Introduction This manual has been prepared by the office of Elections Prince Edward Island and the Department of Finance, Energy and Municipal Affairs to assist the Community Administrators in discharging their duties and responsibilities under the Municipalities Act to coordinate and oversee the elections of municipal officials. Administrators are encouraged to become thoroughly conversant with the information contained in this publication. Persons making use of this publication are reminded they manifest no legislative authority and are concerned primarily with procedures. For precise statutory provisions reference should be made to the Municipalities Act.

Municipal council Every municipality shall have a council consisting of

(a) in the case of a town, a mayor and six councillors; (b) in the case of a community, a chairperson and not fewer than three or more than six councilors elected in accordance with the Municipalities Act.

Election Term Community elections are held on the first Monday of November 2014 and on the first Monday of November in every fourth year thereafter.

The electors of a community shall, at a special election meeting or by election poll elect the chairperson and then elect the councilors of the community. The council shall take office on the third Monday of November following their election and shall continue in office until their successors take office. The council is the governing body of the municipality Election Poll A community council may, instead of conducting elections by means of a special election meeting, determine that elections in that community shall be conducted by means of an election poll. Potential candidates in a community that hold an all day poll under an election bylaws must follow the procedures in that bylaw to be officially nominated. (Municipalities Act, Schedule 2 – Election Procedures for Towns) Special Election Meeting A special election meeting shall be advertised (Appendage A). The administrator shall cause notice of the time, date and place of the annual meeting to be published on at least two (2) occasions in newspaper circulating in the community and the first of such notices shall be published at least seven (7) days before the date fixed for the meeting.

Appointment of Returning Officer The council shall appoint a returning officer who may be the administrator. The Returning Officer is the person responsible for conducting the election. The Chairperson should call the meeting to order and turn the meeting over to the RO. Where the nominations are received from the floor, the Returning Officer shall ask;

1) for a report from the nomination committee, where one has been established; 2) then ask for nomination from the floor

After all nominations have been received, the returning officer must ensure the polling station is set up, staffed and ready for voting Nominations The council may receive nominations at the special election meeting, from a nominating committee and from the floor. There is no nomination fee required for community elections. Where the number of candidates for the position of chairperson and for the positions of councillor is no more than the number of positions available, the seats shall be declared filled by acclamation. Qualifications for Nominations Section 15(4) Municipalities Act The qualification for nomination and holding office as a mayor, chairman or councillor of a municipality are that the nominee is:

(a) not less than eighteen years of age; (b) a Canadian citizen; (c) resident for a period of one year preceding the date of nomination.

Qualifications of an Elector Section 47(1) Municipalities Act The qualifications for an elector are that the elector is: (a) not less than eighteen years of age; (b) a Canadian citizen; and

(c) resident in the municipality for a period of six months preceding the date of the election.

Only qualified electors may vote in municipal elections.

Scrutineers After receiving nominations and prior to the start of voting the Returning Officer shall appoint two electors to act as scrutineers. Voting The vote shall be conducted by secret ballot. The Returning Officer informs voters to :

1) Use the pencil provided 2) Write on the ballot up to ____ name(s) of the candidate(s) for whom you wish to vote.

These same voting instructions should also be posted within the polling booth. Challenged Elector / Declaration of Eligibility If an elector is challenged by a candidate, scrutineer or the returning officer with respect to eligibility to vote, they must declare their eligibility to vote in the form prescribed by regulation (Form 8). If they refuse they are not permitted to vote. Declaration Upon completion of the voting, the returning officer in the presence of the two scrutineers shall:

a) Open the ballot box and examine the ballot papers b) Proceed to count the votes c) Declare the persons having the greatest number of votes elected

Resolution of Tied Vote In the event two or more candidates for office have an equal number of votes and only one position is to be filled, the returning officer shall immediately;

a) Write the names of those candidates on separate identical blank sheets of paper; b) Fold the sheets of paper in an identical manner so that the names are concealed; c) Deposit them in a receptacle and withdraw the number of sheets necessary to elect the

candidates required to be elected.

d) Declare the candidate whose name appears on the sheet withdrawn to be elected. This drawing a name by “Lot” should not be considered until after a recount takes place.

Return of Votes Polled The returning officer shall, after the votes are counted, prepare a written statement showing the results of the election (Form 13). The statement shall be signed by the Returning Officer and witnessed by the scrutineers and shall be filed with the minutes of the meeting. The Returning Officer shall provide a copy of the statement together with all ballot papers, including rejected and unused ballots used in the election of Chairperson and Councillor and place them in the ballot box. The ballot box is then to be sealed and turned over to the Administrator who shall retain the ballot box in their custody for the purposes of a recount. Recount Within seven days of the date the election was held, any candidate may, in writing, request a recount of votes cast. The administrator shall appoint a time and place to recount the votes and shall, at the time and place appointed, in the presence of the chairperson and any candidate who desires to be present, proceed to recount the votes in the ballot box.

Recommended Agenda For Conducting Community Election Meetings

• The Council will have previously appointed the Returning Officer to run the election portion of the meeting.

• The Chairperson calls the meeting to order. • The Chairperson witnesses the signature of the Returning Officer on Form 5 (Oath of

Returning Officer).

