AN ORDINANCE ADOPTING THE SANTA ROSA CITY MARKET CODE.

BE IT ORDAINED BY THE SANGGUNIANG PANLUNGSOD OF SANTA ROSA IN SESSION DULY

ASSEMBLED:

CHAPTER I GENERAL PROVISIONS

ARTICLE A. TITLE AND SCOPE

Section 1. Title. - This ordinance shall be known as the City of Santa Rosa Market Code.

Section 2. Coverage. - This Code shall govern the establishment, classification, administration and operation of all government owned public markets in Santa Rosa City. Likewise, the same shall regulate the operations of privately owned public markets, talipapas and other similar business enterprises housed in structures or buildings.

ARTICLE B. AUTHORITY AND PURPOSE

Section 3. Authority. - This Code is enacted pursuant to Title III Chapter 3 article Three of Republic Act 7160, otherwise known as the "Local Government Code of 199l"which empowers the City through its legislative body known as the Sangguniang Panlungsod to establish markets, slaughterhouses or animal corrals and authorizes the operation thereof. Regulates the operation privately owned public markets, talipapas or other similar buildings and structures, as well as the imposition and collection market rental fees for occupancy of the use thereof and Tit le V Article 19, Section 489 of the Local Government Code which empowers the City Veterinarian of The City Government of Santa Rosa in Slaughtering of animals, routine inspection of all meat shops/stalls, meat processing plants, fish, eggs, supermarkets, lechoneros, motels, hotels, restaurants, KTV Bars, Pet shops, Veterinary Clinics, Food

Section 4. Purpose. - This Code is enacted for the following purposes:

1. To guide control and regulate the growth and development of the City's public market and Slaughterhouse including its premises;

2. To protect the character and stability of the public market and slaughter house and its premises as well as promote an orderly and beneficial development of the same;

3. To promote & protect the health, safety, peace, comfort, convenience, and general welfare of the occupants therein as well as the general public patronizing the public market.

4. To regulate the operation of all business or trade activities in the public market.

5. to regulate and restrict the location and use of stalls, booths or other structures inside the public market compound;

6. To regulate the alteration or remodeling of existing booths or structures in such a way as to avoid public hazards or inconvenience;

7. To eliminate the incompatible or non-conforming uses of public market stall a and procedures.

8. To regulate the operation of privately owned public markets and talipapas and other similar structures;

9. To make public market responsive and effective instrument of public service;

10. To initiate dynamic and viable enterprises, to strengthen the financial capabilities of the city;

11. to develop, regulate and standardize market systems and professionalize market services;

ARTICLE C. DEFINITION AND RULES OF CONSTRUCTION

Section 5. - Definition of terms. - For purposes of this Code, the following terms shall be understood in the sense indicated hereunder.

Market - refers to any place, building or structure of any kind recognized as such under existing laws or ordinances. It embraces all market stalls, tiendas, buildings, roads, subway, waterways, drainage and other connections parking spaces and other appurtenance thereto and is operated under government control, regulation and supervision;

Government - Owned or Operated Public Markets - Refers to Santa Rosa City Public Market established out of public funds or acquired or leased by the city through legal modes or means from private persons, natural or judicial;

Night Market - Refers to any place, building or structure of any kind recognized as such under existing law or ordinance. It is owned established out of private government funds. It should not have a wet section inside or outside the market premises. They can operate seven (7) days in a week from 10:00 o'clock in the evening until 4:30 o'~lock in the morning. They cannot sell marine products, beef, pork, dressed chicken, live fowl and piglet and other exotic animals. They should be 200 meters radius away from the Santa Rosa City Public Market.

Private Market - Refers to a place or building or any structures as such owned and operated by individual person or corporation for the service of the general public where food and other commodities are being bought and sold. They can only operate dry section and shall be subject to govern regulation, supervision and/or control.

Flea Market - Refers to any place within the City made out of tents, and temporary structures of any kind recognized as such under existing law or ordinance. This type of market deals only with

-3-merchandize such ad antiques, souvenirs, display of glassware's decals and all dry goods. It can only operate for three(3) days in a week, more specially during Saturdays, Sundays, and holidays from ten o'c;lock (10:00) in the morning up to five o'clock (5:00) in the afternoon. It should be two hundred (200) meter radius away from Santa Rosa City Public Market and cannot operate a wet section either inside or outside its premises.

Market Section - Refers to classification of a group of contiguous stalls in market according to the kind of merchandise offered for sale therein.

Fish Section - refers to the area where only fresh fishes, clams, oysters, crabs, lobsters, shrimps, seaweeds, and other aquatic and marine products should be sold;

Meat, Pork, and Dressed Chicken Section - Refers to the area where all kinds of meat and other meat products shall be sold, provided that the meat, pork or dressed chicken shall be separately displayed and properly labelled.

Butcher - refers to any person engaged in slaughtering pigs, cows, poultry, and other livestocks.

Dry Goods Section - Refers to the areas where all kinds of textile, ready made dresses and apparels, native products, toiletries, novelties, foot wears, laces, kitchen wares, utensils and other household articles or appliances; handbags, school and office supplies or similar products shall be sold.

