CONDITIONS OF PERMISSIONS

COMPLIANCE WITH ALL LAWS

G1 All activities conducted under this permission must be undertaken in accordance with the provisions of the laws in force from time to time in the State of Queensland and the Commonwealth of Australia.

G2 To the extent applicable and unless written endorsement to the contrary appears in this permit, the Permit Holder must: (i) comply with the enforcement provisions contained in Part 2 of the Plans of Management gazetted

under Part VB of the Great Barrier Reef Marine Park Act 1975; and(ii) may only operate to an intertidal area adjacent to a location within the Planning Areas with access

consistent with that provided in the Plans of Management for that adjacent location.

G3 The Permit Holder must ensure that when operations are conducted in the Marine Parks under this permit, a copy of this permit is held at the site or sites of operation and on the vessel or aircraft during transit to and from that site or sites.

G4 The Permit Holder must inform staff and participants in the program of relevant restrictions applying under any zoning plans, plans of management, Marine Parks regulations and this permit.

G5 The Permit Holder must further comply with the conditions specified in any schedules attached to this permit when entering or using a zone of, or place in, the Marine Parks to which the relevant conditions relate.

G6 The Permit Holder must, at its own expense during the term of the permit, punctually comply with all Acts of Parliament, statutes, local laws, regulations, ordinances or rules for the time being in force, which apply to the permitted area and/or the Permit Holder’s use of the Marine Parks.

INDEMNITY

G7 The Permit Holder(i) indemnifies; and(ii) releases and dischargesthe Managing Agency from and against all actions, proceedings, claims, demands, costs, losses, damages, liability and expenses which may be brought against or made upon the Managing Agency, or which the Managing Agency may pay, sustain or be put to by reason of, or in consequence of, or in connection with this permit and the occupation and use of the Marine Parks by the Permit Holder except to the extent of any negligent act of the Managing Agency, its servants or agents.

G8 The Permit Holder must notify the Managing Agency in writing of any death, injury, loss or damage immediately upon the Permit Holder becoming aware of such death, injury, loss or damage.

NO WARRANTY AND RISK

G9 The Managing Agency does not warrant that the Marine Parks are free from defect or that they are safe, fit, suitable or adequate for the permitted use. To the full extent permitted by law, all warranties as to fitness, suitability and adequacy implied by law are expressly excluded.

G10 The Permit Holder uses the Marine Parks entirely at its own risk and is responsible for ensuring the area is suitable for the Permitted Use prior to commencing any permitted use.

INSURANCE

G11 For the term of this permit, the Permit Holder must take out and maintain the following insurances, and must supply documentary evidence of such insurances to the Managing Agency upon request:(i) a public liability insurance policy for not less than $20 million arising from any one (1) event in respect

of the death of, or injury to, persons or loss or damage to property; and(ii) insurance under all applicable laws relating to workers’ compensation to cover workers, eligible

persons, self-employed contractors, directors, trustees and partners.

G12 From time to time the Managing Agency may issue a notice to the Permit Holder increasing the minimum insurance cover required by condition G11(i) if the Managing Agency reasonably believes increased insurance coverage is required.

G13 The Permit Holder must ensure that the insurance policies required under condition G11 are with an Appropriate Insurer.

G14 The Permit Holder must ensure that the insurance policies that it has effected to cover the insurable interests pursuant to condition G11(i) cover all invitees, employees, contractors, agents, members or clients of the Permit Holder and names the Managing Agency as an interested party.

G15 In any circumstance where the insurances required under this permit are cancelled, altered or expire before the expiry date of this permit, the Permit Holder must cease all activities in the Marine Parks until such time as alternative insurance policies that comply with the requirements of condition G11 have been obtained.

G16 The Permit Holder is deemed to have complied with conditions G11(i) where: (i) is a Commonwealth, State or Territory government department, agency or statutory body; and (ii) is a self-insurer; and(iii) has provided the Managing Agency with a certificate from an authorised officer of that department,

agency or statutory body, to that effect.

AUTHORITY CONDITIONS

G17 The Permit Holder may authorise other persons to conduct the activities covered by this permit, by giving to those persons an Authority in the form attached to this permit (Attachment A) or as otherwise approved by the Managing Agency.

G18 An Authority remains valid for the period of time shown on each individual Authority, unless the Authority is sooner revoked in writing by the Permit Holder or unless the permission is sooner suspended, revoked or expires.

G19 The Permit Holder must provide a copy of this permit to any person issued Authority under condition G17.

GENERAL CONDITIONS

G20 When providing transport in the Marine Parks to another operation permitted under a different Marine Parks permit, the Permit Holder must ensure that the total number of persons (including crew) on the vessel or aircraft does not exceed relevant setting or permit limits.

G21 The Permit Holder must ensure that any mooring used is:(i) permitted under a current Marine Parks permit;(ii) safe to use; and(iii) of a type and design suitable for the vessel or aircraft used under this permit.

G22 Prior to any vessel or aircraft being operated under this permit, the Permit Holder must:(i) have given written notification to the Great Barrier Reef Marine Park Authority of the vessel or aircraft

name and registration number of the specific vessel or aircraft to be operated under this permit; and(ii) have received written approval for use of that vessel or aircraft from the Managing Agency and a copy

of that approval must be held on-board the vessel or aircraft at all times.

G23 An approval under condition G22 above ceases to have effect for a specific vessel or aircraft when a subsequent approval for the same or any other vessel or aircraft is given under that condition.

