Urban; New of Reconstruction Projects)
Dear Ms. Elwood,
Submitted for consideration by the September 2020 State Aid Variance Committee is the enclosed State
Aid Variance Request packet, including the Design Element Variance Justification Checklist and
associated appendices. The packet contains the necessary documentation to appropriately support the
request for the variance noted above. The design speed variance is sought for multiple horizontal curves
proposed on Stickney Avenue between Bircher Avenue and East Annapolis Street, located in the City of
South St. Paul. The proposed horizontal curves closely match the existing condition, for which a design
variance was approved in 1995 during the previous reconstruction project and is advisory signed at 25
mph. The proposed 20 mph design speed is intended to greatly minimize project impacts while improving
safety for all modes of transportation.

Design Element Variance Justification Checklist
This checklist should be completed and submitted with all required attachments to the State Aid for Local
Transportation Division when a local agency has determined that a variance from Minnesota Rules 8820 for
State Aid Operations Rules is justified.
The following documents and information is needed when one or more variance requests is identified on a
project. Note additional information may be requested by the Variance Advisory Committee after submittal of
the checklist and attachments for their investigation.
Ensure to check the box for items attached to this checklist and to respond to all questions. Where the question
does not apply to the variance request or no impacts, note it in the field provided and give a brief explanation on
how that was determined.
1. A variance request cover letter addressed to the State Aid Division Director

The existing Stickney Avenue roadway centerline is not compliant with 30 mph horizontal design curves.
In an effort to minimize land disturbance and impacts to adjacent properties, the proposed centerline is
offset 5' to the west of the existing centerline alignment. A variance was approved in 1995 during the
last reconstruction project to Stickney Avenue through this corridor for 25 mph horizontal curves. Please
see the included horizontal curve design layouts and 1995 Variance Approval Letter in the appendices
for reference. On the design layouts, in red and green, is the horizontal alignment if the roadway were
to be constructed to standard.
9. Include existing and projected traffic counts.
Existing ADT: 630 Projected ADT: 693
10. Include legal and posted speeds of abutting roadway sections.
Stickney Avenue does not have a posted speed limit in this area, the curves have advisory 25 mph
signing.
The adacent roadways of E Annapolis Street and Bircher Avenue are not posted.
11. Provide information on the economic impacts which may result from the requested variance. For
example compare the difference in cost to construct to standard versus the preferred alternative. MN
Rules, part 8820.3300, subpart 1a, item D, MN Rules, part 8820.3400, subpart 3, item A
The economic impact to construct to standard would be approximately $85,000. Additional construction
costs would be related to erosion control, turf establishment, earthwork, and retaining wall. Due to the
steep boulevard grades at 1682 Stickney Avenue, retaining wall would be required along the majority of

the property. Please see the included Existing Conditions Google Street View images in Appendix A1 for
reference. Additional right-of-way and temporary construction easements would also need to be
aquired from property owners.
12. Provide information on the social impacts which may result from the requested variance. MN Rules,
part 8820.3300, subpart 1a, item D, MN Rules, part 8820.3400, subpart 3, item A
A design variance would minimize impacts to adjacent property owners while still improving on the
existing condition. The proposed roadway section narrows the motor vehicle travel lanes, removes the
western shoulder/parking lane, and adds a turf boulevard bewteen the proposed sidewalk and roadway.
This turf boulevard will serve as a safety buffer zone between the different modes of transportation
through the corridor and add snow storage that will allow the sidewalk to remain clear with less
maintenance in the winter months. Constructing to standard would reduce the width of the boulevard
in areas if the appropriate amount right-of-way was not aquired.
13. Provide information on the safety impacts which may result from the requested variance. For example
provide the summary data on the number of crashes, type of crashes, severity of crashes, and
contributing factors and crash modification factors with or without meeting the design element in the
variance request. MN Rules, part 8820.3300, subpart 1a, item D, MN Rules, part 8820.3400, subpart 3,
item A
The roadway curves currently meet 25 mph design speeds in accordance with repealed MN Rules, part
8820. 9935, with sidewalk directly adjacent to the back of curb. The proposed horizontal curves closely
match the existing condition. Additionally, the prososed typical section will create separation between
motor vehicles and pedestrians. There have been only 5 crashes on Stickney Avenue over the last 10
years. None are indicated as run-off-road. Three were single vehicle crashes but they appear to be
crashes with parked cars. Of the other two crashes, both were rear-end crashes, one at an all-way stop
and one for a vehicle that stopped or slowed down suddenly (following car noted to be likely following
too closely). None of the crashes are specifically located at the curves. Current Crash Data is included in
the Appendices.
14. Provide information on the environmental impacts which may result from the requested variance. MN
Rules, part 8820.3300, subpart 1a, item D, MN Rules, part 8820.3400, subpart 3, item A
The requested variance would reduce the overall disturbed area, as it more closely follows the existing
footprint than the standard. Constructing to standard would encroach on multiple properties and
increase the amount of area that would need to be stabilized and restored.
15. Provide information on the effectiveness of the project in eliminating an existing and projected
deficiency in the transportation system. MN Rules, part 8820.3300, subpart 1a, item E, MN Rules, part
8820.3400, subpart 3, item B
The projected ADT through this corridor is low and the horizontal curves are not deficient. The existing
sidewalk, however, is directly adjacent to the roadway curb and gutter. This negatively impacts the
sidewalk users.