Grocery Section - Refers to the area where all kinds of cake, biscuits, pastries, crackers, butter, cheese, confections, candies, canned or bottled foods, beverages, softdrinks, cigarettes, flour, oatmeal, ham, bacon, sugar, sauce, onions, garlic, potatoes, eggs, sausages, starch, smoked fish, salt, feed, soap, and either household and food products, including firewood and charcoal shall be sold.

Animal Feeds and Cereal Sections - Refers to the area where all kinds of manufactured Animal feeds and Cereals, including rice and corn shall be sold.

Vegetables and Fruit Section - refers to the area where all kinds of vegetables, fruits, coconuts, root crops and other similar agricultural product shall be sold.

Live Fowl and Piglet Section - Refers to the area where live fowls, such as chickens, ducks and similar birds as well as piglets shall be sold.

Flower Shop Section - Refers to the Area where all kinds of flowers, whether fresh or artificial, flower pot vases, and other materials needed in the floral arrangement shall be allowed.

Cold Storage Service section - Refers to the area where only refrigeration services shall be made ava ilable and the sale of ice in whatever form shall be conducted.

Carinderia/Eatery Section - refers to all kinds of cooked foods, including refreshment & cafe where foods are served.

Rice Section - Refers to the area where varieties of rice, corn and other related items sold.

Dried Fish, Eggs and Coconut Section -

a. Dried Fish - refers to all kinds of dried fish b. Eggs - refers to all kinds of fresh eggs, salted eggs, and balut c. Coconut - refers to coconut

General Merchandise - Refers to all kinds of Dry goods products or merchandise except those being sold at groceries, textiles, rice, rice Dried Fish, Egg Section and Native Product Section.

Services - Refers to services to the public such as medical, drug store, jewelry repairs, salon, etc.

Native Products - Refers to various Native Products such as potteries, shell crafts, brooms, wood carvings, native decorations, etc.

Footwear Section - Refers to all kinds of footwear such as slippers, sandals, shoes, etc.

Bakery Section - Refers to all kinds of Bakery products.

Delicacies Section - Refers to all kinds of delicacies such as puto, bibingka, coconut gel, etc.

Miscellaneous Section - Refers to all kinds of items not being sold and included in the other

Market Booth - Refers to an enclosure built or erected on market space for the purpose of sale of goods, commodities and/ or services.

Market Stall - Refers to any allotted stand, space, compartment, store or any place wherein merchandise is sold, offered for sale or intended for such purposes in the public market.

Bolante Stalls - refers to stalls occupied by former ambulant vendors usually located in front ways in the market.

Market Premises - refers to any space in the market compound, or part of the market lot consisting of bare grounds, out side of the market building occupied by ambulant vendors especially during market days.

Shopping Center - A group of not less than 115 contiguous retail stores, originally planned and developed as a single unit, with immediate adjoining off street parking facilities.

Stall Lease (Also known as Stall Holder) - Refers to the awardees or a definite space within a public market that pays rentals thereon for selling his/ her goods, commodities or services.

Market Rental Fee - refers to the amount of rental fee paid to and collected by the City Treasurer concerned for the privilege of occupying and utilizing a market stall and facilities for commercial activities.

Ambulant, Transient, or Itinerant Vendor - Refers to a vendor or seller who does not permanently occupy a definite place in the market but one who comes either daily or occasionally to sell his/ her wares.

Marine Products - refers to fresh and dried fish, seaweed, shells like clams, shrimps, lobsters and the like.

Vendor - Refers to a person other than a stall holder who sells goods, commodities or foodstuffs within the market premises.

Gadgets - refers to reflectors, color papers or colored cellophane or colored aluminium foil.

Market Committee - Refers to the Body which has the duty to conduct the drawing of lots and opening of bids in connection with the adjudication of vacancy on newly constructed stalls or booths in the City market and certify to the City Mayor the results thereof.

Waste treatment Facility - Processing facility responsible for treating waste water and reducing its pollution content to permissible level in accordance with government standards. It may be a combination of Physical, chemical and biological method. Also called as Sewerage Treatment Plant (STP).

Ramp - A sloped surface connecting two more planes at different levels or elevations.

Generator - refers to a machine by which a mechanical energy is change to electrical energy. Used as alternative supply of electricity where there is Meralco power failure.

Generator Room - An enclosed room within a building compound where the generator set and transfer switch are located.

Cistern - An Artificial reservoir or tank usually located below natural ground level for storage of water atmospheric pressure for use when required.

Deep well - An artificial source of water obtained by drilling metal pipes into the ground until the water table is reached. A submersible motor pump will draw water from the deep well. Primary purpose is for water supply for cleaning of the market area and secondary as back up supply for the market and Mall in case of water service interruption for Maynilad.

Power Room - An Enclosed room within a building where the main electrical equipment is located (e.g. low voltage switch gears, main distribution panel boards, main telephone cabinet).

Electrical Meter - An instrument used in measuring electrical consumption in kilowatt hour.

Water Meter - An instrument used in measuring water consumption in cubic Meter.

Sound System - Consists of speakers, amplifiers wiring and music player situated on designated market location with pre program music of FM station music.

Public Address System - An apparatus including a microphone and loud speakers used for public service announcement.

Signage - A display board or surface of the buildings used for direction, identification, instruction or advertising usually consisting of letterings pictures, diagrams, decorations etc. Usually in combination on a contrasting background surface.

