GLOSSARY

Affected person/Affected household

- As individuals, households, companies or individual organizations that due to the change of the project or any stage, subproject (i) are negatively affected to the standard of living; (ii) the ownership and use of land (including residential land, business land, agricultural land, forest land, land for salt mining and/or grazing land), water resources or any mobile assets or any fixed that is restricted or adversely affected partially or wholly, temporarily or permanently; and/or (iii) badly affected business establishments, employment, workplace, residential land or habitat may or may not be a substitute

The affected household includes all members of the family and is considered a single economic unit, who are adversely affected by the project or any component of the project.

Compensation - It is the payment in cash or in kind to compensate for the loss of land, houses, income and other assets caused by the project. All compensation must be based on the principle of replacement cost, which is the method of valuing lost assets at current market prices plus any costs incurred such as administrative costs, taxes, registration fee.

Cut-off date - Is the date of the notice of land recovery by local authorities. Affected people will be notified of the cut-off date for each sub-project, any person or property resolved in the project area after the cut-off date will not be compensated and supported according to the policy of the sub-project.

Ethnic minorities - These are groups of people with different social and cultural characteristics than the majority in society

Benefit - Refering to a range of measures including compensation, income restoration support, conversion support, income replacement, relocation assistance ... for affected people depending on the type and extent of the loss to restore their economy and lives.

Local community - As communities that receive physically displaced people of a project (resettlers).

Income restoration - It is the reconstruction of the productive life of displaced people to generate income equal to or better than their income at the time before of relocation if possible.

Income restoration program

- A program is designed with different activities to support affected people to recover their income/livelihoods during the project preparation period. The program is designed to meet the specific needs of affected people based on socio-economic surveys and consultations.

Inventory of losses - The process by which all fixed assets (land used for residential, commercial, agricultural purposes, including ponds, houses and shops, auxiliary works such as fences, graves, wells, commercial trees ...), income and livelihood sources in the project area are identified, measured, identified owners, locations and replacement costs. In addition, the severity of impact on affected assets and the severity of impacts on the livelihood ability and productivity of affected people will be determined.

To clear the ground - A process by which government agency implement with individuals, households, companies or private organizations that convert all or part of the land it owns or uses for public purposes to compensate according to replacement cost.

Households receive preferential policies

- Including households with meritorious services to the revolution, war invalids, martyrs, Vietnamese heroic mothers, families of heroes of the people's armed forces, which have been awarded by the State of Vietnam according to the regulations of the Ministry of Labor - Invalids and Social.

Recovery - Refers to additional support for affected people who lose production assets, income, employment or living resources, and supplement payment of compensation for recovered assets, in order to recovery minimum of living standards and their life quality

Displacement - The physical displacement of an affected person from residence and/or business prior to the project.

Resettlement Plan and Ethnic Minority Development

- As a resettlement plan for affected people including ethnic minorities, combining resettlement plans with specific concern of ethnic minority and cultural sensitivity to specific needs of ethnic minority groups.

Replacement cost - This is the amount needed to replace an affected asset minus transaction costs such as administrative fees, taxes, registration costs and other eligible expenses.

Researching on replacement cost

- The process of determining the replacement cost of affected assets based on empirical data.

Resettlement - This is the implementation of compensation and remedial measures for all direct economic and social losses resulting from involuntary land acquisition and/or involuntary land use rights or public areas, protected areas.

Natural habitat - It is understood that land and water areas, where biological populations are naturally formed by native plants and animals and where human activity does not change the fundamentally ecological characteristics of that area.

Resettlement Plan - Is a time-bound action plan with a budget to devise strategies, goals, benefits, actions, responsibilities, monitoring and evaluation of compensation and resettlement implementation.

Seriously affected households

- As affected households will (i) lose 10% of total productive land and/or income-generating assets, and/or (ii) relocated households.

Related parties - Are individuals, organizations that are interested or related to the results of the project. The term also applies to people who may be affected by the project. Stakeholders include land users, national, regional and local, implementing agencies, project management agencies, and contracting parties to conduct activities at different stages of project and other groups related to the project.

Vulnerable groups - As different groups of people may be affected disproportionately or facing with the risk due consequences of resettlement, including: (i) women-headed households with dependents, (ii) disabled household heads, (iii) poor households, (iv) households with children and elderly people who have no land and no other

support; (v) ethnic minority households severely affected by the project.

I. INTRODUCTION

1. General Information

1. Asian Development Bank (ADB) sponsors the Basic infrastructure for Inclusive Growth

in the Northestern Provinces Sector Project in Ha Giang, Cao Bang, Bac Kan and Lang Son

(BIIG1) to implement the economic- society development plan in the mountainous provinces

of the Northeast. The project is in line with the strategy of the Government of Vietnam with the

aim of using preferential investment capital for poor provinces to strengthen the linkage

between the provinces to promote economic growth because it has lagged behind so far. The

project includes the following 4 outputs: i) Improve road network connection; ii) Improve rural

water supply; iii) Improve infrastructure of agricultural and rural value chains (ARVC) in Lang

Son province; iv) Decentralize the implementation of public asset management process. In

which, the subproject “Basic infrastructure for inclusive growth in northest provinces sector

project: Ha Giang, Cao Bang, Bac Kan and Lang Son”.

2. The summary of project in Ha Giang are as follows:

• Project name: "Basic infrastructure for inclusive growth in northest provinces sector project: Ha Giang, Cao Bang, Bac Kan, Lang Son – Ha Giang Sub-project.

• Governing body: People's Committee of Ha Giang Province.

• Investor: Department of Planning and Investment of Ha Giang province

• Project implementation time: From 2017 - 2022.

• Capital source: ODA loans funded by the Asian Development Bank (ADB) and the local budget reciprocal capital.

• Location: Districts of Bac Quang, Vi Xuyen, Hoang Su Phi, Dong Van, Meo Vac and Ha Giang City.

2. Information of Ha Giang’s subprojects

3. In Ha Giang province, 05 subprojects have been proposed under BIIG1, the details are

summarized as below:

• Subproject 1: “Upgrading and improvement of Provincial Road 184 (PR184) from Dong Tam Commune, Bac Quang District to Ngoc Linh Commune, Vi Xuyen District, Ha Giang province”. The road shall be upgraded to the mountainous IV grade with the technical specifications meeting standard TCVN4054. The proposed subproject passes through Dong Tam Commune, Bac Quang District, Trung Thanh Commune, Ngoc Linh Commune and Viet Lam Town, Vi Xuyen District with the total length of 24.896km.

