Qualified Person’s Statements and CertificationsAs the qualified person, I certify that:

A phase one environmental site assessment of the RSC property, which includes the evaluation of the information gathered from a records review, site reconnaissance, interviews, a report and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation.

A phase two environmental site assessment of the RSC property, which includes the evaluation of the information gathered from planning and conducting a site investigation, a report, and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation.

The information represents the site conditions at the sampling points at the time of sampling only and the conditions between and beyond the sampling points may vary.

As of 2014/11/28, in my opinion, based on the phase one environmental site assessment and the phase two environmental site assessment, and any confirmatory sampling, there is no evidence of any contaminants in the soil, ground water or sediment on, in or under the RSC property that would interfere with the type of property use to which the RSC property will be put, as specified in the RSC.

Ground water sampling has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation.

I have, within the six months immediately before the submission of this record of site condition, given written notice of intention to apply non-potable ground water site condition standards to the clerk of the local municipality in which the property is located and the clerk of any upper-tier municipality in which the property is located.

As of 2014/11/28, in my opinion, based on the phase one and phase two environmental site assessments and any confirmatory sampling, the RSC property meets the applicable full depth generic site condition standards prescribed by section 37 of the regulation for all contaminants prescribed by the regulation in relation to the type of property use for which this RSC is filed, except for those contaminants (if any) specified in this RSC at Table 2, Maximum Contaminant Concentrations Compared to Standards Specified in a Risk Assessment.

As of 2014/11/28, the maximum known concentration of each contaminant in soil, sediment and ground water at the RSC property for which sampling and analysis has been performed is specified in this RSC at Table 1, Maximum Contaminant Concentrations Compared to Applicable Site Condition Standards.

I am a qualified person and have the qualifications required by section 5 of the regulation.

I have in place an insurance policy that satisfies the requirements of section 7 of the regulation.

I acknowledge that the RSC will be submitted for filing in the Environmental Site Registry, that records of site condition that are filed in the Registry are available for examination by the public and that the Registry contains a notice advising users of the Registry who have dealings with any property to consider conducting their own due diligence with respect to the environmental condition of the property, in addition to reviewing information in the Registry.

The opinions expressed in this RSC are engineering or scientific opinions made in accordance with generally accepted principles and practices as recognized by members of the environmental engineering or science profession or discipline practising at the same time and in the same or similar location.

I do not hold and have not held and my employer AMEC FOSTER WHEELER AMERICAS LIMITEDdoes not hold and has not held a direct or indirect interest in the RSC property or any property which includes the RSC property and was the subject of a phase one or two environmental site assessmentor risk assessment upon which this record of site condition is based

The Phase Two CSM is provided below:

Regulatory Requirement Phase Two Property Information

i. Areas where potentially contaminating activity has occurred, areas of potential environmental concern and subsurface structures and utilities that may affect contaminant distribution and transport.

The location of the Phase One and Two Property is shown in Figure 1. Based on the findings of the Phase One ESA, three APECs and PCAs are associated with the Phase Two Property (Figure 8) due to historical in-filling and former retail fuel outlets (RFOs) west and northwest of the Phase Two Property. As discussed above, based on the findings of the Phase One ESA, PCAs and APECs associated with the property are as follows (Figure 8):

- APEC #1 – Former buildings on east portion of Phase Two Property (#30 - importation of fill material of unknown quality);

- APEC #2 – West portion of the Phase Two Property from former USTs west of the Phase Two Property (#28 - gasoline and associated products storage in fixed tanks); and

- APEC #3 – Northwest portion of the Phase Two Property from former USTs northwest of the Phase Two Property (#28 - gasoline and associated products storage in fixed tanks).

APEC#1 was addressed by sampling the soil and/or ground water in BH3, BH5 and BH/MW7 as well as testpits TP1 to TP8 for contaminants of concern including metals, EC, SAR, cyanide (free), mercury, PHCs and /or VOCs. APEC#2 and APEC#3 were addressed by sampling the soil and/or ground water in BH/MW1 and BH2 for contaminants of concern associated with the former RFOs located off-Site including PHCs and VOCs. These APEC/PCA’s are inferred to be regionally transgradient to the Phase Two Property. Subsurface features that may affect contaminant distribution at the Phase Two Property include inactive natural gas, hydro, telephone, sanitary sewer and water lines from Queenston Street to the north end of the Site (associated with residential and commercial buildings) as depicted on Figure 2. The relative water level elevation of the geologic unit ranged from 101.30 metres above sea level (mASL) (BH/MW7) to 106.86 mASL (BH/MW1). The inferred ground water flow within the native silty clay/clayey silt/sandy silt till is inferred to be easterly (Figure 5).

ii. Description and figures illustrating the physical setting of the property including, stratigraphy, hydrogeological characteristics, depth to bedrock, depth to water table, aspect related to Section 41 or 43.1 that apply to the property, areas where soil has been brought onto the property, location of any proposed buildings.

