modification to provide for the conti­nuance of the customs union arrange­ments in the changed circumstances ona basis designed to ensure the continuedeconomic development of tbe customsunion area as a whole, and to ensurein particular that these arrangementsencourage the development of the lessadvanced members of the customs unionand the diversification of their econo­mies, and afford to aU parties equitablebenefits arising from trade among them­selves and with other countries;

Have agreed as follows:

ARTICLE 1

DEFINITIONS

In this Agreement. unless inconsistentwith the oontext-

"additional duties" means duti~ imposediIi terms Of Article 6 of this Agree­ment;

"Botswana" means the area of the Repu­blic .of Botswana;

"common customs area" means the com­bined areas of Botswana:. Lesotho.South Africa and Swaziland;

"customs duties", "excise duties" and"sales duties" mean customs duties,excise duties arid sales duties as definedin the customs and excise legislationin force in the countries of the con­tracting parties;

"financial· year" means the period oftwelve months commencing on the firstof April;

"Lesotho" means the area of the King­dom of Lesotho;

"South Africa" means the area in respeCtof which the Government of the Repu­blic of South Africa is a contractingparty to the General Agreement onTariffs and Trade;

"Swaziland" means the area of the King­dom of Swaziland;

and cognate expressions shall be construedaccordingly.

ARTICLE 2

INTERCHANGE OF OOMESTICPRODUCTS

ARTIKEL 1

WOORDOMSKRYWING

In hierdie Ooreenkom~tensy strydig metdie samehang, beteken~

"bykomende regte" regte· gehef kragtensArtikel 6 vanhierdie Ooreenkoms;

"Botswana" die gebied van die RepubliekBotswana;

"gemeenskaplike doeanegebied" die gesa­mentlike gebiede van Botswana, Leso~

tho, Suid-Afrika en Swaziland;"doeaneregte". "aksynsregte" en "verkoop

regte" doeaneregte. aksynsregte en ver­koopregte soos omsktyf in die doeane­en aksynswetgewing van kr~g in dielande van die kontrakterende partye;

"boekjaar" die tydperk van twaalf maandcwat op die eerste dag van April begin;

"Lesotho" die gebied van die Koninkrykvan Lesotho;

"Suid-Afrika" die gebied ten opsigte waar­van die Regering van die Republiekvan Suid-Afrika 'n k?ntrakterende partyby die Algemene· Ooreenkoms OOrTariewe en Handel is;

"Swaziland" die gebied van die Konin­kryk van Swaziland;

en moet verwanteuitdrukkings dienooreen­komstig uitgele word.

ARTIKEL 2

VERKEER VAN PLAASLIKEPRODUKTE

Uitgesonderd soos eld~rs in. hierdie Oor­eenkoms hepaal, mag 'n k~ntrakterendepartyDie kwantitatiewe beperkiJtgs toepas of enigeregte opIe op goedere wat in die gemeen­skaptike doeanegebied verbou. geproduseerof vervaardig is, by die invoer daarvan uitdie gebied van enigeen van die ander kon­trakterende partye nie.

ARTICLE 3

INTERCHANGE OF GOODSIMPORTED FROM OUTSIDE THE

COMMON CUSTOMS AREA

Except as elsewhere provided herein acontracting party shall not impose anyduties on goods which were imported fromoutside the common customs area onimportation of such goods from the areaof any other contracting party.

ARTICLE 4

CUSTOMS AND SALES DUTIES ONIMPORTED GOODS

(1) Except as elsewhere provided herein,the customs tariff and duties and the salesduties as in force in South Africa fromtime to time shall be applied to goodsimported into the common customs areafrom outside such area.

(2) Any rebates, refunds or drawbacksof customs duty or sales duty on importedgoods granted by the Government of Bot­swana, Lesotho or Swaziland in respect ofsuch goods for use· in or used in anyindustry shall be identical to any suchrebates, refunds Of drawbacks in force inSouth Africa in respect of such goods foruse in or used in a corresponding industryin South Africa.

(3) Subject to paragraphs (2) and (4),all other rebates, refunds or drawbacks ofcustoms duty or sales duty on importedgoods granted by the Government of Bot­swana, Lesotho or Swaziland in respect ofsuch goods shall be similar to any suchrebates, refunds or drawbacks in force inSouth Africa.

(4) (a) A contracting party may grant afull rebate of the customs and sales dutiesin respect of goods imported into its area:

(i) for the relief of distress of personsin cases of famine and other nationaldisaster;

(ii) under any technical assistance agree­ment; and

(iii) in terms of an obligation under anymultilateral international agreementto which such contracting party isor becomes a party.

(b) A contracting party may, with theprior approval of the other contracting par­ties, grant a full rebate of the customs andsales duties in respect of goods importedinto its area for such other purposes asmay be agreed upon by the parties to thisAgreement from time to time.

ARTIKEL 3

(1) Uitgesonderd soos elders in bierdieOoreenkoms bepaal, is die doeanetarief en-regte en verkoopregte wat van tyd tot tydin Suid-Afrika van krag is, van toepassingop gocdere wat van buite die gemeenskap­like doeanegebied in sodanige gebied inge­voer word.

(2) Enige kortings, terugbetalings of terug­gawes van doeane- of verkoopreg op inge­voerde goedere wat deur die Regering vanBotswana, Lesotho of Swaziland toegestaanword op sodanige goedere bestem vir gebruikin of reeds gebruik in enige nywerheid. meetidenties wees met enige sodanige kortings,terugbetalings of teruggawes.wat in Suid­Afrika van krag is ten 'opsigte van sodanigegoedere vir gebruik in of reeds gebruik in'0 ooreenstemmende nywerheid in Sujd·Afrika. -f

(3) Beholldens die bepalings van para­grawe (2) en (4) moet aIle ander kortings,terugbetalings of teruggawesvan doeane- ofverkoopreg op ingevoerde goedere wat dieRegering van Botswana, Lesotho of Swazi­land op sodanige goedere toestaan, soort­gelyk wees aan enige sodanige kortings,terugbetalings of teruggawes van krag inSuid-Afrika.

