    l.That I am humiliated and insulted mother.

    2.1 am making this affidavit in support of my point of view that proveclaimant's fraudulence, corruption, and dirty tricks ,and dishonesty.

    3.Claimant is the owner of the few properties: 4219 Atlantic Avenue,4221 Atlantic Avenue - two family house, and 120 Oceana Drive WestCondominium also claimant owned all expensive furniture silverware

  • ,lightings, TV, computers that we possessed together and peculatefrom apartment we lived.

    4.Claimant is driving mini cooper made about 2009 and look inexcellent condition .

    5.A approximately for period between 2000-2009 claimant made about$180.000-$250.000 per year. In 2010 as soon as claimant find out thathe should pay $2045 per month of child support Claimant falselyreassured court that he (krichevsky) was fired and called himself"disabled" but never provide any proof of disability.

    S.At the same time when he claimed that he lost and becameunemployed ,krichevsky was working from home doing non-fault casesand collected unemployment benefits at the same time.

    7. Marian Wittenstein , Attorney at Law who has to be truthful nomatter what .But Wittenstein fraudulently shields deception to coverup claimant's(who is wittenstein's partner and friend) unlawfulbusiness.

    8. Krichevsky had never provide court with MRI findings and even so hehad stroke in his past but he has no complications such as weakness ofone part of the body limited range of motions of upper and lowerextremities and -or slurred speech , claimant still able to provide hischild with basic needs. By the way child's mother(svenson) due toharassment by Krichevsky developed diabetes and should constantlytake antidepressant, but regardless my health condition , I am workinghard to support our son financially. During all this time Krichevsky nevermade any effort to communicate with our son.

    9.It is hard to believe that Krichevsky who is shopping in 99 cents store.financially able to spend money for approximately 4-6 deposition in arow cost about $300-$800 each.

  • lO.AIso Krichevsky paid for transcript fees and claimant was willing topay for my(svenson) bank statements in order to find out about myfinancial status.

    ll.Any person who owns houses and condominium and car cost about$9000 cannot be considered as a poor person. By recklessly misleadingcourt with false representation, krichevsky continuously abusing hischild as well.

    WHEREFORE, I respectfully ask this court for justice and stopkrichevsky from ignoring his child's needs.

    [01] Stay away from:[A] Elena Svenson (DOB: 03/24/1958);[A] David Svenson (DOB: 08/14/1994);[B] the home of Elena Svenson (DOB: 03/24/1958) at 2620 Ocean Parkway Apt. 3K, Brooklyn, NY 11235;[C] the school of David Svenson (DOB: 08/14/1994);

    [02] Refrain from assault, stalking, harassment, aggravated harassment, menacing, reckless endangerment, disorderlyconduct, intimidation, criminal mischief, threats or any criminal offense against Elena Svenson (DOB:03/24/1958);

    [11] Permit Elena Svesson (DOB: 03/24/1958) to enter the residence at 4336 Manhattan Avenue, Brooklyn, NY11224 during: October 28,2008 between 7:00 pm and 10:00 pm to remove personal belongings not in issue inlitigation: to retrieve her and her son's personal belongings that are not in dispute with NYPD escort;

    It is further ordered that this Temporary Order Of Protection shall remain in effect up to and including November 25,2008;

    The Family Court Act provides that presentation of a copy of this order of protection to any police officer or peace officeracting pursuant to his or her special duties shall authorize, and sometimes requires, such officer to arrest a person who is alleged tohave violated its terms and to bring him or her before the court to face penalties authorized by law.

    Federal law requires that this order must be honored and enforced by state and tribal courts, including courts of a state,the District of Columbia, a commonwealth, territory or possession of the United States, if the person against whom the order issought is an intimate partner of the protected party and has or will be afforded reasonable notice and opportunity to be heard inaccordance with state law sufficient to protect that person's rights (18 U.S.C. 2265,2266).

    It is a federal offense to: cross state lines to violate an order of protection; cross state lines to engage hi stalking,harassment or domestic violence against an intimate partner or family member; possess, purchase, ship, transfer or receive ahandgun, rifle, shotgun, or other firearm or ammunition following a conviction of a domestic violence misdemeanor involving theuse or attempted use of physical force or a deadly weapon; or (except for military or law enforcement officers while on duty)possess, purchase, ship, transfer or receive a handgun, rifle, shotgun or other firearm or ammunition while an order of protection,issued after notice and an opportunity to be heard, that protects an intimate partner against assault, harassment, threatening and/orstalking, remains in effect (18 U.S.C. 922(g)(8), 922(g)(9), 2261,2261A, 2262).
