NOW, THEREFORE F?F tt ORDAINED by the Sangguniang Panlungsod of acotod City, that:

Section 1. Title. This Ordinance shall be known as the "Bacolod Sports and Jevelopment Ordinance of 2011*

Section 2. Declaration of Policy. The following are the policy of the City on Sports Development:

a. To unite all existing and duly accredited sports associations, club, foundations, etc in the City of Bacofod;

b. To have a coordinated sports activities and competition in the City of Bacolod, from among the public and private schools, the out of school youth, special children and Barangay based;

c. To support and provide annual contribution to the needs of an individual athlete, or group of athletes, particularly in their training and sports competitions;

d Develop a program that would encourage our citizens particularly to those who are inclined to a particular sport to train for purposes of competing in the local, national and international competitions;

e. That Physical fitness program shall also be given priority, as a way of advocating by practice a healthy and clean living among the citizens of the City;

f To prioritize grassroots sports development programs, as a way of discovering potentiaf athletes;

g. Barangay Competitions and annual Inter-Barangay Competitions shall be given priority An annual Pafarong Bacofod shall also be given priority

h. To organize, promote and support competitive leagues ,toumament for achievement and competence and other related activities in order to enhance the lives of the people in the communities regardless of creed, sex or beliefs, political affiliation as well as social and economic status in life.

Section 3. Objectives: The Sports Council shall have the following Objectives:

a. Develop and aggressively promote and support sports leagues, tournaments and physical programs;

b. Pursue a vigorous sports development program that recruits, trains, retains, and achieve expertise on a particular sports discipline;

c. To seek whatever appropriate and greater involvement from the public and stakeholders as an advocate for sports; and

d To attain the total development of man through programs conduct and services undertaken which are designed to contribute to character building, values education, habit formation, leadership training and conviction development through sports program

Section 4. Definition of Terms. For the purpose of this ordinance, the following shall mean:

Sports - Is an organized competitive, entertaining, and skillful activity requiring commitment, strategy, and fair play, in which a winner can be defined by objective means. Sports are governed by a set of rules or customs.

Executive Committee - refers to the Management Committee of the Bacolod City Sports Development Council.

Sports Council - refers to the Bacolod City Sport Development Council.

Cluh / Sport Association - Organization or association of people whose primary mission is to take part in an activity that involves both physical and mental components in the pursuit of recreation and / or competition. The said organization must be duly accredited by the Sangguniang Panlungsod in order to be considered as such.

Advisory Body - Refers to the Bacolod Sports Advisory Body, which comprised all the presidents of aft recognized sports associations in the City of Bacolod.

Section 5. Creation of Bacolod City Sports Development Council.

To carry out the above policy, a body known as the Bacolod City Sports and Development Council under the Office of the City Mayor, hereinafter referred to as the Sports Council, is hereby created and established.

Section fi. Structure and Composition. The Bacolod City Sports Development Council should have the following structure & Composition,

Vice Chair - A Representative of the Sangguniancj Panlungsod, as elected by the Sangguniang Panlungsod Members

Members - Three (3) members coming from the different accredited sports associations to be appointed by the City Mayor

- One (1) representative from the Negros Occidental Private Schools Sports Cultural and Educational Association (NOPSSCEA) /

- One (1) representative from the Association of Christian Schools International (ACS!)

- School Division Superintendent or his or her authorized representative.

- Two (2) representative from private sector, preferably from the business sector

- President of Liga ng Barangay or his/her duly authorized representative

- SK Federation President or his/her duly authorized representative

- Representative of the Association of Student Government Association of Bacolod

- Representative of the athletes' essociation, as accredited by the City of Bacolod

- City Treasurer

- Office of Youth and Sports Development (OYSD) Head

3. The Sports Council Chairman shall appoint from any of the members of the Council an Executive Director, which shall have a term of one (1) year subject to re-appointment

4. The Office of Youth and Sports Development (OYSD) head shall serve as the secretariat of the Sports Council.

5 The member of the Sport Council, except for the chairman, the Vice Chairman, the SK Federation President, SK Federation Vice President, Liga ng mga Barangay President and School Division Superintendent, shall have a term of office of two (2) years, subject to re-appointment

6. The Executive Committee shall be the management committee of the Sports Council that will run the day to day operation of the council, through its Executive