• Subproject 2: Construction and Improving Provincial Road 184 (From Minh Khai Ward, Ha Giang city to Binh Vang Economic Zone, Vi Xuyen District), Ha Giang Province. The road will be improved to Category IV and V mountain road (TCVN 4054-05). The provincial road 184 subproject passes through Minh Khai ward, Ha Giang city and 3 communes, Phu Linh, Ngoc Linh and Dao Duc, Vi Xuyen district, Ha Giang province with a total length of 24.311km.

• Subproject 3: Upgrading and renovating provincial road in Yen Minh – Mau Due – Meo Vac. The section of the designed road is a mountain road of grade V, and designed according to the standards TCVN 4054-2005. This route goes through 4

communes in 2 districts: Dong Van and Meo Vac with a total length of 16.21 km including Sung Trai and Lung Phin commune of Dong Van district; Sung Mang and Sung Tra commune belong to Meo Vac district.

• Subproject 4: Construction and Widening of Domestic Water Supply System for Vinh Quang Town, Tu Nhan and Ban Nhung Communes, Hoang Su Phi District, Ha Giang Province. The designed capacity of the subproject is 2,200m3 per day.

• Subproject 5: Construction and expansion of domestic water supply system in Coc Pai township and adjacent communes of Nam Dan, Ban Ngo, Xin Man district, Ha Giang province. The designed capacity of the subproject is 3,600m3 per day.

4. As results of IOL during project preparation, all 05 subprojects will involve to land

acquisition. The summary of impacts will be presented in following sections.

3. Implementation arrangements

5. In order to ensure the compliance of the project with regard to the implementation of

safeguard policies of ADB, since the beginning of the project preparation stage, the Ha Giang

PMU have assigned an officer who is responsible for social safeguard policy issues, including

social and land acquisition and environment with the support of the Specialists in term of

resettlement and environment from project implementation and supervision consultant (LIC).

In addition, the safeguard policy training courses have been started from the beginning of the

subproject and the PMU staff have been assisted during the subproject implementation.

Therefore, the issues relating to the social safeguard policy have been implemented in

compliance with the ADB’s requirements and the Policy Framework approved for this

subproject.

4. Objective of internal report

6. Because this project is categorized as B for involuntary resettlement and B for

indigenous people, therefore project is only required the internal monitoring during project

implementation. The main purpose of the internal monitoring is to ensure that matters related

to involuntary resettlement and indigenous people have been implemented in accordance with

the policies and procedures of the RPs/REMDPs/DDRs following ADB SPS 2009 and project

policy.

7. Objectives of internal monitoring and evaluation for evaluation:

✓ Conformity with the REMDP;

✓ Availability of resources and efficiency, effective use of resources to carry out land acquisition, resettlement and EM activities;

✓ Implemented organizations perform their functions and duties well throughout the project implementation process;

✓ Resettlement and EM activities are implemented in accordance with the implementation schedule described in the uREMDP;

✓ To identify problems, if any, and corrective actions for next period.

8. This report is prepared by Ha Giang PMU to provide information and report to ADB on

the implementation status of social safeguard for for the first half of 2021, covering the period

5. Summary of impacts based on IOL results (Approved REMDP in 2017)

9. According to the preliminary inventory results during the PPTA period, there are 993

households affected by the subproject, of which 754 households are EM households, 954

households are marginally affected, 39 AHs are severely affected including 09 relocated

households, and 30 households lose by 10% or more of productive land holding), 392

households are vulnerable groups and 22 agencies/organizations are also affected by land

acquisition for subprojects. Details in Table 1.

5.1 Impacts on lands

10. The total land acquired of the road component: 03 subprojects is expected to

acquire of 193,335m2, in which 80.5% is land of household (155,682m2) và 19.5 % and is land

of units/organizations (37,707m2). Subproject 2 has the highest acquired land 96,862m2

accounting for 48.1%, followed by subproject 190,868m2 (45.2%). Specifically in table 2.

11. The total land acquired of the water component: According to preliminary data,

200m2 of residential land and 8,000m2 of productive land will be acquired.

5.2 Impacts on houses and structures

12. Structure affected in the road component: The sub-projects under the road

improvement category will affect a number of houses and architectural objects of the people.

The subprojects under this component affect about 549m2 of house; 574m storehouse; 52m2

kitchen; 20m2 bathroom/toilet; 5,999m2 fance; 351m2 gate; 6,670m2 concrete yard; 30m wall;

30 concrete culvert; 210m2 animal shed; 95m2 Kiot; 639m2 covering roof; 10m2 sliding iron

doors; 107m2 the entrance to the house is Proximang; 2 water tank; 291 electrical telecom

poles; 10,430m electrical wire và 01 transformers. Specifically at the subproject as follows:

13. Structures are affected in the expansion of the water supply system: There will

be 50m2 of houses, 15m2 of cattle sheds permanently affected by the subproject.

5.3 Impact on annual crop and trees

14. There will be about 39.260 affected trees, of which the subproject 1 has largest number

with 9,794 trees; followed by the subproject 2 7,365 trees; SP 3 429 trees; SP 4 42 trees and

SP 5 2,000 trees. Besides, the sub-project affects 51,159m2 of crops and rice. Specifically at

the subprojects as follows:

6. Summary of impacts based on DMS results

15. By the time of this report, the DMS process is only conducted for subprojects 1 and 2;

subproject 3 are in the process; subprojects 4 and 5 have not been implemented. Therefore,

the DMS data of this report mentioned on subprojects 1 and 2 only, the DMS data of

subprojects 3, 4 and 5 will be updated in the next report.

6.1 Impact on households

16. Up to 30/06/2021, the number of affected households is 1,418 households due to land

acquisition for two subprojects 1 and 2. Of which, 1,407 households are marginally affected

and 11 households are severely affected due to losing 10% or more of their productive land.

In addition, 82 households are classified as vulnerable households. Out of total 1,418 AHs,

1,076 households are ethnic minorities (06 ethnic minority households are severely affected).

