3 Guide to the Application

3.1.1 We enclose an updated version of the Guide to the Application at APP199. We have sought to update the guide to include all of the documents submitted during the examination, including those forming part of our 11 March 2014 submission. This updated document has been prepared in parallel with the other documents in today’s submission. The long lead in time for desktop publishing the guide means that there may be some minor discrepancies between what we enclose as part of our 11 March 2014 submission and the guide. The definitive list of what we have submitted today is contained at Schedule 1 to this letter.

3.1.2 The updated Guide to the Application comprises three parts:

Part 1 contains a list of our application documents submitted in February 2013; a.where appropriate, it also indicates where revised versions of drawings, plans and documents have been submitted during the examination of the application.

Part 2 identifies the documents submitted during the examination. It also identifies b.the documents where we have provided updates and/or revised versions during the examination.

Part 3 provides a description of each submitted document. With the exception of c.documents forming part of today’s submission, where possible, the document titles are also hyperlinked to the relevant document on the Planning Inspectorate’s website. It also contains a document index, which details the box and/or folder reference for each document submitted in hard copy.

4 Errata and clarifications

4.1.1 Following a further review of documents forming our 3 March 2014 submission, we have identified a number of errata to the Book of Reference. These are enclosed at APP200.

4.1.2 We also enclose, at APP206, a slightly amended version of the Design Principles. Following further discussions with the Environment Agency, we have agreed to amend para. 3.6.1, in order to clarify the meaning of the sentence. This clarification has been made in direct response to comments from the Environment Agency in its 3 March 2014 submission. We enclose three documents relating to the Design Principles:

a ‘clean’ final version which incorporates the clarification a.

a ‘comparite’ which shows the clarification made against the version issued on b.3 March 2014; we only include the page where the amendment has been made

a ‘comparite’ which shows the clarification made against the submission version c.issued on 28 February 2013; we only include the page where the amendment has been made.

5 Section 127 and Section 138 schedules

5.1.1 We enclose, at APP201 and APP202, updated Section 127 and Section 128 schedules. The schedules have been updated to accommodate the following amendments:

Errata resulting from further information that has been supplied by stakeholders; a.this includes interests not falling within the definition of Section 127 or Section 138 of the Planning Act 2008.

Submissions made to the ExA confirming that representations have been b.withdrawn. Where this is the case in the Section 127 Schedule, the relevant plots have been removed. For the Section 138 Schedule, we have noted against the relevant plots that a withdrawal has been made. One withdrawal was submitted too late for the schedules to note this. This is a withdrawal made on 10 March 2014 by the Port of London Authority (PLA) and we would therefore ask the ExA to note that the PLA plots shown on the schedules no longer require certification under Section 127 or consent by the Secretary of State for Transport under Section 138.

5.1.2 The letter of partial withdrawal of representations from Network Rail of 7 March 2014 states clearly that Network Rail’s objection in respect of the applications for certification are withdrawn. However, Sections 127 and 138 of the Planning Act 2008 refer to the withdrawal of representations rather than withdrawal of objections. The schedules for the Section 127 application submitted for 11 March 2014(APP201) omit the Network Rail plots and, for Section 138 (APP202), note that Network Rail has withdrawn. In the event that the ExA considers that Network Rail has not withdrawn its representation for these purposes, it is asked to include in its determination for Section 127 certification for Network Rail its interests as noted against plots 42,43 and 53 (City of London), 32 (City of Westminster), 179 (London Borough of Hammersmith and Fulham), 187, 190, 192, 199 and 200 (London Borough of Lewisham), 15 (London Borough of Newham), 4 (London Borough of Southwark), 67,68,69,70,72,230 (London Borough of Wandsworth) and 8, 9, 10, 11 12, 13, 18a (Royal Borough of Greenwich). These were all listed in the submission of S127 schedules for 3 March 2014 (APP193). For Section 138, Network Rail’s interests are listed in the 11 March 2014 submission but if the ExA considers the representation not to have been withdrawn, can these please be considered for consent under Section 138 (4) (b).

5.1.3 Copies of the updated schedules have also been submitted to the relevant Secretaries of State.

6 Application document consistency check

6.1 Overview

6.1.1 In our 3 March 2014 cover letter, we noted that in some of the recently updated documents, issues remained regarding internal consistency. We have further reviewed the documents submitted for the 3 March 2014 deadline and enclose updated versions of the following documents:

6.1.2 As stated in our cover letter dated 3 March 2014, these documents have only been updated to ensure they are internally consistent and the updates do not materially change the meaning of the documents, or contain material changes in our approach to issues or introduce new polices. documents go beyond updates to cross-references, etc, a description of the changes made is provided in the subsections below.