G24 Interchange with another vessel or aircraft of similar size and passenger capacity is permitted for a period of less than 72 hours, if such interchange is of an unexpected nature resulting from maintenance or repairs of the permitted vessel or aircraft, or for a period exceeding 72 hours, subject to written approval from the Managing Agency.

DELIVERY OF GOODS

G25 If carrying hazardous substances, the Permit Holder must only carry limited quantities in accordance with the International Maritime Dangerous Goods Code.

TOURIST PROGRAM SCHEDULE

PERMITTED EQUIPMENT

T1 The following types of motorised equipment and non-motorised equipment used in conjunction with a vessel, may be used under this permit:(i) aquatic devices;(ii) motorised canoe;(iii) personal watercraft;(iv) powered surfboard;(v) water propelled flying board;(vi) inflatable or boom net (towed behind vessel); (vii) water-ski or wakeboard (towed behind vessel); and(viii) parasail or parakite (towed behind vessel).

Advisory note: When any of the motorised equipment is used in a manner that meets the definition of motorised water sports, the Permit Holder must adhere to other relevant conditions on this permit.

T2 The following types of non-motorised equipment may be used under this permit:(i) kayak, canoe, surf ski, raft and other sit-on-top craft;(ii) kitesurfer; (iii) stand-up paddleboard;(iv) surfboard; and(iv) windsurfer.

PERMITTED ACTIVITIES

T3 In addition to provision of general services to tourists, the Permit Holder may offer the following services to tourists, in accordance with specific Conditions of Permission:(i) coral viewing;(ii) craftless operation;(iii) fishing;(iv) fish feeding;(v) guided tours;(vi) helmet diving;(vii) motorised water sports;(viii) non-motorised water sports;(ix) overnight accommodation including live aboard and mothership vessels;(x) passenger transport;(xi) photography, filming and sound recording;(xii) sailing and sail training;(xiii) scenic flights(xiv) snorkelling;(xv) swimming;(xvi) SCUBA diving; and(xvii) whale watching.

AQUATIC DEVICES

T4 The Permit Holder must ensure that aquatic devices are operated under the active supervision of crew where:(i) a minimum of one (1) crew member is present with every 10 participants; and(ii) the supervising crew member(s) remains in the water for the duration of the activity.

T5 The Permit Holder must ensure that aquatic devices are not operated:(i) within two (2) metres of coral;(ii) at a speed greater than five (5) knots;(iii) at a depth greater than five (5) metres; and(iv) in a manner similar to a motorised water sports, notwithstanding the Permit Holder’s obligations to

prevent or minimise harm to the environment and other persons in the Marine Parks.

CRAFTLESS OPERATION

T6 The Permit Holder must ensure that the use of, or entry to, the Marine Parks:(i) only takes place using a vessel or aircraft permitted under a valid Marine Parks permission;(ii) only occurs in the zones and locations as specified in the permission for that vessel or aircraft; and(iii) only includes the same access and activity conditions which are specified in the permission for that

vessel or aircraft.

FISHING AND FISH FEEDING

T7 The Permit Holder must only offer fishing activities in accordance with the Zoning Plans.

T8 When conducting fish feeding, the Permit Holder must:(i) operate no more than one (1) fish-feeding station at each location;(ii) not feed the fish directly by hand; (iii) not conduct fish feeding at the same time or place on two (2) or more consecutive days;(iv) use only food that consists of fresh, raw marine products and/or manufactured marine fish food pellets

that are within the expiry date;(v) not use more than 1 kilogram of food per day per location;(vi) warn participants of the potential dangers of fish feeding; (vii) not feed fish when participants are in the water; (viii) not deliberately attract sharks; and (ix) display a legible copy of the Marine Parks 'Guidelines for Fish Feeding on the Great Barrier Reef' at the

fish-feeding station.

GUIDED TOURS

T9 When conducting guided tours using motorised or non-motorised equipment, other than in accordance with condition T10, the Permit Holder must ensure that all equipment is operated under the active supervision of crew where: (i) a minimum of one (1) crew member is present with every 10 participants; and(ii) the supervising crew member(s) remains in the water for the duration of the activity.

T10 When conducting guided tours using jet skis, the Permit Holder must ensure that all equipment is operated under the active supervision of crew where: (i) the supervising crew member(s) remains in the water for the duration of the activity; and(ii) the primary jet ski is approved for use under a Vessel Notification Approval in accordance with

condition G22 and no more than 10 ancillary units are permitted in the water at any one time.

Advisory note: the ratio of one (1) crew member to 10 units is not intended to override any Workplace Health and Safety Queensland requirements or other safety regulations. If such legislation requires a smaller ratio then the permission holder must comply with that requirement.

HELMET DIVING

T11 When conducting helmet diving, the Permit Holder must ensure that helmet divers remain under the active supervision of crew where:(i) a minimum of one (1) crew member is present with every 10 participants; and(ii) the supervising crew member(s) remain in the water for the duration of the activity; and(iii) the Permit Holder must ensure that helmet divers:

(a) do not operate within two (2) metres of coral, or other sessile marine fauna and flora; (b) do not chase or threaten mobile marine fauna; and (c) only walk on bare sand and do not walk on coral, seagrass or other marine organisms.

Advisory note: the ratio of one (1) crew member to 10 participants is not intended to override any Workplace Health and Safety Queensland requirements or other safety regulations. If such legislation requires a smaller ratio then the permission holder must comply with that requirement.

MOTORISED WATER SPORTS

T12 If any motorised equipment is used in a manner which meets the definition of motorised water sports, the Permit Holder must comply with condition G2, condition T13 and the motorised water sports exclusion list.

