Section 5 Postponement of election. - When for any

ARTICLE XV

WATCHERS

Section 178. Ocial watchers of candidates. - !veryregistered political party, coalition of political parties

and every independent candidate shall each be entitled

to one watcher in every polling place.

area, a representative authori'ed to appoint watchers,

furnishing the provincial election supervisor or the city

election registrar, as the case may be, the names of 

such representatives. )he provincial election

supervisors shall furnish the municipal election

registrars and election registrars of component cities

with the list of such representatives.

In the case of (etropolitan (anila, the designation of 

the persons authori'ed to appoint watchers shall be

led with the Commission, which shall furnish the list of 

such representatives to the respective city and

municipal election registrars.

Section 179. Rights and duties of watchers. - *pon

entering the polling place, the watchers shall presentand deliver to the chairman of the board of election

inspectors his appointment, and forthwith, his name

shall be recorded in the minutes with a notation under

his signature that he is not disqualied under the

second paragraph of %ection +-. )he appointments of 

the watchers shall bear the personal signature or the

facsimile signature of the candidate or the duly

authori'ed representatives of the political party or

coalition of political parties who appointed him or of 

organi'ations authori'ed by the Commission under

%ection +-. )he watchers shall have the right to stay in

the space reserved for them inside the polling place.

 )hey shall have the right to witness and inform

themselves of the proceedings of the board of election

inspectors, including its proceedings during the

registration of voters, to ta#e notes of what they may

see or hear, to ta#e photographs of the proceedings and

incidents, if any, during the counting of votes, as well as

of election returns, tally boards and ballot boes, to le

a protest against any irregularity or violation of law

which they believe may have been committed by the

board of election inspectors or by any of its members or

by any persons, to obtain from the board of election

inspectors a certicate as to the ling of such protestand/or of the resolution thereon, to read the ballots after

they shall have been read by the chairman, as well as

the election returns after they shall have been

completed and signed by the members of the board of 

election inspectors without touching them, but they

shall not spea# to any member of the board of election

inspectors, or to any voter, or among themselves, in

such a manner as would distract the proceedings, and

to be furnished with a certicate of the number of votes

in words and gures cast for each candidate, duly

signed and thumbmar#ed by the chairman and all the

members of the board of election inspectors. 0efusal of 

the chairman and the members of the board of election

inspectors to sign and furnish such certicate shall

constitute an election oense and shall be penali'ed

under this Code.

Section 180. Other watchers. - )he duly accredited

citi'ens arm of the Commission shall be entitled to

appoint a watcher in every polling place. 1ther civic,

religious, professional, business, service, youth and any

other similar organi'ations, with prior authority of the

Commission, shall be entitled collectively to appoint one

watcher in every polling place.

Section 4. Postponement, Failure of Election and

Special Elections. 2 )he postponement, declaration of 

failure of election and the calling of special elections as

provided in %ections 3, 4 and of the 1mnibus !lectionCode shall be decided by the Commission sitting en

banc by a majority vote of its members. )he causes for

the declaration of a failure of election may occur before

or after the casting of votes or on the day of the

election.

In case a permanent vacancy shall occur in the %enate

or 5ouse of 0epresentatives at least one 6+7 year before

the epiration of the term, the Commission shall calland hold a special election to ll the vacancy not earlier

than sity 647 days nor longer than ninety 687 days

after the occurrence of the vacancy. 5owever, in case of 

such vacancy in the %enate, the special election shall be

held simultaneously with the succeeding regular

election.

SEC. 22. Electronic Returns. 2 !ach copy of the of the

printed election returns shall bear appropriate control

mar#s to determine the time and place of printing. !ach

copy shall be signed and thumbmar#ed by all the

members of the board of election inspectors and the

watchers present. If any member of the board of 

election inspectors present refuses to sign, the

chairman of the board shall note the same copy in eachcopy of the printed election returns. )he member of the

board of election inspectors concerned refusing to sign

shall be compelled to eplain his or her refusal to do so.

9ailure to eplain an unjustiable refusal to sign each

copy of the printed election return by any member of 

the board of election inspectors shall be punishable as

provided in this :ct. )he chairman of the boards shall

then publicly read and announce the total numbers of registered voters, the total number of voters who

actually voted and the total numbers of votes obtained

by each candidate based on the election returns.