6.1.3 ‘Comparites’ are enclosed for each of the documents listed above to show the changes between the different versions of the documents. ‘Comparites’ against the 3 March 2014 versions are enclosed for all the documents listed above. Where appropriate, we also enclose ‘comparites’ against the 28 February 2013 version.

6.2 Code of Construction Practice

6.2.1 An updated version of the CoCP has been submitted rather than issuing errata for the two amendments that have been identified. A mistake was made during the editing process, which resulted in the document title changing from Code of Construction Practice, Part A: General Requirements to Code of Construction Practice, Part A: General controls, which is how it appeared in the February and March 2014 versions (APP104, APP125 and APP178). The document enclosed at APP205 returns the CoCP to its original title. Although a minor error, this erratum was apparent on the title page, page i, and in the footer of every page of the document. We therefore considered it was more appropriate to update and resubmit the CoCP than provide sheets of errata.

6.2.2 We also identified an erratum in relation to underwater noise and vibration. Text at para. 6.4.7a was removed from the February 2014 versions of the document (APP104 and APP125), but reinstated in the 3 March 2014 version (APP178). The reinstatement should have been carried out with a slight clarification to ensure that an incorrect assumption could not be implied. In APP178, para. 6.4.7a stated: “avoiding piling at night to ensure windows of no disturbance within each 24-hour period”. In the final enclosed version, para. 6.4.7a now states: “piling shall only occur during standard working hours. Avoiding piling at night also ensures windows of no disturbance within each 24-hour period”. We do not believe that this amendment constitutes a material change since the amendment has been made in the interest of clarity and to give reassurance that, although respite periods for fish will occur during the evening and night, it is not our intention to pile outside of standard working hours.

6.3 Environmental Statement Update Report

6.3.1 The Environmental Statement Update Report has been submitted in updated form at APP208 to incorporate two main changes.

6.3.2 We have made corrections to ensure that the cross-references in the update report are consistent with the draft final DCO, including amended Requirements, which is also resubmitted (at APP204).

6.3.3 It has also come to our attention that the summary assessment tables, contained in the appendices to the update report submitted for the 3 March 2014 deadline (APP184), were edited incorrectly. As a result, the changes made to the assessment tables were not shown in ‘tracked changes’. This formatting anomaly has been resolved and the summary tables, enclosed at APP208.01.01 and APP208.01.07 onwards, are now correct.

6.4 Book of Reference

6.4.1 The entire Book of Reference was republished for the 3 March 2014 submission (APP138.01 to APP138.15). Since then, a number of statutory undertakers have supplied additional information about their assets and property. In addition, we have

received further information regarding interests held by government departments at Albert Embankment Foreshore. These plots were always identified as Crown land but the identity of the government department which owns them has now been clarified. These are captured in the errata at APP200 and have also informed the revised section 127/138 tables.

7 Update on legal agreements

7.1 Legal agreement with the river regulators

7.1.1 In our cover letter dated 3 March 2014, we indicated that we would submit a completed legal agreement between Thames Water, the Port of London Authority, the Environment Agency and the Marine Management Organisation on either 3 March 2014 or 11 March 2014. A copy of the completed legal agreement was submitted under separate cover on 3 March 2014 (APP183).

7.2 Legal agreement for securing off-site mitigation policies and resources for local planning authorities

7.2.1 We enclose, at APP209.03, the final form legal agreement and associated Section 106 unilateral undertaking between Thames Water and the 15 local planning authorities (the LPAs). This deed seeks to ensure our compliance with the policies for securing off-site mitigation and compensation relating to the project. The covering note at APP209.01 summarises the background and arrangement of the deed, and APP209.02 sets out how we sought agreement with the LPAs and lists those LPAs which provided detailed comments on the draft deeds.

7.2.2 We further enclose, at APP209.06, copies of the letter dated 10 March 2014 sent to the councils which accompanied engrossments of the legal agreement and requested confirmation from the LPAs of their ability and/or willingness to sign the deed against a proposed deadline of 24 March 2014. Where any LPA confirms it is unwilling or unable to sign the legal agreement, the letter confirms our undertaking that we will observe the terms of the legal agreement as if all LPAs were a signatory party.

7.2.3 Once each of the LPAs willing to sign the legal agreement returns the executed agreement to us, we will proceed to execute the agreement and complete it on a date that will be confirmed to the LPAs. Those LPAs which do not wish, or are not able to enter into the legal agreement will have the benefit of the undertaking referred to in paragraph 7.2.2 above. Upon the grant of development consent, we will proceed to execute the Section 106 unilateral undertaking as provided for in the legal agreement.

7.2.4 We are aware that the London Borough of Ealing emailed the Planning Inspectorate on 10 March 2014 (see email to [email protected] from Neil Bleakley at the London Borough of Ealing at 13:52) explaining why it would not be completing the legal agreement. It included with that submission earlier correspondence between our solicitors, Berwin Leighton Paisner LLP, and the borough. In that correspondence, Berwin Leighton Paisner explains why we have offered the legal agreement to the LPAs, including reference to the extensive discussions on the issue of noise mitigation that have taken place at issue specific hearings.

7.2.5 We are disappointed that the London Borough of Ealing has responded in the manner it has. We note that the council has no authority to enter the agreement at this time, but do not accept that the reasons given in the three bullet points represent insurmountable reasons not to enter the legal agreement. In that respect, APP209.01

explains how the agreement and subsequently the Section 106 unilateral undertaking secure the off-site mitigation policies and resources for the LPAs. These proposals have been discussed with the ExA and the LPAs which attended the relevant issue specific hearings. There is a general acceptance that the off-site mitigation policies and the proposals regarding local authority resourcing need to be secured, and neither the ExA nor any of the LPAs attending the issue specific hearings has raised any objection or concern as to the principle of our approach.

7.2.6 Of course the London Borough of Ealing will benefit from the undertaking referred to in paragraph 7.2.2 and, if the development consent is granted, it will be in receipt of the completed Section 106 unilateral undertaking. Notwithstanding its comment that the legal agreement and unilateral undertaking protect individual property interests, we believe it is reasonable to secure these protections by way of Section 106 obligation, not least given the views expressed forcibly by other LPAs that they must have some way of protecting the communities they represent; a point we understand to be of importance to the ExA also. We believe that the legal agreement and unilateral undertaking is an appropriate, proportionate and lawful response to the issues raised.

8 Update on matters progressed and yet to be resolved

8.1.1 In our cover letter for the 3 March 2014 submission, we indicated that we would provide an update as part of our 11 March 2014 submission on how matters identified as not yet resolved have progressed in the intervening period. This update is provided at Schedule 2. Where appropriate, a hyperlink is provided to referenced letters and/or agreements.

9 Other matters

9.1 National Planning Policy Noise Guidance

9.1.1 This was formally published by the Department of Communities and Local Government on 6 March 2014. As it is in the public domain and the beta version of the National Planning Policy Guidance (NPPG) has been the subject of many questions from, and submissions to, the ExA during the examination period, we hope it is of assistance to confirm the following:

The published version of the NPPG is materially the same as the beta version a.

It now explicitly references government noise policy (the Noise Policy Statement for b.England 2010(NPSE)); and

It now explicitly references the National Policy Statement (NPS) for Waste Water. c.

9.1.2 It is therefore clear that the Government regards the NPS noise policy as being consistent with and part of national noise policy. Just as with the latest draft NPS for National Networks (which contains the same words as paragraph 4.9.9 of the Waste Water NPS and directly references the National Planning Policy Framework (NPPF), the NPSE and the NPPG), no different policy is proposed.

9.1.3 There are two technical points where the published guidance has been modified compared to the beta version that are relevant to the project. Both of these clarifications relate to the table that summarises the noise exposure hierarchy. Neither affects our interpretation of policy.

9.1.4 For observed adverse effects, the published table clarifies that these effects give rise to the “potential for some reported sleep disturbance”. This importantly differs from ‘non-awakening’ sleep disturbance, as noted in the table of the beta version. The change clarifies that objectively measured sleep disturbance due to noise does not generally occur until a significant observed adverse effect level is reached. As noted in our oral submissions to the noise hearings, 'reported' sleep disturbance relates to self-reported disturbance where people believe they have been disturbed but objective measures show that they have not been disturbed. This occurs because people generally wake up many times a night for different reasons (eg, anxiety, needing to go to the toilet, etc) and on hearing a noise can mistakenly believe it is the noise that woke them. A significant observed adverse effect level for sleep disturbance needs to reflect objectively observed sleep disturbance, as set out in our submissions (APP157, Section 5.2). The distinction between reported and objective sleep disturbance therefore needs to be borne carefully in mind when considering guidance such as that provided by the World Health Organization when setting a significant observed adverse effect level (SOAEL).

