CONDITIONS OF SALE.

I. 'l'h.:l highest bidder to be the buyer; and if any dispute arise between bidde \ the lot so disputed ::;hall be immediately put up again, provided the auctioneer Cal1Ilot decide the said dispute.

n. No perSOl l to advance less than Is.; above five pounds 2s. 6d.; and so on in proportion.

Ill. All lots are sold subject to the right of the seller or his agent to bid, or else to impose a n~serve.

IV. The purchasers to give in their names and places of abode, and to pay down 10s. in the pound, if required, in part payment of the purchase-money, in default of which t.he lot or lots purchaspd will be immediately put up again and re-sold.

V. The lots to be taken away, at the buyer's expense, immediately after the conclusion of the sale; in default of which Messrs. SOTHEBY & Co. will not hold themselves responsible if lost, stolen, damaged, or otherwise destroyed, but they will be left at the sole risk of the purchaser. If, at the expiration of ONE WEEK after the conclusion of the sale, the books or other property are net cleared or paid for, they will then be catalogued for immediate sale, and the eXlJcnses, the same as if re-sold, will be added to the amount at which the books were bought. Messrs. SOTHEBY & Co. will have the option of re-selling the lots uncleared, either by public or private sale, without any notice being given to the defaulter.

VI. All the books are presumed to be perfect, unless ot.herwise expressed; but if, upon collatillg, any should prove defective, the purchaser will be at liberty to take 01' reject thelll, provided they are received back within FOURTEEN DAYS after the cOllclusion of the sale, when the purchase-money will be returned.

VII. The sale of allY book or books is not to be set aside on account of any worm­holes, st"tined 0]' short leaves of text or plates, want of list of plates or blank leaves, (It' on account of the publication of any subsequeut volume, supplement, appendix, or plates. All the manuscripts, autographs, all magazines and reviews, all bool::s in lots, and all tracts in lots or volumes, will be sold with all fault;';, imperfections and errors of description. The sale of any illustrated book, lot of prints or drawings, is not to be set aside on account of any error in the eJlllllleratioll of the numbers stated, or error of description.

In Sir Edmund Gosse's opinion this MS. is the only trustworthy source for the order of his Holy i::)ollnets, besides being very reliabl"e and often the only evidence for the text of It portion of his other 'york, especially the Epistles and Epigrams.

The MS. consists of 50 folio leaves, of which the first and the last four are blank except for inscriptions. One blank leaf has had three-quarters of it removed; othenvise the MS. is in a remark­ably fine state of preservation. The writing is neat and legible,. and almost without corrections, c. 1625.

It contains in order fj Satires, 13 Elegies, Epithalamium (Is: stanzas), 20 Epistles, 19 Holy ~onnets, La Corona (7 verses), 1 (} Paradoxes (Prose), 20 Epigrams. .

It is bonnd in almost unstained original cream vellum', lettered on the back in MS. ,. Manuscript Poems~ " ,

It is conjectured that it passed from the hands of Woodward. to whom no less than five of the I(pistles concained in it are addressed. into the hands of Donne's disciple Mildmay, second Earl of Westmoreland; at the sale of the Westmoreland Library (where it was found with a copy of the" PseudomcLrtyr " presented by Donne to Woodward, it was acquired by Sir Edmund Gosse. It bean a MS. label "The Earl of Wcstmoreland," 1856," and the signature" Edmund Gosse."

Sir Edmund regarded this splendid MS. as the greatest treasure, in his library, It ranks as one of the most important litera.ry MS. of the early XVII century which has come down to us intact.