Timbangan ng Bayan - A precision weighing machine strategically located at the inner road of the public market where consumers can compare and weigh the commodities they purchased.

Toilet Facilities - an adequate and approved type of toilet and handwashing facilities which include water faucets, wash basins, lavatories, toilets and bath facilities.

Vermin Abatement Program - a series of preventive and control procedures and activities for vermin/ pests.

CHAPTER II SUPERVISION, REGULATION AND CONTROL

Section 1. Administration. - The City Mayor, through the appointed/ designated City Administrator, shall exercise direct and immediate supervision, administration and control over the Santa Rosa City Public Market and personnel thereof, including those whose duties concern the maintenance, upkeep, peace and order of the Market premises, except market Collectors who are under the control and supervision of the Office of the City Treasurer.

Section 2. City Market Supervisors - There shall be a City Market Supervisors in the City of Santa Rosa Public Market who shall be appointed by the City Mayor with the concurrence of the Sangguniang Panlungsod.

Section 3. Duties and Responsibilities of the City Market Supervisor IV. - The City Market Supervisor IV shall supervise and regulate the operation of all public markets within the City. He

shall have full control of the administrative direction of all personnel involved in the City of Santa Rosa Public Market, and shall enforce the provisions of the ordinance and other rules and regulations governing the operations of public market.

Towards this end, The City Market Supervisor IV shall have the following specific duties and responsibilities.

a.) Plans, directs, administers, and supervises the operation of all markets which includes sanitation, cleanliness, security, order and deportment inside the market premises and its environs.

b.) Supervises the preparation of periodic collection reports that shall include comparative statements of collections of market revenues and statistical data on prevailing prices of goods in all markets for other agencies and flea market operation.

c.) Supervises and evaluates the activities and performance of Market Supervisor I, and the other market personnel and investigate complaints affecting their public performance.

d. ) Supervises, evaluates and administers property operations, programs perta ining to property, facilities and supplies acquisition, maintenance, losses and disposal which shall include proper recording and reporting thereof.

e.) Prescribes rules and regulations with regard to the Administration, superv,s,on and regulation of the market under his jurisdiction subject however to the provisions of the Market Code and other ordinances, resolutions that the Sangguniang Panlungsod may deem proper and reasonable.

f.) Performs such duties and functions that may be assigned by the City Mayor.

g.) He shall see to it that public markets are always clean and in excellent sanitary conditions, including the aisles, divisions, stalls, floors, walls and equipments as well as the whole tract of land belonging to the market. The market building and ground should at all times be kept from garbage and rubbish.

h.) He shall post in each public market the rules and regulations in English or Filipino concerning the sanitation and good order of the market, the manner of leasing of stalls therein, the privilege and obligations of the stall holders, and such other rules and regulations as deem necessary in the operation and maintenance of the same. He shall also furnish such stallholder or vendor with a copy, in English or Fil ipino, of the rules and regulations mentioned.

Section 4. City Market Supervisor - There shall be one City Market Supervisor in each government owned public market. The City Market Supervisor shall be appointed by the City Mayor with the concurrence of the Sangguniang Panlungsod.

Section 5. Duties and Responsibilities of the City Market Supervisor . - The City Market Supervisor shall be the custodian of the market where he is assigned and shall have immediate administrative supervision over all subordinate market personnel. He shall see to it that the market personnel where he is assigned perform their duties properly.

Towards this end, the City Market Supervisor shall have the following specific duties and responsibi lities .

a.) Executes and implements directives and policies emanating from the City Market Supervisor IV/Designated Market Administrator pertain ing to the operation of the public market within his jurisdiction which shall normally includes sanitation, cleanliness, security, order and conduct inside the market premises and its immediate environs.

b.) Prepares periodic reports, to include comparative statements of statistical data on prevailing prices of goods in public markets for other agencies and flea market operations.

c.) Supervises and evaluates the activities and performances of all subordinate market personnel and investigates complaint affecting their public performance and attitudes.

d.) Responsible for the maintenance and efficient utilization of all public market properties, facilities and supplies.

h.) He shall see to it, at the close of each day's business and before leaving, stall holders and vendors shall clean their stall/s, booth/s or fixtures.

Section 6. Responsibilities of the City Health Offices - the City Health Offices shall have the following specific duties and responsibilities

a.) Conduct or cause the regular inspection of every establishments and its premises to ascertain its state of sanitation.

b.) Issue sanitary permit after a complete evaluation/inspection of the establishments and its premises and after compliance to the requirements.

c.) Recommend the withholding, disapproval and revocation of the sanitary permits upon violation of or pending compliance to certain terms and conditions stipulated in the Sanitation Code.

d.) Supervise over the maintenance of adequate sanita ry conditions in government or privately owned markets and abattoirs and their premises.

e.) Ascertain the validity of sanitary permits of the establishments concerned and health certificates of their employees.

f.) Enforce the Code of Sanitation of the Philippines (PD 856) and its implementing rules and regulations.

Section 7. Other Market Personnel - Other market personnel as may be deemed necessary shall be appointed in accordance with existing Civil Service Rules and Regulations.