The stratigraphy at the Phase Two Property is depicted on the cross sections (Figures 3 and 4) and in general, the subsurface conditions consisted of asphalt (BH/MW1, BH3, BH/MW4, BH5, BH/MW6, TP1 to TP12) or granular surface (BH2) over granular to depths of up to 0.3 metres below ground surface (mbgs) over silty sand fill in BH2, BH3, BH/MW4, BH5 and BH/MW6 to depths ranging from 0.9 to 2.2 mbgs (BH/MW6) or sand fill TP1 to TP12 to 0.5 to 1.0 mbgs overlying sand and gravel to depths ranging from 4.1 to 5.6 mbgs overlying silty clay/clayey silt (with the exception of BH5) to depth (in boreholes only). Concrete and brick pieces were noted in the fill material in BH3, TP5, TP6, TP7 and TP8 and trace ceramics were noted in TP1. The testpits were not extended to native soil. No deleterious materials were noted in the boreholes. Visual or olfactory evidence of environmental impacts were not observed by Amec Foster Wheeler during the drilling or testpitting program. Combustible Organic Vapour (COV) and Total Organic Vapour (TOV) concentration headspace measurements recorded in the soil samples collected from the boreholes were non-detectable.

Regulatory Requirement Phase Two Property Information

Two buildings are present on-Site including a residential dwelling and a commercial building, both located at the west end of the Phase Two Property. The owner will construct a multi-unit residential building but the plan for the new building is not finalized. The buildings will be demolished prior to construction of the residential multi-unit building. Both buildings were not located in the areas with Contaminants of Concern (COCs) and therefore, on-Site vapour intrusion is not considered a concern at the Phase Two Property. A former building was present at the east end of the Phase Two Property and fill material of unknown source and quality was historically imported to the Site. No other soil has been brought from another property to the Phase Two property. The overburden in the vicinity of the Phase Two Property is interpreted to consist of glaciolacustrine deposits of sand, gravelly sand and gravel (i.e., nearshore and beach deposits) (“Quaternary Geology of Southern Ontario”, map 2556, Ontario Geological Survey, 1991). Bedrock is anticipated to be of the Upper Ordovician Age consisting of shale, limestone, dolostone and siltstone of the Queenston Formation (“Bedrock Geology of Ontario”, Ontario Geological Survey, 1991). Bedrock is anticipated to be encountered at a depth of at least 45 mbgs (“Niagara Sheet Southern Ontario Drift Thickness”, Preliminary Map No. P. 537, Ontario Department

of Mines, 1969). Bedrock was not encountered during drilling. The regional ground water flow direction, based on topographic features and knowledge gained from other sites in the area, is expected to be to the south toward the Old Welland Canal. Locally, however, the shallow ground water flow may be influenced by underground utility trenches, conduits, and structures, variations in soil type, and minor fluctuations in topography. As shown in Figure 5, the interpreted ground water flow is easterly based on hydrogeological testing. The Phase Two Property is not located within or within 30 m of an Area of Natural Significance which would classify it as a sensitive site under O. Reg. 153/04, as amended. AMEC visited the websites of the City of St. Catharines’ Official Plan and the Government of Ontario’s Ontario Heritage Properties Database and searched for natural heritage plans or protected site maps. The Phase Two Property does not appear to have been designated as a protected area. There are no conditions that would apply to the Phase Two Property under Section 41 (Environmentally Sensitive Areas) or Section 43.1 does not apply as the Phase Two Property is not a shallow soil property. The pH was within the applicable ranges for surface and subsurface soils for use of the Table 3 SCS.

The water level measurements undertaken in BH/MW1, BH/MW4, BH/MW6, and BH/MW7 on January 6, 2015 ranged from 4.40 to 9.85 mbgs. The relative water level elevation of the geologic unit ranged from 101.30 mASL (BH/MW7) to 106.86 mASL (BH/MW1). The inferred ground water flow within the native silty clay/clayey silt/sandy silt till is inferred to be easterly (Figure 5). The estimated hydraulic conductivities of BH/MW1, BH/MW4 and BH/MW6/BH/MW7 were 1 x 10-5 metres per second (m/s), 1 x 10-8 m/s and 2 x 10-

11 m/s, respectively. The horizontal hydraulic gradient is 0.75 m/m based on the water levels measured on January 6, 2015. The vertical hydraulic gradient was not measured as there was only one geologic unit.