(4) (a) 'n Kontrakterende party kan 'nvolle korting van die doeane- en verkoop­reg toestaan ten opsigte van goedere watin sy gebied ingevoer word:

(i) vir die verligting van menslike noodin geval1c van hongersnood en andernasionale rampe;

(ii) ingevolge enige tegniese hu)p-ooreen­koms; en

(iii) ingevolge'n verpligting ooreenkomstigenige multilaterale internasionale oor­eenkoms waarby sodanige kontrak­terende party 'n party is of word.

(b) Met die voorafgaande goedkeuring vandie ander kontrakterende partye, kan 'n kon­trakterende party '0 volle korting van diedoeane- en verkoopreg toestaan ten opsigtevan goedere wat in sy gebied ingevoer wordvir enige ander doeleindes, soos van tydtot tyd deur die partye by hierdie Oorcen­korns ooreengekom mag word.

ARTICLE 5

IMPOSITION AND AMENDMENT OFCUSTOMS DUTIES

(1) Subject to the provisions of para­graph (2) of this Article, the Governmentof South Africa shall give the other con­tracting parties adequate opportunity forconsultations before imposing. amending orabrogating any customs duty with· respectto goods imported into the common cus­toms area from outside such area.

(2) Paragrapb (1) of this Article shall notapply if the imposition of, or the removalof. or an amendment to any customs dutyeither forms part of the measures of theGovernment of South Africa designed pri­marily for fiscal purposes, or is resortedto .as an interim measure designed to assista local industry in the common customsarea pending the completion of an inves­tigation by the appropriate South Africanauthorities.

ARTICLE 6

IMPOSITION OF ADDITIONALDUTIES FOR PROTECfIVE PURPOSESBY BOTSwANA, LESOTHO OR SWAZI-

LAND

(1) The Government of Botswana.Lesotho or Swaziland may levy additionalduties on goods imported into its area toenable ~ew industries in its area to meetcompetition from other producers or manu­facturers in the common customs area, pro­Vided that such duties are levied equallyon goods grown, produced or manufacturedin other 'parts of the common customs areaand like products imported from outsidethat area, irrespective of whether the lattergoods are imported directly or from thearea of any other party to this Agreementand subject to payment of the customsduties applicable to such goods on impor­tation into the common customs area.

(2) Before any such duties are imposedor amended the Government concernedshall consult the other contracting partiesin terms of Article 20, and such partiesmay make recommendations thereon. H therecommendations of any such parties arenot acted upon, the Government concernedshall inform the other contracting partiesof the reason for its decision.

(3) Protection which is afforded to anew industry in terms of this Article shallnot be given for a period exceeding eightyears without the prior· consent of the· con­tracting parties.

ARTIKEL 5

ARTI~EL 6

OPLEGGING VAN BYKOMENDEREGTE VIR BESKERMINGSDOELEIN­DES DEUR BOTSWANA, LESOTHO OF

SWAZILAND

(1) Die Regering van Botswana, Lesothoof Swaziland kan bykomende regte hef ~op

goedere wat in sy gebied ingevoer 'word ten'einde nuwe nywerhede in sy gebied in staatte stel am mededinging van ander produ­sente of vervaardigersin die genieenskap­like doeanegebied die hoof te bied, mitssodanige regte in geJyke mate gebef wordop goedere verbou. geproduseer of vervaar­dig in ander dele van: die gemeenskapJikedoeanegebied en soortgelyke produkte watvan buite .daardie gebied ingevoer word,ongeag of laasgenoemde goedere regstreekseof deur die gebied van .'n ander party byhierdie Ooreenkoms ingevoer word en onder­worpe aan die betating van die doeaneregtewat op sodanige goedere by invoer in diegemeenskaplike doeanegebied van toepassingis.

(2) Voordat sodanige regte geher of gewy­sig word. moet die betrokke Regering dieander kontrakterende partye ooreenkomstigArtikel 20 raadpleeg en sodanige partyekanaanbevelings daaroor doen. Indien daar nievolgens die aanbeve1'ings van sodanige anderpartye gehandel word nie moet die betrokkeRegering die redes vir I sy besluit aan dieander kontrakterende partye verstrek.

(3) Beskerming wat kragtens hierdie Arti­kelaan 'n nuwe nywerbeid verleen word.mag nie vir '0 tydperk, langer as agt jaarsonder die voorafgaande tbestemming ,vandie kontrakterendepartyc verleen word nie.

(4) In this Article, "new industry" inrelation to· any contracting party means anindustry which has been established· in thearea of that party for not more than eightyears.

ARTICLE 7

SPECIFICATION OF INDUSTRIES OFMAJOR IMPOR T ANCE TOBOTSWANA, LESOTHO OR SWAZI-

LAND

(1) The Government of Botswana, Leso­tho or Swaziland may with the concurrenceof the other contracting parties~

(a) specify industries which are or arelikely to be of major importance toits economy; and

(b) specify periods in relation to suchindustries for the purposes of para­graph (2) of this Article.

(2) The customs duties applicable togoods, imported from outside the commoncustoms area and competing with those ofany industry specified in terms of thisArticle, shall not for the period specifiedin terms of paragraph (1) (b) above in

.. relation to that industry be decreased· orabrogated without the consent of theGovernment specifying the industry; andduring such period the GoverJ"!.ment of SouthAfrica shall with due regard to the inte­rests of the other contracting· parties andto the criteria usually applied by it in theconsideration of representations for tariffassistance and relief, give sympathetic con­sideration to proposals by any other con­tracting party to increase any customs dutyapplicable to such goods or to affordrelief of customs duty applicable to anymaterial, used directly in the production ormanufacture thereof and to requirementsfor such industries, where the Governmentconcerned regards such increase or reliefnecessary to assist the establishment of suchindustry or to prevent its contraction.