T13 The Permit Holder must not conduct any motorised water sports in locations specified in the following motorised water sports exclusions list, unless the Permit Holder has received prior written approval from the Managing Agency.

Advisory note: At the time of granting this permission, whale watching as part of a tourist program is prohibited in the Whitsunday Whale Protection Area under Part 9 of the Regulations.

GENERAL VESSEL AND ACCESS SCHEDULE

V1 The Permit Holder must only use vessels no greater than 35 metres in overall length.

V2 The Permit Holder may only undertake beach landings to permitted intertidal areas using a vessel, not exceeding 12 metres in length, and must ensure that the vessel does not remain in the intertidal areas for longer than necessary to either load or unload passengers.

V3 If operating a vessel greater than 12 metres in length, the Permit Holder may only access the intertidal areas:(i) using a boat ramp, barge ramp, jetty or harbour wharf that is of a type and design suitable for the

vessel; or (ii) in accordance with an Intertidal Areas Notification Approval.

V4 If access to other intertidal areas is required using a vessel greater than 12 metres in length, the Permit Holder must:(i) give the Managing Agency at least 14 days written notice seeking approval to access an intertidal area;(ii) not access the intertidal areas unless an Intertidal Areas Notification Approval is received;(iii) comply with any direction the Managing Agency may impose on access; and(iv) hold a copy of the Intertidal Areas Notification Approval on-board the vessel at all times.

V5 The Permit Holder must take reasonable steps to ensure that activities carried out under this permit are carried out in a manner to prevent or minimise harm to the environment.

V6 The Permit Holder must take reasonable steps to prevent:(i) the introduction of pests into the Marine Parks; and(ii)the transfer of pests between locations within the Marine Parks.

MINI-SUBMARINES

V7 Any mini-submarine used under this permit must:(i) not exceed an overall length of four (4) metres and passenger capacity of three (3) persons, including

pilot;(ii) be operated by licenced staff or crew; and(iii) have robotic manipulator arms stowed or secured when the vessel is in operation, unless the vessel is

being chartered for other permitted conduct which specifically permits the taking of an animal, plant or marine product.

FAR NORTHERN MANAGEMENT AREA

V8 The Permit Holder must not visit a permitted location in the Far Northern Management Areas on more than two (2) visits in any seven (7) consecutive day period, with each vessel.

V9 The Permit Holder must not access the following areas during the periods specified unless otherwise approved in writing by the Managing Agency.

CAIRNS/COOKTOWN MANAGEMENT AREA

V10 The Permit Holder must not visit a permitted location in the Cairns/Cooktown Management Areas outside the Cairns Area and the Fitzroy Marine Management Area on more than two (2) visits in any seven (7) consecutive day period with each vessel except when operating:(i) to a permitted mooring or pontoon; or(ii) as specified in condition V11.

V11 The Permit Holder may operate to the permitted locations in the Cairns/Cooktown Seasonal Gamefishing Area for up to 30 days in any 60-day period with each vessel during the period from 1 September to 31 December each year, if operating primarily for the purposes of gamefishing.

V12 The Permit Holder may access the intertidal area adjacent to Cedar Bay National Park only for the purpose of dropping off and/or picking up persons who are either the holders of a National Parks camping permit valid for camping in the Cedar Bay National Park on the given dates or intend to hike out of the National Park on that day, and must stay in the vicinity only as long as required to effect the transfer.

V13 The Permit Holder must not access the following areas during the periods specified, unless otherwise approved in writing by the Managing Agency.

ACCESS TO THE CAIRNS PLANNING AREA

V14 When conducting a tourist program and in accordance with condition G2, the Permit Holder must comply with all enforcement provisions contained in Part 2 of the Cairns Area Plan of Management as updated from time to time.

V15 The Permit Holder must not operate to any intertidal area adjacent to Sensitive Locations as defined in the Cairns Area Plan of Management, without a booking, except:(i) those intertidal areas adjacent to the Sensitive Locations of Cod Hole Locality and Lizard Island

Locality 1; or(ii) when conducting a camper transport operation (Cairns); or(iii) where otherwise endorsed.

V16 When conducting guided tours using jet skis, the Permit Holder must not operate to any intertidal area adjacent to Sensitive Locations as defined in the Cairns Area Plan of Management.

ACCESS TO FITZROY ISLAND STATE MARINE PARK

V17 When conducting a tourist program, the Permit Holder must not access the Fitzroy Marine Management Area on more than 50 days in a year with each vessel and without a prior booking with the Managing Agency, unless sourcing clients only from within the Fitzroy Marine Management Area.

V18 The Permit Holder must not access the Fitzroy Marine Management Area Locality 1 and the Fitzroy Marine Management Area Locality 2 with a group size of more than 60 people.

V19 The Permit Holder must not access the Fitzroy Marine Management Area Locality 3 with a group size of more than 15 people, unless operating to a permitted mooring where a maximum group size of 60 people is permitted.

V20 The Permit Holder must not access the Fitzroy Marine Management Area Locality 4 with a group size of more than 15 people.

V21 The Permit Holder must not access the intertidal area of the Fitzroy Marine Management Area Locality 4 (Nudey Beach) between 9:30am and 3:30pm.

V22 The Permit Holder must not store any equipment or vessels associated with the permitted activities within the Fitzroy Marine Management Area, unless moored on a permitted mooring.