 )hereafter, the copies of the election returns shall be

sealed and placed in the proper envelopes for

distribution as follows;A. In the election of president, vice2president, senators

and party2list system<+7 )he rst copy shall be delivered to the city or

municipal board of canvassers<=7 )he second copy, to the congress, directed to the

$resident of the %enate<>7 )he third copy, to the commission<?7 )he fourth copy, to the citi'en@s arm authori'ed by

the Commission to conduct an uno&cial count37 )he fth copy, to the dominant majority party as

determined by the Commission in accordance with law<47 )he si copy, to the dominant minority party as

determined by the Commission in accordance with law<

and7 )he seventh copy shall be deposited inside the

compartment of the ballot bo for valid ballots.-7 )he eight copy to the $rovincial Aoard of canvassers<87 )he ninth to the eighteenth copies, shall be given to

the ten 6+7 accredited major national parties, ecluding

the dominant majority and minority parties, inaccordance with a voluntary agreement among them. If

no such agreement is reached, the Commission shall

decide which parties shall receive the copies on the

basis of the criteria provided in %ection =4 of 0epublic

accredited major local parties in accordance with a

voluntary agreement among them. If no suchagreement is reached, the commission shall decide

which parties shall receive the copies on the basis of 

criteria analogous to that provided in %ection =4 of 

0epublic :ct "o. +44<++7 )he twenty2rst to the twenty2fourth copies, to

national broadcast or print media entities as may be

equitably determined by the Commission in view of 

propagating the copies to the widest etent possible<

+=7 )he twenty2fth and twenty2si copies, to localbroadcast or print media entities as may be equitably

determined by the Commission in view of propagating

the copies to the widest etent possible< and+>7 )he twenty2seventh to the thirtieth copies, to the

major citi'en@s arms, including the accredited citi'en@s

arm, and other non2partisan groups or organi'ation

enlisted by the Commission pursuant to %ection 3=6#7 of 

Aatas $ambansa Alg. --+. %uch citi'ens@ arm, groups

and organi'ation may use the four certied copies of 

election returns for the conduct of citi'ens@ quic# counts

at the local or national levels<

B. In the election of local o&cials and members of the

5ouse of 0epresentatives;+7 )he 9irst copy shall be delivered to the city or

municipal board of canvassers<=7 )he second copy, to the Commission<

at the local or national levels.

Immediately after the eight copy is printed, the poll

cler# shall announce the posting of said copy on a wall

within the premises of the polling place or counting

center, which must be su&ciently lighted and accessible

to the public. :ny person may view or capture an imageof the election return by means of any data capturing

device such as, but not limited to cameras at any time

of the day for forty2eight 6?-7 hours following its

posting. :fter such period, the chairman of the board of 

election inspectors shall detach the election return from

the wall and #eep the same in his custody to be

produced as may be requested by any voter for image

or data capturing or for any lawful purpose as may be

ordered by competent authority.

Within one hour after the printing of the election

returns, the chairman of the board of election inspectors

or any o&cial authori'ed by the Commission shall, in

the presence of watchers and representatives of the

accredited citi'ens@ arm, political parties/candidates, if 

any, electronically transmit the precinct results to the

respective levels of board of canvassers, to thedominant majority and minority party, to the accredited

citi'en@s arm, and to the Kapisanan ng mga Brodcaster 

ng Pilipinas 6BA$7.

 )he election results at the city/municipality canvassing

centers shall be transmitted in the same manner by the

election o&cer or any o&cial authori'ed by the

commission to the district or provincial canvassingcenters.

 )he election returns transmitted electronically and

digitally signed shall be considered as o&cial election

results and shall be used as the basis for the canvassing

of votes and the proclamation of a candidate.

:fter the electronic results have been transmitted

additional copies not to eceed thirty 6>7 may beprinted and given to requesting parties at their own

epense.

SEC. 25. an!assing "# Pro!incial, it#, $istrict and

%unicipal Boards of an!assers. 2 )he City or (unicipal

board of canvassers shall canvass the votes for the

president, vice2president, senators, and parties,

organi'ation or coalitions participating under the party2

list system by consolidating the electronicallytransmitted results contained in the data storage

devices used in the printing of the election returns.

*pon completion of the canvass, it shall print the

certicate of canvass of votes for president, vice2

president, senators and members of the 5ouse of 

0epresentatives and elective provincial o&cials and

thereafter, proclaim the elected city or municipal

o&cials, as the case may be.

