EXECUTIVE SUMMARY One of the components of the Participatory Small-Scale Water Resources Project (the Project) is to construct water management infrastructure. The Project objectives will be achieved through the participation of stakeholders in identification, implementation, improvement and management of water management related infrastructures. The Project infrastructure is diversified, including: re-excavation and improvement of khal (channels, or rivulets); construction of levees on the bank of khal; construction and supplementary irrigation in monsoon/dry season. In addition, suitable hydraulic structures will be constructed The main objective of the Project is to enhance agricultural production, poverty reduction and economic growth in subproject areas. Project objectives will be achieved through the participation of stakeholders in identification, implementation, improvement and subsequent operation and maintenance of small scale water resources management systems. The Resettlement Plan (RP) for Goshinga-Shitalakhhaya Command Area Development subproject is indicative, given that detailed design has not been prepared during the project preparation. As part of the Detailed Measurement Survey (DMS), a census/socioeconomic survey (SES) will be undertaken upon completion of the subproject’s detailed design (DD) to identify all affected persons (APs), their socioeconomic status, and the extent to which they will be affected, including an assessment of their residual properties/assets in the locality. Based on the DMS, a finalized RP will then be prepared. The Goshinga subproject area lies in Goshinga Union of Sreepur Upazila in Gazipur District. The subproject is bounded on the:

o North by high land along the bank of Janer Khal o West by the earthen road from Hayat Khar Chala to a crossing with Goshinga-

Sreepur Road and further to crossing the Janer Khal o South by earthen road from Hayat Khar Chala to Goshinga and Narayanpur Khal

crossing and on the o East by the Banar/Sitalakhya River

The subproject site is about 7 km from Sreepur Upazila headquarters and is served by a bitumen road. The subproject has a gross area of 1,025 ha and net area of 588 ha which has been adopted for design of the water management system. There are three mauzas – Nij Khozekhani, Karnapur and Goshinga and five villages – (1) Nij Khozekhani, (2) Karnapur, (3) Goshinga, (4) Matiagara and (5) Khilpara. The Banar River originates from the Old Brahmaputra river at Toke in Gaffargaon Upazila of Mymensingh District. It flows for about 37 km in Gazipur District and takes a southward course along the border between Gazipur and Narsingdi Districts in the name of Sitalakhya (Lakhya) to meet the Dhaleswari River south of Narayanganj. This in turn discharges into the Meghna River near Munshiganj. The Banar/Lakhya is a perennial river, reasonably navigable during dry months and is mildly tidal at the location of the subproject. Land levels in the subproject vary between 6.22 m PWD to 13.04 m PWD, including the forest area. There is no major flooding in the subproject area. The mean annual flood level is 7.43 m PWD, so there is no extensive area of seasonally flooded land. However, shortage of water in the dry season is the main reason for low crop production, which is mainly boro paddy.

Some 11,144 people live in 2,143 households in the subproject area. The average number of people per household in the subproject area is 5.2. The subproject benefits will primarily accrue to three villages: (1) Goshinga; (2) Khojekhani; and (3) Kornapur, inhabited by 2,143 households of which 1,534 (72%) are considered to be beneficiaries of the subproject. The gross subproject area is 1,025 ha and the subproject will benefit 588 ha by providing piped irrigation. The subproject supports the overall objectives of the Project by developing an appropriate irrigation water distribution system in the command area of the proposed subproject to provide irrigation to HYV Boro rice in the winter-summer season and to facilitate supplemental irrigation to T Aman crop during periods of drought. The command area development (CAD) will include buried pipe water distribution and an irrigation system comprising precast reinforced concrete (RC) pipes of different diameters. Low lift pumps will lift water from Banar River to fill a header tank from where water will be distributed through the buried pipe lines which will have outlets fitted with butterfly valves at specific locations to supply water to the crop fields. The Banar River is a large river with relatively high flows even during dry season. The water drawn from the river will be relatively small and will have no impact on downstream water users. The subproject will comprise the following:

o Earthwork for laying a pipe line network o Construction of about 13 km of buried pipe lines using reinforced concrete (RC) pipe

with diameters from 900 mm to 300 mm, including a necessary number of alfa alfa valves, risers, and air vents and

o Header tank (6.0 m x 3.0 m) The subproject will not require any land acquisition, but it will require land on temporary basis for laying the pipe network. The construction of the 13 km pipe line network will directly affect 65 affected households (AHH) (338 persons). Five AHHs will be dislocated from a portion of their homesteads, 15 AHHs will also have to move commercial and business enterprises (CBEs), usually located within their residences, and 43 AHHs will lose 675 trees. No AHH will lose agriculture land, but they will be unable to cultivate on temporarily affected land for a short period of time, expected to be less than one season. This is, however, a feasibility stage assessment – the detailed design will aim to minimize any resettlement impacts which can be achieved through reviewing pipe alignment. In line with the Project’s entitlement matrix-as provided in the Project’s resettlement framework (RF), those affected persons (AP) who have to rebuild their homes will be awarded the following:

o Cash Compensation under Law (CCL) at market value plus 50% premium as per Law for their home

o Additional grant to cover market value of the structure o Transfer grant (TG) @ 12.5% of the value of non-masonry (kutcha) and semi-pucca

and 5% for masonry (pucca) structure assessed by PVAT o Owner will be allowed to take all salvageable materials (free of cost) without delaying

the project work o Re-construction grant (CG) @ 12.5% of the value of all structures assessed by the