Advisory Note: For the purpose of conditions V18, V19 and V20 a calculation of the number of people that a vessel is carrying must include each person on board the vessel who is aged 4 years or older (including the officers and members of the vessel's crew).

TOWNSVILLE/WHITSUNDAY MANAGEMENT AREAS

V23 The Permit Holder must not visit a permitted location in the Townsville/Whitsunday Management Areas outside the Whitsundays Area and the Hinchinbrook Area on more than two (2) visits in any seven (7) consecutive day period with each vessel.

Advisory Note: For the purposes of this condition the Marine National Park Zone in Five Beach Bay (Magnetic Island) is considered as one (1) location.

V24 The Permit Holder must not access Balding Bay (Magnetic Island) or Florence Bay (Magnetic Island) (including the intertidal areas) on a Saturday or a Sunday.

V25 The Permit Holder must ensure that anchoring in Florence Bay (Magnetic Island) only takes place in the southern half of the bay.

V26 When carrying more than 24 passengers (excluding crew) the Permit Holder must not access the following areas:(i) waters adjacent to the following islands of the Great Palm Island Group: Great Palm, Curacoa, Esk,

Falcon, Eclipse, Brisk and Havannah;(ii) intertidal areas adjacent to Fantome Island, Pelorus Island or Orpheus Island (except Hazard Bay

(Orpheus Island)); and(iii) waters adjacent to Magnetic Island (except Horseshoe Bay (east of Endeavour Creek), Geoffrey

Bay, Nelly Bay and Picnic Bay).

V27 The Permit Holder is exempt from condition V26(i) when conducting activities on behalf of residents of Great Palm Island.

V28 In addition to condition V26, when carrying more than 50 passengers (excluding crew) the Permit Holder must not access intertidal areas adjacent to Hazard Bay (Orpheus Island).

V29 The Permit Holder must not access the following areas during the periods specified, unless otherwise approved in writing by the Managing Agency.

ACCESS TO THE HINCHINBROOK PLANNING AREA

V30 When conducting a tourist program and in accordance with condition G2, the Permit Holder must comply with all enforcement provisions contained in Part 2 of the Hinchinbrook Plan of Management as updated from time to time.

V31 For the purpose of conducting:(i) a passenger transport operation (Hinchinbrook); or(ii) an operation using a non-motorised craft where a guide or crew is provided;the Permit Holder may access the Hinchinbrook Area and operate in a Sensitive Location (Hinchinbrook) on a daily basis without the requirement to make a booking provided the Permit Holder does not access the following Locations (Hinchinbrook): Eastern Hinchinbrook Channel Location, Western Hinchinbrook Channel Location, Hecate Point Location or Missionary Bay Location.

V32 When conducting a passenger transport operation (Hinchinbrook) the Permit Holder must not transfer passengers into the intertidal area of George Point.

V33 The Permit Holder may operate above the Setting Limits specified in the Hinchinbrook Plan of Management when:(i) transiting through a Location (Hinchinbrook), other than the Eastern Hinchinbrook Channel Location,

Western Hinchinbrook Channel Location, Hecate Point Location or Missionary Bay Location; or(ii) conducting a passenger transport operation (Hinchinbrook) in the Cape Richards Location.

V34 The Permit Holder must not conduct non-motorised water sports within the following Locations (Hinchinbrook): Eastern Hinchinbrook Channel Location, Western Hinchinbrook Channel Location or Missionary Bay Location.

ACCESS TO THE WHITSUNDAYS PLANNING AREA

V35 When conducting a tourist program and in accordance with condition G2, the Permit Holder must comply with all enforcement provisions contained in Part 2 of the Whitsundays Plan of Management as updated from time to time.

V36 The Permit Holder must not operate in a setting 5 area as defined in the Whitsundays Plan of Management or an abutting intertidal area, except in accordance with condition V36.

ACCESS TO THE WHITSUNDAYS STATE MARINE PARK

V37 The Permit Holder may only access the intertidal area abutting Tongue Point on Whitsunday Island in accordance with the following:(i) the Permit Holder must hold a relevant authority issued under the Nature Conservation Act 1992

allowing access to the Tongue Point walking tracks;(ii) the Permit Holder may only access the intertidal area of Lookout Beach and Betty’s Beach via foot.

Advisory Note: The Permit Holder is advised that the commercial use of intertidal areas within the Whitsundays Area will be subject to review. The Permit Holder is further advised that should that review determine commercial use is unsuitable at some sites, those sites may be removed from this permit until further notice.

ACCESS TO MAGNETIC ISLAND

A22 When conducting a tourist program, the Permit Holder must not operate an aircraft at a vertical height less than 1500 feet in the vicinity of Magnetic Island (the prescribed area) except in the course of landing, taking off or taxiing an aircraft seaward of the intertidal area at Horseshoe Bay, Nelly Bay or Picnic Bay.

Advisory Note: Despite condition A22, for emergency or other extraordinary reasons, Air Traffic Control requires the aircraft to fly within the prescribed area. The Permit Holder shall ensure that any airways clearance requested from Air Traffic Control shall be for outside the prescribed area except in the course of landing, takeoff or taxiing at Horseshoe Bay, Nelly Bay and Picnic Bay.

A23 When conducting a tourist program in the prescribed area, the Permit Holder must not operate before 0900 hours or after 1700 hours on any day.

A24 Notwithstanding conditions A14 and A15, when conducting a tourist program anywhere within the prescribed area, the Permit Holder must not operate on more than six (6) days in any seven (7) consecutive day period, with each aircraft.

