Management Services Bureau

Patrol • Respond to all calls for service and

• Investigates sexual assault, relationship violence, stalking, harassment, child abuse, elder abuse, and missing persons.

Behavioral Threat Assessment Unit

• Responds to reports of students, employees, or others on campus who have engaged in behavior indicating a possible threat of harm to self or other members of the community

• Maintains cooperative partnership with CAPS and provides mutual aid to our law enforcement partners to help students who reside off-campus.

Digital Forensics & Cyber Crimes Unit

• Conducts digital forensic investigations and examinations involving computers, mobile devices, digital media, servers, networks, internet service providers, and cyber enabled crimes. This service is provided as part of mutual aid to assist other law enforcement agencies in cases involving sexual assault, homicide, etc.

Crime & Intelligence Analyst

• Applies the tactical, strategic, administrative, and intelligence analysis process to provide proactive research and analysis of data and intelligence information

• Detects crime trends, crime groups, and other criminal activity on campus and in the local area

• Provides mutual aid assistance to area law enforcement agencies with incidents involving students that may reside off-campus

Special Events

• Coordinates and assists with planning for any special event on campus that involves resources from the Michigan State University Police Department

• During certain special events, the events can be staffed department wide to include civilian staff to assist with parking, accountability, records processing, communications, and intelligence and threat assessment.

• What are the main priorities for the MSUPD?

Safety & Security for all on campus.

We work to enhance the quality of life on campus by building relationships, strengthening stewardship, and working collaboratively within our diverse community to reduce crime, enforce laws, preserve peace, and provide for a safe environment.

MSU has always made the safety of our students, faculty/staff, and visitors a priority and ensuring a safe environment and campus for all aligns specifically with our mission statement

Where are all the campus offices for the MSU Police? Why is there one [auxiliary police office] in the library?

The MSU Police Department emphasizes on the concept of Community Policing that involves a high degree of community outreach. We strive to have close interaction between officers and the Michigan State University community to develop a relationship built on mutual trust.

MSU Police officers are out in the community and utilize the community policing offices around campus.

Does the MSUPD meet regularly with community liaisons of color? I feel that they should.

• Yes. Through the MSU Police Department Community Policing initiative and the department’s Inclusion and Anti-Bias Unit, officers attend events and meetings hosted by students, faculty and staff.

• MSU Police Officers attend weekly meetings with our campus partners and stakeholders including REHS, Facilities, Neighborhood meetings, etc.

• The purpose of these meetings is to increase trust with the university community by listening to concerns and finding positive methods to solve issues through communication strategies and training.

Do the officers feel part of the university community? Do they feel connected to the students and faculty?

• Yes, many officers are alumni of MSU. The officers have been in the student’s shoes and understands the rewards and challenges of being a college student.

• Many of our officers have also obtained advanced degrees.

• Officers are proud to be part of the MSU community and find many ways to interact, connect, and contribute ideas towards common goals.

• Throughout the year we attend a variety of campus events, resource fairs and programs hosted by students, faculty and staff.

Can we please decouple policing and education?

All MSU police officers are trained and understand FERPA and students rights and generally educational efforts and criminal actions and enforcement remain separate.

There are however situations where the safety of an individual student or the safety of the MSU community is threatened and we must take enforcement action while respecting all applicable laws to bring an incident to a safe conclusion.

We are always willing to discuss specific situations with any campus partners that may have any concerns.

Mutual Aid Requests

The MSU Police Department maintains a cooperative relationship with local, county, state, and federal law enforcement agencies. On a county level, this cooperation is documented in a mutual aid assistance agreement. Examples would be K9 requests, traffic assistance for accidents, and weather related emergencies.

The MSU police department does receive mutual aid from other agencies including large special events, football games, concerts, and dignitary events.

Part of our mutual aid agreements involve the MSUPD assisting our local partners with sexual assault investigations involving MSU students.

What arrangements does MSU PD have with LPD and ELPD?

The MSUPD works closely with all of our local law enforcement partners with the goal of provided a safe and secure environment for people to live, work, travel, and learn.

What are MSU Police’s policies regarding cooperation with ICE in reference to the recent rule change on international students? What makes them eligible to stay in the US? Will/how far will MSU Police cooperate with these operations, if it comes to that?

No. The MSUPD operates with the premise that it is the responsibility of the federal government to enforce federal immigration law, not local police departments.

Did MSU PD “assist” the Lansing Police with tear gas that was used on protestors in the BLM protest a couple of month ago? If so, why? And, how does this action align with MSU police priorities and with our institutional values?

