APPLICATION AND EXPLANATION OF

A. APPLICATION

1. These rules and regulations apply toservices and facilities furnished byCompany, hereinafter referred to as the Telephone Companyor Company. Failure on the part of the subscribers toobserve these regulations and rules of the TelephoneCompany, after due notice of such failure, automaticallygives the Telephone Company the privilege to discontinuethe furnishing of service.

2. In the event of a conflict between any rate, rule,regulation, or provision contained in these General Rulesand Regulations and any rate, rule, or regulation, orprovision contained in the Local Exchange Service Tariffs,the General Exchange Service Tariffs, or the Message TollTelephone Service Tariffs, the rates, rules, regulations,or provision contained in the specific tariffs shallprevail.

3. Should any tariffs of this Company conflict with rules orregulations applying to all telephone utilities which areapproved by the Michigan Public Service Commission or theFederal Communications Commission, the rules andregulations established by the Commission will takeprecedence.

OBLIGATION AND LIABILITY OF TELEPHONE COMPANY

D. USE OF CONNECTING COMPANY LINES

1. When suitable arrangements can be made, lines of othertelephone companies may be used in establishing wireconnections to points outside this Company’s service areas.In establishing connections with the lines of othercompanies, the Telephone Company is not responsible orliable for any action of the connecting company.

E. DEFACEMENT OF PREMISES

1. The Telephone Company shall exercise due care in connectionwith all work done on customer’s premises. No liabilityshall attach to the Telephone Company by reason of anydefacement or damage to the customer’s premises resultingfrom the existence of the Telephone Company’s facilities onsuch premises, or by the installation or removal thereof,unless such defacement or damage is the result of the solenegligence of the Telephone Company.

F. BILLING ERROR ADJUSTMENTS

Adjustment of charges will be made when billing errorsare brought to the attention of the Company. Theadjustment (additional billing or refund) will bedetermined from records without regard to time period,except as provided in the Statute of Limitations.Refunds due the customer will be paid with interest onany amounts for service supplied over one (1) year fromthe date the billing inquiry was initiated, at theinterest rate specified for credit deposits.

No customer will be liable for net underbilled serviceafter one (1) year, except when the service wasobtained by the customer by fraud or deception.Correction of billing errors will be made for theperiod over one (1) year from the date the billinginquiry was initiated to determine a net refund due thecustomer. This refund will be paid together withinterest at the rates established for credit deposits.

USE OF SERVICE AND FACILITIES

A. OWNERSHIP AND USE OF EQUIPMENT AND RESALE OF SERVICE

1. Lines and facilities furnished by the Telephone Company onthe premises of a customer are the property of theTelephone Company, whose agents and employees shall havethe right to enter said premises at any reasonable hour forthe purpose of installing, inspecting, maintaining orrepairing the lines and facilities.

B. INSTALLATION IN HAZARDOUS LOCATIONS

1. If the installation and maintenance of service arerequested at locations which are or may be hazardous ordangerous to the Telephone Company’s employees or to thepublic or to property, the Telephone Company may refuse toinstall and maintain such service and, if such service isfurnished, may require the customer to install and maintainsuch service, and may also require the customer toindemnify and hold the Telephone Company harmless from anyclaims, loss or damage by reason of the installation andmaintenance of such service.

c. USE OF CUSTOMER SERVICE

1. Customer telephone service as distinguished from public,semi-public, and customer-owned coin-operated telephoneservice is furnished only for use by the customer, familymembers, employees, or business associates, or otherpersons residing in the customer’s household, except as theuse of business service may be extended to joint users.The Telephone Company has the right to refuse to installcustomer service or to permit such service to remain onpremises of a public, semi-public, or customer-owned coin-operated (COCOTS) character, when the service is so locatedthat the public in general or patrons of the customer maymake use of the service.

The Telephone Company may refuse to furnish or may denytelephone service to any person, firm, or corporation onwhose premises is located any facilities owned by theTelephone Company which shows any evidence whatsoever oftampering, manipulation, or operation, or use of any devicefor the purpose of obtaining telephone service withoutpayment of the charges applicable to the serviced rendered.

OF PROFANE LANGUAGE, IMPERSONATION, ANNOYANCE

The Telephone Company may refuse to furnish or may denytelephone service to any persons, firm, or corporation,who , over the facilities furnished by the TelephoneCompany, use or permit to be used, foul, abusive, obscene, .or profane language; or impersonate or permit others toimpersonate any other individual with fraudulent ormalicious intent to repeatedly annoy or offend anotherindividual.