PVAT for titled owners o Special assistance for Female Headed/Vulnerable Households @ Tk 2,000, Tk

3,000 and Tk 5,000 for kutcha, semi-pucca and pucca structure

o Land/Homestead Development Grant assessed by PVAT o Special Assistance of Tk 5,000 for Vulnerable Households having disabled member

in the family Commercial business enterprises (CBEs) will receive compensation for lost income and re-establishment, and tree owners will be given market-price compensation, as detailed in the subproject RP budget. As the subproject has a very insignificant impact on the property or livelihood of the AHHs, some 93% of households of the area consider that the subproject will benefit them and no major adverse effect was reported in surveys or in focus group discussions. The APs will also benefit as farmers will produce additional crop with cost efficient irrigation, the operation of pump, irrigation channel and service charge collection will become regular activities during the boro and aman seasons. The potential for carrying out other non-farm activities such as micro-credit, gender-related programs and other social activities are also present. Women in the community in general also expressed a favorable opinion regarding the benefit of the subproject. It seems people are aware of modern agricultural practices but lack proper irrigation as well as community management and this creates a barrier towards the agricultural practices. The Water Management Cooperative Association (WMCA) and the subproject structure will bridge this gap and there good prospects for regeneration of local economic and social activities through the subproject and the WMCA. In addition to the above directly affected APs, about 500 HHs along the pipe line right of way (RoW) for some 7.42 km will be unable to use a narrow strip of their cultivated agriculture land for one season, as excavated spoils will be temporarily stored on this land. These APs will receive crop compensation at market value by the Contractors, as specified in their contracts under damage and management costs; and payment will be monitored through the Environmental Management Plan (EMP). There will not be any negative impacts on common property resources (CPRs) such as mosques, schools, or Union Parishad offices. The subproject’s policy is to minimize adverse resettlement impacts and reduce the number of affected persons (APs) by continuously reviewing the design to minimize land acquisition and resettlement requirements. All possible means have been explored to minimize or avoid resettlement and land acquisition impacts by modifying the engineering design. This has been carried out in close consultation with those affected. Works will commence following compensation payments and other assistance has been made available to those affected. As the subproject will have insignificant resettlement effects and the scope for resettlement will not be large, establishment of a resettlement unit to take care of resettlement issues independently will not be necessary. Integrated Water Resources Management Unit (IWRMU), with the support of the project implementation consultants (PIC), will prepare RPs during the preparation stage of candidate subprojects. LGED will appoint a Chief Resettlement Officer (CRO) within the IWRMU Social and Gender Development Section who with the Safeguards Officer of the Environment and Safeguards Section will manage RP implementation and monitoring. Social preparation is an essential part of the planning and implementation of the resettlement process. The Local Government Engineering Department (LGED) and Upazila officers, in

conjunction with the water management cooperative association (WMCA)/Union Parishad (UP) representative will inform APs of the subproject impacts, and their entitlements and rehabilitation options under the RP. Copies of the draft RP will be distributed amongst the WMCA including APs. A grievance redress committee (GRC) will be formed at the Union level. The Ministry of Local Government, Rural Development and Cooperatives (MoLGRDC) will notify authorizing LGED District Engineer to form GRC at the Union Level. LGED’s community organizer (CO), who will be the Resettlement Coordinator (RC) at the Upazila Engineer’s Office will chair the GRC. Members will include AP representatives including women, and representatives of the WMCA and UP. Other than disputes relating to ownership rights under the court of law, the GRC will review grievances involving all resettlement benefits, relocation, and other assistance. Any grievances submitted to the GRC will be resolved within 2–3 weeks. Internal monitoring will be carried out by IWRMU’s Environment and Safeguards Section with support from the CRO, field staff at LGED district and upazila offices and the PIC Resettlement Specialist will establish a monthly monitoring system and prepare a Monthly Progress Report on all aspects of RP implementation. LGED will also report to ADB on land acquisition and resettlement and social development in the quarterly progress report. The entire amount for resettlement and rehabilitation and training for this subproject is estimated to be Tk 3,553,495. This subproject does not have any budget for land acquisition as all the land is required for a short period of time The estimated resettlement cost of the subproject will be finalized design has been finalized.

Replacement Cost The cost of replacing lost assets and incomes, including cost of transactions.

Resettlement Effects All negative situations directly caused by a project, including loss of land,

property, income generation opportunity, and cultural assets. Resettlement Framework (RF) Adopted at the time of the Loan Agreement, the RF lays out the policy,

principles, procedures and entitlements, as well as the institutional responsibilities to be followed in preparing subproject RPs under the Loan. The RF is Supplementary Appendix K: Resettlement Framework for Riverbank Protection Works to the Project’s RRP of October 2002.2

Resettlement Plan (RP) A time-bound action plan with budget setting out resettlement strategy,

objectives, entitlements, actions, responsibilities, monitoring and evaluation.

Severely Affected Person (SAP) A person who will (i) lose more than 10% of total agriculture/aquaculture

land holding, and/or (ii) relocate, and/or (iii) lose more than 10% of total income sources due to a project.

Squatter A person who occupies a building or land without title or

permission. Union Parishad The Union Parishad is one of the lowest administrative units in

Bangladesh, part of a four- tier local government, namely Gram (Village) Parishad, Union Parishad, Upazila (Subdistrict) Parishad and Zila (District) Parishad.

