VOICEThere is no mistaking it: a very heated political season is

upon us. But the political tension in the air isn’t necessarily a bad thing; it forces us to really pay attention to the direction our country is headed, and the seriousness of the issues at hand. And that, in a nutshell, is the primary purpose of the Political Action Advisory Committee (PAAC): to pay strict attention to the political environment as it relates to the real estate industry. More specifically, the Committee’s purpose is to advise the members and leadership team, which candidates and issues best align with the ideals of the Association.

Electing pro-Realtor® candidates is essential. The money to accomplish this comes from voluntary contributions made by members into the Florida Realtors® PAC. These are not members’ dues; this is money given freely by Realtors® and Business Partners in recognition of how important campaign fundraising is to the political process. PAC is essentially promoting and defending issues that impact the livelihood of every Realtor® member of our Association.

It’s important to know that the Florida Realtors® PAC doesn’t buy votes, but rather enables Realtors® to support candidates that in turn, support the issues that are important to their profession and clients, a.k.a. property owners. Working together as a unified team, the Realtor® Party takes on an active leadership role in the political process, staying well-versed in the many changes that are now being contemplated by elected officials as well as legislative and regulatory acencies across the country, such as mortgage qualifications, and tax code changes– real issues that affect the livelihood of their fellow Realtors®. The Realtor® Party is all about Realtors® working together to vote, act, and invest to protect the dream of home ownership, to build vibrant communities, and to promote a strong U.S. economy. Supporting the right candidate, as well as educating the voters, is vital insurance for the future of the real estate profession.

However, the committee serves another very important purpose; it gives the members an intimate look into the campaign process and what it truly takes to win. “Without the intense interview process, probing questions and the collaborative scoring process, choosing the right Realtor® champion may be nothing more than a coin toss, said Barry Grooms, Realtor® and Chair of the PAAC. “It is critical that the candidates vying for our support understand that we are not the Republican or Democratic Party, we are the Realtor®

Party!”, Grooms added. Of course elections don’t take place every day, but keeping

an eye on the issues that arise in our community, that may impact housing or commercial interests on a routine basis, is key. Whether it is a new ordinance that creates an impact or a referendum question that is put before voters, the PAAC will review the impact of those issues and make recommendations to the Board of Directors about whether or not to offer support or comment.

“When there is planning that is occurring in the communities we serve we work to ensure a Realtor® member participates and who can be a conduit between the Board and that planning organization”, commented

Laura Benson, Realtor® and Chair of the Public Policy Commitee. “We strive to stay ahead of issues in order to offer constructive input and to make sure our members are aware of how local rules and regulations impact their ability to put people in homes and help businesses grow. Our members are also active participants in other

business organizations as well. We believe coordination and communication between multiple stakeholders creates a productive opportunity for participation,” Benson added.

One of the biggest events of the year just took place in Washington, D.C. On May 9-14, 2016, nearly 9,000 Realtors® and their guests gathered together for the annual Realtor® Legislative Meetings & Trade Expo. The Realtors® Legislative Meetings & Trade Expo is where NAR members take an active role to advance the real estate industry, public policy and their Associations. Realtors® come to Washington, DC, for special issues forums, committee meetings, legislative activities and the industry trade show. They advocate policies to protect and advance investment in residential and commercial property. Realtors® are offered informative sessions concerning top issues impacting the industry and their business and clients. They meet with legislators, congressional and regulatory staff, and top industry executives who are working to provide real solutions. The meetings focus on critical real estate issues such as preserving the mission and accessibility of Federal Housing Administration and Veterans Affairs home loan programs, protecting real estate-related tax policies, and reforming the secondary mortgage market. The Legislative Meetings & Trade Expo brings together thousands of people with different backgrounds, philosophies and political

RASM Gives Back RASM Partners with Area Charities

The Realtor® Association of Sarasota and Manatee (RASM) partners with vari-ous charities in our commu-nity to promote awareness, offer volunteer assistance and provide financial aid. There are many opportunities for

RASM members to contribute, from community projects to programs and/or events, as well as giving a financial donation. Please consider how you might make a difference in our com-munity by donating your time, energy and/or funds to our Community Outreach charity recipients listed below.

