• Timsbury Pointe – Issue - easement for fencing/plantings/

water/power (R/L is working with the County to fix the easement problem).

– SGS has already paid to get the water connected and installed some fencing.

– Only 2 lots still owned by R/L in Timsbury Pointe (have sold signs on lots).

• Still owns 9 lots in Stoney Glen South Sections 1-10. – 7 are available for sale, other 3 have sold

signs.

Function: – Review requests for any modifications to

home/property exteriors to ensure that proposed changes meet all requirements outlined in Association Covenants & Community Standards.

– Enforce violations to the Association Covenants & Community Standards.

• 2012 Accomplishments: – Requests for modification(s) processed – Violation letters sent. – Enforcing broader Covenant violations.

• 2013 Plans – Enforce more covenant violations.

Committee Highlights: Covenants Committee (ARB)

Citation Procedures:

• The Association reserves the right to notify & fine homeowners and/or renters for any Covenant violations.

– Notice must restate the rule, the violation, the possible penalty & the “must correct by” date

– Notice must provide the homeowner an opportunity to appeal to the Board

• Homeowners have the right to initiate court action themselves to stop violations that affect them.

Committee Highlights: Covenants Committee (ARB)

Enforcement Procedures:

• Single incident fines for violations which are not corrected immediately are charged at $50. Continuing violations fines are $10 per day for 90 days ($900), after which legal action will follow.

• Inability for the homeowner to hold a position on the Board or any Committee; restriction from use of common areas.

• Automatic denial of future ARB requests, until violation is corrected & assessed fines paid.

• Third party collections (Law Firm).

Little Known County Ordinances

• Sec. 14-27.(c) – Loud Noises Prohibited Unlawful to allow any animal or bird except farm animals in

agricultural districts to create noise such that it is plainly audible at least once a minute for ten consecutive minutes (i) inside the confines of the dwelling unit, house or apartment of another; or (ii) at 50 or more feet from the animal or bird.

• Sec. 11-32.(a).4 –Unlawful conditions of weeds, grass, shrubbery, trees and other vegetation generally.

No owner of occupied residential real property shall permit to remain on such property or any part thereof a grass or lawn area of less than one-half acre when growth on such grass or lawn area exceeds 12 inches in height.

• Function: Manages care of lawn, shrubs & flowers in common areas to include mowing, weeding, trimming shrubs & plantings.

• 2012 Accomplishments: – Seasonal and permanent plantings near

entrances – Yard-of-the-Month program – Playground Clean-Up Day – Added new wood chips, 4 benches, & signs at

playground – Replaced damaged playground equipment,

cleaned graffiti – Added grass, shrubs, and fence at the entrance

to Timsbury Pointe 15

• 2013 Plans: – Yard-of-the-Month program (May – October) – Seasonal and permanent plantings near

entrances – Extended Irrigation & fence along Branders

Bridge Road west of Baltustrol toward Timsbury Pointe

– Add irrigation, lights, and extend fence at Timsbury Pointe

– Power wash all fencing along Branders Bridge Road

– Replace tree at playground – Playground Clean-Up Day (March 23 with a

• Function: Maintains irrigation system, lighting & fencing, resolves general maintenance issues in common areas

• 2012 Accomplishments: – Lighting: Lighting at Tooley & Baltustrol

entrances repaired and blown out bulbs in street lights replaced by Dominion

– Playground: Irrigation System continuing maintenance and seating/signs installed

– Streets: VDOT repaired potholes – Irrigation: Extensive repairs to irrigation system

along Branders Bridge Rd (e.g., repairs due to cars running over heads)

– Signs: Replace/repair to poles; added Neighborhood Watch sign at entrance to Timsbury Pointe

• Function: Organizes events to unite community • 2012 Accomplishments:

– Spring & Fall Yard Sales – National Night Out

• Function: – Empowers homeowners to recognize criminal &

suspicious activity in community – Acts as liaisons between Board & homeowners,

disseminating and/or collecting urgent information • 2012 Accomplishments:

– Monthly Neighborhood Watch newsletters – 2012 Annual Meeting Flyer – Yard Sale Flyers

• 2013 Plans: – Maintain contact with police

– Continue distribution pertinent information to homeowners

• Front Entrances – Added shrubs, plantings, fence to Timsbury Pointe entrance – New flowers planted

• Administration – Enforcing covenant violations

– Completed Community Complaint Procedures (to register complaints regarding the actions, inaction, or decision by the Association Board that is inconsistent with applicable laws and regulations NOT general complaints against others)

– Hired new accounting firm including administrative support

• Communications – Set-up Next Door site (similar to Facebook for communities)

– Signs at entrances for meetings/events

• Playground – Completed installation of benches and signs