Uthulies Long Term Squatters. Also called Informal Settlers, i.e., HHs on others’

land with permission. Vulnerable Households For this Project, vulnerable groups are defined as APs who suffer more -

economically and socially - from relocation than other affected population. Based on past experiences from similar Projects, the vulnerable groups include (i) women-headed HHs; (ii) landless HHs (those without agricultural land, and depend largely on day labor for survival); (iii) disabled HHs heads (iv) HHs having residual agricultural land less than 1 acre or losing more than 10% of their income from agriculture due to acquisition; and (v) Those APs who have gone below the poverty line due to the subproject.3

A. Project Background and Description

a. The Project

1. The Small Scale Water Resouces Project (the Project) intends to increase agricultural production while reducing poverty in subproject areas through sustainable stakeholder-driven, small-scale water resources (SSWR) management systems; and to internalize and institutionalize participatory processes through strengthening of LGED's Integrated Water Resource Management Unit (IWRMU)4 to plan, implement, monitor and support sustainable SSWR development. LGED is the Project’s Executing Agency (EA). 2. The Project objectives will be achieved through the participation of stakeholders in identification, implementation, improvement and management of water management related infrastructures. The Project infrastructure is diversified, including: re-excavation and improvement of khal (channels or rivulets); construction of levees on the bank of khal; construction and supplementary irrigation in monsoon/dry season. 3. The RP for the Goshinga-Shitalakhhaya Command Area Development subproject is indicative, given that detailed design has not been prepared during the project preparation. The current document has been prepared taking into account the findings of sample survey data, field visits, and meetings with different levels of stakeholders, and focus group discussions (FGDs). The RP identifies:

o Extent of losses o Policies and legal framework followed o Provision for compensation and income restoration programs o Provision for assisting vulnerable and any indirectly affected APs to re-establish their

incomes o Responsibilities of Chief Resettlement Officer (CRO), Resettlement Coordinator

(RC), Community Organizer (CO) and others having a key role in delivering and monitoring the RP implementation measures

Property Ordinance, 1982), the draft National Policy on Resettlement and Rehabilitation (NPRR), 2007 and ADB’s Involuntary Resettlement Policy (1995). The RF will apply to all subprojects to be prepared under the Project. It will ensure that all APs – titled and non-titled – will be eligible for appropriate compensation packages under the Project. The RP will refer to the RF for procedures to be followed. 5. The ADB’s OM Section F2/BP (29 October 2003) paras 26 and 27, specifies that a full resettlement plan will include a statement of involuntary resettlement objectives and strategy, with (i) organizational responsibilities; (ii) community participation and disclosure arrangements; (iii) findings of the socioeconomic survey and social and gender analysis; (iv) legal framework, including eligibility criteria and an entitlement matrix; (v) mechanisms for resolution of conflicts and appeals procedures; (vi) identification of alternative sites and selection; (vii) inventory, valuation of, and compensation for, lost assets; (viii) landownership, tenure, acquisition, and transfer; (ix) access to training, employment, and credit; (x) shelter, infrastructure, and social services; (xi) environmental protection and management; (xii) monitoring and evaluation; (xiii) a detailed cost estimate with budget provisions; and (xiv) an implementation schedule, showing how activities will be scheduled with time-bound actions in coordination with the civil works.

6. Note that if subproject impacts are significant, i.e., the number of people physically displaced or losing 10% or more of their income producing assets is two hundred or more, a full RP is required by ADB policy, in which case the subproject will be rejected. If the impact is insignificant, less than two hundred persons, a short RP will be sufficient to meet ADB policy requirements. If no involuntary resettlement effects are foreseen, no RP will be prepared. As the subprojects will have only short resettlement plans, they will cover the same issues as that of a full resettlement plan, as relevant, but in less detail (OMS F2/BP, para 27). They will also ensure that adequate compensation, rehabilitation, and relocation arrangements are planned and budgeted based on updated information from the DMS.

3. Area and Location

8. The Goshinga subproject is located between Latitudes 24°09’ N and 24°12’ N and Longitudes 90°30’50” E and 90°33’30” E. The subproject area lies in Goshinga Union of Sreepur Upazila in Gazipur District. The subproject is bounded on the:

o North by high land along the bank of Janer Khal o West by the earthen road from Hayat Khar Chala to a crossing with Goshinga-

Sreepur Road and further to crossing the Janer Khal o South by earthen road from Hayat Khar Chala to Goshinga and Narayanpur Khal

