Box 676 Melbourne, AR 72556 RE: Reconnaissance Inspections of Bluebird Sand (Izard Co) AFIN: 33-00264 NPDES Permit No.: AR0051772 Dear Mr. Morris: On May 19, 2014, I performed a reconnaissance inspection of the above referenced facility in response to a complaint. The complainant alleged that East Lafferty Creek was cloudy due to stormwater runoff from the Bluebird Sand processing facility. This inspection was performed in accordance with the provisions of the Federal Clean Water Act, the Arkansas Water and Air Pollution Control Act, and the regulations promulgated thereunder. A copy of the inspection report is enclosed for your records. Please refer to the “Summary of Findings” section of the attached inspection report and provide a written response for each violation that was noted. This response should be mailed to the attention of the Water Division Inspection Branch at the address at the bottom of this letter or e-mailed to [email protected]. This response should contain documentation describing the course of action taken to correct each item noted. This corrective action should be completed as soon as possible, and the written response with all necessary documentation (i.e. photos) is due by June 20, 2014. SUMMARY OF FINDINGS

1. Best Management Practices (BMPs) for Outfall SW-1, SW-2, and SW-3 do not appear adequate or maintained (see Photos 1 – 15 and 19 – 20). This is a violation of Part 3.5.6 of your permit.

2. There is sand deposited in the unnamed tributary to East Lafferty Creek between Outfalls SW-2 and SW-1 (see photos 16 – 18). This is a violation A.C.A. §8-4-217. (a) (2) which states, “It shall be unlawful for any person to place or cause to be placed any sewage, industrial waste, or other wastes in a location where it is likely to cause pollution of any waters of this state.”

AFIN: 33-00264 NPDES Permit No.: AR0051772 Dear Mr. Morris: I have reviewed your response pertaining to my May 19, 2014 inspection of the above referenced facility. However, the information provided does not sufficiently address the violations referenced in my inspection report. Your response letter dated June 30, 2014, stated:

1. “The facility was in the process of installing a new sediment basin.” Please provide the ADEQ Water Division Inspection Branch with a timeline for the completion of this sediment basin.

2. “The facility has cleaned out the accumulated sediment deposited in the unnamed tributary between SW-2 and SW-1.” The picture provided does not show the completed work. Please provide the ADEQ Water Division Inspection Branch with photos demonstrating the completion of this work.

This information should be complete as soon as possible. Please provide the timeline and photos no later than July 24, 2014. Thank you for your attention to this matter.