RASM is partnering with The Tiny Hands Foundation, Inc., and Feeding Empty Little Tummies Inc., of Manatee (F.E.L.T.), as part of RASM’s Community Outreach program.

The Tiny Hands Foundation’s core mission is to improve the quality of impoverished children’s lives within our area. They believe in fostering an exchange of generosity and gratitude between the fortunate in our community and those who are in need.

They are a small, all-vol-unteer non-profit organi-zation, with no paid staff, pay no rent, and they have minimal administrative costs, which are paid for by their volunteers. As a result, 100% of donations they receive go directly to fund the children’s initia-tives they lead.

The foundation leads several annual community children’s charitable initia-tives that have benefited more than 40,000 com-munity children and fami-lies in need. RASM will be assisting The Tiny Hands Foundation with their “2016 Back-to-School Backpack Brigade.” The goal is to provide 1,500 new backpacks filled with school sup-plies for community children in need, serving Sarasota, Mana-tee, and DeSoto counties.

“One in five children in our community is growing up be-neath the poverty level. Families shouldn’t have to struggle fi-nancially so that their children can be prepared to participate in their education,” commented Ron Trytek, Project Coordi-nator for the 2016 Back-to-School Backpack Brigade. “Chil-dren should not have to go without the supplies they need to succeed in school. Many of the families we’re helping are single parent families with multiple children: back-to-school expens-es can be overwhelming for a family that is already struggling to make ends meet”, Trytek added. Feeding Empty Little Tum-mies (F.E.L.T.), Inc. is a local, non-profit charity. The mis-sion of F.E.L.T. is to provide nutritious meals for Mana-tee County’s homeless chil-dren, particularly during the weekends and during school vacation. F.E.L.T was first introduced in 2010, by founder Jane L. Evers, to 3 county elementary schools, and now they service 16 Manatee County schools and their numbers are growing.

F.E.L.T. is based on the foundation of volunteer, donor-gen-erated charity. There are many children in Manatee County that rely on free and reduced-price breakfast and lunch during the school year. However, hunger doesn’t go away after the school day is over. All F.E.L.T. proceeds go directly to provid-ing children in need with nutritious food while not in school. Their volunteers graciously give their time and resources with-out compensation or reimbursement.

Throughout Florida, approximately 83,400 are homeless on any given night. Manatee County has approxi-mately 2,000 homeless people, many of whom are children.

Volunteers who wish to donate supplies are re-quested to collect single-serve food items, par-ticularly proteins such as peanut butter, tuna, chicken, and sausage. Additional items needed include: oatmeal/cereal packs, pasta/mac cups, fruit cup/raisins, beans with franks, fruit bars/ granola, ramen noodles, peanuts/almonds, pud-ding cups, hot choco-late, soup cups, snack

persuasions, all brought together by the common interest of political action in real estate. “It’s an energetic environment, where Realtors® from across America come together and speak with one voice about the stability that a sound and dynamic real estate market brings to our communities,” said Adam R. Davis, RASM Governmental Affairs Director. “It’s a great way to educate yourself and be a part of something truly special. I encourage all RASM members to attend at least once.”

From city hall to the state house to the U.S. Capitol, our elected officials are making decisions that have a huge impact on the bottom line of Realtors® and clients. The PAAC encourages RASM members to vote for candidates at the local, state and national levels who support the Realtor® Party and make the right decisions for our profession. “We need allies in local, state and federal government and we need to all work together to continue to support the interests of the real estate profession. The Realtor® party has been a leader in building the bipartisan relationships necessary on both sides of the aisle in meeting our goals, but it does take investments to make it happen. If you’re not investing currently, we encourage you to do so in financial donations and volunteerism with the Florida Realtors® PAC. We’ve raised the bar and I’m so proud of our accomplishments but we need to continue to build on our success, and member involvement is crucial,” added Davis.

Realtor® Attorney Joint Committee Issues to Consider When Dealing with Distressed Propertiesby Janelle Esposito and Patrick Bryant, Esposito Law Group, P.A.