ARTICLE 8

EXCISE AND SALES DUTIES ONGOODS PRODUCED IN THE COMMON

CUSTOMS AREA

(1) The excise duties and the sales dutiesas in force in South Africa from time totime shall be applied to goods grown, pro­duced or manufactured in the commoncustoms area.

(2) Any rebates, refunds or drawbacksof·· excise duty or sales duty granted bythe Government of Botswana, Lesotho orSwaziland in respect of goods grown, pro­dUCedor manufactured in Ute common

(4) In hierdie Artikel beteken"nuwenywerheid", met betrekking tot enige kon­trakterende party, 'n nywerheid wat in diegebiedvan daardie party vir nie langer asagt jaar gevestig is nie.

ARTIKEL 7

SPESIFISERING VAN NYWERHEDEVAN BESONDERE BELANG VIRBOTSWANA, LESOTHO OF SWAZI·

LAND

(1) Die Regering van Botswana, Lesothoof Swaziland kan, met die instemming vandie ander kontrakterende partye-

(a) nywerhede spesifiseer wat vir sy eko­nomie van besondere belang is ofwaarskynlik sal wees; en

(b) tydperke spesifiseer met be!rekkil1!! totsodanige nywerhede vir doeleindes-vanparagraaf (2) van hierdie Artikel.

(2) Die doeaneregte wat van toepassing isop gocdere wat van buite die gemeenskaplikedoeanegebied ingevoer word en wat meedingmet die van 'n nywerheid wat kragtens hier­die Artikel gespesifiseer is mag vir die tyd­perk ingevolge paragraaf (1) (b) hierbo tenopsigLe van daardie nywerbeid gespesifiseer,nie verminder of ingetrek word sonderdieinstemming van die Regering wat dienywer­heid gespesifiseer het nie; en gedurende soda­nige tydperk moet die Regering van Suid­Afrika; met inagneming van die belangevan die ander kontrakterende partye en diemaatstawwe wat hy gewoonlik by die oor­weging van vertoe am tariefbystand en -ver­ligting toepas, simpatieke oorweging skenk:aan voorstelle deur enige ander kontrak­terende party vir verhogillg van enige doe­anereg wat op sodanige goedere van toe­passing is of vir verligting van doeaneregwat van toepassing is op enige stof watregstreeks in die produksie of vervaardigingdaarvan gebruik word en op benodigdhedevir sodanige nywerhede, in gevalle waar diebetrokke Regering sodanige verhoging ofverligting as noodsaaklik ag am die vestig­ing van sodanige nywerheid te bevorder ofdie inkrimping daarvan te vermy.

ARTIKEL 8

AKSYNS- EN VERKOOPREGTE OPGOEDERE GEPRODUSEER IN DIEGEMEENSKAPLIKE DOEANEGEBIED

(1) Die aksynsregte en die verkoopregtesoos van tyd tot tyd van krag in Suid­Afrika is van toepassing op goedere ver­bou, geproduseer of vervaardig in die ge­meenskaplike doeanegebied.

(2) Enige kortings, terugbetalings of terug­gawes van aksyns- of verkoopreg wat deurdie Regering van Botswana, Lesotho of

. Swaziland toegestaari. word ten opsigte vangoedere verbou, geproduseer of vervaardig

customs area, for use in or used in anyindustry shaH be identical to any suchrebates, refunds or drawbacks in force inSouth Africa in respect of such goods foruse in or used in a corresponding industryin South Africa.

(3) All other rebates, refunds or draw­backs of excise duty or sales duty grantedby the Government of Botswana, Lesothoor Swaziland in respect of goods grown,produced or manufactured in the commoncustoms area shall be similar to any suchrebates, refunds or drawbacks in force inSouth Africa.

ARTICLE 9

DUTIES ON GOODS PRODUCED nySPECIFIED INDUSTRIES

(l) If goods grown. produced or manu­factured . in Botswana, Lesotho or Swazi­land, by an industry specified in pursuanceof Article 7 of this Agreement, are sub­ject to excise duties, the margin of protec­tion afforded by the customs duty applic­able to such goods shall be maintainedfor the period specified under that Articleand may be changed only with the agree·ment of the Govemmentspecifying theindustry.

(2) During the specified period theGovernment of South Africa shall with dueregard to the interests of the other con­traCting parties and to the criteria usuallyapplied by it in the consideration of repre­sentations for tariff assistance and relief,give sympathetic consideration to proposalsby such a Government to reduce or abro­gate any excise duty applicable to suchgoods where such a Government regardssuch duty as injurious to that industry.

ARTICLE 10

LAWS RELATING TO CUSTOMS,EXCISE AND SALES DUTIES

Subject to the provisions of Articles 4and 8. the Governments of Botswana,Lesotho and Swaziland shall apply lawsrelating to customs, excise and sales dutysimilar to such laws in force in SouthAfrica from time to time.

ARTICLE 11

IMPORT AND EXPORT PROHIBI·TIONS AND RESTRICTIONS

(l) The contracting parties recognise theright of each party to prohibit or restrictthe importation into or exportation fromits area of any goods for economic, social.cultural or other reasons.

ARTIKEL 9

REGTE OP GOEDERE GEPRODUSEERDEUR GESPESIFISEERDE

NYWERHEDE

(1) Indien goedere verbou, geproduseer ofvervaardig in Botswana, Lesotho of Swazi­land deur 'n nywerheid gespesifiseer. inge­volge Artikel 7 van hierdie Ooreenkoms,onderworpe is aan aksynsregte, moet diebeskermingsmarge verleen deur die doeane·regte wat op sodanige goedere van toepas­sing is, gehandhaaf word gedurende die tyd­perk kragtens daardie Artikel gespesifiseeren sodanige beskermingsmarge kan slegs metinstemming van die Regering wat die nywer­heid spesifiseer, verander word.