F. GOVERNMENTAL OBJECTIONS TO SERVICE

1. Whenever the judge of any court of record havingjurisdiction over criminal offenses, the Attorney Generalof Michigan, or the United States Attorney, in and for anyfederal judicial district in Michigan, or the prosecutingAttorney, shall represent in writing to the TelephoneCompany that he has probable cause to believe that theservice furnished at a designated location is being used infurtherance of the commission of specified criminaloffense, and in such writing shall request that suchservice be discontinued, it shall be, and with like effectas to both the Telephone Company and the customer as thoughthe latter had of his own volition directed that the samebe done.

G. INJURIOUS USE OF SERVICE

1. If the service of another customer or the manner of use ofa service or facility affects injuriously the efficiency ofthe aeneral telephone system or circuit, the TelephoneComp~ny may deny-ser ending customer untilarrangements can be ma ontinue the injurious useof the facility.

USE OF SERVICE AND FACILITIES

INJURIOUS USE OF SERVICE

If the service of another customer or the manner of use of aservice or facility affects injuriously the efficiency of thegeneral telephone system or circuit, the Telephone Company maydeny service to the offending customer until arrangements canbe made to discontinue the injurious use of the facility.

CALLING PARTY REQUIREMENT

1. The calling party on any local* or long distance* telephonecall is required to establish the calling party’s identityto the satisfaction of the called party.

2. The called party has the right to have any call terminatedat any point in the conversation by hanging up the calledtelephone. The calling party is required to disconnect anycall immediately when the called party indicates the callshould be discontinued whether verbally or by hanging upthe receiver to disconnect the call.

ESTABLISHING AND FURNISHING OF SERVICE

APPLICATION FOR SERVICE

1. Armlications for service become contracts upon thea..

establishment of service. Applicants for service may berequired to pay in advance at the time application is made,all charges accruing for the first billing period forexchange service and equipment, the service charges~ non-recurring charges, and installation charges applicable.Such contracts are subject to these General Rules andRegulations, the General Exchange Service Tariffs, and theLocal Exchange Service Tariffs for the particular exchangefrom which service is to be furnished. Any change inrates, rules, and regulations shall act as a modificationof the contract.

TELEPHONE NUMBERS

1. The customer has no property right in the telephone numberand the Telephone Company may change the telephone numberwhenever exigencies of the business so require.

ALTERATIONS

1. The customer agrees to notify the Company promptly inwriting whenever alterations or new construction onpremises owned or leased by him will necessitate changes inthe Company’s facilities; and the customer agrees to paythe Company’s current charges for such changes.

PAYMENT FOR SERVICE

1. Charges for exchange service and facilities, and for tollmessages (including charges for messenger service) , are duewhen billed. The customer is responsible for all chargesfor telephone service rendered at his telephone or chargedto his Toll Credit Card, both exchange and toll, includingcharges for toll messages on which the charges have beenreversed. Failure to receive a bill does not relieve thecustomer of his liability.

A. DISTRIBUTION

1. The Telephone Company will furnish to its customers,without charge, a directory containing alphabeticallistings of customers in the local calling area asnecessary for the efficient use of the service. Otherdirectories will be furnished at a charge.

GENERAL RULES AND REGULATIONS

ESTABLISHMENT AND MAINTENANCE OF CREDIT

DISCONTINUANCE OF SERVICE FOR FAILURE TO ESTABLISH CREDIT

1. Service may be discontinued for failure to establishcredit, as authorized above, within five (5) days after theCompany has served or mailed notice requiring the customerto do SO.

RESTORAL OF SERVICE

1. Restoral of service charges apply where service has beentemporarily denied for non-payment - but not terminated -or where, on account of nonpayment of charges, theTelephone Company’s representative visits the premises ofthe customer to disconnect and remove the service.

2. Restoral of service charge does not apply where service hasbeen terminated. In that event, service is reestablishedon the basis of a new application for service and thecharges associated therewith apply. (See Service Charges)

ADVANCE PAYMENTS

1. Applicants may be required to pay one (1) months’s exchangeservice, plus service connection charges and applicableinstallation charges and taxes before service is furnishedby the Company.

APPLICATION OF BUSINESS AND RESIDENCE RATES

A. BUSINESS RATES APPLY AT THE FOLLOWING LOCATIONS:

1. In offices, stores, factories, mines, and all other Placesof a strictly business nature.

2. In boarding houses, college fraternities or sororityhouses, except as noted under B.2. ; offices of hotels?halls, and offices of apartment buildings, quartersoccupied by clubs or lodges, schools or colleges~hospitals, libraries, churches, and other similarinstitutions.