 )he city board of canvassers of cities comprising one or

more legislative districts shall canvass the votes for

president, vice2president, senators, members of the

5ouse 0epresentatives and elective city o&cials by

consolidating the certicates of canvass electronically

transmitted or the results contained in the data storage

devices used in the printing of the election returns.*pon completion of the canvass, the board shall

procedure the canvass of votes for president, vice2

president, and senators thereafter, proclaim the elected

members of the 5ouse of 0epresentatives and city

o&cials.

In the (etro (anila area, each municipality comprising a

legislative district shall have a district board of 

canvassers which shall canvass the votes for president,

vice2president, senators, members of the 5ouse of 

0epresentatives and elective municipal o&cials by

consolidating the electronically transmitted results or

the results contained in the data storage devices used

in the printing of the election returns. *pon completion

of the canvass, it shall produce the certicate of 

canvass of votes for president, vice2president, and

senators and thereafter, proclaim the elected membersof the 5ouse 0epresentatives and municipal o&cials.

!ach component municipality in a legislative district in

the (etro (anila area shall have a municipal board of 

canvassers which shall canvass the votes for president,

vice2president, senators, members of the house of 

0epresentatives and elective municipal o&cials by

consolidating the results electronically transmitted from

the counting centers or the results contained in the data

storage devices used in the printing of the election

returns. *pon completion of the canvass, it shall prepare

the certicate of canvass of votes for president, vice2

president, senators, members of the 5ouse of 

0epresentatives and thereafter, proclaim the elected

municipal o&cials.

 )he district board of canvassers of each legislative

district comprising two municipalities in the (etro

(anila area shall canvass the votes for president, vice2

president, senators and members of the 5ouse of 

0epresentatives by consolidating the certicates of 

canvass electronically transmitted from the

city/municipal consolidating centers or the results

contained in the data storage devices submitted by the

municipal board of canvassers of the component

municipalities. *pon completion of the canvass. It shall

produce a certicate of the canvass votes for president,

vice2president, senators and thereafter, proclaim the

elected members of the 5ouse of 0epresentatives in the

legislative district.

 )he district/provincial board of canvassers shall canvass

the votes for president, vice2president, senators,

members of the 5ouse of 0epresentatives and elective

provincial o&cials by consolidating the results

electronically transmitted from the city/municipal

consolidating centers or the results contained in the

data storage devices submitted by the board of 

canvassers of the municipalities and component cities.

*pon completion of the canvass, it shall produce the

certicates of canvass votes for president, vice2

president and senators and thereafter, proclaim the

elected members of the 5ouse of 0epresentatives and

the provincial o&cial.

 )he municipal, city, district and provincial certicates of 

canvass of votes shall each be supported by a

statement of votes.

Within one hour after the canvassing, the Chairman of 

the district or provincial Aoard of Canvassers or the city

board of canvassers of those cities which comprise one

or more legislative districts shall electronically transmit

the certicate of canvass to the commission sitting as

the national board of canvassers for senators and party2

list representatives and to the Congress as the "ational

Aoard of Canvassers for the president and vice

president, directed to the $resident of the %enate.

 )he Commission shall adopt adequate and eective

measures to preserve the integrity of the certicates of 

canvass transmitted electronically and the results in the

storage devices at the various levels of the boards of 

canvassers.

 )he certicates of canvass transmitted electronically

and digitally signed shall be considered as o&cialelection results and shall be used as the basis for the

proclamation of a winning candidate.

SEC. 26. &um"er of opies of erti'cates of an!ass of 

(otes and their distri"ution. 2 6a7 )he certicate of 

canvass of votes for president, vice2president, senators,

members of the 5ouse of 0epresentatives, parties,

organi'ation or coalitions participating under the party2

list system and elective provincial o&cials shall be

produced by the city or municipal board of canvassers

and distributed as follows;6+7 )he rst copy shall be delivered to the provincial

board of canvassers for use in the canvass of election

results for president, vice2president, senators, members

of the 5ouse of 0epresentatives, parties, organi'ation or

coalitions participating under the party2list system andelective provincial o&cials<6=7 )he second copy shall be sent to the Commission<6>7 )he third copy shall be #ept by the chairman of the

board< and6?7 )he fourth copy shall be given to the citi'en arm

designated by the Commission to conduct an uno&cial

count. It shall be the duty of the citi'ens@ arm to furnish

independent candidates@ copies of the certicate of 

canvass at the epense of the requesting party.637 )he fth copy to Congress, directed to the $resident