Post-meltdown, the real estate market became flooded with distressed properties, presenting legal challenges for even the most seasoned of Realtors® and buyers. However, a distressed property can still provide the right opportunity for a prudent buyer to walk away with a bigger, better purchase. In evaluating distressed properties, whether obtained by foreclosure or a deed in lieu of foreclosure, the following are some things to consider:Is the title clean?

In dealing specifically with bank-owned properties (“REO Properties”), it is especially important to obtain a title search. A title search will reveal whether there remain liens or other title issues presented.

A buyer should never assume that a bank has fully cleared title to the property during the foreclosure process.Are there unpaid utility balances or code enforcement fines?

Similar to a title search, which searches the county’s official records, a municipal lien search provides information about liens on property resulting from unpaid utility balances or code enforcement fines that are not typically discoverable through a title search. These liens can be very expensive to clear up and in some instances cannot be eliminated through foreclosure.Are there unknown defects or maintenance issues?

Since a bank probably does not have first-hand knowledge regarding the historical maintenance and care of its REO Property and because REO Property sometimes sits empty for a significant amount of time or for a variety of other reasons has not been well maintained, it is critical that a buyer have a thorough inspection completed. It is important to note that most REO Properties are sold “as is” and with no warranties.Is the purchase price on point?

Be confident that you are getting the right price considering the value of the property, any special title issues presented and the current condition of the property by obtaining an appraisal every time. While banks tend to price distressed properties at a discount, that discount is not as steep as it used to be and it can very quickly disappear if the cost of repairs and any potential cost to clear title are not taken into account.

Does the bank already hold title or is this a short sale?It is important when considering a short sale to know

whether or not the bank has already agreed with the owner(s) of the property to sell it for less than is owed to the bank or whether the seller is just hopeful the bank will agree to a lesser price. If the bank has not already agreed to a lesser price, precious time may be wasted attempting to purchase

the property at a price that will never be bank-approved, or at the very least, significant delay may be suffered by the buyers in attempting to close on such a purchase. Are there delinquent taxes or is a tax deed involved?

If a tax deed is discovered in the title search and it has been of record less than four years, it does NOT create marketable title unless the owner does one of two things: (1) obtains a quitclaim deed from each of the prior owners and

obtains releases from any prior lienholders whose liens have not been otherwise satisfied; or (2) files a quiet title action in court against each of the prior owners and any prior lienholders whose liens have not been otherwise satisfied.

Florida law provides further protection for a property owner that obtained ownership via a tax deed where such tax deed has been recorded for more than four years, however, there are some additional conditions a title insurance company or closing agent may impose to insure title and not all interests can be eliminated through a tax deed or quiet title action.

Therefore, in any instance, when delinquent taxes or a tax deed are involved, it is advisable to seek legal counsel.

For another Sarasota family, the goal to provide an adequate home has been fulfilled and a dedication celebration is scheduled for Thursday, June 16, 2016. Since 1984, Habitat Sarasota has provided safe, affordable homes to low-income working families. A dedicated, volunteer workforce provides on average 2,500 labor-hours per home, resulting in a 25%-30% reduction in construction cost. The organization builds new homes (and renovates purchased properties) with

an emphasis on energy efficient features using building materials and techniques for sustainability, culminating in lower monthly expenses for homeowners.

In early May, your fellow RASM colleagues joined Realtors® from around the country and other affiliated nations in Washington D.C. for the 2016 NAR Legislative Meetings and Trade Expo. This is our time to share exactly where Realtors® stand on issues of importance to real estate. It also helps that the halls of the capitol are flooded with Realtors®,

which demonstrates an even stronger presence.Although we are in a Presidential election year and not

much is anticipated, it’s important we remain engaged and prepare our elected for 2017. This year RASM members met with Rep. Vern Buchanan, Senator Bill Nelson and Senator Marco Rubio. The meeting with Rep. Buchanan was led by RASM member Bill Furst and the issues discussed were well received. RASM member Barry Grooms had the pleasure of representing all of Florida Realtors® by leading the meeting with Sen. Marco Rubio. All meetings lasted approximately 30 minutes, which in the political realm is a telling sign that we had a captive and engaged audience.