A25 When conducting a tourist program anywhere in the prescribed area and subject to conditions A14 and A15, the Permit Holder must not operate more than eight (8) flights total on any day.

ACCESS TO THE WHITSUNDAYS PLANNING AREA

A26 When conducting a tourist program and in accordance with condition G2, the Permit Holder must comply with all enforcement provisions contained in Part 2 of the Whitsundays Plan of Management as updated from time to time.

A27 When conducting a tourist program, the Permittee must not operate aircraft at a height less than 1500 feet in the intertidal area of the Whitsundays Area, on more than 50 days per year, in total with all aircraft, unless conducting a passenger transport operation (Whitsundays).

A28 The Permit Holder must not operate an aircraft in the intertidal area EXCEPT in the course of landing, taking off or taxiing an aircraft at:(i) Hamilton Island Airport, Lindeman Island airstrip or Whitsunday airstrip; or(ii) the intertidal area adjacent to a regular aircraft landing area as defined in the Whitsundays Plan of

Management.

A29 The Permit Holder must not operate in a setting 5 area as defined in the Whitsundays Plan of Management or an abutting intertidal area.

MACKAY/CAPRICORN MANAGEMENT AREAS

A30 The Permit Holder must not visit a permitted location, other than intertidal locations, in the Mackay/Capricorn Management Areas on more than two (2) visits in any seven (7) consecutive day period, with each aircraft.

A31 The Permit Holder must not land or operate aircraft at a height less than 1500 feet in the intertidal area at a permitted location on more than two (2) visits in any seven (7) consecutive day period, in total with all aircraft.

A32 When operating an aircraft in the Mackay/Capricorn Management Areas, the Permit Holder must ensure that:(i) the aircraft does not taxi onto or stand upon beaches except when transferring passengers; and(ii) the aircraft's landing and takeoff approaches below 500 feet do not traverse Marine National Park

Zones except when weather conditions make alternate routes unsafe.

A33 The Permit Holder must not, in the vicinity of the areas set out in this condition, during the periods specified:(i) operate an aircraft at a height less than 1500 feet; or(ii) land or takeoff by aircraft; or(iii) taxi the aircraft;(iv) unless otherwise endorsed on the permit or when in transit for landing/takeoff from a location outside

the Marine Parks.

CHARTER OPERATION SCHEDULE

C1 When conducting transport and related services to persons other than tourists, the Permit Holder must not access Preservation Zones and Designated Areas unless:(i) in the presence of an officer of the Managing Agency;(ii) with persons other than an officer of the Managing Agency, the Permit Holder must notify the

Managing Agency and must not conduct activities until written approval is given.

C2 The Permit Holder must ensure that when conducting charter operations in accordance with condition C1 this activity is not conducted whilst transporting tourists or in conjunction with a tourist program.

C3 When providing transport and services to persons conducting activities in the Marine Parks which require the written permission of the Managing Agency, the Permit Holder must:(i) not operate under this permit unless those persons have been granted the appropriate Marine Parks

permit; and(ii) only conduct operations in accordance with the conditions of that permit.

C4 When providing transport and services to persons conducting activities in the Marine Parks which require notification to the Great Barrier Reef Marine Park Authority under Part 5 of the Great Barrier Reef Marine Park Zoning Plan 2003 and/or Part 4 of the Marine Parks (Great Barrier Reef Coast) Zoning Plan 2004, the Permit Holder must:(i) not operate under this permit unless those persons have notified the relevant Managing Agency of

their intended activities; and(ii) only conduct operations in accordance with any directions imposed by the Managing Agency.

C5 When conducting charter operations under this permit, the Permit Holder may provide transport and related services to persons other than tourists, in accordance with the tourism program conditions without prior notification to the Managing Agency.

INTERPRETATION AND DEFINITIONS

INTERPRETATION

This permit extends to all employees of the Permit Holder, or other persons, who are acting on behalf of, or at the direction of, the Permit Holder for the purposes specified in this permit.

This permit is not intended to extinguish any native title.

A law shall be taken to be a law in force in the State of Queensland notwithstanding that it applies to only part of the State.

A word or phrase in this permit has the same meaning as the word or phrase has in the Great Barrier Reef Marine Park Act 1975 (Cth), the Great Barrier Reef Marine Park Regulations 2019 (Cth), the Marine Parks Act 2004 (Qld), the Marine Parks Regulation 2017 (Qld), Zoning Plans or Plans of Management, unless the contrary intention appears.

A reference to the Cairns Area Plan of Management is a reference to the Cairns Area Plan of Management as gazetted under Part VB of the Great Barrier Reef Marine Park Act 1975 and as amended from time to time.

A reference to the Hinchinbrook Plan of Management is a reference to the Hinchinbrook Plan of Management 2004 as gazetted under Part VB of the Great Barrier Reef Marine Park Act 1975 and as amended from time to time.

A reference to the Whitsundays Plan of Management is a reference to the Whitsundays Plan of Management as gazetted under Part VB of the Great Barrier Reef Marine Park Act 1975 and as amended from time to time.

A note or heading may be used to give assistance in interpreting conditions in case of ambiguity.

A reference to a date includes that date.

A reference to the Far Northern Management Areas is a reference to the geographical area defined by the Far Northern Management Area of the Amalgamated Great Barrier Reef Section, the Far Northern Management Area of the Great Barrier Reef Coast Marine Park and those areas of the Outer Islands Management Area of the Great Barrier Reef Coast Marine Park enclosed within the Far Northern Management Area of the Amalgamated Great Barrier Reef Section.