9.1.5 For significant observed adverse effects, the published table clarifies that these effects relate to “where there is no alternative ventilation, having to keep windows closed most of the time because of the noise”. The text underlined has been added since the beta version. Examples of alternative ventilation would be either ventilation to a room from another window on a quiet façade of the property, or the provision of additional mechanical or other attenuated ventilation equivalent to an open window. This is the form of additional ventilation provided by the noise insulation package proposed by the project and reinforces our submissions that noise insulation trigger levels proposed by the project align with the relevant significant observed adverse effect level for day, evening or night (APP157, Section 3.2 and Appendix A).

9.1.6 The NPPG clarification confirms that:

a significant observed adverse effect does not necessarily occur when windows a.facing the noise have to be closed most of the time if the same room has access to a window to a quiet façade (the outcome will depend on the sound insulation provided by the closed window); and

once noise insulation, which includes alternative ventilation, is provided then the b.significant observed adverse effect is avoided.

9.1.7 The published guidance therefore confirms our submissions to the ExA on NPS noise policy (APP102.03, Appendix B, and APP157, Appendix A), the key matters being:

NPPG guides how the aims at NPS paragraph 4.9.9 should be interpreted. a.

The first aim relates to ‘significant observed adverse effects’ as defined by NPPG b.and NPSE (and not to any other definition of significant effect in the Environmental Statement (ES).

SOAELs are aligned with the trigger values for noise insulation (or other equivalent c.off-site mitigation).

Where on-site mitigation is exhausted, the provision of noise insulation avoids any d.residual significant observed adverse effects and, therefore, the first aim of NPS noise policy is met.

The second aim relates to ‘observed adverse effects’ and these occur when the e.noise exposure is between the lowest observed adverse effect level (LOAEL) and the SOAEL.

Observed adverse effects have been assessed in the ES (against the A and B f.thresholds of the BS5228-1 ABC method) and, taking account of noise level, duration and number of dwellings affected, can be reported as a significant effect in the ES. These observed adverse effects primarily relate to change in the acoustic character of the area and do not cause ‘material change in behaviour and/or attitude’.

The Environmental Impact Assessment and Thames Water’s noise strategy has g.resulted in on-site mitigation being maximised. In maximising mitigation, the residual observed adverse effects are minimised and hence the second aim of NPS noise policy is met.

NPPG, like NPSE, is clear that avoiding significant observed adverse effects and h.minimising observed adverse effects (ie, the first and second aims of NPS noise policy) “must be made taking account of the economic and social benefit of the activity causing the noise”. In other words, there is a balance to be made and NPS noise policy should not therefore be applied in isolation.

Where residents elect to retain the off-site mitigation provided, it will reduce i.exposure to existing noise sources, thus improving their existing situation over the short and long term and meeting the third aim of NPS noise policy.

9.2 Delivery body

9.2.1 We wanted to draw attention to a couple of appointments we have made to the organisation which will eventually for, or be part of, the Infrastructure Provider (IP) which, as the ExA will be aware, will be the entity responsible for the delivery of the project.

9.2.2 In December 2013, we appointed Sir Neville Simms as Chairman. He is one the most experienced and distinguished figures in the UK infrastructure industry and will be a significant asset to the project when it enters the delivery phase.

9.2.3 In January 2014, we also appointed Andrew Mitchell as the Chief Executive Officer. Mr Mitchell is currently the Programme Director and Board Member at Crossrail and will report to Sir Neville Simms, and lead the development of the delivery company.

9.3 Secret Intelligence Services

9.3.1 At the hearing on 21 February 2014, the ExA expressed concern at the way that the project was referring to the Secret Intelligence Services.

9.3.2 The ExA has received confirmation that, following discussions with us, ‘Secret Intelligence Service’ (SIS) is the agreed terminology to be used within Schedule 3 of the draft final DCO. The ExA should note that the application documentation also includes references to “the occupiers of Vauxhall Cross” and “the occupiers of 85 Albert Embankment”.

10 Enclosed documents
