!. Purpose and Statement of Work

This Mcmorandun• of Agreement (MOA) is between the Nuclear Regulatory Commission (the"Partner Agency") and the U.S. Environmental Protection Agency (the "'Managing Partner") tosupport the maintenlance and operation of the government-wide electronic docket manancmentsystem known as the Federal Docket Management System (FDMS), (publicly accessible at

wwwreg taionisgov). The e~lmking Program is one of the Presidential F-Governmentprogr'ams arnd lines Of buisiiness. It fulfills the requirements unader the F-Government Act of 200)2{Section 206). the Clinger-Cohen Act. and the Government Paperwork Elimination Act, as wellas furthering the effectiveness and efficiency of governiment. This MOA~ establishes ManagingPartner and P~artner Agency responsibilities and funding requirements in support of the ProgramManagement Office (PMO) operations related to the eRulemaking Program and will beincoi'porated by reference into EPA's funding document, the interagency agreement (IA).

T'he NRC will transfer funds to EPA that reflect NRC's service fee for the implementation, use,and the operation and management of FDMS. Access to) and use of FDMS will be granted toNRC. along with all other Federal agencies and the general puiblic.

The ekulemaking Pro~gram is a collaborative', inter-agency effort, whose purpose is to establish aconimon, automated, and inutegratedi repository for managing Federal rulernakings and non-rulernaki ne actions that follow a structured notice atid comment process. The pro()ectcons.olidates the dockets of various departments and agencies and centr'al ly manages themthlrotugh a web-based environment offering services such as one-stop access, search capabiltfies.public comment submission. eniai notification. hookmarki ng, and electronic recordsmlanagementl meecting the 1)OI) 50) 5.2 standard recognized by the National Archives andRecords Adrnunistratmon.

Thc EPA is the designated Program Management Office for the eRulemaking Program. TheeRulemnaking Programn Office was established by' EPA to implement this effort. Thle NRC is apartner agency under this agreement.

IV. Vision and Goals for the eRulemnaking Program

The overall vision andct oals f'or the eRulemaking Program are:

Goals

Through the usc of information technology, the eRulemaking Program seeks to:

Expand public understanding of the rulemaking process;Improve the quality of Federal rulemnaking decisions and streamline and improve theefficiency, of the rulemakin,, process: andIncrease the amount, breadth, and ease of citizen access and participation in rulemaking.

The eRulemaking Program will achieve these goals by' implementing a r'ange of performancemeasures related to technology, processes and activities, customer results, and mission andbusiness results:

Technology - The PMO will ensure Fl)MS/Regulations.gov is available 99.5% of thetime to the public and the Federal agencies .Av ailability -.-(flours FDMS accessible topublic and Federal entities)/(total hours in measurement period less scheduledmaintenance + plus Network downtime)

Processes and Activities - The PMO will deploy two F'DMS version releases per year anidimplement technical improvements to Rcgu lations.gov.

Customer Results - The PM() will complete the implementation of Federal entities thatrequest and pay for migration to FDMS.

Customer Results -The PMO will maintain the existing FDMS security plan andcertification.

Miission and Business Results - 90% of total Federal rules promulgated by Federalentities are implemented in FI)MS and have associatedi dockets available and posted forpublic access via ________uluim-go

V. Roles and Responsibilities

T[his MOA addresscs participation in and the funding of the eRulenmaking Program as mandatedby the 2002 eGovcrrnmcnt Act. Section 206 according to 0MB directive M-03-18"'Implementation Guidance for the E-Government Act of 2002. The FDMS will be the centralelectronic docket management systeni for all Federal agencies.

The Managing Partner will:

1. Staff an eRulemaking Program Management Office in order to manage theProgram. convene and participate on an inter-agency advisory board comprised ofFederal representatives of partner agencies, and establish work- grotups to addressprojects and tasks essential to the successful execution of the Program.

2. Conduct meetings for the purpose of collaborating with other Federal agencies toenhance the Program.

3. Facilitate an effort under the Advisory Board to con vene a budget workgrou p todvlpan annual budget for the eRulemaking Program erc o e o

service model, and a fee for service model.

4. Manage development, migration, and operation of the FDMS/Regul at ions. nov.Costs borne by EP'A and reimbursed by NRC will reflect NR.C's fee for service in2()16 to s;upport, operate, and maintain the eRulemaking Program. FDMS, andwww.regulations.gov.

5, Coordinate and ensure participating and partner members have an opporttunity toreview project management documentation., ilctiding the draft annual 0MBExhibit 30(i talso known as the Business Case or CPIC).

6. Execute any, interagency agreements (IA) to affect NRC's transf'er of funds andcoordinate the LA prior to start of work, monitor progress, establish performancemleasures, and ensure reporting requirements are mlet.

7. Evaluate project progress. interoperabilIity policies, practices and proceduredocuments and testing reports, as well a~s provide programmatic and technicalassistance as required, and attend all meetings. reviews and conlerences.

8. Cionvene meetings of an interagency Executive Committee on ant as-needed basisand annually, at a minimum.

Each Participating or P~artner Agency signing this MOA' will:

1.'Iransfer the funding amlotint identified in Section IX of this MOA. If the partneragency is under a permanent continuing resolution (PCR), it will be expected to pay infull within 45 days of the signed PCR. If the partner agerncy is tinder a temporary CR.-,

2. Identify a manager or senior executive to coordinate activities and serve as the mainpoint of contact to address any issues that may arise. The manager or senior executiveand/or his/her designee will also participate in the governance structurie of thleeRulemaki ng program.

3. Identify; a qualified staff persorns) to work with P~M( staff on the agencyvs use ofFaDMS/Regulations.gov.

4. In using thle FDMS. the agency will be required to do the following:

VII. Dispute Resolution Mechanism

In the event the participating or partner agency' determines that its ability to fulfill its financialobligation, under this MOA/IA as identified in Section IX of this MOA is at risk. it shall[promptly inform the eRulemaking Program Manager in writing. If the Program Managerbecomes aware of like circumstances, the Program Man ager shall apprise participating andpartner agencies in writing.

In the event of any disagreement arising under this agreement, the parties shall, in good faith,attempt tonegotiate diareet ate eoit oa resolution to the dsgeen.If the priscannot neoit esolution,the 0MRB E-Government portfolio manager is authorized to resolve the dispute.

IX. Transfer of Funds

Each partner agency is responsible for providing funding arid/or in-kind contributions. Thegovernment-wide total estimated cost for development and support in 2016 is $7.7 mnillion.Funding and resources from participating agencies shall be made available within 45 days of theenactmnent of an Agency's fiscal year 2016 appropriations bill.

Nothing in this agreement is intended to he a direct transfer of funds from NRC? to EPA. Alltransfers are to be effected through the Interagency Payment and Collection Systern tIPAC).

The NRC will transfer funds to EPA in accordance with the following table:
