EXECUTIVE SUMMARY

Project Description MTA Capital Construction is managing construction of the Fulton Center in Lower Manhattan. The project will improve access and connectivity amongst several subway lines (A,C,E,J,Z,R,2,3,4,5), create modern retail spaces, provide improved passenger amenities and upgrade the complex to full ADA compliance. The project includes the building of a new transit hub for Lower Manhattan (the Transit Center Building) and the restoration of the historic Corbin Building. Note: As of June 2010, MTA New York City Transit service changes include the W train elimination and the M train which no longer serves Fulton Street. Budget Summary (As of 03/31/2013)

Remarks: The Project’s cost and expenditures reflects the overall budget as reported in the Project Status Report (PSR) as of March 31, 2013. PSR does not separate expenditure in Federal and Local funding. The Project-Wide Activities in this table includes, In-House Design EFA, Artwork, Dey St Agreement., NYCT Equip, Outside Consultant’s Design and Construction Phase Support, Prior Consult Const. Management and other Indefinite Quantity Consultants costs to support the project.

Highlights Achieved substantial completion on Contract A-32126, 4G, Corbin Building Restoration on

April 19, 2013. On April 29, 2013, The Corbin Building Restoration contract received the Lucy G. Moses

Preservation award, which is The New York Landmarks Conservancy’s highest honor for excellence in preservation.

Contract Progress Status by Expenditure As of March 31, 2013, all Fulton Center (FC) contracts have been awarded. Five contracts are closed out (1, 3, 4I, 2 and 4A) and two contracts achieved substantial completion (4C/D and 4E). The FC project is 83% complete. The percent complete is based on the projects total expenditures of $1.155 billion to date, an increase of $32.9 million from the last quarter with an Estimate At Completion (EAC) of $1.4 billion.

Active Contracts All contract dates are from the contractor’s schedule updates as of March 2013. A/C Mezzanine Reconstruction and J/Z Vertical Circulation (Contract A36121, 4B) Based on the current working/progress schedule, the contract is currently -139 working days beyond the revised contractual substantial completion date of March 4, 2013. Based on Additional Work Order (AWO) #191, the substantial completion date will be revised without impact costs or liquidated damages being assessed as the delays are understood to be concurrent. A Recovery Plan is being drafted by MTACC and will be submitted to the FTA during the 2nd Quarter 2013. MTACC is proposing a new substantial date of June 2014. The contractor is late with the installation of the elevators and the delay to the fire alarm system was a result of extended design changes. The only significant remaining work involves the installation of the fire alarm and data communication system, testing and commissioning of the elevators and escalators and the completion of the AWO #191 fiber optic and video display enclosures. The only other remaining work is the structural facade at 129 Fulton Street (which involves change order work). The remaining work at the entrance at 150 William Street is the CCTV and HPI work (which involves change order work). The open design issues with the 8” DEP water tap is being resolved and the installation of the tap is scheduled to be performed during the 2nd Quarter 2013. All five (5) elevators are installed, testing is underway and a preliminary punch list has been developed. The contractor is working on the Punch-list items.

4/5 Station Rehabilitation and Dey Street Headhouse (Contract A36137, 4C/D) This contract declared substantial completion on December 14, 2012. A punch-list has been prepared to identify all remaining work to be performed. The contractor and MTACC are currently reviewing the impacts of contract changes and delays to determine if, or how many days are impactable. The last of the General Orders (GO) under this contract were held during the week nights of March 11th – 15th and 18th-22nd. The contractor tested the heat trace system under the platform edge, installed Customer Information Signs above the platform edge along both the northbound and southbound platforms, removed abandoned hardware and equipment no longer needed and tested the high pressure wash system. MTACC and the contractor are meeting several times a week to update the status of the punch-list and review completed work and the status of the remaining punch-list items. Testing and acceptance of the elevators and escalators including the life safety systems will need to be retested prior to the area opening to the public. Dey Street and R Underpass Finishes (Contract A36138, 4E) This contract declared substantial completion on December 31, 2012. The contractor is currently completing their punch-list work including the remaining testing and commissioning of the two elevators. The majority of the area within the 4E site will not be opened to the public until it can be opened with the Transit Center facility in June 2014, the testing of the elevators, escalators and the life safety systems will need to be redone prior to opening to the public. An agreement had been reached on the extension of time and negotiations are currently underway to establish the number of days deemed impactable. A resolution is expected by the end of May 2013. Transit Center Building (Contract A36125, 4F) Based on the current working/progress schedule, the contract is currently 11 work days beyond the substantial completion date of February 4, 2014, due to Super Storm Sandy and its associated impacts such as the skilled labor (elevator mechanics, electricians, etc.) shortage and materials availability. The contractor continued working on the concourse and mezzanine levels including fire protection, mechanical, electrical and plumbing (MEP), masonry and hollow metal frames installation. New stone flooring is nearly complete on the concourse level. The contractor installed all five escalators. The electricians are currently installing the escalator control conduits. Masonry installation is nearing completion. Communications, MEP, hollow metal frames and fire protection installation continues on all levels. Structural concrete work is complete with the exception of the hoist run and platform level elevated slabs. This work is expected to be completed during the second quarter of 2013.

On Fulton Street, the pavilion mullions and glazing has been completed, except for the seven damaged lites of glass. The service elevators have been tested and are in service for construction use, they will be retested prior to opening to the public. The hoist has been removed. The installation of the dome cladding and metal roof on the fourth floor was completed; the contractor is preparing for the start of the interstitial building cladding toward the end of the first half of 2013. The installation of the interior donut glazing is near completion on the second and third floors. The installation of the exterior donut mullions is also near completion on the second and third floors. The external donut glazing is still in fabrication. Fabrication of the cable net has been completed and delivery is pending. Corbin Building Restoration (Contract A36126, 4G) This contract achieved substantial completion on April 19, 2013. Installation of MEP systems are nearly complete. Interior finishes work such as drywall installation, plastering and painting prep are also nearly complete. Restoration work on the existing staircase has been completed. General cleaning of the staircase remains. At the street level, the escalator lobby and sheetrock installation was completed. Wood window work is in progress and nearly complete, miscellaneous hardware remains to be installed. On the exterior of the building, leaded glass, canopy frame and storefronts were installed. Work began for the historical lobby and is now nearly complete. Installation of the marble wainscot was completed on all floors as well as marble flooring in the stair tower. On the exterior of the building, the leaded glass, the canopy frame and storefronts were installed The roof and skylight installation were completed. Punch-list work for architecture and MEP has begun. R Cortlandt Street Southbound Platform Rehabilitation (A36165) Contract substantial completion was achieved on August 29, 2011 and opened for revenue service on September 6, 2011. The close out date for this contract is being revised due to additional work, which was requested by the User Department. A Scope of Work has been provided by NYCT and will be incorporated into the Scope of Work for the Church Street Corridor Transportation Improvement Projects. Once a draft of this Scope has been approved by all parties, an MOU between NYCT and MTACC will be signed and a new revised close out date can be established.

Master Lease Status MTA is in the process of bringing on a Master Lessee (ML) who will lease, maintain and operate the non-transit portions of the Fulton Center project. The ML areas will cover approximately 180,000 square feet, of which 65,000 square feet is commercial space in the Fulton Building, the Corbin Building and the Dey Street Headhouse. In addition, the ML will lease and program approximately 50 digital signs throughout the FC. The MTA issued an RFP for the ML in the Fall 2012 with proposals received in December 2012. The MTA is currently in confidential negotiations with the proposers and is expecting to ask for board approval of the contract in the summer of 2013.

Construction Management Status MTACC continues to meet monthly and to provide project status presentations to the New

York City Department of Transportation (NYCDOT) regarding the program wide Maintenance and Protection of Traffic (MPT) requirements for all construction contracts related to the FC project; any changes in the MPT or permits are discussed during these meetings. Meetings were held on January 23, 2013, February 27, 2013 and March 27, 2013. NYCDOT has continued to hold bi-weekly coordination meetings on Tuesday afternoons. The work and the meetings have continued through the end of the 1st quarter of 2013 and will continue at the discretion of the NYCDOT.

A Quarterly Risk Workshop was held on January 24, 2013. An updated Risk Assessment for Contract 4F was performed in November 2012 by Golder Associates. The purpose of the updated assessment was to re-analyze and document the potential range in both project cost and schedule due to risks or opportunities and other uncertainties with consideration of the technology enhancements that was introduced subsequently to contract award. Golder Associates issued a final draft report to the Fulton Center Team February 10, 2013. (Please see the Risk section for additional information).

A Quality Workshop was held on March 14, 2013 with Quality Engineers from all the contracts. MTACC requested that the contractors submit their as-built drawings, O&M Manuals and other record documents.