A reference to the Cairns/Cooktown Management Areas is a reference to the geographical area defined by the Cairns/Cooktown Management Area of the Amalgamated Great Barrier Reef Section, the Cairns/Cooktown Management Area of the Great Barrier Reef Coast Marine Park and those areas of the Outer Islands Management Area of the Great Barrier Reef Coast Marine Park enclosed within the Cairns/Cooktown Management Area of the Amalgamated Great Barrier Reef Section.

A reference to the Townsville/Whitsunday Management Areas is a reference to the geographical area defined by the Townsville/Whitsunday Management Area of the Amalgamated Great Barrier Reef Section, the Townsville/Whitsunday Management Area of the Great Barrier Reef Coast Marine Park and those areas of the Outer Islands Management Area of the Great Barrier Reef Coast Marine Park enclosed within the Townsville/Whitsunday Management Area of the Amalgamated Great Barrier Reef Section.

A reference to the Mackay/Capricorn Management Areas is a reference to the geographical area defined by the Mackay/Capricorn Management Area of the Amalgamated Great Barrier Reef Section, the Mackay/Capricorn Management Area of the Great Barrier Reef Coast Marine Park and those areas of the Outer Islands Management Area of the Great Barrier Reef Coast Marine Park contained within the Mackay/Capricorn Management Area of the Amalgamated Great Barrier Reef Section.

A reference to the Fitzroy Marine Management Area means all areas of the Great Barrier Reef Coast Marine Park (State) within the boundaries of:(a) the 500m coastal line around Fitzroy Island and Little Fitzroy

Island; and(b) the landward boundary of the marine park surrounding Fitzroy

Island and Little Fitzroy Island.

DEFINITIONS

'aircraft' means any machine supported for flight in the air by buoyancy (such as balloons and other lighter-than-air craft), or by dynamic action of air on its surfaces (such as aeroplanes, helicopters, gliders and other heavier-than-air craft).

'ancillary vessel' means a small tender which:(a) is not the primary vessel of the operation;(b) is only operated to provide services to the participants of the

Permit Holder's operation; and(c) is only operated within three (3) nautical miles of the primary

vessel.

'Appropriate Insurer' means an insurer that is registered with the Australian Prudential Regulation Authority and has an S&P rating of no less than A-.

'aquatic devices' means motorised equipment used for the purposes of participating in activities being assisted snorkelling and assisted SCUBA diving, including, but not limited to: motorised swimming aids (e.g. seabobs, diver propulsion vehicles) and underwater ride-on scooters (e.g. scubabobs, hydrobobs).

'Bulk Fuel' means fuel that is carried in vessel cargo spaces or fuel that is carried in container(s) with a capacity greater than 3000 Litres; and does not include the vessel's primary fuel tank.

'Cairns Area' for:(a) the Great Barrier Reef Marine Park has the same meaning as

the 'Planning Area' defined in the Cairns Area Plan of Management; and

(b) the Great Barrier Reef Coast Marine Park means those areas enclosed within the outer boundaries of the aforementioned 'Planning Area' and those intertidal areas of the Great Barrier Reef Coast Marine Park contiguous with the 'Planning Area'.

'Cairns/Cooktown Management Area of the Amalgamated Great Barrier Section' is that part of the Amalgamated Great Barrier Reef Section that lies:South of a line commencing at 14° 18.181' South, 144° 39.064' East,

then running south-westerly along the geodesic to its intersection with the mainland coastline at 14° 39.909' South, 144° 56.564' East; and

North of a line commencing at 17° 40.409' South 147° 17.013' East then running progressively:

1. south-westerly along the geodesic to 17° 52.809' South 146° 30.064' East

2. west along the parallel to its intersection with the mainland coastline at 17° 52.810' South 146° 06.269' East.

'Cairns/Cooktown Seasonal Gamefishing Area' is described at Attachment B.

'camper transport operation (Cairns)' means an operation whose sole purpose is to transport a passenger/s to and/or from an island in accordance with a camping permit issued to the passenger/s by the Managing Agency.

'Far Northern Management Area of the Amalgamated Great Barrier Reef Section' is that part of the Amalgamated Great Barrier Reef Section that lies north of a line commencing at 14° 18.181' South, 144° 39.064' East, then running south-westerly along the geodesic to its intersection with the mainland coastline at 14° 39.909' South, 144° 56.564' East.

'fish feeding' means the deliberate attraction of fish (other than sharks) to allow them to be viewed.

'harm' means any adverse effect, direct or indirect, to which the person’s use or entry has contributed, to any extent (whether or not other matters have contributed to the harm).

'hazardous substances' has the same meaning as in the International Maritime Dangerous Goods Code.

'Hinchinbrook Area' for:(a) the Great Barrier Reef Marine Park has the same meaning as

the 'Planning Area' defined in the Hinchinbrook Plan of Management; and

(b) the Great Barrier Reef Coast Marine Park means the Family Islands Segment and the Hinchinbrook Segment, described in Marine Parks (Great Barrier Reef Coast) Zoning Plan 2004 (Qld).

'intertidal area' means that area of the Great Barrier Reef Coast Marine Park between mean low water and the landward boundaries of the Great Barrier Reef Coast Marine Park.

'in the vicinity of' means:(a)   for a specified bay, island or mainland, those waters and land

between the high water mark on the coastline and a line every point of which is a distance of 1 kilometre seaward from that high water mark; or

(b)   for a specified reef, those waters and land enclosed by a line every point of which is a distance of 1 kilometre seaward from the reef edge of that reef; or

(c)   in relation to rivers, streams and inlets that part of those rivers, streams and inlets that are in the Great Barrier Reef Coast Marine Park.