Section 8. wearing of Uniforms.- All market personnel shall be required to wear prescribed uniform provided by the City, design of which shall be prescribed by the City Mayor.

Section 9. Collection of Market Fees and Charges. - All activities relating to the collection of market rental fees and charges as provided in Chapter III hereof, including Mayor's Permit and License fees and other fees due to the City Government and all accounting works incident to the market operation are in accordance with the Revised Revenue Code of the City and otherwise known as Ordinance No. 1675-2011, approved on May 16, 2011 and implementation thereof is vested upon the City Treasurer.

Section 10. For the purpose of collection of fees and charges, and assignments of stalls, provisions of the Revised Revenue Code approved through Ordinance No. 1675-2011 shall be implemented, specifically CHAPTER VI, Article A and B thereof.

Section 11. Other Fees and Charges. - In addition to the above schedule of fees, the following fees and charges shall be imposed.

a.) Electrical consumption fees at the rate depending on the kind of individual meter, payments depend on the electrical consumption based in the reading of the meter.

b.) Water consumption fees

c.) other fees in relation to the maintenance, preservation, repair and upgrade of the public market.

d. ) Discharge Fees - To be taken from all trucks, jeepneys, trailers and other convenience discharging, disposing or advertising products within 500 meter radius from the City of Santa Rosa Public Market.

Section 12. Issuance of Rules and Regulations. - For purpose of this section, the City Market Supervisor and duly Designated Market Administrator shall issue the necessary rules and regulations including the Classification of fishes and other sea foods. Such rules and regulations issued by him shall be in force and effect unless rescinded, modified or revoked by the City Mayor or the Sangguniang Panlungsod.

Section 13. Vacancy of Stall/Booth and Adjudication to Appicants and Others pertaining to Agreements and Contracts. - The Following rules pertaining to Ajudication to Applicants shall be in accordance with Sec. 6A.07, Article A, Chapter VI of Ordinance No.1675-2011 otherwise known as the Revised Revenue Code of the City of Santa Rosa,Laguna.

Section 14. Committee on Awards of Lease Contracts. - A committee is hereby created to oversee the awarding of Lease Contracts over the Market Stalls and Mall spaces composed of the following City Officials:

The committee shall have the power to inspect, visit, inquire and to formulate additional guidelines towards maximizing the profitability of this economic enterprise.

Section 15. City Mayor Contracting Authority. - Authority is hereby given to the City Mayor to enter into Lease Contracts based on the minimum terms and conditions indicated herein.

Section 16. Market Hours. - Unless a different time is fixed by the Sangguniang Panlungsod the public market shall be opened for sale of articles permitted for the sale therein from 12:00 midnight until 9:00 0

1clock in the evening of everyday. However, on the 24th and the 31st of December every year, all public markets shall be opened at 1:00 am to 12:00 midnight. The use of any stall or place in the market as living quarter room and/or sleeping quarter is strictly prohibited and no vendor or stall holder shall remain inside the market building after the same has been closed.

Section 17. Responsibility for Loss or Damage of Articles or Merchandise After Closure Time.-

The following rules shall apply, to wit:

1. The City Government shall not be responsible for any loss or damage to the lessee1s property caused by fire, theft, robbery, "force majeure11

, or any other unavoidable cause. All articles or merchandise left in the public market after closure time shall be at the risk of the stall holder or owner thereof.

2. All articles abandoned in any public market building in violation of any of the provisions of this Article or any regulations or rules relating to the management of the market, shall be deemed a nuisance, and it shall be the duty of the City Market Supervisor II or the Officer-in­Charge thereof to take custody of such articles. It shall be the duty of the City Market Supervisor II to inform the owner of such articles, if possible to remove the same within 24 hours. In case the articles are claimed within twenty four (24) hours thereafter, they shall be returned to the owner thereof unless they are so deteriorated as the constitute a menace to the public health, in which case, they shall be disposed of in the manner directed by the City Market Supervisor II or the officer-in-charge thereof, who may also in his discretion, take appropriate action. In case the articles have not deteriorated and are not claimed within the time herein fixed, said articles shall be sold at public auction, and the proceeds thereof shall be disposed of in accordance with Jaw.

Section 18. WEIGHTS AND MEASURES IN ALL MARKETS, including Fees for sealing and Licensing of weights and regulations thereof shall be governed by the provisions of Ordinance No. 1675-2011 (Revenue Code of the City), specifically Article H, Chapter IV.

CHAPTER III RULES AND REGULATIONS

Articles A. Miscellaneous Provisions

Section 1. Unlawful Acts - It is hereby declared unlawful for any person:

1. To peddle hawk, sell of offer for sale or exposed for sale any article in the passageway (pasillo) used by purchasers in the Santa Rosa City public Market premises;

2. To idly chat, saunter, lie in or around the market premises, nor shall any person beg or solicit c contributions of any kind in the Santa Rosa City Public Market;

3. To resist, obstruct, annoy or impede any market employee or personnel in the performance of his duties, nor shall parents allow their children to play around in their stalls or in the Santa Rosa City Public Market premises;

4. To drink, serve or dispense liquor or any intoxicating beverages for immediate consumption within the premises, of the Santa Rosa City Public Market at all times;