• We did have a small contingent of officers that responded to a mutual aid request form the Lansing Police Department on Sunday, May 31st. We sent one supervisor that was operating under the command and control of the Lansing Police Department since it was their event.

• The event unexpectedly turned into a riot with multiple vehicles overturned and one set on fire. Multiple businesses were looted including a bank. Projectiles including bricks were thrown at officers and some members of the crowd exhibited violent behavior.

• The event was declared an unlawful assembly and the Lansing Police Department authorized the use of chemical munitions.

It is my understanding that parking revenue goes to the police department. Why does it not go to the general fund? And now that they do not have parking income , will we (Academics) have to recover their financial loses?The parking system is a revolving account and is 100% self-supported. No funds are allocated to or from the general fund for parking. Revenue generated from parking violations is consigned to safety projects, including Green Light phones. Revenue generated from parking sales, including permits, meters, and events, is used to maintain and operate the system. Expenses include:

• $4.2M debt service on bond funding for parking ramps 1, 5, 6, and 7

• $1.5M of CATA bus service total costs ($3M/year)

• Parking lot/ramp maintenance including crack sealing, floor sealing, cleaning, trash removal, mowing, snow plowing.

• Replacement costs when pavement reaches end of life (Lot 62, ~$1M rebuild)

Will the police budget be cut to the same (or greater) amount than academic units? What are the priorities and values that will inform such cuts?

• Our department received notification on 5/15/2020 from the President’s Office that general fund units, which includes the Police Department, will sustain a reduction of at least 3% in addition to a 1% annual Reinvestment Fund.

• The priorities and values that inform such cuts are determined by the department and include not filling position vacancies which have occurred in the 3rd and 4th quarter of FY20.

• Postponed projects:• Special Event two-way radios corresponding with the new radio system ($450K)

• Replacement of a dual-purpose explosive canine.

Why has the equipment purchases and other services increased by over 200% since the 2005-06 fiscal year. In fact, in the last 15 years, there has only been a decrease in that budget item once. Please explain.

• After the events of Virginia Tech in 2007, the police department has purchased improved firearms and body armor; after the events of Ferguson, Missouri, the department has purchased and continues to maintain digital dashboard cameras and individual body cameras for each officer at a significant expense.

• MSUPD was the first agency in the state to issue and equip every officer with a body worn camera.

• The department has also been appointed to maintain the emergency mass notification system (MSU Alert) which is a subscription service through a 3rd party and required as part of the federal Clery Act.

Has the MSU Police Department received any equipment from the Defense Logistics Agency 1033 Program?

• Ballistic Blanket (Assigned to IRSRT)

• Why did MSU PD purchase the militarized equipment captured below?

• MSU did not purchase any of the listed equipment, it is a reutilization program offered by the Government. The only cost incurred by the Department were shipping costs.

• What is the justification for this?

• The justification for this was the police department getting useful equipment without incurring any cost to the University.

• Equipment can be used in scenarios that render aid to the community.

• How do these purchases align with our goals as a public institution?

• Responsible stewardship of our budget and expenditure to get necessary resources without incurring high costs during these tough economic times. The equipment obtained also contributed to officer safety and keeping our community safe.

The records I have accessed indicate the MSU Police received the following equipment (the transfers/purchases were made in 2013 and 2015)Radio-controlled car (Equipment that was designed to detect IEDs in Iraq)

• This is not equipment that was designed to detect IED’s in Iraq. This is a person portable robot equipped with an arm that can raise and lower that has a camera attached to it. This unit is attached to the Ingham Regional Special Response Team. The robot takes the place of having to send a human being into a high risk situation.

Rifle Conversion Kits (Equipment used for military war games • The military may use them for “War Games” but we use them as training tools. The kits

convert a “live” weapon into a training weapon that is incapable of firing live ammunition. The round that is fired looks like an actual round but has a plastic tip that is filled with a colored soap for marking purposes.

Ballistic Blankets (Protective Equipment) • The ballistic Blanket is used for several purposes to provide additional protection against

gunfire. It can also be used as a stretcher to help extract a person that has been wounded.

Infrared Strobe Transmitters (Equipment used to prevent friendly fire or for NVG/low visibility markings

• This is what IT strobes are used for. Identification of ground personnel during search.

I believe, with the exception of the ballistic blankets, these equipment purchases are highly suspect (total value for the equipment was $22,246.11, I believe this was the purchase price but I’m not 100% certain).

• We did not actually purchase any of this equipment. However the government does give it a dollar value. The only cost incurred by MSUPD were minimal shipping costs.