3. At residence locations when the customer has no regularbusiness telephone and the use of the service either byhimself, members of his household, or his guests, orparties calling him, can be considered of a businessnature, which fact might be indicated by advertisingmatter, such as on vehicles, etc. , or when such businessuse is not such as commonly arises and passes over to aresidence telephone during the intervals when, incompliance with the law or established customer, businessplaces are ordinarily closed.

4. At residence locations when an additional access line islocated in a shop, office, or other place of business.

5. In any location where the listing of service at thatlocation indicates a business, trade, or profession.

B. RESIDENCE RATES APPLY AT THE FOLLOWING LOCATIONS:

1. In a private residence where business listings are notprovided.

2. In private apartments of hotels, rooming houses, orboarding houses, where service is confined to thecustomer’s use, and elsewhere in rooming and boardinghouses which are not advertised as a place of business orwhich have less than 5 rooms for boarders or which furnishmeals to less than 5 boarders, provided business listingsare not furnished.

INITIAL CONTRACT PERIODS AND TERMINATION OF SERVICE

A. INITIAL CONTRACT PERIODS

1. Except as provided elsewhere in the Tariffs of the Companyfor tariffed service offerings, the initial (or minimum)contract period for all service and facilities is one (1)month at the same location.

2. The Telephone Company may require a contract period longerthan one (1) month at the same location in connection withspecial facilities, or for unusual construction necessaryto meet special demands, and involving extra costs.

B. TERMINATION OF SERVICE

1. Service may be terminated prior to the expiration of theinitial contract period upon notice being given to theTelephone Company, and upon payment of the terminationcharges given below, in addition to all charges due forservice which has been furnished.

In the case of service for which the initial contractperiod is one (1) month, the charges due shall be forone (1) month.

In the case of services for which the initial contractperiod is longer than one (1) month, the terminationcharge will be as set forth in the tariff for thatspecific service offering or as specified in thecontract with the customer.

1. Under the following conditions, the Telephone ComPanY~without incurring liability, may discontinue service orterminate a contract five (5) days after furnishing anotice by depositing in the mail, a letter addressed to thecustomer or his agent.

In the event the customer neglects or refuses to complywith the rules and regulations of the TelephoneCompany, including those pertaining to payment forservice and the said violation is not otherwiseprovided for.

Upon the use of a service or facility for the purposeof reselling the service or performing a service incompetition with any service offered by the TelephoneCompany.

When the manner of use of the service by a customerdiffers from that contemplated for the class or gradeof service contracted for, and upon notice, thecustomer fails or refuses to contract for a properclass or grade of service.

Under the following conditions, discontinuance of servicemay be made by the Telephone Company without previousnotice to the customer and without incurring any liability.

In the event of the use of profane or indecent languageover the facilities.

In the case of abandonment of the facilities or thepremises upon which they are installed.

If a service or facility is used in a manner whichsubstantially impairs the service of a particularcustomer.

Upon written request by a law enforcement officialhaving jurisdiction as provided elsewhere in thisTariff.

A. Payment Period

GENERAL RULES AND REGULATIONS

PAYMENT FOR SERVICE AND FACILITIES

Unless otherwise provided, the customer shall, when billed, pay monthly in advancefor local exchange services and facilities. The customer shall pay when billed forother services and facilities, including service charges, non-recurring charges,installation charges, additional message charges and toll charges.

Charges and credits for a fractional part of a month shall be completed on the basisof a 30-day month; the period of service to commence with the day following theestablishment of service and to end at the close of the day the service isterminated.

B. Customer's Responsibility

The customer is responsible for all charges originated at equipment contracted forby him and for messages received on which the charges have been reversed withthe consent of the person answering the telephone and for other calls charged tohis number with his consent.

When a customer contracts for telephone service at two or more locations, eachlocation is a separate contract. In the case of non-payment of charges, servicemay not be discontinued on such contracts as are paid up and in good standing.Contracts for directory advertising or other services not directly associated with thegeneral telephone service offered by the utility are not enforceable bydiscontinuance or termination of telephone service.

C. Late Payment Charges (N)

A Late Payment charge of 1.5% per month applies to all past due balances.

Customers with past due balances that sign up for electronic payments will receivea one-time waiver of the late payment charge.

3. Final collection procedures, temporary disconnection of service, and therequirements for deposit are unaffected by the application of a late charge. Thelate payment charge does not extend the time for payment or otherwise enlarge orchange the rights of the customer. Notice of intention to pay late will not avoid thischarge.