crossing and on the o East by the Banar/Sitalakhya River

9. The subproject site is about 7 km from Sreepur Upazila headquarters and is served by a bitumen road. The subproject has a gross area of 1,025 ha and net area of 588 ha which has been adopted for design of the water management system. There are three mauzas – Nij Khozekhani, Karnapur and Goshinga and five villages – (1) Nij Khozekhani, (2) Karnapur, (3) Goshinga, (4) Matiagara and (5) Khilpara. 10. The Banar River originates from the Old Brahmaputra River at Toke in Gaffargaon Upazila of Mymensingh District. It flows for about 37 km in Gazipur District and takes a southward course along the border between Gazipur and Narsingdi Districts in the name of Sitalakhya (Lakhya) to meet the Dhaleswari River south of Narayanganj. This in turn discharges into the Meghna River near Munshiganj. The Banar/Lakhya is a perennial river, reasonably navigable during dry months and is mildly tidal at the location of the subproject. 11. Land levels in the subproject vary between 6.22 m PWD to 13.04 m PWD, including the forest area.5 There is no major flooding in the subproject area. The mean annual flood level is 7.43 m PWD, so there is no extensive area of seasonally flooded land. However, shortage of water in the dry season is the main reason for low crop production, which is mainly boro paddy.6 12. Some 11,144 people live in 2,143 households in the subproject area. The average number of people per household in the subproject area is 5.2. The subproject benefits will primarily accrue to three villages: (1) Goshinga; (2) Khojekhani; and (3) Kornapur, inhabited by 2,143 households of which 1,534 (72%) are considered to be beneficiaries of the subproject. The gross subproject area is 1,025 ha and the subproject will benefit 588 ha by providing piped irrigation. Average land ownership in the subproject area is below 0.66 ha. The sample household survey conducted during Project preparation estimated the distribution of households according to landownership as shown in Table 1 below.

The land ownership pattern shows that landless, marginal and small farm households comprise 90% of the total farm households in the subproject area. As far as the poverty incidence, 50% of households live below the poverty line shown in the income and expenditure data of the household survey. The farmers are severely constrained in increasing crop production due to the lack of irrigation in a sustainable and cost effective way. The subproject will bring a tremendous benefit to farmers and is expected to contribute to an increase in farm income as well as wage incomes for the farm laborers. 14. About 76% of HHs are entirely dependent on agriculture, 13% on farming plus non-farming income and 11% fully dependent on non-farming income. Non-cultivated high land, mainly forest, occupies some 42% of the subproject area. Agricultural land occupies 58%, with only a very small portion of non-cultivated land found within the subproject area. Sixty-eight percent of the farmland is operated by landless, sharecropping, marginal and small owners. About 2% are involved in subsistence fishing and earn some money out of it, mainly during monsoon season. Less than 4% of the land is owned by persons living outside the subproject area. 15. It is expected that implementation of the subproject will generate additional short-and long-term employment as well as agriculture production which will have a multi-dimensional effect on the socioeconomic development of the area. Specifically, implementation of the subproject will:

o Improve irrigation facilities; o Increase production of boro and aman7 paddy; o Improve the post Monsoon farming conditions; and o Improve food security.

16. The prospect for WMCA also seems bright. As the farmers will benefit by producing additional crop with cost efficient irrigation, the operation of pump, irrigation channel and service charge collection will have to become a regular activity during the boro and aman seasons. The potential for carrying out other non-farm activities such as micro-credit, gender-related programs and other social activities are also present. 17. The household survey revealed that 93% of households of the area consider that the subproject will benefit them. No major adverse effect is reported in the survey or in the focus group discussions. Women in the community in general also expressed a favorable opinion regarding the benefit of the subproject. It seems people are aware of modern agricultural practices but lack proper irrigation as well as community management and this creates a barrier towards the agricultural practices. and there good prospects for regeneration of local economic and social activities through the subproject and the WMCA.

4. Scope of Land Acquisition and Displacement

a. Work Proposed at the Subproject Site

18. Mainly because of the large amount of land remaining fallow during the dry season for want of irrigation, local people have requested the development of a comprehensive irrigation system in the command area of the proposed subproject and have expressed strong willingness to support and participate comprehensively in the community based irrigation subproject that will cover a larger area to grow irrigated HYV Boro rice.

b. Subproject Objectives

19. The subproject supports the overall objectives of the Project by developing an appropriate irrigation water distribution system in the command area of the proposed subproject to provide irrigation to HYV Boro rice in the winter-summer season and to facilitate supplemental irrigation to T Aman crop during periods of drought.

c. Construction Activities

20. In support of beneficiary requests project objectives, a command area development (CAD) subproject with buried pipe water distribution and irrigation system comprising precast reinforced concrete (RC) pipes of different diameters8 is proposed. Low lift pumps will lift water from Banar River to fill a header tank from where water will be distributed through the buried pipe lines which will have outlets fitted with butterfly valves at specific locations to supply water to the crop fields. The Banar River is a large river with relatively high flows even during dry season. The water drawn from the river will be relatively small and will have no impact on downstream water users. The subproject layout is shown in Figure 3 below.

21. According to the feasibility level design, the proposed subproject will comprise the following:

o Earthwork for laying a pipe line network o Construction of about 13 km of buried pipe lines using reinforced concrete (RCC)

pipe with diameters from 900 mm to 300 mm, including a necessary number of alfa alfa valves, risers, and air vents9 and

o Header tank (6.0 m x 3.0 m) 22. The subproject will not require any land acquisition, but it will require land on temporary basis for laying the pipe network. The APs will be, for purposes of this RP, referred to as Affected Households (AHHs). The construction of the 13 km pipe line network will directly affect 65 households, (AHH) or 338 persons. Five AHHs will be dislocated from a portion of their homesteads, 15 AHHs will also have to move commercial and business enterprises (CBEs), usually located within their residences, and 43 AHHs will lose 675 trees. No affected HH will lose agriculture land, but they will be unable to cultivate on temporarily affected land for a short period of time, expected to be less than one season. 23. The survey identified about 10% of affected HHs headed by a female. During the DMS special attention will be given verifying female-headed HHs, who classed as vulnerable. 24. About 500 affected persons (APs) along the pipe line right of way (RoW) for some 7.42 km will be unable to use a narrow strip of their cultivated agriculture land for one season, as soil excavated during the placement of the pipes and will be stored on their land. These APs along the pipe line RoW may receive compensation for loss of crops due to the excavation and storage of soil on their land, depending on the duration (and if it does affect production for one season). While the RP budget includes indicative costs for crop compensation, this cost will be borne by Contractors, and this requirement will be included in their contracts under damage and management costs. Payment will be monitored through the Environmental Management Plan (EMP). 25. All APs will be identified through the DMS by the third quarter10 of 2009. ADB's policy and best practice in Bangladesh, requires that the identified 88 displaced HHs be consulted through FGDs and a questionnaire survey for their resettlement and rehabilitation preferences. This was completed during project preparation in April 2008. This at present is a preliminary discussion but will be furthered during the DMS, which will finalize the subproject RP. Participatory Rapid Appraisal (PRA) and Stakeholders Discussions (SD) will be used during the DMS Census and SES.