of %enate<647 )he sith copy to be posted on a wall within the

premises of the canvassing center<67 )he seventh and eighth copies shall be given to the

dominant majority and minority parties<6-7 )he ninth to eighteenth copies shall be given to the

urbani'ed areas and distributed as follows;6+7 )he rst copy shall be sent to congress , directed to

the president of the %enate for use in the canvass of 

election results for president and vice2president<

6=7 )he second copy shall be sent to the Commission for

use in the canvass of the election results for senators<6>7 )he third copy shall be #ept the chairman of the

board< and6?7 )he fourth copy shall be given to the citi'ens@ arm

designated by the Commission to conduct an uno&cial

count. It shall be the duty of the citi'ens@ arm to furnishindependent candidates copies of the certicate of

entities as may be equitably determined by the

Commission in view of propagating the copies to the

widest etent possible< and

6+7 )he fourteenth copy to another citi'ens@ arm or inthe absence thereof, to a non2partisan group or

organi'ation enlisted by the Commission pursuant to

%ection 3=6#7 of Aatas $ambansa Alg. --+. %uch

citi'ens@ arm or non2partisan group or organi'ation may

use the copy of election return for the conduct of 

citi'ens@ quic# counts at the local or national levels. )he board of canvassers shall furnish all other

registered parties copies of the certicate of canvass at

the epense of the requesting party.

6c7 )he certicates of canvass printed by the provincial,

district, city or municipal boards of canvassers shall be

signed and thumb mar#ed by the chairman and

members of the board and the principal watchers, if 

available. )hereafter, it shall be sealed and placed

inside an envelope which shall li#ewise be properlysealed.

In all instances, where the board of Canvassers has the

duty to furnish registered political parties with copies of 

the certicate of canvass, the pertinent election returns

shall be attached thereto, where appropriate.

Immediately after the si copy and its supporting

statement of votes are printed, the chairman of theboard of canvassers shall announce the posting of said

*ecordin2- 2 )he 0eceiving 1&cer shall have the

ministerial duty to receive and ac#nowledge the receipt

of the C1C and C1":< $rovided that, they are led in

conformity with the rules and regulations. )he 0eceiving

1&cer shall stamp every copy of each Certicate with

the date and actual time of receipt and a& a signature

thereon.

 )he 0eceiving 1&cer shall enter in a record boo#, the

following data, leaving no space between entries;

a. date and actual time of receipt<

b. assigned consecutive number thereof<

c. full name of the candidate<

d. the o&ce for which the candidate is see#ing

election<

e. the nominating political party or coalition of 

political parties or the party to which the candidate

belongs, if any<

f. the number of copies received<

g. the name of the authori'ed representative, if the

certicate is not led personally by the candidate< and

h. the name of the 0eceiving 1&cer.

 )he 0eceiving 1&cer shall immediately close the record

boo# by placing a line immediately after the last entry

and writing the word closed after the time allowed forthe ling of the C1C. )he 0eceiving 1&cer shall then

a& a signature immediately below the word closed and

indicate the date and eact time of closing.

Section &1- atchers of Independent !andidatesD

:n independent candidate, $$, or accredited citi'enGs

arm may appoint one watcher each in connection with

the ling of the C1Cs. )he watcher, who shall presentan appointment paper to the 0eceiving 1&cer, shall be

allowed to stay within the premises of the receiving

1&ce. :ny watcher may report to the Commission any

irregularity observed during the proceedings.

Watchers shall be entitled to secure from the 0eceiving

1&cer, a copy of the full list of those who led their

C1Cs and their respective positions for which they

intend to be elected.

If all watchers cannot be accommodated in the area for

ling of C1Cs, preference shall be given to the watcher

of the dominant majority and dominant minority parties

as determined by the Commission in the (ay +>, =+>

allege in its petition such facts that will entitle it to

accreditation.

Parties- H )he dominant majority party, the dominant

minority party, the ten major national parties and the

two major local parties shall be determined on the basis

of the following criteria.

a. )he established record of the said parties,

coalition of groups that now composed them, ta#ing into

account among other things, their showing in past

elections<

b. )he number of incumbent elective o&cials

belonging to them on the last day of the ling of the

c. )heir identiable political organi'ations and

strengths as evidenced by their organi'ed chapters<

determine their relative organi'ations and strengths.

 )he petitioner shall include in its petition, pertinent data
