Different mechanisms of government protection of national audio visual and film production in Slovenia

Slovenia enhances and protects the national visual and film production by:

•co-financing domestic production via Slovenian Film Center,

•co-financing domestic production via Radio-television Slovenia,

•regulating domestic quotes on public and commercial Television.

The Institution controling domestic quotes of AV-market as a whole is AKOS,

Agency for communication networks and services of the Republic of Slovenia which

controls fulfilling of the quotas and advertising on the public and commercial

television.

RTV Slovenia DCQs (domestic content quotas) for television are:

•25% of Slovenian AV-production,

•¼ of all Slovenian AV-production needs to be Slovenian Independent production

Daily:

•20% of the daily aired program needs to be domestic Slovenian production

•at least 50% of daily aired program needs to be European ,

•at least 10% of above mentioned program needs to be European independent

production, of which at least half needs to be new production

In prime time 18:00 – 22:00:

•60 minutes need to be domestic production

•if there’s a repetition, only first repetition counts

Analysis of effectiveness of the mechanisms of state support and suggestions for Ukraine

Slovenian system is good when it comes to the DCQs, but it shouldn’t be so strict,

as sometimes it’s extremely difficult to fulfill it. The system needs to be:

•simple and well defined when it comes to genres and quality of programs,

•Financially better defined than Slovenian one,

•The system has to enhance international co-productions.

Regarding only television, the state has to give good fundaments for the public

television as the commercial networks are very strong and they become

politically powerful very quickly.

Regarding Film Centre, the financial and governance points are really important.

The political control needs to be substituted by the control of the civil society.

For both, all the tenders, results of the tender and final financial reports need to

be announced publicly and need to be from time to time revised by an

international institution or body .

Keeping up with the copyright legislation on TV

Slovenian copyright system is as complicated as possible. Respect of the

copyright legislation brings enormous problems when it comes to TV-

production, especially when it comes to use of music of non-Slovenian

production and use of video or photo material of non-Slovenian origin. The

reason is being small and low profit expectation.

Protection of children broadcasting in Slovenia

Airing of potentially harmfull content is admissible if it is labeled and

appropriate to the selected time, so that children and minors under normal

conditions do not have access to them:

-contents that are not suitable for children and adolescents up to 12

years, may begin to play after 21 hours,

-the contents of which are not suitable for children and adolescents up to

the age of 15, after 22 hours,

-and content that is not suitable for children and adolescents up to 18

years, after 24 hours - but this kind of content can be played no later than

5 am.

•broadcasters are obliged to label potentially harmful content published by

appropriate acoustic and visual warning during playback should be such

content all the time labeled with an appropriate visual symbol (the minister

responsible for the media, the implementing regulations determine the

acoustic and visual warning, a visual symbol and way of publishing). /visual

The protection of children and minors with an acoustic warnings for

broadcasts that are not suitable for children and adolescents in audiovisual

media services on demand is also necessary.

To make a special effort for children protection TV Slovenia has produced

jingles to mark Children programming – children can see it before and after

Slovenia has high protection of domestic production as its
