Article 36 TFEU

The provisions of Articles 34 and 35 shall not preclude

prohibitions or restrictions on imports, exports or goods in transit justified on grounds

of public morality, public policy or public security; the protection of health and life of humans, animals or plants; the protection of national treasures possessing artistic, historic or archaeological value; or the protection of industrial and commercial property.

Such prohibitions or restrictions shall not, however, constitute a means of arbitrary discrimination or a disguised restriction on trade between Member States.

Proportionality

In order to be justified under Article 36 TFEU or one of the mandatory requirements established in the case-law of the Court of Justice, a state measure has to comply with the principle of proportionality.

The measure in question has to be:

• necessary in order to achieve the declared objective;

• the objective could not be achieved by less extensive prohibitions or restrictions, or by prohibitions or restrictions having less effect on intra-EU trade.

The mere fact that a Member State has opted for a system of protection which differs from that adopted by another Member State cannot affect the assessment of the need for, and proportionality of, the provisions enacted to that end. Those provisions must be assessed solely by reference to the objectives pursued by the national authorities of the Member State concerned and the level of protection which they are intended to provide (Case C-124/97 Läärä and Others).

The CofJ does accept any purely economic grounds (Case C-109/04 Kranemann, Case C-456/10, ANETT).

Art. 36 TFEU may not be used to justify restrictions on trade in goods between Member States justified by the need to facilitate administrative work or reduce public expenditure (C-426/92 Deutsche Milch-Kontor), except if in the absence of such restrictions costs for Member State would "obviously exceed the reasonably acceptable" level of public expenditure or administrative workload (C-426/92 Deutsche Milch-Kontor, 104/75 De Peijper).

C-315/92 Clinique - Prohibition of importation and marketing of a product bearing the name "Clinique" - Justification – XXX – Proportionality

- What value is protected by such prohibition?

- Is prohibition the best (most adequate) measure to achieve the protection of the value (lack of alternative)?

- Is the goal cannot be achieved by less restrictive measure then prohibition?

The measure was not proportional to the goal of protection of consumers which could think that products named Clinique could be medicinal products or could be safer, more effective then others beauty products.

Products Clinique were sold in a beauty retail shops not in pharmacies; products were not advertise as medicinal products so they did not mislead consumers.