(2) Gedurende die gespesifiseerde tydperkmoet die Regering van Suid-Afrika, metinagneming van die belange van die anderkontrakterende partye en die maatstawwewat hy gewoonlik by die oorweging vanvertoe om tariefbystand en -verligting toe­pas, simpatieke oorweging skenk aan voor­stelle deur sodanige Regering vir vermin­dering of intrekking vanenige aksynsregte

.wat op sodanige goedere van toepassing isindien sodanige Regering van mening is datsodanige regte nadelig vir die nywerheid is.

ARTIKEL 10

WETTE MET BETREKKING TOTDOEANE-, AKSYNs. EN VERKOOP­

REGTE

Die Regerings van Botswana, Lesotho enSwaziland moet, behoudens die bepalingsvan Artikels 4 en 8,wette met betrekkingtot doeane-, aksyns- en verkoopregte toepassoortgelyk aan sodanige welte wat van tydtot tyd in Suid-Afrika van krag is.

ARTlKEL 11INVOER- EN UlTVOERVERBIEDINGE

(2) Except in so far as may be agreedupon between the parties from time to timethe provisions of this Agreement shall notbe deemed to suspend or supersede the pro­visions of any law within any part of thecommon customs area which prohibits orrestricts the importation or exportation ofgoods.

(3) The provisions of paragraphs (1) and(2) shaH not be so construed as to permitthe prohibition or restriction of the impor­tation by any contracting party into itsarea of goods grown. produced or manu~

factured in other areas of the common cus­toms area for the purpose of protecting itsown industries producing such goods.

(4) A contracting party shall uponrequest by any other contracting party takesuch steps as may be agreed upon betweenthe parties concerned (including action tomake such steps legally enforceable withinits area) to prevent the exportation orunrestricted exportation from its area tothe area of such other contracting partyof such prohibited or restricted goodsimported from outside the common cus­toms area or grown, produced or manu­factured in its area or to prevent theexportation or unrestricted exportation fromits area to a country outside the commoncustoms area of such prohibited or restric­ted goods imported from the area of suchother contracting party.

(5) The contracting parties shall co-ope­rate in the application of import restric­tions with a view to ensuring that theeconomic objectives of any import controllegislation in any country in the commoncustoms area are attained.

ARTICLE 12

ARRANGEMENTS FOR REGULAT.ING THE MARKETING OF AGRICUL­

TURAL PRODUCTS

(l) Whenever an arrangement for regu­lating the marketing of an agricultural com·modity is in operation in any area of thecommon customs area, such arrangementshan be applied on an equitable basis tosimilar commodities produced in any otherarea of the common customs area andmarketed in the area where the marketingarrangement is in operation. and the con­tracting parties concerned. cognisant of theadvantages deriving from the effective ope­ration of these arrangements, shall co-ope­rate in such arrangements on a basis to bemutually agreed upon.

(2) The contracting parties agree to con­sult from time to time on matters affectingproduction and consumption of agriculturalcommodities and the improvement andextension of marketing arrangements, for8uch commodities.

(4) 'n Kontrakterende party moet op ver­soek van enige ander kontrakterendc partysodanige stappe doen as waartoe die betrok.ke partye ooreenkom (insluitende handelingom sodanige stappe wettiglik binne sy gebiedafdwingbaar te maak) am die uitvoer ofonbeperkte uitvoer uit sy gebied na diegebied van sodanige ander kontrakterendeparty te verhoed van sodanige verbode ofbeperkte goedere ingevoer van buite diegemeenskaplike doeanegebied of verbou.geproduseer of vervaardig binne sy gebied.of am die uitvoer of onbeperkte uitvoeruit sy gebied na 'n land buite die gemeen­skap}ike doeanegebied van sodanige verbodeof beperkte goedere wat vanuit die gebiedvan sodanige. ander kontrakterende partyeingevoer is, te· verhoed.

(5) Die kontrakterende partye werk by djetoepassing van invoerbeperkings saam am teverseker dat die ekonomiese oogmerke vanenige invoerbeheerwetgewing in enige landin die gemeenskaplike doeanegebied,bereikword.

ARTIKEL 12

REELINGS VIR DIE REGULERINGVAN DIE BEMARKING VAN LAND­

BOUPRODUKTE

(1) Wanneer oak al 'n reeling vir dieregulering van die bemarking van landbou­kommoditeite in enige deel van die gemeen­skaplike doeanegebied in werking is, wordsodanige reelings op. 'n billike grondslagtoegepas op soortgeIyke kommoditeite watiri enige ander deel van die gemeenskap­like doeanegebied geproduseer en in diegebied waar die bemarkingsreeling in wer­king is, bemark word, en die betrokkekontrakterende partye. bewus van die voor­dele wat uit die doeltreffende werking vanhierdie reelings voortspruit. moet in soda­nige reelings op 'n onderling ooreengekomebasis saamwerk.

(2) Die kontrakterende partye stem in amvan tyd tot tyd oorleg te pleeg oar aan­geleenthede rakende die produksie en ver­bruik: van Pandboukommoditeite en die ver­betering en uitbreiding van bemarkings­reelings ten opsigte van sodanige kommo­diteite.

POOL OF CUSTOMS, EXCISE. SALESAND ADDITIONAL DUTIES

Any customs, excise. sales and additionalduties collected in the common customsarea shall be paid quarterly into the Con­solidated Revenue Fund of South Africa.

ARTICLE 14

THE POOL OF CUSTOMS EXCISE.SALES AND ADDITIONAL DUTIES

(1) The common revenue pool of thecommon customs area shall consist of thegross amounts of customs. excise, sales andadditional duties leviable and collected ongoods imported into or produced in thecommon customs area. and any otherduties coUected in terms of Article 19 (3).but shall not include any duties rebated orrefunded under the provisions of any lawr~latin& to customs. excise and sales duty(mcl';1dmg any. rebate or refund specificallyprovided for 10 any such law but whichis paid from voted· funds and not deductedfrom customs, excise and sales dutyrevenue).