6.2 Impact on land

A. Permanently acquired

17. Through the counting results, subproject 1 and 2 will acquire 598,646.9m2 of the land

of all kinds, in which subproject 1 will acquire 294,776.6m2 and subproject 2 will acquire

303,870.3m2. The subproject mainly affects some types of production land of households such

as: paddy land, burnt-over land, land for perennial crops, and some affected households with

residential land, total land area. The type of households affected by 02 subprojects is

190,137.4m2. Besides, the sub-project will affect 408,509.5m2 of the land of organizations,

mainly transport land. Specifically, in table below.

B. Temporary land acquisition

18. At the time of reporting the DMS work has been completed for subproject 1 and

subproject 2.

19. According to DMS results, during the construction of the subproject, there will be a

temporary impact on the 10,257.3 m2 of annual cropland of 6 households used for camping

and temporary materials yard of the construction contractor. Consultation with these

households shows that the households all agree to allow the contractor to use this area during

the construction period because this area is bare land (the soil is contaminated with alum so it

is not cultivated for a long time). During the contractor uses the land, compensation for impacts

on this land will be agreed upon by the contractor and affected households. Upon completion

of construction work, this land area will be returned to these households. During the

construction process, there might be an additional area of temporary affected land, the PMU

and the construction contractor will have an agreement with the land owner and local authority

according to the regulations, land and properties on land will be compensated and supported

in accordance with regulations (Households with temporarily affected land all signed the

ground handover agreement as in Appendix 2).

6.3 Structure affected

20. The sub-projects under the road improvement category will affect a number of houses

and architectural objects of the people. The subprojects under this component affect about

4,350.57m2 of house; 4,786.48m2 covering roof; 3,884.2m2 fence; 148.06m2 gate; 1,884.3m2

concrete yard; 10,667.6m2 wall; 1,542.7m2 animal shed; 568.34m2 water tank; 198 electrical

telecom poles; 2,180m electrical wire and 40 tombs. Specifically at the subproject as follows:

6.4. Impact on annual crop and trees

21. There will be about 63,435 affected trees, of which 49,912 of fruit trees and 13,523 of

timber trees; and 26,885m2 of crops affected by the two subprojects. Specifically at the

subprojects as follows:

7. Impacts on livelihood, vulnerable and ethnic minority people

7.1 Impact on vulnerable households

22. As shown in Table 5 above, through the counting results, subprojects 1 and 2 will affect

1,418 households, of which subproject 1 affects 695 households, subproject 2 affects 678

households. There are 1,407 households mildly affected and 11 households severely affected

by 2 sub-projects (subproject 1 affected 8 households and subproject 2 affected 3 households),

all of these households are affected by a loss of over 10% of production land, no household

has to be relocated or resettled. The Ahs that lose more than 10% of production land by

subproject 1 and 2 are all the AHs losing from 10 to 30% of agricultural land holding, details in

following table:

23. Subproject 1: Of the 740 affected households, 559 affected households are ethnic

minorities with the following ethnic groups: Dao, Mong, Tay, Nung and most of them are Tay

people; 36 households under vulnerable groups; 01 women headed households with dependent

person, 04 households with disable person, 13 households under preferential treatment policy,

12 poor households and 06 ethnic minority households are severely affected.

24. Subproject 2: Out of 678 households in 4 communes/wards, of which, 517 AHs are

ethnic minorities (Tay, Nung, Giay, Dao ...).. There are 46 vulnerable households, including 21

poor households (no poor households are severely affected), 01 single female household with

small children, 3 households according to preferential policy, 17 households with disabilities

and 03 households of EM households severely affected (losing more than 10% of productive

land), 02 households with the elderly as the householder and no source of support. Specifically,

7.2 Impact on issues of ethnic minorities

25. People in the project area are mainly ethnic minorities. Out of a total of 1,418

households affected by the 2 subprojects, 1,076 households are ethnic minority households,

in which, subproject 1 has 559/740 households, subproject 2 has 517/678. Subproject 1 has

06 households and subproject 2 has 03 households belonging to ethnic minority households

II. DETAILED PROGRESS OF LAND ACQUISITION IMPLEMENTATION

1. Status of social safeguards documents for subprojects

26. As mentioned above, the land acquisition will be involved in the construction of all 5

subprojects, therefore, during project preparation stage, a REMDP has been prepared for all

subprojects based on basic design, the results of the inventory of losses (IOL) and

socioeconomic survey (SES) of affected households (AHs), including consultations with the

AHs.

27. During the project implementation phase, there are 5 REMDP reports that need

updating to monitor the progress of resettlement activities and social policies of the

subprojects. By the end of June 2021, ADB has approved 02 REMDPs and the remaining 03

REMDPs have not been updated (REMDP of subproject 3 is expected to be updated in the

third quarter of 2021, after the results of the DMS and compensation, site clearance plan are

available). Up to the present time, subproject 3 is completing cadastral mapping and

measurement work, preparing for DMS. Details are shown in the table below:

28. The site clearance completion reports of Sub-projects 1 and 2 have been approved, all

sections of roads in the communes affected by the sub-projects are eligible to carry out

construction according to regulations of ADB and they have commenced construction.

29. The consultant and the PMU have had close contact and coordination, and closely

followed the project progress. In general, reports on Resettlement and Development of Ethnic

Minorities (REMDP) and reports on completion of site clearance have been completed in a

timely and complete manner in accordance with ADB’s request, without affecting the

construction progress of the project’s works.

2. Project information disclosure and public consultation

30. PMUs have collaborated with the design consultancy unit, DMS’s unit, to organize

public consultation meetings at the People's Committee of the communes in the project area

with Ahs, representatives of local authorities and organizations from October 2016 to

December 2020. During the meetings, representatives were informed of project information,

progress and uREMDP activities, discussions about plans and activities during the uREMDP

process. Representatives of the CPCs, affected households and local organizations/mass

organizations participating in the consultation meeting pledged to actively support the project.

31. Necessary documents provided to affected people and community include: (i) Project

information booklet (PIB); and (ii) PPC's compensation unit price for affected land, trees and

structures; (iii) support and allowances for affected households.