'Intertidal Areas Notification Approval' is a written approval from the Managing Agency that lists additional intertidal areas that may be accessed under this permit.

'island' includes islands, islets, cays, rocks and sandbanks.

'limited quantities' has the same meaning as in the International Maritime Dangerous Goods Code.

'Localities (Fitzroy Marine Management Area)'The Fitzroy Marine Management Area is subdivided into four (4) localities by the following lines:Boundary of Localities 1 and 2 — a straight line north west/south east through the points 16.922323° South, 145.98735° East and 16.92478314° South,145.99013460° East.Boundary of Localities 2 and 3 — a straight line south from the 500m coastal line to Mean High Water Springs tide line (MHWS) on Little Fitzroy island at about 16.9215166° South, 146.0074° East then following the MHWS line to a point at about 16.9233° South, 146.0065° East, then south westerly to a point on Fitzroy Island at MHWS at about 16.92425° South, 146.0058666° East.Boundary of Localities 3 and 4 — a straight line east/west through the points 16.93749371° South, 145.98265191° East and 16.9374931° South, 145.97799886° East.Boundary of Localities 4 and 1— a straight line north west/south east through the points 16.93064569° South, 145.98046909° East and 16.93381900° South, 145.98376578° East.

'Location (Hinchinbrook)' for:(a) the Great Barrier Reef Marine Park has the same meaning as

'Location' defined in the Hinchinbrook Plan of Management; and(b) the Great Barrier Reef Coast Marine Park means:

(i) those areas enclosed within the outer boundaries of the aforementioned ‘Location’ and those intertidal areas of the Great Barrier Reef Coast Marine Park contiguous with the ‘Location’; and

(ii) the areas identified as The Haven/Scraggy Point Location, Hecate Point Location, Oyster Point Location, Cardwell Location, Dungeness Location, Eastern Hinchinbrook Channel Location, Western Hinchinbrook Channel Location and Missionary Bay Transit Lanes.

'Mackay/Capricorn Management Area of the Amalgamated Great Barrier Reef Section' is that part of the Amalgamated Great Barrier Reef Section that lies: South of a line commencing at 19° 39.545' South, 150° 35.061' East

then running progressively:1. south-westerly along the geodesic to 20° 09.907' South

150° 20.061' East2. southerly along the geodesic to 20° 29.907' South

150° 30.062' East3. south-westerly along the geodesic to 20° 40.907' South

150° 10.063' East4. north-westerly along the geodesic to 20° 33.908' South

149° 07.063' East5. south-westerly along the geodesic to 20° 39.727' South

148° 45.813' East

6. west along the parallel to its intersection with the mainland coastline at 20° 39.727' South 148° 43.056' East.

'Managing Agency':(a) in relation to the Great Barrier Reef Marine Park, means the

Great Barrier Reef Marine Park Authority, a member of the staff of that Authority or a person referred to in Section 48A of the Great Barrier Reef Marine Park Act 1975 (Cth) performing functions or exercising powers under that Act in accordance with an agreement referred to in that section; and

(b) in relation to the Great Barrier Reef Coast Marine Park, means the Chief Executive of the Department of National Parks, Sport and Racing, his/her Delegate, an officer of the Queensland Parks and Wildlife Service, or a person referred to in section 52 of the Marine Parks Act 2004 (Qld), appointed as an inspector.

‘manner similar to a motorised water sport’ means irregular driving otherwise than in a straight line (except for necessary turns or diversions), including:(a) driving in a circle or other pattern; or(b) weaving or diverting; or(c)  surfing down, or jumping over or across, any wave, swell or

wash.

'Marine Parks' means:(a) the Great Barrier Reef Marine Park established by the Great

Barrier Reef Marine Park Act 1975 (Cth); and(b) the Great Barrier Reef Coast Marine Park established pursuant

to the Marine Parks Act 2004 (Qld).

'Marine Parks regulations' means:(a) in relation to the Great Barrier Reef Marine Park, the Great

Barrier Reef Marine Park Regulations 2019 (Cth); and(b) in relation to the Great Barrier Reef Coast Marine Park, the

Marine Parks Regulation 2017 (Qld).

‘marine product' includes:(d) any naturally-occurring material making up the sea-bed within

the Marine Park (for example, coral, limestone, shell-grit, or star sand); and

(e) Seawater.

'motorised water sports' means any of the following activities:(a) irregular driving of a motorised vessel - that is, driving a

motorised vessel other than in a straight line (except for necessary turns or diversions), including:(i) driving in a circle or other pattern; and(ii) weaving or diverting; and(iii) surfing down, or jumping over or across, any wave, swell or

wash;(b) an activity in which a high-speed vessel or motorised vessel

tows a person on top of the water or in the air (for example, waterskiing or parasailing);

(c) an activity in which a personal watercraft is used, except:(i) for transport by taking the most reasonable route (and

driving in a regular manner between 2 places; or(ii) if that personal watercraft can only be operated when fully

submerged under the water and for the primary purpose of viewing coral (excluding in the Hinchinbrook Area).

'non-motorised water sports' means activities requiring non-motorised craft (e.g. paddleboats, waterbikes, windsurfers) which are not for separate hire.

'passenger transport' means the transport of persons who are tourists into, out of or within the Marine Park, in order that those persons may engage in tourism activities in the Marine Park.