(2) The contracting parties agree that indetermining the share of Botswana. Lesothoor Swaziland of the common revenue poolin respect of any financial year the follow­ing formula shall be used:

The cost-insurance-freight value at bor­der of goods from aU sources importedduring the financial year into the areaof each party. plus the value of excisableand sales duty goods produced and con­sumed in such area during such year.plus the excise and sales duties paidthereon during such year shall be expres­sed as a percentage of the cost-insurance­freight value of the goods importedduring the financial year into the com­mon customs area. plus the customs andsales duties paid thereon during suchyear. plus the value of excisable andsales duty goods. produced and consumedduring such year in the common cus­tOlnS area. plus the excise and salesduties paid thereon during such year.The amount calculated by the applica­tion to the common revenue pool of thepercentage so obtained. enhanced by amultiplying factor of 1·42. shall repre­sent the share of each of the three coun­tries in respect of that financial year.

(3) There shall be paid from the Con­solidated Revenue Fund of South Africa tothe Governments of Botswana. Lesotho

(1) Die gesamentlike inkomstepoel vandie gemeenskaplike doeanegebied bestaanuit die brutobedrae van doeane-. aksyns-.verkoop- en bykomende regte hefbaar eningevorder op goedere wat in die gemeen­skaplike doeanegebied ingevoer of geprodu­see~ is en ernge ander regte wat ingevolgeArtikel 19 (3) ingevorder is, maar sluit nieenige ~egte in nie wat gekort of terug­betaal IS kragte~s die voorsiening in enigewet met betrekking tot doeane-, aksyns- enverkoopregte (insluitende enige korting ofterugbetaling waarvoor lIitdruklik voorsie­ning in sodanige wette gemaak is maar wathetaal word uit bewilligdefondse en nieafgetrek word van doeane-, aksyns- en ver·koopreginkomste nie).

be used and that agreed estimatesof the values of sales duty goodsproduced and consumed in thefinancial year 1969/70 and the salesduties collected thereon shall beincluded:

(d) in: respect of the financial year1969/70: an amount equal to thedifference between the total amountactually received by each country inrespect of that year and the amountdue to each country in terms ofthe formula referred to in paragraph(2) above, calculated on the basisof the relevant data for the finan­cial year. 1968/69, except that inthe case of import values 1968 datashall be used, and that no imputedallowances for the values of salesduty goods produced and consumedand the sales duties thereon shallbe included.

(4) The amounts referred to in subpara­graphs (a) and (b) of paragraph (3) aboveshall be determined and agreed uponbetween the contracting parties approxi­mately six months before the beginning ofthe financial year in question.

(5) The amounts referred to in subpara­graphs (0), (b) and (c) of paragraph (3)above shall be remitted in equal quarterlyinstalments during the financial year inquestion.

(6) The payment referred to in subpara­graph (d) of paragraph (3) above shall bemade before the end of the financial year1969/70.

(7) The Government of South Africaundertakes to consult the Governments ofBotswana, Lesotho and Swaziland prior tothe introduction of changes in the fiscalstructure of· South Africa where these areexpected to have a substantial effect onthe structure of taxation measures relatingto the common revenue pool.

(8) This Article shall be deemed to havecome into operation on the first day ofApril, 1969, and to have been su~stitutedfrom that date for the correspondmg pro·visions of the Customs Agreement concludedon 29 June 1910.

ARTICLE 15

RAIL AND ROAD TRAFFIC

(1) The contracting parties undertake thatthe tranpt through their areas of goodsimported from outside the common cus­toms are;1 to or exported to a country out·side the· common customs area from theareas of -the other contmcting parties shallDot be subject to transport rate discrimi­nation.

(4) Die bedrae in sl,lbparagrawe (a) en(b) van paragraaf (3) hierbo genoem, wordbepaal en daaroor word ooreengekom tus­sen die kontrakterende partye ongeveer sesmaande voor die aanvang van die betrokkeboekjaar.

(5) Die bedrae in subparagrawe (a), (b)en (e) van paragraaf(3) hierbo genoemword· in geJyke kwartaallikse paaiementegedurendedie betrokke boekjaar.betaal.

(6) Die betaling in sobparagraaf (d) vanparagraaf (3) hierbo genoem. word voordie einde van die boekjaar 1969/70 gemaak.

(7) Die Regering van Suid-Afrika onder­neem om met die RegeHngs van Botswana.Lesotho en Swaziland oorleg te pleeg voordie inwerkingsteUing van veranderings inSuid-Afrika se belastingstruktuur,in gevallewaar verwag word dat die veranderings 'nwesenlike uitwerking op die struktuur vanbeJastingmaatreels met betrekking tot diegesamentlike inkomstepoel sal he.

(8) Hierdie ArtikeJ word geag op dieeerste dag van April \969 in werking tegetree het en om vanllf daardie datum indie plek gestel te gewees het van die oor­eenstemmende bepalings van die Doeane­ooreenkoms wat op 29 Junie 1910 aange­gaan is.

ARTIKEL 15

(2) Each contracting party shall ensurethat the tariffs applicable within its areato the conveyance of goods by publicly­owned transport to and from the otherareas of the common customs area shallbe no less favourable than the tariffsapplicable to the carriage of similar goodswithin its area.

(3) Each contracting party undertakes toextend to the motor transport operatorsregistered in the areas of the other con­tracting parties treatment no less favour­able than that accorded to motor trans­port operators registered within its ownarea for. the conveyance of goods or pas·sengers for reward or in the course of anytrade or business.