5. To commit any nuisance, make boisterous noise, use any profane or vulgar languages, commit disorderly conduct, or obstruct the passageway of the Santa Rosa City Public Market premises, or any act, which is calculated to lead to breach of peace;

6. To expose, hang or place any article causing obstruction whether the same is for sale in the Santa Rosa Public Market premises;

7. To carry in his possession deadly weapons such as knives, bolos, axes, ice picks, darts, etc. within the Santa Rosa City Public Market premises; or in case of stall holders or their helpers; outside their respective stalls;

8. To sell or offer for sale any merchandise or articles which have been illegally acquired by the vendors and/or stall holders in all markets;

9. To remove, construct and or alter the original structure of any stall or booth, electrical wiring connection, without prior permit from the City Mayor;

10. To sell all goods imported/local not fit for human consumption in all markets;

11. To sell exotic and/or endangered species in all markets;

12. To sell purely rock salt. Iodized salt should be mixed;

13. To sell good commodities in the public market not included in the contract. Any goods and commodities displayed outside its limit/ space occupied shall be confiscated;

14. To construct or alter or fix the leased stall without consent from the City Market Supervisor II in the Santa Rosa Public Market;

15. To use or store fire hazardous appliances in the Santa Rosa Public Market.

Section 2. Rules and Regulations - The following rules and regulations shall be observed :

1. All market vendors should use only licensed weights and measures in all markets.

2. Motorists are required to park their vehicles in designated parking areas in the Santa Rosa Public Markets. The City Treasurer or his duly representative shall charge and collect reasonable fees in the designated parking area in the amount of Php. 20.00 for the 1st two (2) hours; Phpl0.00 for each succeeding hour and fraction thereof; Php.200.00 for overnight parking; Php.200.00 for lost ticket.

3. Vendors, owners of stall, helpers and workers in all markets should wear proper clothes.

4. Pets are not allowed inside the Santa Rosa City Public Market.

5. All markets must have a ''Timbangan ng Bayan" for the protection of consumers.

6. All markets are required to have waste treatment facilities as prescribed and defined by law.

10. Public markets are required to have restrooms subject however to payment of reasonable fees by its users. Such fees shall be used for its maintenance.

8. Cleanliness, orderliness, courteousness and discipline in all markets should be strictly observed.

9. All markets stallholders are required to display their Business License/Permit.

10. Any private individual or government employee caught collecting in excess of the approved rate shall be penalized in accordance with law.

11. Meat vendor or stallholder is prohibited to process by products of pork, beef, chicken, etc. inside the Santa Rosa City Public Market.

Section 3. Transport and Sale of All Types of Shellfish. - The following provisions shall apply:

a) The transport and sale of all types of shellfish declared to be contaminated with red tide etc. in all public markets, talipapas and other marketing outlets within the City of Santa Rosa are strictly prohibited.

b) To enhance public safety and protect consumers the banned shellfish shall be confiscated and shall be destroyed or disposed of in the manner prescribed by the Department of Health (DOH) or Department of Agriculture.

c) The transport and sale of some shellfish shall only be allowed if and when the Department of Health (DOH) and or the Department of Agriculture has declared said shellfish are no longer infected with red tide toxin and safe to eat and which time, the ban as contemplated in this Ordinance shall be temporary lifted: Provided, however, that this will be in full force and effect should concerned national agencies, once again declared the shellfish to be poisonous and unsafe to be eaten.

Section 4. Loose Animals - No dogs or other animals shall be left astray in the city market zone. The City Market Supervisor II or his authorized representative is hereby empowered to catch such stray animals which in turn will be surrendered/transferred to thr designated "City Pound" under the City Veterinary Office.

Section 5. Use of Alleys, Corridors and Walkways - (a) The placing of chicken coops, chopping/ cutting tables, animals carcasses, display hangers, grinders and dressed ch icken and similar paraphernalia's and products as well as dry goods and other articles of commerce on passageways, alleys corridors and walkways of public markets throughout the city is hereby prohibited.

(a) Coconut products shall be stored strictly within the confines of stalls directly selling the same and once extracted, its s hells shall be dispense by placing in garbage bags.

(b) Chicken coops, chopping/ cutting tables meat hangers shall only be allowed within stalls with chicken coops and meat box to be placed preferably underneath said stalls.

Section 6. (a) Special Provisions. - Any selling of ambulant vendors of beef, pork, chicken, fish, prawns, shellfish or other items falling under the category of wet goods are absolutely prohibited from being sold along Liberated Street and specifically at/ or near the Santa Rosa City Public Market.

(b) All markets vendors engage in the business of selling meat, vegetables, marine products and the like, are hereby prohibited using any gadget or chemical preservatives, etc. that would mislead and the buying public as to the real quality, freshness or general appear~mce of the said product and/or in the display of their products in order not to affect the brightness and color of the same.

(c) No public market of any kind shall henceforth be established within the radius of five (500) hundred meters from the Santa Rosa City Public Market except those in existence for 15 years and had already acquired prior rights before the enactment and effectively of the herein ordinance and those that have been granted a franchise by the Sanggunian.

(d) The selling of fresh chicken, porks, beefs, and other fresh meat products including marine products by other licensed markets, supermarkets, groceries or talipapas along the vicinity of ... , is strictly prohibited.