32. Up to 30/06/2021: the consultation activities have been implemented during the

preliminary design, detailed design phase, updated resettlement reports with a total of 1,851

peoples for the whole project. There are 1,266 EM people (68.4%) and 806 women (43,5%).

The number of participants in the consultation was highest in subproject 1 (869 peoples)

followed by subproject 2 (551 peoples), subproject 3 (241 peoples), subproject 4 (63 peoples),

subproject 5 (106 peoples). Most sub-projects have not yet reached the percentage of women

according to the project criteria (at least 50%), so consultations will continue during the DMS

phase to ensure the Project's criteria. Details of consultation data are as follows:

33. The consultation meetings aim to provide details to the local government, mass

organizations, APs and local people; discuss and gather feedback. Specifically, the following

issues have been discussed:

• Subproject description: location, size and scope of impacts;

• The subproject’s implementation plan;

• The notification of land acquisition and DMS plan

• The Sub-Project’s policies in terms of land acquisition, compensation and

resettlement assistance as well as eligibility criteria;

• The Sub-Project’s grievance redress mechanism; and

• Replacement cost

• Issues related to EMs, gender, restoration of incomes, livelihood and other support

policies

34. During the reporting period, PMU conducted 01 public consultation meeting for

subproject 3 to inform on land acquisition, consult local authorities and affected households on

compensation policies, resettlement and discuss on compensation for land clearance with a

total of 29 participants, of which there are 17 men (58.6%), 12 women (41.4%) and all

participants are all ethnic minorities. The content discussed in the consultation session is

presented in Appendix 3.1. Public consultation meeting to inform on land acquisition, discuss

on land clearance and resettlement policy, plan and methods of detailed measurement survey

will continue to be held in the remaining affected communes by this subproject including: Sung

Mang, Sung Tra, Lung Phin in the next reporting period.

35. Results from observations and consultation meetings with local authority, organizations

and affected people are summarized as follows:

• Affected and non-affected people support and agree with construction of the road;

• During the meetings, the potential impacts of the subproject in terms of land

acquisition were duly discussed with APs whose lands and assets will be affected;

All agreed that the impact of subproject is marginal however all impacts on the

assets should be compensated and assisted;

• The APs agreed with the subproject's principle on compensation and resettlement

assistance;

• During the detailed design phase, it is necessary to consult with communal authority

and local people;

• It was noted that the environmental impacts of the subproject during construction

are inevitable, but these can be minimized with the proposed mitigation measures

in the EMP;

• It is necessary to have proper construction method especially for the road section

running through residential area, structures of households near the road, structures

of CPC, school, bridge and culvert in the territory of communes. During the

construction period, the traffic should be controlled so that the disturbances to

transportation, production and business of local people as well as enterprises will

be avoided.

• Before civil work commencement, it is necessary to check the condition of houses

close to the road to avoid the dispute on the cracking of the house;

• It was proposed that meaningful consultation with and participation of women and

EMs in the process of REMDP implementation, management and monitoring will

be continuously undertaken in next steps;

• APs proposed that the compensation payment should be paid at one time and

before the start of construction. The APs also mentioned that the issues on the

quality of the subproject should be considered and that they are willing to be

representative in the Community Monitoring Board during subproject construction;

• Complaints of APs should be resolved timely and successfully.

36. According to the survey results and consultation with affected households during the

preparation of this report, the affected households are fully informed about the project

implementation, compensation and support policies. In general, the households are satisfied

with the activities of information dissemination and public consultation meetings during the land

acquisition process, including DMS activities, public posting and payment of compensation.

3. Detailed measurement survey (DMS)

37. The DMS of damage is done publicly and transparently for each household. The

process of carrying out the DMS has the participation of representatives of households, village

heads, commune cadastral officials and members of the DMS group involving in identifying

affected assets in terms of land, houses, structures, trees and crops, taking part in measuring

affected properties, confirming in the minutes of damage DMS. (see Appendix 3.2 for details).

38. The DMS team and households discuss and agree on the types and the degree of

impact of each type of property; Household representatives together with the DMS team and

the participants sign the minutes of damage DMS after agreeing on the DMS results. The

results of damage DMS (the minutes of damage DMS) are made into 3 copies: the household

keeps one copy for re-inspection, the DMS team keeps two copies - one to be posted publicly

in a public place, the other to summarize the results of the DMS and to be kept.

39. The DMS results are posted publicly in the community. Affected households

participating in the DMS re-check the DMS results above to see if there are any errors which

will be recorded in the questionnaire. The village head will summarize the questionnaires,

record a list of households that need to carry out the DMS again or need to additionally conduct

the DMS and pass it on to the DMS team when they return to the village to carry out the DMS

again according to the opinion of the people.

40. The DMS team publicizes the second DMS results to households in the community.

They explain and answer questions and complaints related to the DMS results.

41. When no household in the hamlet/village has any questions about the DMS results,

that results can be officially used for legal review, pricing and building a compensation plan

and updating the resettlement plan.

42. Currently, subproject 1 and subproject 2 have completed detailed damage inventory

and compensation for site clearance has reached over 90%. In Sub-project 3, the

measurement of affected assets of organizations and individuals is being carried out within the

land acquisition boundary in Meo Vac district. In addition, the cadastral map of the affected

area in Dong Van district is being corrected to issue the notice of acquisition to conduct detailed

measurement survey. The implementation of DMS for this sub-project implemented in Sung

Trai and Lung Phin communes of Dong Van district have been delayed due to the complicated

situation of the Covid-19 epidemic in the district. Travel restriction and epidemic zoning in the

district has significantly affected the progress of the DMS.The subprojects 4 and 5, are

expected to be implemented in the third quarter of 2021. The details of the subproject

4. Preparation and approval of compensation plans

4.1 Replacement cost survey

43. The replacement cost survey and study were carried out in September and October by

DCARB of Bac Quang, Vi Xuyen districts, and CARB of Ha Giang city to determine the unit

price of land compensation and will be appraised by the Department of Natural Resources and

Environment and approved by the Provincial People's Committee. The cost is determined

based on the price at some implemented projects in the project area.

