would like to say a huge “THANK YOU” to our members. As of November 30, 2019 we have a net profit of $12,176.80. We had a great Reverse Trade Show and Trade Show, which allows us to continue to provide scholarships to our members in 2020. As of November 30, 2019, the Chapter awarded a total of $42,276.89 in scholarships and reimbursed subsidies to Chapter members totaling $5,561.99. I would also like to congratulate our members on collecting $1,794.65 for 50/50 and the Trade Show Raffle Baskets which was donated to Feeding Tampa Bay at our Chapter luncheon on December 5, 2019. The Chapter has scheduled five professional development training classes for 2020. This upcoming year, the Board made it a priority to schedule classes at different locations throughout the Tampa Bay area to engage more members. We are also offering a 40% subsidy for ALL classes. The following classes will be offered by the Chapter in 2020:

The Chapter will be hosting two three-day classes in the upcoming year. Confirmation of dates and the assignment of instructors is still pending from NIGP.

The Professional Development survey for next year will be distributed as soon as NIGP finalizes class offerings. Upcoming 2020 Classes: Introduction to Public Procurement: to held at the Pasco County Government office in New Port Richey. Dates: January 29th-31st

Contract Administration in Public Procurement: to be held at the City of St. Petersburg Water Resources Administration Building. Dates: February 26th-28th. Core Certificate: Foundations of Strategy and Policy: to be held at Tampa International Airport Boardroom Dates: March 25th-26th

Core Certificate: Foundations of Planning and Analysis: to be held at Tampa International Airport Dates: June 9th- 10th

Ethics, Integrity, & Transparency/Legislation & Legal Environment: One-day Seminar to be held at HART in Ybor City. Date: November 13th

A look back on SunPass

Barbara Grilli, CPPO, CPPB, C.P.M. Director, Non-Capital Procurement, HCAA Last March, NIGP-TB published my article on the SunPass situation. If you recall, the FDOT department heads strongly influenced the procurement process for this transponderless pay-by-plate technology “upgrade” and ongoing support project. During the process, minimum requirements that reflected current account and transaction volume were significantly decreased and a protestor was essentially paid to go away, and the resulting contract was fraught with issues from its summer 2018 inception. Let’s take a look at the investigation and see what has unfolded in the past nine months. In July, new DOT Secretary Kevin Thibault announced that contractor Conduent’s seven-year contract would not be renewed after it expires in 2022. The seven-year renewal option would have expired in 2029. In September, Nicola Liquori, new Executive Director of FDOT’s Turnpike Enterprise announced that revenue losses from uncollected tolls could exceed $50 million, even with the efforts of collection agencies. “We realize we tripped a little bit,” Liquori stated to the House subcommittee. Subcommittee member Representative Mel Ponder recommends stronger controls need to be in place in the new contract. Liquori also announced that she would personally oversee an RFI developed to better research the market for development of the future RFP. The three-page RFI posted on September 20 and closed less than a month later on October 11. Though current contractor performance metrics are reported to have improved, the state has assessed the contractor $10 million in damages so far per the contract’s 25% annual maximum penalty. The contract had a potential $600 million payout over 14 years. Secretary Thibault has also requested that Conduent add staff to its service centers. In addition, Governor DeSantis’ administration has sent a clear internal message by replacing the FDOT’s director of toll systems, as well as multiple personnel changes. (continued on next page) All of these positive moves should not reduce our curiosity on how the 2014 RFP did not appear to have strong facilitation by certified high-ranking procurement officials. The 2014 RFP evaluation team was led by former Florida Turnpike Enterprise head, Diane Gutierrez-Scaccetti, along with Joe Waggoner, the head of the Tampa-Hillsborough Expressway Authority and Laura Kelly, the then interim director of Orlando’s expressway authority. While procurement policy required negotiations with three short listed firms, the evaluators negotiated only with Conduent, seemingly breaking their own procurement policy. The technical review team and selection committee “merely created an illusion of a competitive procurement, but the contract award decision was in fact solely placed in the hands of the Turnpike Director,” a lawyer for one respondent stated. Gutierrez-Scaccetti flew to an industry conference in New Jersey less than two weeks before the selection meeting and met with Conduent representatives, clearly violating the Sunshine Law. Conduent’s global headquarters are located in Florham Park, New Jersey. Gutierrez-Scaccetti was appointed Commissioner of the New Jersey DOT in June 2018 and left FDOT. She was replaced by Paul Wai, who was replaced by Nicola Liquori this past fall. While the FDOT’s Procurement Office in Tallahassee is headed by a P.E. (Professional Engineer), each district office also has a Procurement Office. A UPPCC directory search revealed no certified staff in the Central Office in Tallahassee, however the Turnpike Enterprise Division in Ocoee, which is the division that published the RFI, has both a CPPO and CPPB on staff. Neither of their certifications appear on the staff listing on the web. So far there is no news on release of the new RFP that will result in a new operational SunPass back office by May of 2022. Hopefully it will be facilitated by the certified team in Ocoee with a well-balanced and objective evaluation.

Member Spotlight Member Name: Dave Fechter Public Agency: Pinellas County Public Works Department Number of Years in Public Procurement: Technically, 7 years from November 2010-December 2017, when I was employed by the Pinellas County Purchasing Department. However, my work now as the PW Contracts Group Manager requires me to interact daily with the Purchasing Department and make decisions effecting advertised ITBs, RFPs, Amendments and Change Orders. What was your childhood nickname? Not as a child but as a young adult, I became “the Dome.” My dad was “Moose” as a young man. Both nicknames originated from our roles as softball players and managers. Do you have any pets? I had my lovebird Treat for almost 15 years, but she passed sometime ago. My girlfriend has 2 small dogs, 2 parakeets, 1 cat and a turtle so I still get to play with lots of pets! What was your first job? Evening newspaper route for the former Cleveland Press from age 12 – 15. What was your favorite TV show when growing up? Happy Days Can you play any instruments? Drums What is one interesting fact about you? I have bartended part-time at Ruth Eckerd Hall and Capitol Theater in Clearwater for over 18 years. What is one thing that all of your friends have had in common? We are all good people and very nice. What is your favorite quote?