( e) The pertinent provisions of this local measure shall not apply to the other commercial spaces at the Santa Rosa City Public Market classified by the City Government as part of the mall which shall be covered by another and separate ordinance.

Section 7. Penalty - Any violation of the provisions of this Article shall be punished by a fine of not less than One Thousand (Phpl,000.00) Pesos or imprisonment of not less one (1) month but not more than six (6) moths, or both such fine and imprisonment, at the discretion of the court.

Section 8. Applicability Clause - The provisions of other existing Ordinances dealing on market administration which are not in conflict with or contrary to the herein provisions of this Article are hereby adopted and made an integral part hereof.

CHAPTER IV - Article I THE MEAT SAFETY INSPECTION CODE

Section 1. Declaration of Policy - (a) It is hereby declared that the primordial concern of the City Government of Santa Rosa is to regulate the slaughter of animals for human consumption and maintain the highest standard of sanitation in handling, transport and distribution of meat and meat products to the general public.

(b) No person, entity, association, partnership, corporation, cooperative shall slaughter for food any livestock, fowl, or any other animal, including by its products, and distribute or sell the same for public consumption, unless said livestock, fowl, and other animals, including its by- products are subjected to veterinary inspection and examination.

€ No person shall be employed in livestock and meat inspection without undergoing training and accred itation by National Meat Inspection Commission. (d) The City Government shall require licensing and registration of butchers, meat dealers and meat stalls.

(2) €No vehicle shall be used to deliver meat products in Santa Rosa City unless the same has been properly inspected and certified by the City Veterinarian as safe and sanitized to transport the said products for human consumption.

Section 2. Operative Principle of the Meat Safety Inspection Board. - The City Veterinarian as mandated by Section 489 of Republic Act 7160, otherwise known as the Local Government Code, shall have the following additional functions, to wit:

1) To formulate polices, guidelines, rules and regulations, quality and safety standards governing marketing preservation, and inspection of meat and meat products.

2) To exercise technical supervision over the established and operation of slaughterhouses, both public and private, with the authority to recommend sanctions and closure to the City Mayor for those that do not comply or meet the requirements and standards set thereof.

3) To exercise technical supervision over City meat inspectors.

4) To review all existing city ordinances related to the establishment and operation of slaughterhouses and granting franchise thereof, including the imposition of taxes, fees and charges, formulate a City Meat Inspection Code and recommend to the Sanggunian Panlungsod for its enactment.

5) To exercise such other power and perform such other duties and functions as may prescribed by law or ordinance.

Section 3. Composition of the Meat Safety Inspection Board. - There is hereby created the City Meat Inspection Board whose primary function is to assist the City Veterinarian in the formulation of polices and guidelines to be composed of the following:

1. The City Mayor - Honorary Chairman 1. The City Veterinarian -Chairman 2. Representative from the National Meat Inspection Service - Vice Chairman 3. Representative City Health Office 4. Representative Sangguniang Panlungsod Chaired by the Committee on Market and

Slaughterhouse 5. Representative Office of the City Mayor 6. Representative Meat Dealers in Santa Rosa City 7. Representative Slaughterhouses in Santa Rosa City 8. Association of Barangay Chairmen (ABC) 9. The PNP Staion Commander or any designated police representative 10. The City Legal Officer 11. The City Information Officer

Section 4. Determination and Composition. - Within thirty (30) days from the approval of this ordinance, the Office of the City Mayor shall coordinate and make arrangements with the National Meat Inspection Service (NMIS) and request for at least ten (10) qualified personnel from the said office who may be appointed as the permanent representative of the NMIC to the City Meat Safety Board. Immediately thereafter the list of qualified personnel shall be submitted to the Sangguniang Panlungsod for proper evaluation and screening, within thirty (30) days from receipt of the list by the Sangguniang Panlungsod, the Sanggunian shall forward to the City Mayor a list of three (3) most qualified representatives to the Board. The City Mayor shall have period of fifteen (15) days from receipt of the list of the three (3) qualified personnel within which to appoint the permanent representative of the NMIC to the Board.

Section s. Duties and Responsibilities. - The Meat Safety Inspection Board shall have the following duties and functions, to wit:

1. Conduct Ante Mortem and Post Mortem inspection of livestock/meat/meat products for human consumption;

2. Conduct post abattoir inspection and surveillance/ apprehension/ condemnation of illegally slaughtered food animals and contaminated meat/meat products.

3. Conduct animal diseases prevention and control;

4. Create a City Pound and enforce its regulatory functions under the Animal Welfare Act Law;

5. Conduct regular Anti-Rabies Prevention and Control;

6. Conduct Inspection/Examination of fish, milk, dairy products and other related products for human consumption;

7. In coordination with Department of Environment and Natural resources (DENR), the PCMSIO shall strict quarantine measures to all incoming livestock/birds/pets and other endangered species suspected to be carrier of deadly animal disease in order to prevent the transmission of the same to other animals and humans;

8. Conduct surveillance /confiscation of all endangered species that may be shipped in or out, to and form, the NAIA/ Domestic Airport and monitor pet shop within the City that sell/

breed/ keep the same without necessary permit/ license from agencies concerned, and file the necessary charges against all violators including "Veterinary/animal clinics" in surveillance/ confiscation, of all endangered species that may be illegally shipped in and out.