44. Compensation for structures: The compensation unit prices of structures are based

on provincial decision (Decision No. 16/2019/QD-UBND dated 26/6/2019 of the People's

Committee of Ha Giang province on promulgating the level of compensation for damage to

houses, other construction structures on land and relocation of graves when the state recovers

land in Ha Giang province). During preparation of the compensation plans for AHs, these prices

have been consulted with the AHs and all of AHs have agreed on these compensation rates.

45. Compensation for trees/crops: Similar to structures, the compensation unit prices for

trees also are based on the provincial decision (Decision No. 1354/QD-UBND dated 10/7/2019

of the People's Committee of Ha Giang province, promulgating the unit price of compensation

plant and animal when the State acquires land in Ha Giang province) with the agreement of

AHs through consultations.

46. Compensation for land: As said in above, the compensation unit prices for land is

determined by Vi Xuyen and Bac Quang CARB. Both CARB studied and collected information

on land, market price and land price information in the land database and consulted Ahs. The

replacement cost will be appraised by Department of natural resources and environment and

approved by PPC.

47. The unit price consultation implementation progress applies to subprojects:

- Subproject 1: completed the survey, researched replacement cost and used the unit price to calculate compensation, support for AHs.

- Subproject 2: completed the survey, researched replacement cost and used the unit price to calculate compensation and support for AHs.

- Subproject 3: Carrying out DMS, not yet carried out survey and study of replacement cost.

- Subproject 4, and Subproject 5 have not implemented RSC.

48. Consultation with AHs shows that they agreed with these proposed compensation

prices. (The consultation is carried out with all affected households in the project area as shown

in Appendix 3.3).

49. Supports: In addition to compensation for affected land, trees, crops and structures,

AHs also receive other supports, which are: Support on living stabilization for households who

have lost from 10% to 30% of agricultural land; support for job creation/change for households

that have lost their land for annual crops and perennial crops and support for poor households

and other vulnerable households including i) single women headed households with

dependents, (ii) disabled head households, (iii) households below the poverty standard, (iv)

households headed by children and the elderly without other support; (v) ethnic minority

households heavily affected by the project, (vi) policy households as defined in the REMDF

framework. During the preparation of the compensation plan, the clearance level of support for

the above beneficiaries will be considered, compared, between the level of support prescribed

by Ha Giang province with the provisions of the REMDF framework and the higher level of

support will be is applied. These types of support are consistent with the approved policy

framework for the project as well as the benefit matrix mentioned in the REMDP.

4.2 Preparation and approval of compensation plans

50. Up to the time of reporting, only subproject 1 and subproject 2 have completed the

compensation plans for AHs. The 3 remaining sub-projects have not been completed yet due

to the completion of DMS and RCS. Sub-project 1 and 2 have had the compensation plan

approved for 1,334 affected households with a total amount of VND 54,749,396,727. In which,

subproject 1 has 740 households with VND 25,489,810,277 according to the decision

approving the compensation plan of Bac Quang district and Vi Xuyen district; subproject 2 has

620 households with a total amount of 29,259,586,450 VND with the decision to approve the

compensation plan of the People's Committee of Vi Xuyen district. For subproject 2, there are

678 households affected by the subproject according to the results of the DMS count, however,

only compensation and support plans of 620/678 households have been approved because

the remaining households belong to the route section in the territory of Minh Khai ward, Ha

Giang city. The section of the route in Minh Khai ward is being adjusted in the direction of

recruitment and is currently in the process of editing the design. According to the preliminary

result, there are 58 affected households in this section. It is expected that in the third quarter

of 2021, after completing the additional design and overall adjustment of the whole route

submitted and approved, a detailed inventory of affected households in Minh Khai ward of

subproject 2 will be carried out once adjustement of the route is approved. Hence, the approval

decisions of compensation plans of subprojects will be updated in the next report.

5. Process of compensation payment

51. Compensation and support payments for households and organizations have been

completed in affected communes in Bac Quang and Vi Xuyen districts of subproject 1 and

affected communes in Vi Xuyen district of subproject 2. The PMU is responsible for paying the

affected households and units. Payment is made at the headquarters of the People's

Committees of communes with the participation of local authorities, village heads, and

representatives of affected households. The payment process is carried out in turn in the

affected communes, according to each route section. The payment procedures are simple and

convenient, and the affected people have been informed before paying. After receiving

compensation and support, people sign a written commitment to hand over the site. The

payment of compensation takes place quickly, conveniently, in accordance with the process,

the people of the affected areas are satisfied with the compensation payment without

complaints or lawsuits.

52. During the reporting period, subprojects 1 and 2 have completed payments to affected

households. In January 2021, the PMU made payments to the remaining 408 affected

households in Phu Linh commune, and the affected households in Ngoc Linh and Dao Duc

communes (under Km8+50 – Km20+783.23 and Km3.621 of branch section) under subproject

2. In June 2021, subproject 1 has completed payment for 715/740 affected households, all

affected households have received compensation, committed to support and hand over the

premises. Subproject 1 has 25 affected households that have not yet received compensation

because they are working in other localities, some households have permanent residence in

other places, far from the project area, so they have not received compensation yet.

53. The PMU has contacted the families to quickly complete the authorization documents

to receive the compensation, this AH has made appointments to receive the compensation.

This information will be updated in the next internal monitoring. Other subprojects due to

incomplete work (i) DMS, (ii) preparation of compensation plan (iii) as well as submission of

uREMDP report to ADB and (iv) PPC approval of uREMDP report in most of the subprojects

therefore, there is no basis for compensation payment.

6. Process of resettlement and site clearance

6.1 Resettlement

54. According to the DMS results of subprojects 1 and 2, no households have to be

relocated or resettled. The impacts of subprojects 3,4,5 will be updated in the next reporting

period.

6.2 Site clearance

55. By the time of reporting, the clean site clearance for construction has been completed

for subproject 1 and affected communes in Vi Xuyen district of subproject 2. The handover of

the site between affected households with the project management unit and construction unit

shall be carried out immediately after conducting compensation, support, and resettlement

activities. During the process of receiving compensation, people signed a written commitment

to hand over the site. The land area for clearance of subprojects 1 and 2 have been fully

compensated, supported and permanently recovered to serve the project. Details are shown

in the table below:

7. Income restoration program

56. During the DMS process for subproject 1 and subproject 2, the consultation on LRP

with households affected by these subprojects was conducted. Accordingly, there are 841

affected households in the project area affected by subprojects 1 and 2 that are eligible to

participate in livelihood restoration needs. They were consulted and provided with sufficient

information about the livelihood restoration program for vulnerable households and severely

affected households.

