school years. This situation makes a totalevaluation in this area very difficult. (SeeKHSAA Recommended Action.) It does appearfrom the data provided that the standardsestablished in Tests 1 and 2 are not currentlybeing met. The school's T-3 forms alsoindicate Test 3 has not been met during thepast three school years. The two sports inwhich an interest is indicated (slow pitchsoftball and bowling) are non-sanctioned at thistime and there are few, if any, teams in theschool's competitive area which offer thesespods. The school offers a1I sanctioned spodsfor girls at the varsity ievel and 21 total teamopportunities for girls while there are 22 teamopportunities for boys. Based on these facts, itwould appear that the standard established inTest 3 is currenlly being met. KHSAA officialsreviewed the school's Title IX file. It was foundto contain the original Title IX repod from May14, 2001 , alI the annual repods to KHSAA forthe past five years, a board approved salaryschedule for coaches, sample jame schedulesfor aI1 spods, school djstrict planningdocuments relating to gender equity, writtenfacility usage schedules for al1 shared faciiities,written team practice schedules, very limitedguidelines relating to rewards and recognition,written designation of Iocker space and storagespace assigned each team, and writtenminutes for aII Gender Equity ReviewComm ittee meetings for the past three years.School officials were encouraged to continueto buiid a com prehensive and functional TitleIX file. (See Equipment and Supplies andTravel and Per Diem in the body of this report.)

Equipment and X The May 14, 2001 audit repod rendered thisSupplies area satisfactory but suggested that a uniform

review and/or replacement plan be developedand implemented. The recent school visitrevealed ihat this plan had not beendeveloped. (See KHSAA RecommendedAction.) According to the school's 2008-09annual repod and its re-visit report, it wasspending approximately $288 per femaleathlete and $349 per male athlete for theprovision of equipment and supplies. AII theuniforms reviewed during the visit appeared tobe of high quality. There was an advantage toboys basketball in a ''Iike'' sport comparison.

Scheduling of X According to the school's re-submitted re-visitGames and form, the num ber of com petitive evenlsPractice Time scheduled for ''like'' spods appears to be

comqarable, The school's shared athleticfacilitles seem to be assigned equitably. Primetime playing opportunities for girl's spods werediscussed. The school's 2008-09 girlsbasketball resuits posted on the KHSAA website indicate that 50% (6/12) of the girl's homegames were played on prime dates. A reviewof game times shows that the standardrequested for prime time is also being met. Theschool's 2009-10 girls basketball scheduleposted on the KHSAA web site indicates that50% (6/12) of their games will be played onprime dates.

Travel and Per X This area was impossible to evaluate due toDiem Allowances the school's failure to subm it accurate data

relating to travel and per diem on the 7--35 and7-36 forms and the lack of development ofwritten guidelines for the provision of travel andper diem.

Coaching X According to the May 14, 2001 audit report,male athletes had an advantage in tbis areadue to the provision of more coaches forbaseball than softball. This situation seems tohave been addressed. According to theschool's re-visit form, the num ber of coachesprovided for ''Iike'' teams is comparable and thetotal amount expended for coaches' salariesfor ''like'' spods a ears e uitable. A review of

the school district's extra service pay schedulefor coaches shows parity. According to the

Coaching school's re-visit repod, 44D/0 (4/9) of the girlshead coaches are on-campus employees while

continued 70% (7/10) of the boys coaches are employedOn Cam pus.

Locker Rooms, X According to the May 14, 2001 audit repod,Practice and there was a com parative shodage of lockerCompetitive space for girls projrams and the girl's softballFacilities dugouts were infenor to those provided at the

baseball field. Although :0th of these issueshave been addressed (upjraded dugouts andconstruction of one new glrls dressing room),there is still a rather wide dlsparity in b0thcategories. The amenities provided at thebaseball field are superior to those at thesoftbail field. (See KHSAA RecommendedAction.) This inequity in amenities includes, butis not limited to provision of a baseball:dressing room adlacent to the field and theindoor hitting facility, a field tarp for baseball,and ''boxed in'' seating for baseball fans. Thepress box and backstop at the baseball fieldare also of superior quality to those at thesoftball field. ln the area of locker room s, theboys have at least five exclusive dressingrooms-the girls have one. (See KHSAARecommended Action.) AII other practice andcom petitive facilities appeared to becomparable and most are very weli appointed.The storage areas provided for athleticequipment show parity.

X edicai and X The school provides access to an athleticTraining Facilities trainer on an equitable basis three days perand Services week through a contract with Orthopedics and

Sports Medicine of Owensborp. Tbe schoolhas a Iarge and well equipped training roomand a weight training room accessible to aIIstudent athletes. The weight room hasequipment that is suitabie for use by femaleathletes. An equitable usage schedule isposted at the facility and is a pad of theschool's Title IX file.