In 2015, our very own Bradenton Beach Mayoral race ended in a tie, 195-195. Had one more constituent of that city voted, it would have been the deciding vote and greatly influenced the outcome and future of the city. The winning Mayor was ultimately decided by luck of the draw…literally. Both candidates pulled a card from a deck with an ace of clubs trumping a ten of clubs.

The scenario of the card draw is rare, but the tight race is becoming the norm and happens in our region with almost every election cycle.

In 2011, RASM supported candidate Paul Caragiulo for Sarasota County Commission and when he ultimately won by 11 votes of the 3,400 cast, he personally thanked the Realtors® for pushing him across the finish line.

RASM members make up approximately 1% of the general population of Sarasota and Manatee County so we have the opportunity to impact the outcomes of many races, especially when we support a candidate.

Market Analysis Inventory and Median Sales Prices Continue to Climb

April’s housing statistics show that our current trend is continuing as inventory of available properties rose in both counties. For single family homes in Sarasota County, inventory is up 8 percent from April last year, and up 14.2 percent in Manatee County from last year. Condo inventory is also on the rise in Sarasota County, up 25.5 percent from last year, while Manatee County experienced a 19.8 percent increase year-over-year.

The months’ supply of inventory in the two-county area remains in the range of 4.5 to 5.4 months’ inventory this year, compared to a range of 4.2 to 4.5 months at this

time last year. This statistic reflects the time it would take to sell all the active listings on the market at the current month’s rate of sales. Six months is traditionally considered the benchmark for a balanced market; anything higher is considered a buyer’s market and anything lower is a seller’s market. So while the months’ supply is on the rise, it is still a seller’s market. However, the rise in inventory is very encouraging sign that we are returning to a balanced market.

“We continue to see an inventory increase in our area, which is great because there are more options for our homebuyers,” said Linda Formella, RASM President. “Homes priced at $300,000 and under continue to sell at a quick pace, and this trend is likely to continue. There is a high demand for quality, affordable housing. In the upper end of the market we are seeing an extended buying season in our two-county area, with 80 properties closed in April with prices of $1 million plus, significantly higher than last year.”

The median sale price rose year-over-year across the board for both counties. Single family median sales prices are up 12.6 percent in Sarasota County to $250,000, while Manatee County experienced an 8.9 percent to $279,300. Sarasota County condo median price rose 13.9 percent to $218,000, and Manatee County likewise witnessed a significant increase of 14.1 percent in condo sales price over last year, to $165,500.

Total single family closed sales in Sarasota County reached

733 for the month of April, down only 4.2 percent from last month and down 7.3 percent from last year. Manatee County single family homes sales rose 2.3 percent from last month to 534 total sales, but down slightly, just under 1 percent, from April last year. Condo sales fluctuated, with Manatee County up 12.1 percent from both last month and also last year. Sarasota County increased 4.9 percent increase from last month, but was down 11.8 percent from last year’s figures at this time.

The total number of closed distressed property sales (foreclosures and short sales) in April this year was 63.7 percent lower than last April. That significant drop is a great sign of a healthy market. Distressed sales for single family homes in the two-county area represented only 7.58 percent of all closed sales for the month, compared to 19.7 percent last year. Similarly, distressed condo sales represented 2.62 percent of closed sales, compared to 7.37 percent last year. At their peak a few years ago, 48 percent of all sales were distressed.

One of the things that makes me most proud to be President of CID this year and affiliated with RASM is the amount of cooperation and comradery we have here in our local market amongst commercial real estate practitioners. You definitely won’t see that in larger markets where the market is more segregated and the competition is more fierce.

All you have to do to see this in action is to attend our Friday morning pitch session headed up by Erick Shumway of

Re/Max Alliance Group. If the person presenting a new listing or a “want” for a client is not getting any takers from the group directly, many times members sitting around the table will offer up suggestions on how to find a buyer for that particular product, or to call another agent not at the meeting who they believe might be looking for the product they are presenting.