ARTICLE 16

FREEDOM OF TRANSIT

A contracting party shall afford freedomof transit without discrimination to goods~nsigoed to and from the areas of theother contracting parties: Provided, how­ever, that a contracting party may imposesuch conditions upon such transit as itdeems necessary to protect its legitimateinterests in respect of goods of a kind ofwhich the importation into its area is pro­hibited on grounds of public morals, publichealth or. security, or as a precautionagainst animal or plant diseases, parasitesand insects, or in pursuance of the provi­skins ofa multilateral international con·vention to which it is a party: And pro­vided, further, that a contracting party shallnot be precluded from refusing transit, orfrom taking any measures deemed neces­sary by it in connection with such transit,for the purpose of protecting its securityinterests.

ARTICLE 17

BILATERAL CONSULTATIONS

Notwithstanding the provisions of Article2, if, as a resuh of unforeseen develop­ments, any product is being introduced intothe area of one of the contracting partiesfrom the area of another contracting partyin such increased quantities and undersuch conditions as to cause or threatenserious injury to producers or manufac­turers of like or directly competitive pro­ducts in the area into which such goodsare so introduced, the Government of thelatter area shall have the right to requirethe other party to consult at the earliestpossible opportunity and to co-operate withit in finding as soon as possible a mutuallyacceptable solution.

(2) Eike kontrakterende party moet toe­sien dat die tariewe wat binne sy gebiedvan toepassing is op die vervoer vangoedere deur openbare vervoer na en vandie ander gebiede van die gemeenskaplikedoeanegebied nie minder guns~ig is as dietariewe wat van toepassing is op die ver­voer van soortgelyke goedere binne sy eiegebied nie.

(3) Eike kontrakterende party onderneemom aan die motorvervoerkarweiers wat indie gebiede van die ander kontrakterendepartye geregistrecr is behandeling te ver­Ieen wat nie minder gunstig is nie as diewat verleen word aan motorvervoerkar­weiers wat in sy eie gebied geregistreer isvir die vervoer van goedere of passasiersteen vergoeding of in die loop van enigehandel of bedryf.

ARTIKEL 16

VRYHEID VAN DEURVOER

'n Kontrakterende party moet vryheidvan deurvoer sander diskriminasie aan goe­dere verleen wat versend word na en vandie gebiede van die ander kontrakterendepartye: Met dien verstande dat '0 kontrak­terende party sodanige voorwaardes opsodanige deurvoer kan plaas as wat hynoodsaaklik ag vir die beskerming van syregmatige belange ingeval van goederevan'n aard waarvan die invoer in sy gebiedverbied is op grond van openbare sedes,openbare gesondheid of veiligheid of asvoorsorg teen dier- of plantsiektes, para­siete en insekte. of ooreenkomstig die bepa­linge van 'n multilaterale internasionalekonvensie waarby hy 'n party is: En metdien verstande verder dat 'n kontrakterendeparty nie verhinder word nie om deur­voer te weier of om maatreeIs te tref wathy noodsaaklik ag in verband met sodanigedeurvoer ter beskerming van sy veiligheids­belange.

ARTIKEL 17

BILATERALE OORLEGPLEGING

Nieteenstaande die bepalings van Artikel2, indien enige produk as gevolg vanonvoorsiene ontwikkelinge die gebied vaneen van die kontrakterende partye uit diegebied van 'n ander kontraktereode partybinnekom in sulke toenemende hoeveelhedeen onder sulke omstandighede dat dit dieoorsaak is of 'n bedreiging iohou vanernstige skade aan produsente of vervaar­digers van soortgelyke of regstreeks mede­dingende produkte in die gcbied waarinsodanige produkte binnekom, het die Rege­ring van hasgenoemde gebied die reg amdie ander party te versoek om by dievroegsmoontlike geIecntheid oorleg te pleegen met hom saam te werk om so goumoontlik 'n onderling aanvaarbare oplossingte vind.

TERS

Subject to the provisions of Article 11,the c<;mtracting parties recognise the impor­tance of measures prescribing zoo-sanitaryand phyto-sanitary requirements aimed atthe prevention of the spread of animal andplant diseases, parasites and insects andagree .to consult from time to time toachieve such aim in the common customsarea with due regard to the need to faci­litate the flow of trade in productsaffected by such measures.

ARTICLE 19

TRADE AGREEMENTS WITH COUN­TRIES OUTSIDE THE COMMON CUS­

TOMS AREA

(1) A contracting party shall Dot, withoutthe prior concurrence of the other con­tracting parties and subject to such condi­tions as may be agreed upon by the can·tracting parties. enter separately into or1i'menda trade agreement with a countryoutside the common customs area in termsof which concessions on the duties in forcein the common customs area are grantedto that country.

(2) A contracting party may enter sepa­rately into or amend a trade agreement,other than a trade agreement mentioned inparagraph (1), with a country outside thecommon customs area, provided the termsof such an· agreement or amendment donot conflict in any way with the provi­sions of this Agreement. Such contractingparty shall, as soon as possible after theconclusion of the agreement or amendment,supply each of the other contracting partieswith a copy of the agreement or amend­ment.

(3) (a) A contracting party, having anagreement with a country outside the com­mon customs area which provides for theimportation into its area from such countryof goods at lower rates of duty than thoseapplicable to like goods in the commoncustoms area, shall collect the duties pay­able on importation into its area.

(b) Unless the contracting parties haveotherwise agreed in respect of any suchagreement, where such goods are to beremoved from the area of such contractingparty to the area of any of the other con­tI1lcting parties the duties applicable in thecommon customsarfia shall become due andpayable lind the contracting party fromwhose area such goods are to be removedshall, prior· to such removal, collect thedifferences between the· lower duties paidand the duties applicable. ARTIKEL 18

OORLEGPLEGING OOR DIER-SANI­T~RE EN PLANT~ SANITERE AAN­

GELEENtHEDE

Behoudens die bepalings van Artikel II,erken die kontrakterende partye die belang­rikheid van maatreels wat dier-sanitere enplant-sanitere vereistes voorskryf, watgemik is op die voorkoming van versprei.ding van dier- en plantsiektes,. parasiete eninsekte, en stem in dat hulle van tyd tottyd oorleg sal pleeg ten einde sodanige oog­merk in die gemeenskaplike doeanegebiedte bereik met inagneming van die noodsaak·likheid om die handelsverkeer van produktewat deur sodanige maatreels geraak word,te vergemaklik.