B. Review and Analysis of Socioeconomic Survey Data

1. The Subproject Area

26. The subproject area is characterized by high undulating land prone to shortage of water in the dry season, within the Madhupur tract11 of Bangladesh’s central region. Farmers mainly depend on rain fed irrigation and face continuous water shortages during the dry season. This area is part of the Madhupur Tract’s reserve forest. Only few of the affected structures will need to be displaced totally but will only need to be shifted nearby on remaining homestead land.

2. Land Use and Settlement Pattern

27. At present part, of the subproject affected area is being used as agriculture or fallow land and a few structures are located on the RoW. It is a rural area whose primary economy is based on agriculture. The majority of the agriculture land is double-cropped and a smaller part is being used as a single cropped area. The current agriculture pattern is mixed. The major agricultural production is boro and aman paddy. Rabi crops are grown in some of the land having shallow pump irrigation.12 Crops are also damaged due to water shortages in winter. 28. The subproject area is a closed area characterized by the absence of any perennial beel or channel connecting seasonal lowlands with adjoining rivers. Thus, there is virtually no open water fishery. During the monsoon, relatively lowlands along the valley turn into pools which are inhabited by opportune migrants with monsoon overflows from Sitalakhya River. As there is no outlet monsoon rain water accumulations cannot be drained out. A seasonal khal, called Narayan Khal, becomes operational during heavy rain and connects the Bara Beel (part of which is included in the subproject) to the Sitalakhya River. 29. Lowlands in the valley area of the subproject and homestead ponds are mostly used for fish culture. According to a Department of Fisheries (DOF) report, there are 253 fish culture water bodies in the subproject area, about 126 of them are seasonal (400 m2 average size) and 127 ponds (800m2 average size) are perennial. Productivity of the seasonal ponds is 0.5t/ha and that of seasonal ones is 1t/ha. While there are many people involved in open water seasonal fishing, no fisherman was found during the survey negatively affected by the subproject. This will to be rechecked by the DMS.

3. Methodology and Data Collection

30. Consultants, including women staff, made a reconnaissance survey and carried out stakeholder meetings with farmers, when necessary in agriculture fields.13 Initially, all the potentially Affected People (APs) were listed and considered as household as a unit on the RoW. In this case, alignment for buried pipe installation is the RoW. The reconnaissance survey showed a very limited negative impact on the AHHs due to there being no land acquisition required. AHHs will experience a partial affect of some structures that need to be shifted on homesteads that straddle the RoW. Seventy percent of the AHHs were selected as the sample for a socioeconomic survey. The sample AHHs were interviewed through a structured questionnaire (Annex A). Table 2 shows the distribution of the total 65 AHHs by village.

Focus group discussions (FGDs) were also conducted in four villages along the RoW, including household premises, markets, Union Parishad offices and on roads where APs of all categories are available gathered in social groups. Such social groups tend to include persons of a wide variety of socioeconomic status, both genders, as well as occupational and professional groups as well the people both directly and indirectly affected. No indigenous population (IP) was encountered in the subproject area. 32. In addition to that the market value of land of different categories and locations and affected properties were assessed through collecting market values from different groups. This market price has been used to prepare the tentative budget of this subproject RP.

4. Socioeconomic Profile of APs

33. A socioeconomic profile based on interviewing 47 AHHs, some 73% of the total 65 affected households. The AHHs are going to encounter different kinds of losses. About 8% of AHHs are going to lose a part of their homestead, about 23% will lose CBEs, and some 66% of the AHHs will lose trees. None of these AHHs will need to be displaced totally but will temporarily have to shift their fully or partially affected residence onto remaining homestead land.

Total number of population to be affected due to losing different structures and trees is 338. Percentage of male population is 54% and female 46% (Table 4); and this predominance of males is replicated in all the three villages. More than one third of the population is below 19 years of age. About 11% of the population is above 60 years. Almost all of the adult population is married and all households are Muslim. About 15% of HHs are extended in nature and the rest are nuclear. Household size ranges from 2 persons to more than 12, with an average HH size of 5.2. This is slightly higher than the national average of 4.9. About 10% of the AHHs are headed by women.

35. Agriculture, business, and service are the primary occupations among the male members of the AHHs. Household work is the occupation of most adult females; only a small number of women mentioned that they are involved in agriculture. The young population, irrespective of sex are students attending school. About 92% of HH heads (HHHs) are literate; but the literacy rate seems to be much higher among total village populations. It is remarkable that the young generation of the AHs has almost 100% literacy rate; and the level of education completed is also high. It is much higher among the male population as compared to the females. Only two HH have handicapped or disabled family member.