The Returning Officer now chairs the election portion of the meeting. It is recommended that the Returning Officer check off ( √ ) each □ as completed. □ The Returning Officer places the election materials, ballots and ballot box on the desk for full display. Note: The election for the Chairperson position must be completed prior to the election for the Councillor positions. Following the counting of ballots for chairperson, the ballot box may be reassembled and used for the casting of ballots for councillors. □ The Returning Officer announces that each person attending tonight’s election meeting who is a qualified elector is invited to sign the registration sheet when entering the hall (Schedule A) An individual should be designated to stay at the entrance of the hall to insure electors attending the meeting sign the registration sheet upon their arrival. The Returning Officer asks aloud: “Has everyone signed the registration sheet and if not, please do so now.” □ Prior to beginning the voting process, the Returning Officer announces that:

o Anyone attending the meeting who wants to vote must be a qualified elector and that they may be challenged prior to voting to ensure they meet the qualifications of an elector; o The challenge must be made directly to the Returning Officer and the Returning Officer will then ask the elector the three qualification questions; o If the elector answers “yes” to all three questions, the elector will then be asked to read and sign Form 8 (Oath of Challenged Elector); o If the elector meets the qualifications, the elector’s ballot will then be deposited into the ballot box with all the other ballots.

□ Review qualifications for Chairperson and Councillor: 1. not less than 18 years of age; 2. a Canadian citizen; and 3. resident of (name of your community) for one year preceding the date of nomination.

□ Review the qualification of Electors: 1. not less than 18 years of age; 2. a Canadian citizen; and 3. resident of (name of your community) for a period of six months preceding the date of the election.

First Election: For the Position of Chairperson (To be read aloud by Returning Officer) □ Display the ballot box, illustrate to those in attendance that the ballot box is empty. Then place a seal on the top and bottom fold of the ballot box. □ State that “Our community requires the Chairperson position be filled. □ Make the call for nominations:

o Each person nominated should be nominated by two qualified electors. The nominated candidate and persons nominating must complete and sign Form 2 (Nomination Paper). This completed Form 2 is to be turned over to the Administrator once the election process is completed.

□ To close the “Call for Nominations”, the Returning Officer will call out loud three times (taken from Robert’s Rules of Order) the following: “Are there any other nominations?” □ Once completed, announce the following out loud to those in attendance “The Call for Nominations is now closed.” □ The Returning Officer appoints two scrutineers from among the electors. □ If only one candidate for chairperson is nominated then that person shall be declared elected by acclamation. □ If the position of Chairperson is elected by acclamation, then the Returning Officer will complete Form 11 (Oath of Returning Officer after the Closing of the Poll) stating the name of the candidate and writing in that this person was elected by acclamation, then proceed to the election of the positions of councillor. □ If more than one candidate is nominated for chairperson, then there shall be an election for the position of chairperson. □ If an election is required for the position of Chairperson, alphabetically by last name first then first name, list the nominated candidates (as they appear on their nomination forms) and post at the front of the hall for all to see. □ Explain voting Procedure: (BLANK BALLOTS) □ Each qualified elector must register with the Returning Officer. At this time, the Registration sheet (list of electors) should be handed to the Returning Officer.

□ Each qualified elector will be given a ballot with one blank line to privately write in the name of the candidate for whom they wish to vote for the position of Chairperson. □ A valid ballot for the position of Chairperson must have only one nominated candidate’s name, otherwise it will be considered a spoiled ballot. □ The voting process will cease once all residents attending the election meeting have had an opportunity to cast their votes (last person in attendance has voted) and then the “Close of Poll” will be announced out loud by the Returning Officer. □ Once all qualified electors attending the meeting have voted (regardless of when they arrived during the meeting provided that they are qualified residents (Form 7) and have signed the registration sheet), the Returning Officer must make an announcement declaring that everyone has voted. □ Next, the Returning officer will announce the Close of Poll (that voting has officially ended) and then in a designated room, the Returning Officer in the presence of the two appointed scrutineers shall open the ballot box, examine the ballot papers and proceed to count the votes using the tally sheets. Following the count, all cast ballots will be placed in their appropriate envelopes. The total number of votes cast for the successful candidate will be announced first, followed by the names and number of votes cast for the unsuccessful candidates. □ The Returning Officer completes Form 13 (Return after a Poll Has Been Taken) and it is signed by the Returning Officer and the two scrutineers, turned over to the Administrator at the end of the meeting.

Second Election: For the Positions of Councillor (Any unsuccessful candidate who had been nominated for the position of Chairperson may now offer their name for the position of Councillor) □ Display the ballot box. Illustrate to those in attendance that the ballot box is empty, then assemble and place the seals on the top and bottom of the box. (The ballot box used in the voting for Chairperson may be used for the voting of Councillor). □ State that “Our community requires that _____ (number of positions) councillor positions now be filled. Announce the exact number of councillor(s) positions that the community requires to be filled. □ Make the call for nominations:

o Each person nominated should be nominated by two qualified electors. The nominated candidate and persons nominating must complete and sign Form 2 (Nomination Paper). This completed Form 2 is to be turned over to the Administrator once the election process is completed.

□ After the voting for the position of Chairperson and prior to voting for the Councillor position(s) the Returning Officer should announce that:

Form 11 and 13 is signed by the Returning Officer and Form 13 is signed by the Returning Officer and the two scrutineers. This form is to be turned over to the Administrator at the end of the meeting. □ Place all of the election materials in the ballot box, seal and initial the seals, and turn the sealed ballot box over to the Administrator for safe keeping. □ Congratulate all the nominated candidates for being involved in this election process. □ Thank the electors for attending and for participating in the election process. □ Turn the meeting back over to the (outgoing) Chairperson. □ Finally, the Administrator must complete a copy of the Municipal Election Summary Report on Page 15.