ARTIKEL 19

HANDELSOOREENKOMSTE METLANDE BUlTE DIE GEMEENSKAP.

LIKE DOEANEGEBIED

(1) 'n Kontrakterende party mag nie san­der die voorafgaande instemming van dieander kontrakterende partye, en behoudenssodanige voorwaardes as waartoe die kon­trakterende partye mag looreenkom, afson·derlik 'n handelsooreenkoms met .~n landbuite die gemeenskaplike doeanegebied aan­gaan Of wysig nie ingevolge waarvan toe­gewings op die regte wat in die gemeen.skaplike doeanegebied van krag is aan daar··die land toegestaan word.

(2) 'n Kontrakterende party kan afson.derlik 'n handelsooreenkoms, uitgesonderd 'nhandelsooreenkoms inparagraaf (1) hierbogenoem, met 'n land buite die gemeenskap­like doeanegebicd aangaan of wysig, mitsdie bepalings van sodanige ooreenkoms ofwysiging in geen opsig met die bepalingsvan. hicrdie ooreenkoms bots nie. Sodanigekontrakterende party tIloet, so spoedigmoontlik na die afsluiting van die ooreen·korns of wysiging, aan elkeen van dieander kontrakterende partye 'n afskrif vandie ooreenkorns of wysiging verstrek.

(3) (a) 'n Kontrakterende party wat 'nooreenkoms met 'n land buite die gerneen·skaplike doeanegebied het, wat voorsieningmaak vir die invoer van goedere in sygebied uit sodanige land teen laer skalevan regte as die van toepassing op soort­gelyke goedere in die gemeenskaplike doe­anegebied, moet die regte wat by invoerin sy gebied betaalbaar is, invorder.

(b) Tensy die kontrakterende partyeanders ooreengekom het met betrekking totsodanige ooreenkoms, word, waar sodanigegoedere uit die gebied van sodanige kon­trakterende party na die gebied van enig.eeo van die ander kontrakterende partyeverwyder moet word•. die regte wat in diegemeenskaplike doeanegebied van toepassingis verskuldig en betaa1baar en die kontrak­terende party uit wie se gebied sodanigegoedere verwyder moet word, moet v66rsodanige verwydering die verskille· tussen

ment of the differences in duty cannot befurnished in the area to which the goodsare subsequently removed, the goods shallbe liable to forfeiture.

(c) Any duties and differences in dutiesthus collected shall be paid into the Con­solidated Revenue Fund of South Africa.Any payments due by that contractingparty under such agreement with a countryoutside the common customs area, shallbe paid on its behalf from the ConsolidatedRevenue Fund.

ARTICLE 20

GENERAL CONSULTATIONS

(1) A Customs Union Commission shallbe established, comprising representatives ofall the contracting parties, for the purposeof discussing any matter arising out of thisAgreement.

(2) The Commission shall meet once ayear. A contracting party may, however.at any time request a meeting of the Com­mission for the purpose of discussing amatter connected with this Agreement andthe Commission shall meet as soon as pos­sible thereafter.

(3) Where contracting parties have con­sulted on a matter which may affect therights of the other parties under this Agree­ment and arising under Article 12, 17 or18 or on a matter arising under paragraph(5) of this Article, a report on the resultsof these consultations shall be furnished tothe Commission before its next meeting.

(4) Where a matter bas been referred tothe Commission for discussion, the Com­mission shall use its best endeavours tofind a mutually agreeable solution to theparticular problem or· difficulty and therepresentatives shall report to their respec­tive Governments for consideration of anyremedial measures.

(5) Any difficulty or problem arising outof this Agreement which does not directlyeffect the interests of all the contractingparties may. with the concurrence of allthe contracting parties. form the subject ofdirect consultation between the partiesaffected with a view to seeking a solutionthereof.

ARTICLE 21

TERMINATION OF 1910 AGREE­MENT

The Customs Agreement concluded on29 June 1910. as amended from time te. time.cball terminate on the entry into force ofthis Agreement.

ARTIKEL 20

ALGEMENE OORLEGPLEGING

(1) 'n Doeane-uniekommissie•. bestaandeoit verteenwoordigers van al die kontrak­terende partye, word in die lewe geroepmet die doel om enige aangeleentheid watuit hierdie Ooreenkoms mag voortspruit, tebespreek.

(2) Die Kommissie kom eenmaal perjaar byeen. 'n Kontrakterendeparty kaoegter te enigertyd 'n vergadering van dieKommissieaanvra ten einde 'n aangeleent­heid in verband met hierdie ooreenkoms tebespreek en die Kommissie moet So goumoontlik daarna byeenkom.

(3) In gevalle waar kontrakterende par_tye oorleg gepleeg het oor 'n aangeleentheidrakende ~ie ~egte van die ander partyekragtens hlerdle Ooreenkoms en voortsprui.tende uit Artikel 12, 17 of 18. of oor 'naangeleentheid voortspruitende uit paragraaf(~) v8;0 hierdie Artike! moet 'n verslag oordIe ulls1ag van sodamge oorlcgpleging aandie Kommissie verstrek word voor sy vol­gende vergadering.

(4) In gevalle waar 'naangeleentbeid nadie Kommissie vir bespreking verwys is,moet die Kommissie na sy beste vennoetrag om 'n onderling aanvaarbare oplossingvir die bepaalde probleem of moeilikheidte vind en die verteenwoordigers moet aanbulle onderskeie Regerings verslag doen virdie oorweging van enige regstellingsmaat­reels.