The standards used for the identification of COCs were Table 3 SCS for use in a non-potable ground water condition, residential/parkland/institutional and coarse textured soils.

Regulatory Requirement Phase Two Property Information

iii. Contaminants on the Site The contaminants located on the Phase Two Property and their origin are as follows:

Metals (mercury and lead) in BH3 (lead), TP5 (lead), TP6 (lead), TP8 (lead) and BH5 (mercury) and TP3 (mercury) and EC in BH3, TP5 and TP6 associated with the historical in-filling on the Phase Two Property.

The concentrations of metals and EC are attributed to the historical in-filling on-Site with fill material of unknown quality. The migration of the contaminants away from any APEC via a preferential pathway is not likely as the contaminants of concern are not considered mobile. Furthermore, there were no exceedances of the Table 3 SCS for metals, VOCs and PHCs were noted in ground water in the Phase Two ESA. There are no contaminants discharging to the natural environment. Contaminants that exceeded the Table 3 SCS on the Site in soil are depicted on Figures 3, 4 and 6. The COCs in soil are likely attributed to the historical infilling of former buildings on the Phase Two property. The estimated and actual horizontal and vertical distribution of the contaminants in each area is indicated on Figures 3, 4A, 4B, 6, 6A, 6B and 6C. Based on the soil analytical results from the Phase Two ESA, a SRP was completed at the Site. The horizontal and vertical delineation of COCs and the distribution of metals, EC and mercury exceeding Table 3 SCS on-Site (Figures 3, 4A, 4B, 6, 6A, 6B and 6C) correspond to the locations of the former on-site buildings. The sample analysis in ground water are indicated on Figure 7. Based on the borehole locations and the area of the former building, the separation distance between boreholes with no Table 3 SCS exceedances and boreholes with Table 3 SCS exceedances, AMEC estimated the amount of metal and EC-impacted soil required to be removed for off-Site disposal to be 89 tonnes. Based on actual field observations and lab results, a SRP was completed at the Site and included the removal of approximately 241.37 tonnes of metals-impacted soil to a Ministry of the Environment and Climate Change (MOECC) licensed landfill (Niagara Waste Systems Limited landfill in Thorold, ON). Confirmatory soil sampling at the limits of the soil remediation excavations were below the Table 3 SCS for the COCs [metals and EC]. The locations of the confirmatory samples are indicated on Figures 3 and 4 in the soil remediation report. The remedial excavations walls were sloped and were not backfilled at the time of the SRP. The transport of these COCs in the surface would be influenced by seasonal fluctuations in ground water elevation as well as the underground utilities and are not expected to have had a significant effect on the horizontal and vertical distribution of contaminants.

iv. Cross-Sections and distribution of contaminants, depth to water, stratigraphy, subsurface structures or utilities affecting distribution. For areas of contamination, release mechanisms, transport pathways, receptors, exposure points and routes of exposure.

The cross-sections provided on Figures 3, 4A and 4B identify the depth to water (ranged from 4.40 to 9.85 mbgs), stratigraphy (fill over native sand and gravel over native silty clay/clayey silt) and that there are no significant subsurface features that affect distribution of contaminants. The horizontal and vertical distribution of contaminants is indicated in Figures 3, 4A, 4B, 6, 6A, 6B and 6C. Figures 9 and 10 illustrate the Human Health and Ecological Exposure Conceptual Models. Human and Ecological Receptors: Potential human receptors include future residents and visitors and construction workers and potential ecological receptors include terrestrial plants, invertebrates, mammals and birds. Receptor Exposure Points: Human exposure (resident, visitor) to COCs in soil via dermal contact, ingestion, inhalation of airborne particles. No contaminants were found in ground water and no complete exposure pathway is present. Ecological exposure (terrestrial plants) anticipated through root update and inhalation via wind erosion. The exposure to COCs by terrestrial invertebrates is expected through soil ingestion and dermal contact. The exposure to COCs of terrestrial mammals and birds is expected through soil ingestion, dermal contact, ingestion of plants and prey and inhalation via wind erosion. No contaminants were found in ground water and no complete exposure pathway is present.