Annual HH income ranges from Tk 30,000 to more than Tk. 305,000, with a concentration towards Tk 45,000 to 150,000. The estimated average annual income is Tk 130,000. It is remarkable that most of the active adult male HH members including the head have some kind of income; but most of the women mentioned that they do not have any income. However, women very intensively participate in post harvesting activities.

were identified among the APs. All affected agricultural lands are cultivated by owners; and all the potentially affected trees are located on the land owned by the APs. 38. This subproject has a very insignificant impact on the property or livelihood of the AHHs. Almost all impacts will be temporary due to disruption during construction and it is likely that there will be loss of cropping over two seasons. Other than the linear buried pipe, there are 65 outlets with air valves which will require a footprint of about 10m2. This would result in permanent loss to the land owner. 39. AHHs say they will get more benefit from the subproject compared to their losses. More than 83% of land owners will lose less than 10% of their existing cultivated agriculture land. About 2% of AHHs will lose more than 50% of their cultivable land. About 33% of affected CBEs are run by and owned by the residential structure owner they are located within, mostly by the owner, while the rest are rented. Most of the affected CBE infrastructures are katcha (non-masonry) having mud walls with a tin roof.14 Business losses will be compensated according to the Resettlement Framework and as evaluated by Property Value Assessment Team (PVAT).

All APs are cultivating their own land; but about 12% of HHs are using others’ land in addition to their own. About 56% of this land is khas (Government land) followed by land owned by a relative or land owned by line agencies and other Government entities. The subproject area is adjacent or partly within the Madhupur tract reserve forest area. None of the APs identify themselves as landless; but some of them are marginal farmers. According to the APs' response, all have residual land even after implementation of the subproject. Despite this, marginal farmers or small land holders may become vulnerable due to the subproject. Only a few agriculture laborers will be affected by the subproject, temporarily losing earning. Special attention will need to be given vulnerable households including those with a disabled family member. Household vulnerability will also be correlated to poverty levels which will be identified during the DMS. 41. The subproject area is very much covered with trees. This is more or less a common scenario in the Madhupur Tract. It is estimated that about 675 trees will be affected by the subproject. Just under half are large followed by 26% of small and 22% medium; the rest are very small saplings (charas). All tree losers will be compensated for timber as well as for fruit and will be allowed to take away the timber. They will also be encouraged to plant more trees through the provision of five saplings by the Project to each AHH.

42. Majority of APs are aware of the importance of sanitation and are capable of affording it. About one fifth of APs are aware but incapable of having good sanitation facilities. Table 9 shows that about 24% of households use pucca (masonry) construction, and 56% use a slab latrine, 17% use a katcha (non-masonry) latrine, and rest use only an open space as a latrine. On the other hand, all the AHHs use tube-well for drinking water. According to the local people, this area is free of arsenic contamination.

The number of indirectly affected people is almost negligible. Agricultural lands are mainly cultivated by the farmer with help of some hired labors at the time of requirement. Only a portion of the land is going to be used for a relatively short time, and these labors also work in other fields in the locality. It is anticipated that agricultural laborers will face temporary loss of employment. Only a few unskilled workers will lose employment from the affected CBEs, also only temporarily. All the CBEs are going to relocate within more or less the same homestead land or close by, so these workers will continue working. Temporary income loss will nevertheless be compensated based on DMS identification of agricultural and CBE laborers. 44. About 81% of the affected households have taken credit from different sources including Banks, NGOs and other local people. About 14% of them have taken loan from a bank, mostly the Krishi Bank. Women in the 49% of the AHHs are members of NGOs and have taken credit but the money is mainly operated by the male members, mostly for increasing agriculture input followed by small businesses. The rest are borrowed money from local money lenders and relatives.

Majority of the APs who participated in group discussions and stakeholders meetings have expressed their high expectation in terms of social and economic benefits from the subproject. Local administration and peoples' representatives such as the Chairmen and Members of the Union Parishads have also assured the Project authorities that they will extend all sorts of cooperation to implement the subproject. The potential APs also said that they expect that the subproject will help them to get enough irrigation facilities to serve them for their time of need. They also expect that fishing (open water and cultured) opportunities will be enhanced, which will eventually help in improving socioeconomic conditions of the affected villages.

46. In general, the community responded positively to the subproject. However, some concerns were raised and most of these related to proper and timely compensation payments for lost assets and income. The community concerns were over delays in compensation payment and harassment in receiving compensation payment from the Government. Concerns in this regard are listed as bellow:

o The APs may face, it was said in meetings, delays, harassment and even deprivation from getting rightful compensation. However, according to subproject Feasibility Study and the present survey, no land is to be and therefore, this is unlikely to be an issue;

o For security reasons and for convenience of the APs, payments will be made at camps set up locally in the vicinity of the areas affected.

o The Project should assist APs having not formalized their land ownership in the mutation of lands in the DC’s office to obtain their land ownership documents.

o People losing livelihood from the loss, even temporarily, of agriculture land as well as from CBEs are very much concerned and skeptical about their compensation, as they may not have legal documents establishing their right to the land even though they may have been using it for generations. The Project will provide, as explained in Section C below, compensation regardless of such documentation, through as necessary through Resettlement Framework mandated Project Grants, in addition to Cash Compensation under Law (CCL).