The Safety Roundtable Workshops were held on January 25, February 22, and March 29, 2013 with Safety Engineers from all contracts were in attendance. The key discussions at this quarter’s roundtables were the recent security issues and hazards associated with scheduling pushes to the contracts and the rise in incident rates.

MTACC continues to meet with NYC Department of Design and Construction (DDC) regarding the watermain work on Broadway. DDC has open bids and has identified the low bidder. Registration is currently underway to confirm a qualified bid. NTP is currently expected late April or early May 2013. After mobilization, the construction is expected to begin in June 2013. The first phase of the work is from Ann Street to John Street and is expected to take 9 months. The last Lower Manhattan Construction Command Center (LMCCC) coordination meeting with all stake holders was held on January 22, 2013.

Buy America and Cargo Preference Contractors prepared and submitted Buy America and Cargo Preference Matrices to MTACC

to track items that must be shipped on U.S. vessels. The matrix is an ongoing report and will be updated by MTACC as needed. Below is our calculation to track cargo preference tonnage as of March 2013.

Description: This contract includes the A/C Mezzanine reconfiguration, demolition of the existing multi-level ramp system, systems and finishes, as well as escalators and elevators for the J/Z and 2/3 stations. New entrances at 129 Fulton St., 150 William St. and 135 William St. are also part of the contract scope.

Progress: • Most of the utility work on Fulton Street has been

sidewalk pavement restored. • All elevator cabs are on site and installed and pre-testing has

Description: This contract’s scope includes all of the architectural finishes, as well as MEP and communication systems for the Dey Street Concourse and the R Underpass. In addition, installation of two new elevators, allowing for ADA compliance, and a new stair connecting the R Northbound platform to the R concourse.

Description: The work under this contract is for the building of an above-ground Transit Center Building and all associated systems and finishes. Additionally, this contract interfaces with all of the FSTC packages and completes the MEP and communications work, as well as the fit-out and architectural finishes.

Upcoming Activities: • Continue pre-testing and witness testing of available MEP &

communication systems. • Complete installation pressure plates for on the Fulton Street

facade. Schedule: • Contract 4F is currently -11 work days beyond the contractual

substantial completion date of February 20, 2014. As reported by the Contractor, there are two longest paths, both with a float of -11 work days. The first path is through the installation of equipment for the emergency power system, start-up of the emergency power, testing of emergency power system, testing of the TCAN system, and integrated testing of the fire alarm system, and escalators. The second path begins with the installation of the CCTVs, followed by testing of the CCTVs and elevators. A near critical path begins with the approval of the radio system, followed by procurement, installation, testing and acceptance.

Budget: • A total expenditure of $114.9M indicates an increase of $15.2M

from the last quarter, which includes $14M for the construction payment and $1.2M for the supporting cost payment.

• A total of $4.5M in AWOs have been approved.

Coordination Required (A36125, 4F)

Coordination amongst Contract A36121, 4B, Contract A36137, 4C/D and Contract A36126, 4G. The 4F contractor is responsible for coordinating the utilities and communications systems with all other FC contracts.

Description: The restoration of the historic Corbin Building includes the following work: façade, windows, roof, ground floor entrances, storefronts and tenant ready interior restoration. The scope also includes utility connections from John Street as well as the installation of escalators from the 4/5 underpass to the street level from within the Corbin Building basement.

Progress: • Submittals and approvals are in progress. • Installation of MEP and communications systems continues on

all levels and is nearly completed. • Interior finishes work such as drywall installation, continued

throughout the building and is near completion. • Paint for all floors and main stair has been completed. • Canopy installation is almost complete.

Upcoming Activities: • General cleaning of the staircase. • Continue with submittals, approvals and fabrication activities. • Testing and commissioning of elevator, escalators, fire alarm,

As-built drawing submittals are on-going for electrical, mechanical and plumbing systems. Continue O&M Manual submissions, with 50% received to date. The fire alarm system installation is completed, all back boxes for the various devices

(smoke detectors, horn strobes and heat detectors) have been installed from the second floor through the eight floor. The contractor is currently undergoing pre testing of the equipment.

Achieve substantial completion.

Construction Phase Support Services Lead the Bi-Weekly Progress Meetings for Contracts 4B, 4F and 4G. Review and approve project schedules including leading the monthly schedule update site

visits. Prepare and submit ARRA reporting requirements. Prepare and submit DBE participation reporting requirements. Review contractor invoices to confirm percent complete. Review, transmit and distribute shop drawings and Request for Information (RFIs) per

project as required.