16. Provide information on the effects on adjacent lands. MN Rules, part 8820.3300, subpart 1a, item F,
MN Rules, part 8820.3400, subpart 3, item C
The requested variance will minimize effects on adjacent lands. Constructing to the standard will require
a total of approximately 2,100 square feet of right-of-way acquisition from two properties. Also,
approximately 950 square feet of temporary construction easement in order to rebuild the driveway at
1682 Stickney Avenue due to steep existing grades.
17. Provide information on the number of persons affected. MN Rules, part 8820.3300, subpart 1a, item G,
MN Rules, part 8820.3400, subpart 3, item D
The requested design variance would eliminate direct impacts to two properties.
18. Provide information on the safety considerations and mitigations as they apply to pedestrians. MN
Rules, part 8820.3300, subpart 1a, item H (1), MN Rules, part 8820.3400, subpart 3, item F
The design variance of 20 mph horizontal curves may not directly impact pedestrians, but the proposed
section includes a 5' concrete walk with an 8' turf boulevard. The 8' turf boulevard will provide a sense
of safety from motor vehicle traffic on Stickney Avenue. If the roadway was to be constructed to
standard, the turf boulevard width would need to be reduced or eliminated if appropriate right-of-way
was not obtained.
19. Provide information on the safety considerations and mitigations as they apply to bicyclists. MN Rules,
part 8820.3300, subpart 1a, item H (2), MN Rules, part 8820.3400, subpart 3, item F
The design variance for 20 mph design speeds, with low projected ADT in this residential area, bicyclists
can safely share the road with vehicles to navigate the corridor.
20. Provide information on the safety considerations and mitigations as they apply to the motoring public.
MN Rules, part 8820.3300, subpart 1a, item H (3), MN Rules, part 8820.3400, subpart 3, item F
The motoring public will experience very little change from the existing condition. Travel lane widths are
reduced by one foot but are still compliant with MN Rules 8820.9936 (11' wide). Advisory signage will be
installed in accordance with the MnMUTCD.
21. Provide information on the safety considerations and mitigations as they apply to fire, police, and
emergency units. MN Rules, part 8820.3300, subpart 1a, item H (4), MN Rules, part 8820.3400, subpart
3, item F
Emergency response times, movement constraints, and manuvers will be very similar to the existing
condition.
22. Include available accident data in detail that indicates the resulting damage (property
damage/injury/death), contributing causes, and location.

23. Provide information on the effect on future maintenance. MN Rules, part 8820.3400, subpart 3, item E
Compared to the existing condition, long term future maintenance costs will be reduced. Less pavement
area will result in less roadway rehabilitation costs. Also, with less pavement, snow removal will be more
efficient. Comparing the requested design variance to the standard, future maintenance costs are
relatively equal.
24. Provide information on the effect that the rule and standards may have in imposing an undue burden
on a city or county. MN Rules, part 8820.3400, subpart 3, item G
The 30 mph design speed criteria will increase project costs as described above. As well as permanent
and temporary property acquisition costs. This additional strain on project budget could affect the
timing of this project and/or other city projects.
The 30 mph design would also create strain on project management, engineering, land acquisition staff,
and property owners in discussing potential property impacts.