For what operational reason does MSU PD require the following items:

Armored personnel vehicle(s) • MSU has a Bearcat rescue vehicle that was not obtained from the 1033 program. The vehicle

is assigned to the Ingham Regional Special Response Team. Its primary use is to provide ballistic protection for the team in high risk situations and as a rescue/evacuation vehicle for our community in situations where active violence may be occurring. This vehicle is very similar to a Brinks armored truck used to transport money and has no offensive weapons.

Tear gas • MSU does not have any tear gas in its inventory. The only chemical agent that we have is OC

(Oleoresin Capsicum). This is the same defensive repellent (pepper spray) that officers carry on their belt as a less-lethal option. Besides the defensive repellent we have on our duty belts, the other delivery methods are reserved for Civil Disorder situations where an illegal assembly has been declared and authorization for their use has been granted. These munitions are only deployed by trained and certified officers.

22 military-grade rifle conversion kits • These are invaluable training tools for the Department. It allows our officers to train and

function effectively under the stress of the situation. This is how we do our active shooter training as well as our scenario based training to practice de-escalation.

Can MSUPD get rid of, or sell, the military equipment they have purchased?

• This equipment would have to be turned back in to the DOD, it can not be sold. This would include giving back tourniquets and CPR masks and valuable life-saving equipment.

Are there plans to access more material from the 1033 Program that provides access to military grade equipment?

• The MSUPD does not have any current plans to obtain any more equipment through the government 1033 program.

What was the annual cost for the fiscal year 2019 of maintaining the special response vehicle (armored car)?

• The cost is $500.00 per year to maintain the Bearcat rescue vehicle.

Does the MSU Police Department have a “special response”/SWAT unit?

• MSUPD does not have its own “SWAT” Unit. We do participate in the Ingham Regional Special Response Team (IRSRT) which is a collaborative effort between the Meridian Twp PD, Ingham County Sheriff, and the East Lansing Police Department. Every agency adds a unique asset to the unit.

• If so, how many members are there?

• MSUPD currently has 5 members on the unit. All 5 members had to apply and were selected in a competitive process and then attended specialized training for the assignment. MSUPD also contributes 2 negotiators to the team.

What is the current inventory of assault rifles (fully or semi-automatic), sniper rifles, and sub-machines guns in the possession of the MSU Police Department?

• MSUPD currently has 49 AR-15 patrol rifles in its inventory. These are the same rifles that are commercially available to the public. MSUPD has 2 designated marksmen rifles assigned to the Ingham Regional Special Response Team (IRSRT). MSUPD does not have any sub-machine guns in its inventory.

Are MSU Police Patrol Cars equipped with these weapons during regular duties?

• MSU Police patrol vehicles and most unmarked Investigative Division vehicles are equipped with a patrol rifle to effectively respond to an active shooter.

What is the training officers must undergo to be considered certified to use these weapons and maintain qualifications?

• All officers must attend a basic police academy where they are taught how to use the rifle. In addition, all MSU officers must shoot a qualification course annually with the rifle and participate in scheduled firearms training throughout the year.

• How does MSU PD ensure its officers are applying the law fairly? What oversight of their actions is in place?

• There is always a MSUPD supervisor on-duty that is available to answer any questions. Supervisors monitor the performance of officers to include reviewing in-car and body worn camera video and reviewing and approving officer reports and actions. Officers must abide by all policies and procedures as a condition of employment.

Moving Forward• MSUPD already has a social worker on staff and we are diligently

working with our University partners to effectively utilize our social worker in a multi-disciplinary settings, to include: Community Outreach, Inclusion and Anti-Bias Unit, and Officer Wellness

• Collaborative effort with CAPS to better address response and follow-up of issues involving the behavioral health of students.

• Creation of Community Outreach Unit to bring together many resources that we already have under one umbrella.

• More resources to the Inclusion and Anti-Bias Unit and Community Policing Program.

• Continual emphasis on de-escalation strategies and skills.

Lessons Learned

• A MSUPD Executive Command Officer will now be assigned in the Command Post anytime another agency requests mutual aid assistance for a pre-planned event to aid in the oversight of our MSUPD officers.

• MSUPD officers now provide and discuss the Know Your Rights document created by the ACLU anytime we speak with the organizers of an event. We have also shared this document with other police agencies.

Transparency

• We recently placed all of our Policies and Procedures on our web site

• Working on placing use-of-force statistics on our web page as well.

• We recently looked at and revised how we collect our traffic stop data and we have started to collect data on all officer initiated contacts.

• We are collaborating with a new student group that will have direct access to the Chief of Police for continued student transparency about their concerns.