Many or our friendly competitors have lunch together to compare notes, have a drink after hours to socialize, and work together for non-profit organizations like our upcoming CID Golf Tournament. (By the way, that is scheduled for October 24th, and we’re looking for players and sponsors!)

And cooperation is good for our clients as well. Solomon Poretsky who serves as executive vice president for organizational development for SVN International wrote recently for National Real Estate Investor; “Newly completed research shows that when brokers cooperate, sellers achieve higher prices.” Poretsky explains that “a recent survey of more than 15,000 commercial transactions over a 10-year period valued from $2.5 to $20 million and spanning 10 states established that cooperatively sold properties achieved an arithmetic average price per square foot that was 9.6 percent higher than that of properties sold with only a single brokerage firm involved in the transaction.”

Poretsky firmly believes that “expanding the number of buyers increases the competition for that asset”. That “a single broker’s database is unlikely to adequately span every potential buyer, making cooperation necessary” and obviously beneficial to our clients.

I for one am happy to work with the many CRE agents in our market and always welcome sharing a deal together to get it done. A wise man once told me; “Half of something is better than all of nothing.”

MFCRE UPDATE!As you are probably aware, MFCRE’s contract with

Catalyst as our Commercial Real Estate Exchange (CRE) expired this year. Your Commercial Investment Division (CID) Board of Directors completed extensive due diligence in an effort to determine if Catalyst is still the best platform option, or if another alternative would be a better choice for our members. The CID Board could only make a recommendation as the actual contract is between MFCRE and Catalyst.

After considering the costs and benefits of the systems we investigated, it was determined that for now Catalyst is still the best option for our members. Therefore the CID Board asked MFCRE to renew their contract. However, Catalyst and other vendors are rolling out new systems later this year that we will take a look at once again.

Please note that there was a very slight price increase in your current renewals over last year’s costs. These fees are past due now.

Also as you may recall, we were interested in seeing if the Florida Gulfcoast Commercial Association of Realtors® (FGCAR) and the Central Florida Commercial Association of Realtors® (CFCAR) were interested in joining us on one contract and one system with MFCRE as our provider. That way you could search from Orlando to Tampa to Punta Gorda on one system. FGCAR’s Board has expressed an interest and is looking into joining MFCRE on the same contract as us. More on that to come. CFCAR has not yet shown much interest as they do not currently use Catalyst, but we will continue to work on that for you.

Global Business CouncilAre the Canadians Going to Buy in Florida in 2016 and Beyond?

By Kim Martinez, Sarabay Real Estate Inc. Are the Canadians going to buy in Florida in 2016 and

beyond? This is the question that led me to the Toronto Realtor® Quest May 2016. Where better to get answers than by participating in Canada’s largest Realtor® gathering and by mingling with a number of the over 8,000 Canadian Realtors® in attendance?

Canadian snowbirds have been a way of life for Floridians for many years and Canadians have purchased billions of dollars of Florida Real Estate. Until recently, there didn’t seem to be an end in sight, but in 2015 Florida felt the decline of the Canadian spending. According to Google Finance, Canadian real estate sales between July 2014 and June 2015 were down 32 percent from the previous year. This decrease is due mainly to the combination of the appreciation of Florida property values and the decline in the Canadian dollar. According to Florida Realtors®, Sarasota County median home prices increased about 15% year over year and Google finance says that Canadian spending power has decreased about 20% since 2014!

So I headed to Toronto and set up a booth in hopes to find out what Canadians were saying about buying in Florida for the coming year. The response was very interesting.

1. How? Overwhelmingly, the need for “How to buy in Florida” was repeated over and over. There was much confusion over U.S. Withholding, double taxation, and financing possibilities.

2. Sarasota - Where is it? Many Realtors® were more familiar with Orlando and the East Coast than Sarasota.

3. Investors - Realtors® have clients who want to get into the Florida game but don’t know how and want to know the risks.

4. Canadians love everything tropical - The Sarasota video playing in my booth seemed to freeze Realtors® in their tracks. The beautiful beaches mesmerized them and much of the interest in purchasing property was for the Realtors® themselves.