'passenger transport operation (Hinchinbrook)' means an operation comprising activities:(a) in which passengers are transported between Locations or

between a Location and a place outside the Planning area; and(b) using the most direct reasonable route, and if practicable the

transit lanes; and(c) on route the vessel does not stop except:

(i) to pick up passengers; or(ii) for passengers to disembark at their destination; or (iii) in the case of an emergency; and

(d) permitted under a relevant permission; and(e) all carried out using one particular vessel.

'passenger transport operation (Whitsundays)' means an operation comprising activities:(a) in which passengers are transported between a location and a

place outside the Whitsundays Area; and(b) limited to setting 1 areas, except when transiting the

Whitsundays Area; and(c) permitted under a relevant permission; and(d) all carried out using one particular vessel or aircraft.

'permit' means the permissions the subject of Permit Number PERMITNO granted to the Permit Holder pursuant to the Great Barrier Reef Marine Park Regulations 2019 (Cth) and the Marine Parks Regulation 2017 (Qld).

‘personal watercraft’ has the same meaning as in the National Standard for Commercial Vessels.

'pest' means any animal, plant, parasite or disease causing organism (such as bacteria, virus or fungus) capable of causing adverse impacts to environmental, economic or social values whether or not it is:(a) contributing to a Listed Key Threatening Process under the

Environment Protection and Biodiversity Conservation Act 1999 (Cth); or

(b) prohibited or restricted under the Biosecurity Act 2014 (Qld).

'reasonable steps' - In determining whether reasonable steps have been taken, regard shall be given to the following:(a) the nature of the harm to the environment that might or will result

from the person’s use or entry;(b) the risk of harm from the person’s use or entry;(c) the sensitivity of the environment that might or will be affected by

the person’s use or entry;(d) if the person is using or entering a zone - any objectives

specified for the zone in its zoning plan;(e) the practicalities, including cost, of steps that will prevent or

minimise the harm;(f) whether or not the person’s use or entry complies with the laws

applying in the Marine Parks in relation to the environment or natural resources;

(g) whether or not the person’s use or entry complies with any relevant code of practice, standard or guideline; and

(h) whether or not the person’s use or entry is in accordance with any conditions of a permission granted under the regulations for the purposes of a zoning plan or a provision of the Great Barrier Reef Marine Park Act 1975 (Cth) or the Marine Parks Act 2004 (Qld).

'Sensitive Location (Hinchinbrook)' for:(a) the Great Barrier Reef Marine Park has the same meaning as

'Sensitive Location' defined in the Hinchinbrook Plan of Management; and

(b) the Great Barrier Reef Coast Marine Park means:(i) those areas enclosed within the outer boundaries of the

aforementioned 'Sensitive Location' and those intertidal areas of the Great Barrier Reef Coast Marine Park contiguous with the 'Sensitive Location'; and

(ii) the areas identified as The Haven/Scraggy Point Location, Eastern Hinchinbrook Channel Location and Western Hinchinbrook Channel Location.

‘SCUBA diving’ includes introductory and certified SCUBA diving activities and may include the use of aquatic devices in accordance with the permit conditions.

‘snorkelling’ includes snorkelling with aquatic devices in accordance with the permit conditions or without motorised diving aids.

'taking an animal, plant or marine product' includes:(a) removing, gathering, catching, capturing, killing, destroying,

dredging for, raising, carrying away, bringing ashore, interfering with and obtaining (by any other means) the animal, plant or marine product; and

(b) attempting to do anything mentioned in paragraph (a).

'Tongue Point' means the named peninsula on Whitsunday Island commencing north-east of the intersecting vectors of latitude 20˚ 16'S and longitude 149˚ 01'E.

'Townsville/Whitsunday Management Area of the Amalgamated Great Barrier Reef Section' is that part of the Amalgamated Great Barrier Reef Section that lies:South of a line commencing at 17° 40.409' South 147° 17.013' East

then running progressively:1. south-westerly along the geodesic to 17° 52.809' South

146° 30.064' East 2. west along the parallel to its intersection with the mainland

coastline at 17° 52.810' South 146° 06.269' East; andNorth of a line commencing at 19° 39.545' South, 150° 35.061' East

'transiting' means in transit, by the most direct reasonable route, to a place outside the area concerned.

'visit' in relation to a vessel (including the use of an ancillary vessel) means accessing a permitted location, without departure, for a period not exceeding 24 hours.

'waters adjacent to' means in relation to a reef, the waters enclosed by 'the 500 metre line' and in relation to an island or the mainland, the waters enclosed by 'the coastal 500 metre line' (as defined by the zoning plan or Marine Park regulation that applies to those waters).

‘whale watching activity’ means an activity (other than a swimming-with-whales activity) conducted for the purpose of enabling tourists to observe cetaceans, including using a vessel or aircraft to find cetaceans for that purpose.

'Whitsundays Area' for:(a) the Great Barrier Reef Marine Park has the same meaning as

the 'Planning Area' defined in the Whitsundays Plan of Management; and

(b) the Great Barrier Reef Coast Marine Park means those areas enclosed within the outer boundaries of the aforementioned 'Planning Area' and those intertidal areas of the Great Barrier Reef Coast Marine Park contiguous with the outer boundaries of the 'Planning Area'.

'Zoning Plan' means:(f) in relation to the Great Barrier Reef Marine Park, the Great

Barrier Reef Marine Park Zoning Plan 2003 (Cth); and(g) in relation to the Great Barrier Reef Coast Marine Park, the

Marine Parks (Great Barrier Reef Coast) Zoning Plan 2004 (Qld).