C. Objectives, Resettlement Policy Framework and Entitlements

1. GoB Laws and ADB's Policy Requirements 47. The Resettlement Framework (RF) provides guidelines for the formulation of subproject resettlement plans under the Project and is not a planning document. It is based on national land acquisition and requisition laws (specifically, Acquisition and Requisition of Immovable Property Ordinance, 1982), the draft National Policy on Resettlement and Rehabilitation (NPRR), 2007 and ADB’s Involuntary Resettlement Policy (1995). The RF will apply to all subprojects to be prepared under the Project. It will ensure that all APs – titled and non-titled – will be eligible for appropriate compensation packages under the Project.

2. Land Acquisition and Resettlement Principles

48. Land acquisition and resettlement of the APs, and providing special assistance to vulnerable and indirectly APs in re-establishing their livelihood and income will be conducted in accordance with the GoB’s Acquisition and Requisition of Immovable Properties Act of 1982 and the ADB's Policy on Involuntary Resettlement as well as by following ‘best practice’ followed in Bangladesh, viz: (i) avoiding involuntary resettlement where feasible, (ii) minimizing displacement by considering all alternatives where population displacement is unavoidable, and (iii) ensuring that displaced people receive assistance so that they would be at least as well off as they would have been in the absence of the project. The following are major elements of the policies/practices to be adopted by the Project:

(i) Involuntary resettlement and loss of livelihood will be avoided where feasible; (ii) Where population displacement is unavoidable, it will be minimized by exploring all

viable project options;

(iii) People unavoidably displaced will be compensated and assisted, so that their economic and social future will be generally as favorable as it would have been without the Project;

(iv) Vulnerable APs will be provided with resettlement facilities or support to resettle in proximity to their social groups and good communication network with employment opportunities;

(v) People affected will be informed fully and consulted on resettlement and compensation options;

(vi) Gender equity will be maintained in resettlement planning and implementation; (vii) Existing social and cultural institutions of resettlers and their hosts will be

supported and used to the greatest extent possible, and resettlers will be integrated economically and socially into host communities;

(viii) The absence of a formal title to land by some effected groups will not be a bar for compensation, particular attention should be paid to households headed by women and other vulnerable groups, such as indigenous people and ethnic minorities, elderly and disable persons and appropriate assistance provided to help them improve their status;

(ix) As far as possible involuntary resettlement will be conceived and executed as part of the project;

(x) People who will be affected indirectly will be facilitated to regain their livelihood and socio-economic status;

(xi) Participation of the local community will be ensured through incorporating them in different committees involved in planning through implementation process of RP;

(xii) The full cost of resettlement will be included in the presentation of Project costs and benefits.

3. Compensation Framework

49. The Compensation Framework contains the following packages, which are designed to cover compensation for lost assets and restore or enhance the livelihoods of all categories of the APs (Table 10).

50. The subproject resettlement activities will be carried out in consultation with the APs, and all efforts will be made to minimize disruption during the Project implementation. A Detailed Measurement Survey (DMS), including a full census will be conducted once the Detail Design has been approved. The date of the census will be the cut-off date for resettlement benefits; and any encroachers/informal settlers after that date will not be entitled to resettlement benefits. For land title-holders, notification under Section 3 by the DC under the LAA will constitute the cut-off date.

4. Entitlement Matrix

51. An entitlement matrix has been prepared on the basis of currently known impacts (Table 11). It identifies the categories of impact based on surveys carried out in the subproject area and shows the entitlements for each type of loss. The entitlement matrix will also incorporate potential impacts which will be confirmed by the DMS (census and SES) after finalization and approval of the DD. If new impacts are identified later during preparation of final RP, based on the DMS, then such losses will be included in the Entitlement Matrix and the final RP will be revised accordingly.

1. Consultation and Stakeholders' Participation

52. Consultation and communication with APs and other stakeholders during the preparation stage of the subprojects will be an integral part of gathering relevant data for impact assessment, and facilities and development of appropriate options for resettlement of APs. The resettlement framework will be disclosed to the affected community in Bangla in FGDs to obtain the views of APs and other stakeholders on the compensation and resettlement provisions as per Government laws and ADB guidelines. As appropriate, the contribution of APs and beneficiary groups will be included in the subproject RPs.

The Government and ADB will provide the funds for land acquisition and resettlement, with ADB funding cash grants outside compensation under law (COB) and similar assistance such as special assistance for vulnerable households and social development activities, for operation and consultancy costs, and for monitoring and evaluation.17 The Government will provide the entire fund for land acquisition and resettlement. The cost of rehabilitation and training will be provided by the Project. The fund for land acquisition by the DC will be prepared by the DC’s Land Acquisition Section and sent to the IWRMU for transferring the funds to the DC’s account. The additional benefits as per the framework will be paid directly to eligible persons (EPs). The PIC Resettlement Specialist will facilitate assessment of quantity of losses and EPs for resettlement benefits and deliver a resettlement budget to LGED for approval and periodic release of funds. The rehabilitation and training for APs will be provided through NGOs (already) engaged by the project for skills and livelihood support including agriculture and fisheries activities. The training program will be based on vulnerability and needs assessment carried out through a special census and consultation exercise. If acquisition begins 12 months after Joint Verification Survey (JVS), the replacement value will be increased at the rate of 10% per annum.