5. Referral Fees – Many Realtors® were not aware that this was something that was available for sharing leads.

So are the Canadians coming back in 2016? I had my doubts at first when I considered that the Loonie isn’t likely to regain its former strength anytime soon, and that many Canadians will continue to benefit from profit taking. However, there are a few more factors to take into account; Sarasota-Manatee area rental rates will likely continue to climb and Sarasota-Manatee property values should continue to appreciate. When I combine this with the push for Canadian investors looking for rental cash flow - I am back to feeling positive about the coming year. Not to mention that many of the younger Canadian Realtors® voiced excitement about the possibility of both themselves and their clients getting a foot into the Florida Real Estate door by being able to afford the median costs of Sarasota-Manatee home at approximately $250,000 (NAR) a door that may be closed to many in Toronto with the median price of a Single Family Home above $700,000! (TREB-Toronto Real Estate Board).

The deciding factor to the positive side, Winter will still be coming to Canada next year and Canadians will still be fleeing to the Florida Sunshine. They just might be fleeing on a tighter budget. If you haven’t done so already, be sure to sign up for the CIPS (Certified International Property Specialist) designation courses that are being offered June 6th through the 10th. You can take the entire week of courses or you can take individual classes. The full week is $500; the individual day classes are $125. The classes are being offered at the RASM South office at 2320 Cattleman Road, Sarasota.

Rather, brokers need only show that they initiated an unbroken chain of events that resulted in the deal between the buyer and the seller.”

On May 6, the RASM RPAC Committee hosted the 2016 Great Gatsby Realtor® Party and Casino Night. An April 30, 1989 double page ad in the Sarasota Herald Tribune announced “Exciting plans for Sarasota’s most prestigious new Country Club Community: Laurel Oak Estates!” The 813 acre former cattle ranch was developed by Radnor Corporation with Sarasota businessmen Russ Currin and Ron Foxworthy at a time when building east of I-75 was still a curious undertaking. Conscientious effort was made to be environmentally sensitive; protecting ancient Oaks, Preserves, Wetlands and Hammocks.

The Laurel Oak Country Club was designed as the heart of the community; the 45,000 square foot clubhouse was one of the first buildings constructed. Two Gary Player designed golf courses were completed; a premier tennis facility and junior Olympic Size pool were built as well. Development continued through 2005; there are now 405 homes total. Residents enjoy 29 lakes, 20 common acres, 8 miles of double wide sidewalks. Average home sites are half an acre with 50+ lots over an acre – many include 100-year-old oak trees. Home sizes range from 1900 to 10,000 square feet; prices range from $400,000 to $2,500,000. Seventy five percent of homes overlook one of the golf courses, lakes or 22 wetland preserves.

Laurel Oak Country Club membership is not mandatory for homeowners, however 75% of homeowners are members. Located 2 miles from I-75, it is ideally positioned for convenience to downtown, the beaches or the airports. Rothenbach Park and Celery Fields are close by for walking, biking or bird watching. A newer Publix is a mile away and the 2-mile trek to the amenity-rich Cattlemen/Bee Ridge intersection is about to become much easier this summer when the Bee Ridge widening project is completed.

The main entrance to Laurel Oak Estates is undergoing a major transformation to include water features and enhanced signage. Fun Fact: All streets in Laurel Oak are named after golf course architects!

The Women’s Council of Realtors®, Sarasota had their May Business Resource Meeting at the Bird Key Yacht Club on Friday the 6th of May. At that meeting we were pleased to welcome our newest members Carolyn Hoff and Lilo Pozzi and we also pinned one of our members from last year, Christie May.

We are pleased to welcome our members into a community that is committed to their success and we hope they embrace all of the benefits and services available to them. By getting involved and making the most of their membership, they will uncover a wealth of opportunities to help get plugged in – and stay plugged in – to the power of the Real Estate profession.

While most of our new members joined the Council to aid in their professional growth, they will find the Council experience personally rewarding as well. Whether they make new friends, discover a better balance in their career…investing time with us will pay off in unexpected – but very welcome ways.

We also suggest for all our members…seasoned or new, to get involved with our committees and programs and take our PMN (Performance Management Network) designation. These classes are offered several times during the course of the year.