57. When the State recovers agricultural land, they will be compensated in cash for the

acquired land, and also supported with training, job change. The monetary support is as

follows: For land for annual crops, land for perennial crops, land for aquaculture: 2.5 times the

price of land of the same type in the land price list issued by the PPC; forestry land is equal to

1.5 times of land price of the same type in the land price list issued by PPC; The supported

area is the entire acquired area, but not exceeding the allocated local agricultural.

58. In addition to the subsidies in cash for vocational training, job change, and livelihood

stabilization for those affected, an income restoration program (IRP) will be implemented.

Income restoration measures are implemented for those affected by agricultural land

acquisition (including (i) severely affected households losing more than 10% of the total

agricultural land/household area); (ii) AHs belong to vulnerable group), due to affected

production system or they have no alternative income source. Out of 1,418 households

affected by subproject 1 and subproject 2, 84 households are eligible to participate in IRP. In

which, there are 11 severely affected households (losing more than 10% of productive land)

and 82 households belong to vulnerable group.

59. During the inventory of property damage in subproject 1, subproject 2, a consultation

survey for affected households in these subprojects was carried out. IRP programs will be

integrated with programs of vocational training, loans, and job placement in each locality.

Existing programs in the locality are regularly organized every year such as training courses

on agricultural extension programs on crops and livestock, and bank loan programs. In

addition, local banks such as Bank for Agriculture and Rural Development and Bank for Social

Policies annually have loan programs for local households if they have loan needs with low-

interest rates. Consultation with households with full rights to participate in the IRP shows that

the level of impact on vulnerable households is insignificant compared to their income because

AHs are affected by small structures such as roof, fence, and some short-term trees. For 11

severely affected households, they are all households with main income from business,

trading; the acquired land area was only planted with a few short-term trees due to weathered

land with low cultivation yield, so that the impact on their income is not significant.

60. Some vocational training programs expected to be implemented in the area include

repairing agricultural machines, growing high-yield rice, plant safe vegetables; techniques of

planting, tending, harvesting and processing tea; techniques of afforestation, breeding and

disease prevention and treatment for buffaloes and cows; Medicinal plant classes; grow

vegetables in a greenhouse. (see the consultation minutes in the appendix 3.4,3.5). Due to the

complicated Covid-19 epidemic, the local government of the commune, the Center for

Vocational and Continuing Education, and the District Department of Labor - Invalids and

Social Affairs temporarily postponed vocational training activities in the locality. It is expected

to be deployed in the fourth quarter of 2021 or when the epidemic situation is under control.

61. Up to the time of reporting, subproject 1 has 5/36 households, subproject 2 has 3/46

households registered as workers at the construction sites of the subprojects. IRP

implementation for affected households will be updated in the next internal monitoring reports.

62. Subproject 3, subproject 4 and subproject 5 do not have the list of affected households,

so this content will be updated in the next periodic report.

8. Assessment degree of APs’ satisfaction of compensation and resettlement

63. Compensation and resettlement work has been carried out in the subproject 1 and 2.

Consultation with AHs on results of DMS, replacement cost has been carried out during

subproject implementation phases. The results show that people agree with the results of the

inventory and replacement cost applied to affected land and assets. In the process of

implementing DMS, all AHs, commune authorities, and tally units are involved, so objectivity

and honesty are all ensured.

9. Grievance/complaint (GRM)

64. The grievance redress mechanism (GRM) has been established for project to address

the displaced households' grievances and/or complaints regarding land acquisition,

compensation, and resettlement in a timely and satisfactory manner. All APs can send any

questions to implementation agencies about their rights in relation with entitlement of

compensation, compensation policy, rates, land acquisition, resettlement, allowance and

income restoration. Furthermore, APs will not be ordered to pay any fee from all administrative

and legal fees that might be incurred in the resolution of grievance and complaints at any level

of trial and court.

65. The GRM of the project has also been developed following to Law on complaint No.

02/2011/QH13 and regulation on grievance at Government Decree 75/2012/NĐ-CP dated

20/11/2012.Complaints will pass through 3 stages before they could be elevated to a court of

law as a last resort. The GRM has been disclosed to APs and will be continuously disseminated

to people during project implementation. Beside, as the instruction of LIC, the project CPCs

have set up a GRM monitoring book/log.

66. By the time of this report, none of household made complaints or lawsuits to competent

authorities. This GRM process will be monitored, updated and reported in the next period by

the consultant.

10. Activities for EM following the approved REMDP

67. As of June 31, 2021, the uREMDP report of subprojects 1 and 2 has been approved.

During the reporting period, the activities in the EMDP were carried out and fully complied with

the approved EMDP, the activities for EM are detailed as follows:

(i) CSBs have been established in the communes affected by the subprojects. CSB

participates in supervising social activities and construction activities: In Ha Giang,

09 communes have established a Community Supervision Board dedicated to the

project with a total of 71 members (100% are ethnic minorities), including 28 women

(accounting for 39.4%). CSBs carry out social supervision of construction activities,

legal, undertakings, and safeguard policies. The consultant has coordinated with

the PMU to train and improve the capacity of the Community Supervision Board

under subprojects 1, 2, and 3 (in communes of Dong Tam, Trung Thanh, Ngoc

Linh, Dao Duc, Phu Linh, Sung Mang, Sung Trai, Lung Phin, Sung Tra) in

December 2020 and June 2021. LIC Consultants coordinated with PPMU to

conduct training and improve supervision capacity for CSB in December 2020 for

71 members, 100% are ethnic minorities, of which 28 are female (39.4%).

(ii) Consultation: Public consultation activities in the subproject consultations are 50%

female: During the period January-June 2021, subproject 3 conducted 1

consultation during the REMDP update process, with a total of 29 people, The

number of women participating is 12 people, accounted for 41.4%,100% are ethnic

people, partially complying with the criteria because most male household heads

attended the meeting. Compliance with this criterion will be noted in the next

reporting periods.