58. The IWRMU will ensure that the land acquisition and resettlement budgets are delivered to the DC on time and to WMCA/UP representative for timely implementation of the RPs. LGED will also ensure that the RPs are submitted to ADB for approval and that funds for compensation and entitlements under the RP are fully provided to APs prior to the award of the civil work contract. F. RP Implementation

1. Implementation Schedule

59. Feasibility studies for additional subprojects, including RPs, will be prepared within the project period. The Project’s institutional strengthening and capacity building activities will commence in the first year of project implementation; these activities will taper off towards project completion. Subproject implementation will be conducted following a rolling program over the 8 year life of the project. RPs will be implemented before the award of civil award contracts. However, the implementation schedule for subprojects will be prepared considering any possible changes from the detailed design and DMS. Time schedule for RP implementation for the first batch of subprojects is presented in Figure M1.

2. Monitoring and Evaluation

60. LGED, through the IWRMU Environment and Safeguards Section, will establish a monitoring system involving the Senior Sociologist IWRMU (who will be the Chief Resettlement Officer, CRO), district and upazila officers of LGED and PIC for collecting, analyzing and preparing Quarterly Progress Reports on the progress of RP implementation. LGED will also provide an Annual Report to ADB. 61. The RP monitoring will be conducted to provide feedback to LGED and to assess implementation effectiveness. A Mid-term Review drawing upon monitoring and evaluation reports and other relevant data will identify any action needed to improve resettlement performance. Evaluation of RP implementation will assess whether the resettlement objectives were appropriate and whether they were met, specifically, whether livelihoods and living standards were restored or enhanced. The evaluation will also assess resettlement efficiency, effectiveness, impact and sustainability, drawing upon lessons learned as a guide to future resettlement planning.

a. Internal Monitoring

62. Internal monitoring will be carried out by IWRMU’s Environment and Safeguards Section with support from the CRO, field staff at LGED district and upazila offices and PIC Resettlement Specialist will establish a monthly monitoring system and prepare a Monthly Progress Report on all aspects of RP implementation. The initial Census and SES will provide the benchmark data, and periodic surveys will be carried out over the time frame indicated in Figure M1 to measure changes against this baseline data, using monitoring indicators such as found below in Table M4. Assisted by District and Upazila Engineers, and PIC Resettlement Specialist, the PD will monitor land acquisition and resettlement. The existing LGED Management Information System (MIS) can be updated accordingly to incorporate the necessary data and Environment and Safeguard Section (ESS) of IWRMU will tabulate quantitative information obtained through monitoring.

63. The Resettlement Specialist with the PIC team will supervise and monitor RP implementation for LGED. The PIC will sub-contract the external independent monitoring and evaluation of the resettlement activities to an experienced person/firm or institution that has sufficient experience and understanding of the project. The tasks of the external monitor will be to: (i) verify results of internal monitoring; (ii) assess whether resettlement objectives have been met, especially whether livelihoods and living standards have been restored or enhanced; (iii) assess resettlement efficiency, effectiveness, impact and sustainability, drawing lessons as a guide to future resettlement policy making and planning; and (iv) ascertain whether the objectives were suited to AP conditions. The external monitor will design and adopt methods and tools for data collection facilitating a comparable database of "before" and "after" resettlement conditions.

64. In addition to regular review missions, ADB will undertake a comprehensive Mid-Term Review of the RP implementation. A post evaluation of RP implementation will be carried out by the ADB to assess the resettlement impact in terms of adequacy and deficiency in planning and implementation of resettlement activities. G. Implementation Arrangements

65. MoLGRDC, through LGED, has overall coordination, planning, implementation and financing responsibilities. LGED fully recognizes the importance of the Project’s resettlement programs. Therefore, PIC will include an international Safeguards Specialist and a national Resettlement Specialist with clearly defined tasks including establishing an income restoration program. Senior Sociologist of IWRMU will be appointed as Chief Resettlement Officer (CRO) to supervise the implementation work, with the help of existing LGED community organizers (COs) and engineers at the Upazila level.

4. Water Management Cooperative Association (WMCA)

69. The WMCA is central to the subproject development process including subsequent system operation and maintenance activities. As a registered cooperative the fully inclusive, community based organization is a member-based, member-owned and member-managed institution. Project based links between WMCA and UP are formed early in the subproject development process, with UP involved in identification and approval process for commencing interventions, conflict resolution and potential sharing of office facilities. Resettlement Plan implementation will be undertaken by the WMCA with representation from Union Parishad (Chairman or Member), as a locally based civil society group fully capable of responding to its required role. Ongoing support and institutional strengthening of WMCA through overall project activities will better position the organization as a suitable entity for RP implementation.

Targeted training for WMCA Management Committee (and relevant sub committee members) in the main principles of IR, subproject specific role and responsibilities and procedures for implementation will be provided by the project under its capacity building plan. Close facilitation and mentoring will also be provided by PIC Resettlement Specialist. Implementation will be in coordination with the DC, LGED and the PIC (Resettlement Specialist). Outline Terms of Reference for the role of WMCA/UP representative in RP implementation process is defined in Annex M2.of the draft RF.

5. Resettlement Processing Committees/Teams

71. LGED will form various committees/teams for implementation of the RP at the field level. The WMCA/UP representative will work as member secretary for all the committees/teams involving representatives of the DC, LGED, local government institutes and APs, as the case may be. These committees/teams will ensure stakeholders' participation and uphold the interest of the vulnerable APs. The power and jurisdictions of the committees will be clearly defined in the committee notification.