Publicity X According to the school's re-visit form, it hasone cheerleading squad that cheers at alIhome and away football games. This squadsplits in parts for cheering at boys and girlsbasketball games. It was impossible toascertain from the informatîon given how thecheerleaders are assigned for boys and girlsbasketbail. (See KHSAA RecommendedAction.) The school's band and dance teamperform at aIl home football and boys and girlsbasketball games. According to the re-visitreport, spending for publicity for ''Iike'' spodsappears comparable.

Support Services X This area was difficult to evaluate becausethere was no written documentation (oragreement) regarding the role of the school'sbooster club. Interviews with schooladministrators and coaches gave differentexplanations of the methods of oversight forbooster contributions related to equitableprovision of benefits, In addition, the school'sdata and calculations on the 7--35 and 7--36forms appeared to be in error. (See KHSAARecommended Action.)

6, Observed Deficiencies in Overall Girls and Boys Athletics Programs

The major deficiencies designated as a result of the recent visit are related to theschool's failure to properly submit data and calculations relating to the provision of bothopportunities and benefits. (See KHSAA Recommended Action.)

Other areas of concem that are not currently deemed deficient are in regard to theprovision of amenities at the softball field, provision of equiiable suppod by cheerieaders;proper counting of student athletes, and provision of a uniform review and/orreplacement plan which supports eguity.

KHSM Recom mended Action ln relation to new deficiencies

(TRAVEL AND PER DIEM)

On or before April 1, 2010, the school is to submit to KHSM corrected 1--35 and 1--36forms for the 2008-09 school year (forms were due by 4/15/09) showing correct travelexpenditures for aII sports.

On or before April 1, 2010, the school is to submil to KHSAA written guidelines for theequitable provision of travel and per diem allotments. These guidelines should include,but not be Iimited to, mode of transportation and provision of per diem for meals as wellas lodging.

(SUPPORT SERVICES)

On or before Anril 1 , 2010, the school is to submlt to KHSAA a written description of therole of the school's athletic beoster club, how the club is allowed to provide suppod andbenefits for student athletes, and the methods by which school administrators monilorbooster tpending for the provision of equivalence. This written description is to be signedby the principal and school Title IX coordinator.

OCTC is now under new Ieadership, with tbe appointment ofDr- Jim Klauber as thelr new President. Since Dr. Klauber has taken that leadership tole, ourdistrict has re-started discussions concernlng acquisition of thatprcperty. Just recently, OCTChas agreed to allow us to build on that property. Our Director of Mafntenance, DavidHumphrey? is planning to ask our Boatd of Education for approval to advertise for an archltectat their October meeting, scheduled for October z1. W e should be ready to open bjds for thlsproject by late November or early December. . i!The purpose of this Ietter is to address the status of upgràdes to the Daviess County HighSchool Softball Complex. As discussed during out Title IX Gender Equity Re-visit, at that time,our ability to make physical changes to that complex was Iimited because the property is ownedby the Owensboro Community and Technical College. However, ànd as discussed previously,we have beèn involved in ongoing discussions with that agency regarding acquisition of thatproperty. Our intention has been to eitheracquire or Iease that property, which is adjacent tothe Daviess County High School campus, and to upgrade the facility to standards that areequitable to the DCHS Baseball complex.

Until just recently, OCTC was in the process of searching for and naming a new President, whichstalled our discussions with them. OCTC is now under new Ieadership, with the appointment ofDrvlim Klauber as their new President. Since Dr. Klauber has taken that leadership role, ourdlstrict has re-started discussions concerning acquisition of that propedy. Just recently, OCTChas agreed to allow us to build on that property. Our Director of Maintenance, DavidHumphrey, is planning to ask our Board of Education for approval to advertise for an architectat their October meeting, scheduled for October 21. W e should be ready to open bids forthisproject by Iate November or early December. Providing our Board approves the bids, and toavoid interfering with the 2011 softball season, we plan to start constructing the buildings bynext summer. l have also attached the tentative plan and timeline, which was previouslysubmitted for your review. Softball Field Upgrades and New Am enities

Plans are currently belng developed to upgrade the softball fîeld complex at DCHS. Plans include adaptingexisting areas of the complex as well as new construction, The following list of items further explain details ofcurrent status, Ieadership involvement, goals and expected timelines.

Cuerent Status/Leadership Involvement

The DCHS principal and athletic director recently conducted meetings with the DCLPS Director of

Maintenance (David Humphrey) to communicate needs and to assist in developing the improvementPI-OEQSS.

2. The current DCHS softball coach (John Bîggs) has been involved in the process by participating in additionalmeetings with the principal and athletic director and providing specific feedback concerning general needs.