(iii) Job opportunities: From November 2020 to June 2021, sub-projects 1 and 2 have

commenced construction. During the construction process, contractors give priority

to recruiting and creating jobs for local people. Specifically, as of June 2021,

subproject 1 has 35 local workers (including 32 men and 3 women). Subproject 2

has a total of 5 local workers in the project area, of which 3 are male and 2 female)

All local workers employed in 2 projects are ethnic minorities. All workers receive

the same pay for equivalent jobs. The consultant collaborated with the PMU to

check the compliance of the construction contractor with relevant labor laws such

as: not using child labor, providing protective gear for workers, using laborers. is a

local, oversees the payment of equal wages to male and female workers for

equivalent work in April 2021 and June 2021.

(iv) CSB participates in monitoring social activities and construction activities: In Ha

Giang, 09 communes have established community supervision boards dedicated

to the project with a total of 71 members, including 28 women (accounting for

39.4%). CSB carried out social supervision for construction activities, legal

guidelines, and safeguard policies. The consultant has coordinated with the PMU

to train and improve the capacity of the Community Supervision Board under

subprojects 1, 2, and 3 (in communes of Dong Tam, Trung Thanh, Ngoc Linh, Dao

Duc, Phu Linh, Sung Mang, Sung Trai, Lung Phin, Sung Tra) in December 2020

and June 2021. LIC Consultants coordinated with PPMU to conduct training and

capacity building for the CSB in December 2020 for 71 members, 100% of whom

are ethnic minorities, of which 28 are female (39.4%).

(v) Training on capacity building: During the reporting period, in March 2021, LIC

coordinated with the PMU, the construction contractor to organize propaganda

sessions to raise awareness about HIV/AIDS prevention and human trafficking for

construction workers and community with the participation of 387 people with 198

women (accounting for 51.1%) and 297 ethnic minorities (accounting for 76.7%). In

addition, 2 training programs to raise awareness on traffic safety for vulnerable road

users were also implemented at subproject 1 and subproject 2 with the participation

of 303 people of which 152 female (accounting for 50.2%), in which 220 people are

ethnic minorities (accounting for 72.6%).

(vi) Awareness raising activities for construction workers and the community, especially

for ethnic minority women in ethnic minority areas are expected to be implemented

in QIII/2021.

70. SP 1: uREMDP of the subproject was approved on 11/11/2020, the construction

contract was signed on 13/11/2020 with the construction contractor. Compensation and

resettlement support for affected households have been completed 96.6% because 25

affected households are working in other localities, some households with permanent

residence in other localities, far from the project area, have not received compensation yet ,

The site clearance completion report of the route sections has been approved by ADB in

October 2020, December 2020 and February 2021, recognizing that the sections are eligible

for construction. The subproject is currently under construction.

71. SP 2: uREMDP of the subproject was approved on 11/11/2020, the construction

contract was signed on 02/10/2020 with the construction contractor. Compensation and

resettlement support for affected households have been completed 91.4%, the section of the

route in Minh Khai ward of the subproject is being adjusted in the direction of the route, the

design is currently being adjusted. Therefore, the detailed inventory for this section has not

been implemented yet. The site clearance completion report of the route sections has been

approved by ADB in November 2020, March 2021 and June 2021, recognizing that the road

sections are eligible for construction. The subproject is currently under construction.

III. CONCLUSION AND RECOMMENDATION

1. Conclusions

75. During the reporting period, subprojects 1 and 2 have continued to carry out payment

activities, clean site clearance and carry out construction . Specifically, subproject 1 has

completed paying for 715/740 households affected by the subproject, all affected households

have received compensation, committed to support and hand over the site. For subproject 2,

completed payments to the remaining 408 affected households in Phu Linh commune, and the

affected households in Ngoc Linh and Dao Duc communes. So the compensation payment

have been completed for total of 620/678 households affected by subproject 2 by June 2021.

The sections of the route are eligible to hand over the site to the construction unit in accordance

with ADB's regulations, without complaints.

76. Completing measurement and mapping of land acquisition for compensation and site

clearance of sub-project 3: "Upgrading and renovating Yen Minh - Mau Due - Meo Vac road".

Carrying out a measurement of affected assets of organizations and individuals within the land

acquisition boundary in the territory of Meo Vac district.

77. Activities under the approved uREMDP include (i) social monitoring of construction

activities; (ii) Training on HIV/AIDS, GAP for contractor CSB. During the reporting period, LIC

Consultants coordinated with the PMU, the construction contractor to organize propaganda

sessions to raise awareness about prevention of HIV/AIDS and human trafficking for

construction workers and community people. In addition, 2 training programs to raise

awareness on Traffic Safety for vulnerable road users were also implemented in subproject 1

and subproject 2. PMU staff who have received prior training on gender safety policies and

action plans, they will participate in training and communication on Gender, HIV/AIDS, and

human trafficking as project's communicator. They will work with the Gender expert to ensure

that the contents covered in the Gender Action Plan are fully implemented. Awareness raising

activities for construction workers and the community, especially for ethnic minority women in

ethnic minority areas are expected to be implemented in QIII/2021.

78. In general, activities in the reporting period followed the project schedule. The DMS,

land acquisition, compensation, resettlement, and site clearance on all sections of the

subprojects are carried out in accordance with the project policy framework, the Land Law of

Vietnam and regulations on compensation and land acquisition of the province such as

information disclosure process, project implementation; notice of land acquisition, DMS

process, making the plan of compensation for affected households and making public

announcement. The requests, questions and complaints of households affected by the

subproject were satisfactorily answered by PMU, the unit carrying out the DMS, the District

Land Clearance Compensation Council and local authorities

2. Recommendations

79. Up to the reporting time, there are 25 households affected by subproject 1 that have

not received compensation. In the coming time, the PMU will continue to contact households

to quickly complete the authorization documents or take the initiative to receive compensation

and support to complete the handover of clean ground for the construction unit, ensuring the

project progress.

80. Subproject 2 is in the process of adjusting the route alignment, currently editing the

design. The PMU needs to accelerate the progress, coordinate with relevant units to complete

the additional design and overall adjustment of the entire route, which is expected to be

submitted and approved in Quarter IV/2021 to ensure the project progress.