9. Conduct Regular inspection of meat establishments, dressing plants, meat processing plants and other similar establishments.

10. Shall act as complainant in apprehension of illegally acquired meat.

Section 6. Prohibitions -

1. No person, entity, association, partnership, corporation or cooperative shall slaughter for food any livestock, fowl or any other animal, including its-by products, and distribute or sell the same for public consumption, unless said livestock including its-by products, are subjected to veterinary inspection and examination.

2. No person shall be employed in livestock and meat inspection industries without training from National Meat Inspection Service.

3. The City Government of Santa Rosa City shall required licensing and registrat ion of butchers, meat dealers and meat stalls.

4. Since the National Meat Inspection Service (NMIS) already registers livestock carriers, meat delivering vehicles and meat handlers, it's no longer necessary to impose inspection fees. Hence, meat dealers must submit annually an updated NMIS registration certificate of livestock carrier, meat delivering vehicles and meat handlers' permit to the Office of the City Veterinarian which in turn will inspect the permit and the vehicle. NMIS vehicle accreditation stickers (issued by the NMIS upon registration) should be placed/ attached to the vehicle.

5. The Barangay must spearhead the Prohibition of illegal Meat Trade in their place of jurisdiction and should encourage business operators to secure business license/ permit.

Section 7. Penalty Provision - Any person or entity who violates the prov1s1ons of this ordinance, shall upon conviction, be punished with fine of not less than One Thousand (Pl, 000.00) Pesos but not more than six (6) months or both, upon discretion of the proper court in the City.

CHAPTER V SLAUGTHER AND CORRAL FEES

Article A Slaughter Fees

Section 1. Imposition of Fees, - The following shall be imposed, to wit;

a) Annual Veterinary Inspection Fee. - The amount of Pl, 000.00 pesos shall be imposed and collected as the annual veterinary inspection fee.

b) Slaughter Permit and Inspection Fees. - Before any animal or fowl is slaughtered for public or private consumption, a permit therefore shall be secured from the City Veterinarian and the corresponding fees, per head prescribed herein shall be collected by the City Treasurer.

A monthly permit to slaughter a certain number of animals and fowls may be given to licensed meat dealer, vendor or company upon payment of advance permit fee corresponding to the number of animals and fowls applied for be slaughtered.

Section 2. Entry Permit - (a) No meat carcasses of animals and fowls slaughtered or processed outside Santa Rosa City may be disposed for human consumption in the City without being inspected and given permit by the City Veterinarian or his authorized meat inspector.

(b) Meat and carcasses including process meat without certification from the City Veterinarian that the same are fit for human consumption where it originated shall be confiscated and immediately disposed in accordance with the sanitary requirement of the City.

(c) The hereunder are the permit fees to be imposed, to wit:

(d) A monthly entry permit to bring in a certain number of carcasses of animals or fowls or a number of kilos of meat may be given to applicants upon payment of entry fees based on the number of animals or fowls or number of kilos of meat applied to be brought in the City of Santa Rosa the excess number of carcasses of animals or fowls of kilos of meat shall be paid accordingly based on the rates above.

Section 3. Condemned Animal Carcasses. - (a) No Condemned animal or fowl shall be slaughtered or if already slaughtered be move out of the slaughterhouse except for immediate destruction of the carcass and vice versa.

(b) All condemned animals or fowls carcasses or meat shall be confiscated by the City Veterinarian for sanitary disposal.

Section 4. Penalty. - Any person who shall slaughter his animal or fowl for commercial purposes outside the City- accredited slaughterhouses or designated slaughterhouse or brings in slaughtered animal fowl or meat without entry permit shall be punished by fine of not less than One Thousand (phpl,000.00) Pesos but not more than Five Thousand (PhpS,000.00)Pesos or an imprisonment of not less than one (1) month but not more than six (6) months or both in the ,discretion of the court.

ARTICLE B MEAT HANDLER'S REQUIREMENTS

Section 5. Meat Handlers. - The City Government of Santa Rosa shall require licensing and registration of butchers' meat dealers and meat stalls. All butchers, meat vendors, dealers and meat stall/shop, owners/ operators must first se cure the meat Handler's Licenses or Butchers license from the Meat Safety Inspection Board in addition to the following, to wit:

1. Health Certificate from the City Health office 2. Police Clearance 3. Barangay Clearance & other requirements that the committee may be deemed proper.

ARTICLE C OFFICE OF THE CITY VETERINARIAN

Section 6. - Qualifications, Powers & Duties of the City Veterinarian. - (a) No person shall be appointed veterinarian unless he is a citizen of the Philippines, a resident of the local government unit concerned, of good moral character, a licensed doctor of veterinary medicine. He must have practiced his profession for at least three (3) years in the case of City Veterinarian. The appointment of a veterinarian officer is mandatory for city governments.