Mr. Humphrey, acting on behalf of the DCPS Board of Education, is in the negotiation phase to acquire thesoftball complex property. Options on the table include purchasing the softball com' plex property and

Cheerleader Assignm ent for Girls and Boys Basketball

2009-2010

For boys and girls basketball support, the following process governs the assignment of cheerleading

squads.

1. Two squads are formed according to grade Ievel distribution, not skill Ievel.2. Junior and senior members cheer at boys' basketball games. Freshmen and sophomore

members cheer at girls' basketball games.3. Both squads are comprised of mem bers from the competition cheerleading squad, where

mem bers are selected based upon individual talent. The competition squad is

comprised of members from each class level at DCHS (freshmen, sophomores, juniors andseniors). These members typically have experience in tumbling and/or gymnastics.

4. The squads cheer at an equal number of games throughout the season for boys and girls

basketball teams.

The following descriptions shall serve as the official guideline for athletic travel and per diem at DCHS' Please see Doug

DCHS administration generally provides fundlng for aII athletic team transportation. Special or extended trips mayrequire additlonal or complete funding from team budgets or other sources. A negative impatt on the edutation of

student athletes will be a fattor in approval for travel or participation in any athletlc event. KHSAA W laws specifitallygovern interruptions to class time.

Mode of Transportation

4* DCPS transportation (busses or vans) should be the main option for most travel situations. For trips with fewerstudents, school vans fowned by DCPS) may be requested. The requests must be made through our DCHS

*)* Ovesnight stays will not be allowed during normal school sessions. Exceptions ma# be made for state

1. Regular reports and updates are available and are provided by our school bookkeeper (TammyHoffman).

The principal and SBDM council receive updated reports on aIl accounts at each monthly council

meeting.

3. All deposits must be made on a timely manner to the school bookkeeper. (See ''PAWS'' handbook for

more details).

4. AII purchases must be formally requested. New athletic department purchase requisitionjorms areavailable JnJ must be used starting on M Jy 1, 2010. AtL purchase requests m ust be made with the

Athletic Booster Club Guidelines

2009-2010

The DCFIS Athletic Booster Club is a support organization for aII the athletic teams at Daviess

County High School. The Club is comprised of parents and suppofters of DCHS. The roles of the

organization are as follows:

Provide a representative from each athletic team to secure and organize volunteers to

work in the concession stands at our athletic eventsHelp organize and participate in any fundraisers that are to directly benefit the general

athletic fund and the athletic teams at DCHS

The DCHS Athletic Booster Club is under the direct supervision of the Athletic Director and

Principal and any decisions require the approval of the Athletic Director and Principal.

AII concession purchases and funds are administered through the Athletic Booster Club Account

that only the Alhletic Dlrector and P i ci al can approve for deposits or withd s. Theaccount is used to supplement the general athletic fund at t e end of the fiscal year and/orpurchase any athletic equipm ent or facility improvements approved by the Athletic Director

and Principal. As requests are made by coaches, or as general needs arise, the athletic directorand principal consider a quick response. Sometimes, requests for additional support are made

to officials with the Daviess County Central Office Administration. Generally, when support is

provided (from any Ievel), consideration is given to the possibility of a similar need by thecomparable sport of the opposite gender. In the future, the school bookkeeper, athletic

director, principal and the Title IX com mittee will periodically analyze and evaluate

expenditures of this account to ensure equivalence in spending.

Softball Field Upgrades and New Am enities

Plans are currently being developed to upgrade the softball field complex at DCHS. Plans include adaptingexisting areas of the complex as well as new construction. The following list of items further explain details of

current status, legdership involvement, goals and expected timelines.

Current Status/Leadership lnvolvement

The DCHS principal and athletic director recently conducted meetings with the DCPS Director of

Maintenance (David Htlmpbrey) to communicate needs and to assist in developing the improvementPrOCOSS,

2. The current DCHS softball coach (John Biggs) has been involved in the process by participating in additionalmeetings with the principal and athletic director and providing specific feedback concerning general needs.

Coach Biggs presented sketches/general dimensions pertaining to a new hitting facility, concession area,restrooms and ''press box''M r. Htlmphrey, acting on behalf of the DCPS Board of Education, is in the negotiation phase to acquire thesoftball complex property. Options on the table include purchasing the softball complex property andadjacent community and technical college structures, purchasing the softball complex property separatelyor acqtlisition of a long-term lease of the softball complex property (preferably 20 years).Dr. John Ed Dunn, ctlrrent DCPS Board Chair, serves on the Title IX committee and is aware of the current

needs of the DCHS softball team.

Goals

1. To provide a new hitting facility (comparable to the DCHS baseball team)2. To provide a new concession stand (comparable to the DCHS baseball team)3.