81. As planned, subprojects 3, 4 and 5 will be awarded contracts in QIII/2021, and

QIV/2021. To ensure the progress of the project, some main recommended actions are that

the PMU needs to closely coordinate with relevant units to accelerate the measurement and

mapping of land acquisition for compensation, site clearance of sub-projects 4 and 5. The

compensation councils of districts need to coordinate and closely contact with local authorities

and affected households to speed up the detailed measurement survey, complete the plan of

Waste dump location No 03 was selected at the land of Minh Thanh village, Trung Thanh

commune, Vi Xuyen district, Ha Giang province. Specifically as follows:

After working with DCARB, CPC and PMU, all households agreed to allow the contractor to

use this area during the construction period because this area is bare land (the soil is

contaminated with alum so it is not cultivated for a long time). Upon completion of construction

work, this land area will be returned to these households.

of the meeting and stakeholders.

project: Location, scale and implementation time, expected impact of the project; overview of

the current progress of the project and next implementation steps.

Mr. Nguyen Trung Tuan - Representative of the unit implementing compensation,

assistance, and resettlement introduced the activities, implementation process, and plan of

inventory, acquisition, compensation, and assistance expected to be implemented.

Mr. Le Xuan My – Team leader of LIC Consultant introduced the information and Policy

• Opinion #1: Mrs. Giang Mi My – Sung Nhi A village

The road near my house in Sung Nhi A village, the ditch is small, can not drain and flooded

when heavy rain. The muddy situation is already for a long time, it is very difficult to travel.

Request the construction unit to consider when conducting construction.

- Answers of the units:

The representative of PMU replied: This issue has been noted in the detailed design process

with the arrangement of sewers, construction of trenches and drainage ditches of the road.

The new road after construction will ensure to avoid flooding, muddy, convenient for people's

travel.

• Comment #2:

Mr. Phan May Nam - Sung Nhi A: It is advisable to notify the construction time in advance so

that people know how to arrange and move.

- Answers of the units:

The representative of PMU replied: According to the project's regulations, only when there is

a clean site, the construction will begin. This means that people must be compensated and

signed to hand over the site to the contractor to start construction. The supervision consultant

will inspect and review the conditions of construction and notify the people before starting the

construction.

• Comment #3:

Mr. Phan May Hong - Sung Nhi B village: How is the compensation unit price for trees and

crops determined? Can we give our opinion on the unit price?

- Answers of units:

Representative of the District Compensation, Assistance and Resettlement Board of Meo Vac

district replied: The compensation unit price for trees and crops is regulated by the Provincial

People's Committee. The price of crops that are not in the list of fixed assets of the Provincial

People's Committee will be taken from the market price at the time of inventory, site clearance

and this unit price will be consulted for affected households.

• Comment #4:

Mr. Phung Xuan Choi - Sung Nhi B village: The project needs to be implemented quickly so

that people can live comfortably. Having a reasonable and satisfactory compensation policy

for people when recovering land, property, and site clearance.

III. CONCLUSION

In the meeting, the parties have agreed on the following contents:

- The policy of the project has been disseminated to the households along the route;

- Project information and design drawings have been made public;

According to the Project Agreement of the Loan L3633-VIE dated 12/4/2018 between the

ADB and Ha Giang PPC;

According to request on "replacement cost study" in the REMDP for the Construction

Upgrade, rehabilitate the road from Pac Nam district center, Bac Kan province to Son Lo, Bao

Lac district, Cao Bang province that are approved by the donor (ADB).

According to the implementation progress of support, compensation, site clearance,

resettlement of the Project. We carried out survey, consultations and agreed on replacement

cost for affected assets by the Construction as follows:

1. Dao Duc CPC confirmed that the Vi Xuyen CARB has carried out replacement cost survey

of for affected assets by the Construction.

2. Discussion content on replacement cost as follows:

• On compensation unit cost for affected land:

According to survey results of replacement cost determination (specific price) was carried out

at the time following the procedure, regulation of Ha Giang (the PPC promulgated the

replacement cost for each land type, to implement this project at the time of compensation

planning).

• On compensation unit cost for affected assets, constructions, infrastructures:

Through practical survey on unit cost for affected assets, constructions, infrastructures when

carry out land recovery in the market on Dao Duc commune, there is no big difference

compared to the unit cost in the Decision No. 16/2019/QD-UBND dated 26/6/2019 of the

People's Committee of Ha Giang province on promulgating the level of compensation for

damage to houses, other construction structures on land and relocation of graves when the

state recovers land in Ha Giang province. Hence, all Ahs agreed on using the price in the

Decision No. 16/2019/QD-UBND dated 26/6/2019 of the People's Committee of Ha Giang

province

• On compensation unit cost for affected plants, animals:

Through practical survey on unit cost for affected plants, animals when carry out land recovery

in the market on Dao Duc commune, there is no big difference compared to the unit cost in the

Decision No. 1354/QD-UBND dated 10/7/2019 of the People's Committee of Ha Giang

province, promulgating the unit price of compensation plant and animal when the State

acquires land in Ha Giang province. Hence all Ahs agreed on using the price in the decision

No. 1354/QD-UBND dated 10/7/2019 of the People's Committee of Ha Giang province

agricultural land/household area); (ii) AHs belong to vulnerable group), due to affected

production system or they have no alternative income source

There are 36 households eligible to participate in the IRP including 8 severely AHs (loss more

than 10% productive land), all households are in the vulnerable group.

The level of impact on vulnerable households is insignificant compared to their income

because AHs are affected by small structures such as roof, fence, and some short-term trees.

For 6 severely affected households, they are all households with main income from business,

trading; the acquired land area was only planted with a few short-term trees due to weathered

land with low cultivation yield, so that the impact on their income is not large.

At present, all AHs do not need to participate in IRP.

However, in order to ensure the full benefits of the households, the PMU and local authorities

confirmed that these households will be given priority to participate in local vocational training

and capacity building training programs if they need.

Some vocational training programs expected to be implemented in the area include repairing

agricultural machines, growing high-yield rice, plant safe vegetables; techniques of planting,

tending, harvesting and processing tea; techniques of afforestation, breeding and disease

prevention and treatment for buffaloes and cows; Medicinal plant classes; grow vegetables in

a greenhouse