(b) The veterinarian shall take charge of the office for veterinary services and shall:

1. formulate measures for the consideration of the Sanggunian and provide technical assistance and support to the governor or mayor, as the case may be, in carrying out measures to ensure the delivery of basics services pursuant to law;

2. Develop plans and strategies and upon approval thereof by the City Mayor, implement the same, particularly those which have to do with the veterinary - related activities which the City Mayor is empowered to implement and which the Sanggunian is empowered to authorize;

3. In addition to the foregoing duties and functions, the veterinarian shall:

I. Advise the City Mayor, as the case may be, on all matters pertaining to the slaughter of animals for human consumption and the regulation of slaughterhouses;

II. Regulate the keeping of domestic animals; III. Regulate and inspect poultry milk and dairy products for public consumption; IV. Enforce all laws and regulations for the prevention of cruelty to animal; and V. Take the necessary measures to eradicate, prevent or cure all forms of animal diseases;

4. Be in the frontline of veterinary related activities such as in the outbreak of highly-contagious and deadly diseases and situations resulting in the depletion of animals for work of human and consumption, particularly those arising from and in the aftermath of manmade and natural calamities and disasters;

5. Recommend to the Sanggunian and advise the City Mayor, as the cases may be, on all other matters relative to veterinary services which will increase the number and improve the quality of livestock, poultry and other domestic animals used for work or human consumption; and

© Exercise such other powers and perform such other duties functions as may be prescribed by law or ordinance.

Section 7. Administrative Provisions - (a) The slaughter of any kind of animal intended for sale, shall only be done only in the city slaughterhouse designated as such by the Sangguniang Panlungsod. The slaughter of animals intended for home consumption may be done elsewhere, except large cattle which shall be slaughtered only in a public slaughterhouse. The animal slaughtered for home consumption shall not be sold or offered for sale.

(b) Before issuing permit for the slaughter of large cattle inside the slaughterhouse. The Officer­in Charge of the slaughter shall require the branded cattle, the production of the certificate of ownership and certificate of transfer showing title in name of the person applying for the permit if he she is not the original owner. If the applicant is not the original owner, and there is no certificate of transfer made in his favor, one such certificate s hall be issued and the corresponding fee shall be collected therefore. For unbranded cattle that has not yet reached the age of branding, the Officer-In-Charge of the slaughterhouse shall require such evidence satisfactory to him regarding the ownership of the animal for which the permit to slaughter has been requested. For unbranded cattle of the required age, the necessary certificate of ownership, and/or transfer shall be secured, and the corresponding fees shall collect therefore before the slaughter permit is granted.

(c) Before any animal is slaughtered for public consumption, a permit therefore shall be secured from the City Health Officer or his duly authorized representative, preferably, the City veterinarian of the meat inspector, if any. The permit shall bear the date and month of issue and the stamp of the City Health Officer, as well as the page of the book in which said permit is entered and wherein the name of the permit fee and the kind and sex of the animal to be slaughtered appear.

(d) The permit to slaughter as herein required shall be kept by the owner to be posted in a conspicuous place in his/ her stall at all times.

Section 8. Penalty. - Any violation of the foregoing shall be punished by a fine of not less than One Thousand Pesos (Phpl,000.00) but not more than Five Thousand Pesos (PhpS,000.00) or imprisonment of not less than one (1) month but not more than six (6) months, or both such fine and imprisonment at the discretion of the court.

CHAPTER VI GENERAL PROVISIONS

Section 1. Penalty - Any violation of the provisions of this code not herein otherwise covered by a specific penalty, or of the rules and regulations promulgated under authority of this code, shall be punished by a fine not exceeding Five Thousand (PhpS, 000.00) Pesos or imprisonment of not exceeding six (6) months or both such fine and imprisonment at the discretion of the court.

Payment of fine or service of imprisonment as herein provided shall not relieve the offender from the payment of the delinquent tax, fee or charge imposed under this code.

If the violation is committed by any juridical entity, the resident General Manager or any person entrusted with the administration thereof at the time of the commission of the violation shall be held responsible or liable therefore.

Section 2. Compromise Settlement Fee. - Except as otherwise provide under this ordinance, the City Mayor is hereby authorized to enter into an "extrajudicial" or out-of-court settlement of any offense involving violations of any provisions of this code subject, however, to the following conditions, wit:

1) That the offense does not involve fraud . 2) That the offender shall pay a fee of not less than Three Hundred Pesos (Php300.00) but

not more than Two Thousand Pesos (Php2, 000.00) as may be agreed by both parties. 3) That the payment of the compromise settlement fee above mentioned shall not relieve

the offender from the payment of the corresponding tax, fee or charge due from him as provided under this Code, if he is liable therefore.

CHAPTER VII FINAL PROVISIONS

Section 1. Separability Clause. - If for reason, any provision, section or part of this Code is declared not valid by a court of competent jurisdiction or suspended or revoked by the Sangguniang Panlungsod, such judgment shall not affect or impair the remain ing provisions, sections, or parts thereof which shall remain or continue to be in full force and effect.

Section 2. Repealing Clause. All ordinances, rules and regulations, or parts thereof, that are in conflict with, or in consistent with any provision of this code, are hereby repealed, amended or modified accordingly.

Section 3. Effectivity. - This Code shall take effect upon passage by the Sangguniang Panlungsod, approval by the City Mayor and one (1) day after publication in a newspaper of local circulation.

ENACTED in the City of Santa Rosa during the regular session of the Sangguniang Panlungsod this 23rd day of December, in the year of our Lord Two Thousand Thirteen.