(5) Enige prob1eem of moeilikheid watuit hierdie Ooreenkoms voortspruit en watnie die belange Van al die kontrakterendepartye regstreeks raak nie kan, met dieinstemming van al die kontrakterende par­tye, die onderwerp vorm van regstreekseoorlegpleging tussen die betrokke partye teneiude 'n oplossing te probeer vind.

ARTICLE 22

ENTRY INTO FORCE OF. AND WITH·DRAWALFROM,AGREEMENT

This Agreement shall. subject to the pro­visions. of Article 14 (8) enter into forceon 1 March 1970.

If a contracting party wishes to with­draw from this Agreement that party shallgive notice thereof to all the other con·tracting parties.

If after consultation the contracting par­ties fail to agree on the date and condi­tions of the withdrawal, this Agreementshall remain in force until twelve monthsfrom the date of such notice and shallthen cease to apply to the withdrawingparty.

(2) The contracting parties agree that:(a) goods (including goods for warehous­

ing) destined for Botswana, Lesothoor Swaziland and imported throughany place of entry in South Africa(including Lourenco Marques andJan Smuts Airport) shall be enteredfor customs, excise or sales dutypurposes through South African cus­toms and for that purpose the Jawsrelating to customs, excise and salesduty of South Africa will apply tosuch •goods as if such goods weredestined for South AfriCa: Providedthat if the Jaws relating to customs,excise and sales duty of Botswana,Lesotho or Swaziland as the casemay be, should, in relation to sucRgoods, differ in respect of anyrestriction,' prohibition, tariff. orrebate Under the Agreement, the rela­tive'law of the country' of destina,;tion of such goods shall in thatrespect be deemed to be the lawrelating to customs, excise or saleSduty, as the case may be, of SouthAfrica in relation to such goods;

(b) goods destined for Seuth Africa andimported other than by road throughany place in Botswana, Lesotho orSwaziland shall be entered for cus·toms, excise or sales duty purposesat the place of entry in SoulhAfrica. Goods so destined andimported by road shall be· so enteredat the place of entry into the com­mon customs area;

(c) goods destined for Botswana, Leso­tho or Swaziland and impor,reddirectly into the country in questionshan, subject to .the provisions ofsubparagraph (a). be entered for cus-·toms, excise or sales dllty ptlrpo&eSin that country;

(d) goods for warehousing in any cus·toms and excise storage warehouseestablished in the· area of Botswana,Lesotho or Swaziland shall becleared for warehousing at places ofentry in South Africa for removalto such warehouse without furtherentry, but any clearance ex suchwarehouse of such goods and collec­tion of any customs, excise or salesduty thereon shall be the respons­ibility of the country in whose areathe warehouse is situaled;

(a) goedere (insluitende goedere vir pak­huisopberging) bestem vir Botswana,Lesotho of Swaziland en ingevoerdeur enige plek van binnekoms inSuid-Afrikll (insluiiende LourencoMarques en Jan Smutslughawe) moetvir doeane-, aksyns- of verkoopreg­doeleindes deur Suid-Afrika se doe­ane ingeklaar word en vir hierdiedoel is die wette betreffende doeane-,aksyns- en verkooPregte soos vantoepassingin Suid·Afrika ook opsOdanige goedere van toepassing asofsodanige goedere vir Suid·Afrika,bestem is: Met dien verstande dat in­dien die wette betreffende docane-,aksyns. en verkoopregte van Bots.wana, Leshoto, of Swaziland. nagelang van die geval, wat :;odanigegoedere .betref ten opsigte van enigebeperking, verbod tarief of kortingkragtens die Ooreenkoms verskiI, diebelrokke wet van die I and vanbesteDUlling van sodanige goedere indaardie opsig geag word die wetbetreft'ende doeane-. aksyns- of ver­koopreg. na gelang van die geval, vanSuid-Afrika ten opsig4:e' van sodanigegoedere te wees;

(b) goedere bestem vir Suid-Afrika eningevoer op 'n ander wyse as perpad deurenige plek in Botswana,Lesotho of Swaziland moet vir doe.ane-, aksyns- of verkoopregdoeleindesingekJaar word by die pIek van binne­koins in Suid-Afrika. Aldus bestemdegoedere wat per pad ingevoer word"moet ingeklaar word, by die plek vanbinnekoms in die, gemeenskaplikedoeanegebied;

(c) goedere bestem vir Botswana. Leso.tho of Swaziland en regstreeks in diebetrokke landingevoer. moet. behou­dens die bepaJings van subparagraaf(a) vir doeane·, aksyns- of verkoop­regdoeleindes in daardie land inge.klaar word;

(d) goedere vir opberging in enige doeane­en aksynspakhuis wat in die gebiedvan Botswana, Lesotho of Swazi­land opgerig is. vir pakhuisopber.ging by die plek van binnekoms inSuid-Afrika ingeklaar moet word virverwydering na sodanige pakhuis son­der verdere klaring, maar enige uit.klaring vansodanige goedere oitsodanige pakhuis en invordering vanenige doeane-, aksyns- of verkoop­regte daarop,is die verantwoordelik.heid van die land in wie se gebieddie pakhuis gelee is;

(e) the administration of any customs andeJ!;.cise manufacturing warehouse(including the collection of any cus­toms, excise or sales duty on anygoods manufactured in such ware­house) in Botswana, Lesotho andSwaziland shall be the responsibilityof the country in whose area thewarehouse is situated; and

(j) provisions relating to drawbacks ofduty on goods used in the manu­facture of exported goods shall beadministered by the Government inwhose area the exporter is situated,but the Government of South AfricashaH accept responsibility for theprocessing of claims for drawbackof any duty emanating from expor­ters in Botswana, Lesotho or Swa­ziland in respect of goods exportedfrom the common customs area andPayment .of such claims shall beeffected from the ConsolidatedRevenue Fund of South Africa.