Section 7. Powers and Funct ions. The Sports Council shall be principally responsible for the following functions:

1 It shall determine the future direction of the Sports Council, which shall be reflected in a Short, Medium and Long Term Sports Development Plan,

2. It shall set the goals and objectives of the Sports Council;

3. It shall develop long range plans to achieve the goals and objectives of the Sports Council and submit the same for approval of the Sangguniang Panglungsod,

4. It shall promulgate such rules and regulations to govern leagues and tournaments held in the City of Bacofod;

5. The Bacolod City Sports and Development Council shall be responsible in carrying out the mandate of this Ordinance;

6. Provide support to athletes or associations participating in any competitions subject to availability of funds.

7. Provide support to any local or national sports activities sanctioned by the Sports Council subject to availability of funds.

3. To provide and put up a sports center either privately or publicly-owned as the City sports athletes1 home.

Section 8. Meetings. The Executive Committee shaii meet at least once a month or as often as necessary, upon the call of the Chairman or the Executive Director

The Sports Council shall at least meet once every two (?) months.

Section 9. Bacolod Sports Advisory Body (BSAB). There shall be a Bacolod Sports Advisory Body <BSAB) composed of all Presidents of the accredited sports associations and shall serve as the advisory council of the Sports Council.

The Advisory Body shall meet at least once every six (6) months in an assembly called by the Sports Council Chairman or Executive Director

Section 10. Paiarong Pambarangay (Barangay Games). There shall be a Pafarong Pambarangay (Barangay Games) to be held in every Barangay that wifl be spearheaded by the Sangguniang Kabataan (SK) of such Barangay.

The period of such event shall be announced by the Sports Council for synchronicity purposes.

The Punong Barangay and Members of the Sangguniang Barangay is enjoined to provide support, technical, financial and logistics to the Sangguniang Kabataan (SK) to ensure success of the events.

Section 11. Paiarong Panlungsod. There shall be a Paiarong Bacolod (Bacolod Games) that wifl be a competition of all the winners in the Pafarong Pambarangay, preferably during the month of May

The establishment and guidelines of the Paiarong Panlungsod shall be in compliance with City Ordinance 414, series of 2006, known as "AN ORDINANCE ESTABLISHING AN ANNUAL BARANGAY-BASED OPEN AND SPECIAL SPORTS PROGRAM TO BE CA11 ED THE PALARONG PANI UNGSOD OF BACOLOD CITY"

Section 12. City Wide Sportsfest for Persons with Disabilities fPWDs). The Bacolod City Sports Development Council shall also organize annual Sports Competition that will involve Persons with Disabilities (PWDs) to promote and support the improvement of their total well-being and uplift their integration into the mainstream of society which will develop their skills and potentials to enable them to compete favorably

Section 13. Adopt an Athlete Program. The Bacoiod City Sports Development Council shall establish rules for the Adopt an Athlete Program. It shall be prescribed that the council will look for patrons in Bacolod City to adopt athletes who represent the City during National or fnfernationaf Competitions.

Patrons shall support the needs of the Players particularly in providing food, clothing and other allowances.

Section 14. Funding. An initial appropriation of Five Million Pesos (Php 5,000,000. 00) shaft be appropriated from the Genera* Fund of the City

Section 15. Special Sports Fund. There shall be a Trust Fund to be created for purposes of supporting the various sports program of Sports Council, which shall be taken from the PI .00 levy that a moviegoer shall pay in all cinemas in the City of Bacolod, and in arff Cockpits within the City of Bacolod.

Section 16. Supplementary Clause. On matters not provided in this ordinance, any existing applicable taws and their corresponding implementing rules and regulations, executive orders and relevant issuances issued therefore shall be applied in a supplemental manner.

Section 17. Separability Clause. If for any reason or reasons, any part or provision hereof shall be held lo be unconstitutional or invalid, other parts or provisions hereof which are not affected hereby shall continue to be in full force and effect.

Section 18. Repealing Clause. All ordinances, resolutions or laws of local application and effect inconsistent hereto are hereby modified, superseded and repealed accordingly. City Ordinance No. 85 Series of 1993 and City Ordinance 159 Series of 1996 are specifically repealed by this ordinance.

Section 19. Fffectivity. This Ordinance shall take effect ten (10) days after publication in at (east two <2) newspapers of local circulation.
